An Act Respecting Elections and Referendums in Municipalities Chapter E-2.2 AN ACT RESPECTING ELECTIONS AND REFERENDUMS IN MUNICIPALITIES This administrative codification only applies for purposes of the November 7, 2021, municipal general election and any proceedings recommenced after said election in accordance with section 276 of the Act respecting elections and referendums in municipalities. FOREWORD The special situation we are experiencing due to the COVID-19 pandemic, since March 2020, requires many adjustments. The November 7, 2021, municipal general elections is no exception. In this context, certain rules pertaining to holding and organizing polls as well as political financing must be adjusted to facilitate the conduct of this election and any proceedings recommenced after said election. This is why on March 25, 2021, the Assemblée nationale adopted the Act to facilitate the conduct of the 7 November 2021 municipal general election in the context of the COVID-19 pandemic (S.Q. 2021, Chapter 8)1. Section 3 of this Act grants me, in the capacity of Chief Electoral Officer, the power to amend, by regulation, certain provisions of the Act respecting elections and referendums in municipalities2 and its regulations as well as certain provisions of the Act respecting municipal territorial organization3 applicable to the election for the office of warden of a regional county municipality. To ensure the foreseeability of regulations that will oversee this election and facilitate its process, I enacted, on April 30, 2021, the Regulation amending certain municipal provisions to facilitate the conduct of the municipal general election of November 7, 2021, in the context of the COVID-19 pandemic4. This regulation will come into force 15 days after its publication, i.e. on May 15, 2021. It amends the Act respecting elections and referendums in municipalities, the Regulation respecting the tariff of remuneration payable for municipal elections and referendums5 and the Regulation respecting voting by mail6. This administrative codification incorporates those changes. However, when it comes to interpreting or applying the legislations and regulations governing the November 7, 2021 municipal general election, reference must be made to the texts published by the Éditeur officiel du Québec and in the Gazette officielle du Québec.     1 INTRODUCTION Entangling the Quebec Act Ollivier Hubert and François Furstenberg Although it features in many historical accounts, the Quebec Act too often remains on the sidelines. National narratives – which most often structure historical writing – highlight other foundational events instead. Quebec and Canadian history both make La Conquête a central turning point: the conquest of 1759–60, when New France fell, and landed (providentially or tragically, depending on one’s perspective) in the British Empire. In Native American history, the Royal Proclamation of 1763 stands as a milestone: indigenous resistance to British power resulting in the creation of a Native American territory off limits to European settlement, establishing land and treaty rights that would persist into the present. The United States, meanwhile, dates its foundation from 1776, the year when settler resistance to British power culminated in a Declaration of Independence and a war for nationhood. As for the British Empire, 1783 marks the date at which the first empire ended and the second began. Even the events of 1812 have recently joined the mix, now reframed as “the fight for Canada” waged by the nation’s three founding peoples, French, English, and Native American. In these and other narratives, the Quebec Act of 1774 plays a bit part – if it plays any at all.1 Thus does the Quebec Act fall through the scholarly cracks. (The last sustained analysis of the Act is now thirty years old.2) And yet today, more than ever, there are good reasons to question its marginality. Recent attempts to approach history from transnational perspectives offer an opportunity to reinterpret the Quebec Act across these and other historiographical boundaries.

Brief Histcry of Quebec Long before the North American Continent was known to the British, the shores of Canada and Newfoundland were visited by the fishermen of France in search of new fishing grounds. These were the people who awakened the daring and adventurous of France to an interest in that part of North America now known as Canada. In 1534 Jacques Cartier planted the standard of Francis I of France upon the shores of New Brunswick, and a year later discovered the St. Lawrence River. His attempts at colonization were without success until the time of Samuel de Champlain, who established the city of Quebec and laid the foundation of the Empire of New France. For two centuries and a quarter, Arcadie (New Bruns- wick) and Canada were provinces of New France, but in 1759 passed to English Rule.
