Preserving Native American Families in New Mexico The Indian Child Welfare Act & The Adoption & Safe Families Act A Resource for Judges, Attorneys, Social Workers, Child Advocates, and Others Who Work with Children and Families Introduction Native Americans in New Mexico live in 19 Pueblos, two Apache Tribes, and the Navajo Nation, as well as off-reservation throughout the state, especially in Albuquerque, Farmington, and Gallup. Overall, Native Americans represent nearly 10% of our population. The Pueblos, Tribes, and Nations in New Mexico – each of which is a sovereign, self-governing entity – vary considerably from one another in language, government, judicial structure, custom, and tradition. The National Council of Juvenile and Family Court Judges, in their Native American Resource Directory, acknowledges that it is difficult to generalize about Native American cultural traditions or customs, recommending that judges and others who wish to know more seek information directly from local tribal authorities. Appropriately addressing the needs of Indian children who come into the State’s child welfare system because of abuse or neglect has long been a priority of New Mexico’s Courts; the Children, Youth & Families Department; the Court Improvement Project of the New Mexico Supreme Court, and the Tribal-State Judicial Consortium. In addition, the Court Improvement Project and the Tribal-State Judicial Consortium have identified improving outcomes for Indian children in abuse/neglect cases as a primary goal, whether served by Tribal agencies and courts or State agencies and courts. The U.S. Congress recognized the importance of protecting the rights of Indian children and tribes when it passed the Indian Child Welfare Act of 1978 (25 U.S.C. -

BRF PUBLIC SCHOOLS HISTORY CURRICULUM RELATED TO AMERICAN INDIAN STUDIES GRADES 8-12 COMPONENT The following materials represent ongoing work related to the infusion of American Indian history into the History curriculum of the Black River Falls Public Schools. Our efforts in this area have been ongoing for over 20 years and reflect the spirit of Wisconsin Act 31. SEPTEMBER 2011 UPDATE Paul S Rykken Michael Shepard US History and Politics US History BRFHS BRF Middle School Infusion Applications 1 INTRODUCTION AND OVERVIEW The Infusion Task Force was established in December of 2009 for the purpose of improving our efforts regarding the infusion of American Indian history and cultural awareness throughout the BRF Public School K-12 Social Studies Curriculum. This action occurred within the context of several other factors, including the signing of a Memorandum of Understanding between the Ho-chunk Nation and the School District and the establishment of a Ho-chunk language offering at BRFHS. Our infusion efforts go back to the early 1990s and were originally spurred by the Wisconsin Legislature’s passage of Act 31 related to the teaching of Native American history and culture within Wisconsin’s public schools. In this acknowledgement, we hope to demonstrate respect for the treaties that were made on these territories and remorse for the harms and mistakes of the far and recent past; and we pledge to work toward partnership with a spirit of reconciliation and collaboration. The ecology of the Pine Ridge region, especially its mammalian and avian wildlife, is woven into the stories of the children. 111ustrated by the author, the book includes drawings of Pine Ridge wildlife, regional maps, and Native American pictorial art. Late 1790s: A small group of Cherokees relocated to the New Madrid settlement. Early 1800s: Cherokees continued to immigrate to the Arkansas and White River valleys. 1805: John B. Treat opened a trading post at Spadra Bluff to serve the incoming Cherokees. 1808: The Osage ceded some of their hunting lands between the Arkansas and White Rivers in the Treaty of Fort Clark. This increased tension between the Osage and Cherokee. 1810: Tahlonteeskee and approximately 1,200 Cherokees arrived to this area. 1811-1812: The New Madrid earthquake destroyed villages along the St. Francis River. 1 Lands of the Lakota: Policy, Culture and Land Use on the Pine Ridge Reservation Joseph Stromberg Senior Honors Thesis Environmental Studies and Anthropology Washington University in St. Louis 2 Abstract Land is invested with tremendous historical and cultural significance for the Oglala Lakota Nation of the Pine Ridge Indian Reservation. Widespread alienation from direct land use among tribal members also makes land a key element in exploring the roots of present-day problems—over two thirds of the reservation’s agricultural income goes to non-Natives, while the majority of households live below the poverty line. In order to understand how current patterns in land use are linked with federal policy and tribal culture, this study draws on three sources: (1) archival research on tribal history, especially in terms of territory loss, political transformation, ethnic division, economic coercion, and land use; (2) an account of contemporary problems on the reservation, with an analysis of current land policy and use pattern; and (3) primary qualitative ethnographic research conducted on the reservation with tribal members. Findings indicate that federal land policies act to effectively block direct land use. Tribal members have responded to policy in ways relative to the expression of cultural values, and the intent of policy has been undermined by a failure to fully understand the cultural context of the reservation. The discussion interprets land use through the themes of policy obstacles, forced incorporation into the world-system, and resistance via cultural sovereignty over land use decisions. Outline of United States federal Indian law and policy The following outline is provided as an overview of and topical guide to United States federal Indian law and policy: Federal Indian policy – establishes the relationship between the United States Government and the Indian Tribes within its borders. The Constitution gives the federal government primary responsibility for dealing with tribes. Law and U.S. public policy related to Native Americans have evolved continuously since the founding of the United States. David R.
