Chapter E-2.2 AN ACT RESPECTING ELECTIONS AND REFERENDUMS IN MUNICIPALITIES This administrative codification only applies for purposes of the November 7, 2021, municipal general election and any proceedings recommenced after said election in accordance with section 276 of the Act respecting elections and referendums in municipalities. FOREWORD The special situation we are experiencing due to the COVID-19 pandemic, since March 2020, requires many adjustments. The November 7, 2021, municipal general elections is no exception. In this context, certain rules pertaining to holding and organizing polls as well as political financing must be adjusted to facilitate the conduct of this election and any proceedings recommenced after said election. This is why on March 25, 2021, the Assemblée nationale adopted the Act to facilitate the conduct of the 7 November 2021 municipal general election in the context of the COVID-19 pandemic (S.Q. 2021, Chapter 8)1. Section 3 of this Act grants me, in the capacity of Chief Electoral Officer, the power to amend, by regulation, certain provisions of the Act respecting elections and referendums in municipalities2 and its regulations as well as certain provisions of the Act respecting municipal territorial organization3 applicable to the election for the office of warden of a regional county municipality. To ensure the foreseeability of regulations that will oversee this election and facilitate its process, I enacted, on April 30, 2021, the Regulation amending certain municipal provisions to facilitate the conduct of the municipal general election of November 7, 2021, in the context of the COVID-19 pandemic4. This regulation will come into force 15 days after its publication, i.e. on May 15, 2021. It amends the Act respecting elections and referendums in municipalities, the Regulation respecting the tariff of remuneration payable for municipal elections and referendums5 and the Regulation respecting voting by mail6. This administrative codification incorporates those changes. However, when it comes to interpreting or applying the legislations and regulations governing the November 7, 2021 municipal general election, reference must be made to the texts published by the Éditeur officiel du Québec and in the Gazette officielle du Québec.
