Development Control & Regulation Committee DEVELOPMENT CONTROL & REGULATION COMMITTEE Meeting date: 3 January 2013 From: Corporate Director – Environment WILDLIFE AND COUNTRYSIDE ACT 1981 LEGAL EVENT MODIFICATION ORDER NO 3 – 2000-2009 1.0 EXECUTIVE SUMMARY 1.1 Officers have been collating the information to bring Cumbria County Council’s Definitive Map and Statement of Public Rights of Way up to date since its last review in 1976. 1.2 In order to make any amendment to the Definitive Map and Statement an Order must be made under the provisions of Section 53 of the Wildlife and Countryside Act 1981 1.3 All the legal events in all six district of the county for the period 2000 to 2009 have been recorded and Legal Event Modification Order No 3 is now ready to make. A copy of the Schedules to the proposed Order are attached at Appendix A to this report and lists all the path orders to be included. 2.0 POLICY POSITION , BUDGETARY AND EQUALITY IMPLICATIONS , AND LINKS TO CORPORATE STRATEGY 2.1 The relevant corporate theme is the creation and protection of a high quality environment for all. 2.2 This matter is a decision making process of a quasi-judicial nature. There should be no policy or political consideration given and any potential financial implication should be ignored. It is solely a matter of ensuring that the legal steps must be taken. 3.0 RECOMMENDATION 3.1 That the Assistant Director Legal & Democratic Services be authorised to make Legal Event Modification Order No 3 to modify the Definitive Map and Statement pursuant to Section 53(3) (a) of the Wildlife and Countryside Act 1981. 4.0 BACKGROUND 4.1 The Definitive Map and Statement was first drawn up under the provisions of the National Parks and Access to the Countryside Act 1949. Reviews were carried out under that Act in 1967 and 1976. The relevant date for the 1976 review was 1 January 1976. This means that all amendments to the rights of way before that date should have been incorporated into that reviewed Map and Statement. However, the task of carrying out a review is so complex and time consuming that the 1976 review was not concluded until 1989. 4.2 The Wildlife and Countryside Act 1981 was in force by the conclusion of the 1976 review. This Act introduced different and new procedures for altering the Definitive Map and Statement. 4.3 An evidential Modification Order under the Wildlife and Countryside Act 1981 can alter a public right of way. This is where evidence becomes known of an incorrect route or of a new route not previously on the map and statement. This is the procedure that frequently comes before this committee. Such an order serves to establish or confirm the route and incorporates authority to amend the Definitive Map and Statement. 4.4 However, a public path may also be altered, created or extinguished by various other methods under a number of other legislative provisions, particularly the Highways Act 1980 and the Town and Country Planning Act 1990. Such provisions will result in an order being made by the Courts or the Highway Authority or the Planning Authority and such matters frequently come before this committee. Such orders are called “legal events” and will allow a valid alteration to the right of way but do not in themselves authorise any amendment to the Definitive Map and Statement. 4.5 In order to make any amendment to the Definitive Map and Statement an Order must be made under the provisions of Section 53 of the Wildlife and Countryside Act 1981. Section 53 (2)(a) is a provision to place a duty upon the Surveying Authority to make such modifications to the map and statement as appear to them requisite in consequence of legal events. A copy of the Schedules to the proposed Order are attached at Appendix A to this report and lists all the path orders to be included. 5.0 OPTIONS 5.1 There are no procedures or grounds for any person or authority to raise objections. This is an administrative, procedural process only; the alterations to the rights of way having already taken place. 5.2 The Committee may accept or reject the recommendation 6.0 CONCLUSION 6.1 The proposal is an administrative, procedural process only. Some 180 legal events have occurred during the period 2000-2009 in the areas concerned. The County Council has a duty as the Surveying Authority to record these on the map and statement. 6.2 The Committee are asked to support the recommendation.     ALLERDALE DISTRICT WARDS REVIEW 2016 An initial submission on behalf of the Labour Group of Allerdale Councillors. A. Methodology for Area allocations The starting point for this submission to the review process is that the Allerdale District is made up of seven Areas, each centred on a town as service centre and its hinterland. These areas were first defined by the County Council as part of its initiation of the “Neighbourhood Forms” concept in the late 1980s and have evolved since into the pattern now used by Allerdale Council for engagement with members and localities, shown in this map: The map was originally based on school catchment areas. Following a review of “natural communities” by the Health service in 2000, it began to be used to define primary care boundaries. Under localism and devolution policy in the 2000s it was also used to define neighbourhood policing areas, community regeneration areas, childrens centre areas, parish council groupings, and planning policy areas, amongst others. Although some organisations, under budget pressures, have resiled from earlier commitments to use these Areas for organisation and service planning, they remain the most appropriate basis for any division of Allerdale into smaller areas. Accordingly it is suggested that these Areas should be the starting point for consideration of ward boundaries – following the pattern of the parliamentary boundary review which uses counties within the Region as its starting point. The first step is therefore to define the quota, making an assumption of 48 members as the size of the Council based a) on the actual electorate in 2016 (a quota of 1576 electors); and b) on the forecast electorate in 2022 as estimated by the Elections Officer at the Council (a quota of 1622 electors).

    Annual Monitoring Report 2011/12 Introduction Background 1.1 This is the eighth Annual Monitoring Report (AMR) produced by Allerdale Borough Council. It covers the period from 1 April 2011 to 31 March 2012. 1.2 The AMR reports on a number of monitoring statistics, including progress made towards the Local Plan. The publication of the AMR enables the Council to publish a comprehensive set of data about the Borough that is easily and publicly accessible, to meet a wide range of data requests that Planning Services receives. 1.3 The current system of plan making is designed to be a continuous process, with the local planning authority regularly preparing, adopting and reviewing Local Development Documents, to take account of changing national and local circumstances. Keeping development plans up-to-date is assessed by the AMR. Changes to Monitoring of Indicators 1.4 As part of the package of reforms to the planning system put forward by the current government, there is no longer a requirement for local planning authorities to monitor indicators previously set at the national and regional level. Instead, the onus is for local planning authorities to determine indicators which best complements their policy requirements. 1.5 Although there is an intention to remove the requirement to submit the AMR to the Government, the Localism Act requires for Planning Authorities to publish an AMR on the implementation of their development plan and Local Development Scheme. 1.6 At the July 2011 meeting of the Cumbria Monitoring Officer’s Group (CMOG) the implications of emerging legislation and guidance, and the removal of information concerning the core indicator set were discussed.

    FAO [email protected] Allerdale Boundary Commission Review Part 2 Submission of the Independent Group Introduction The Independent Group met on Thursday 1st December to consider the proposals tabled by Officers at the Group Leaders' Meeting the preceding Monday 28th November. Being a group not affiliated with any political party, the group's six members main concern is to properly represent the views of their respective electorates specifically in: • Dalton Ward • Broughton St Bridgets Ward • Harrington Workington Ward • All Saints Cockermouth Ward • Keswick Ward • Aspatria Ward In relation to the boundary review process Part 2, its nature is such that members of the group have engaged in general discussion within e.g. local parish councils on the matter, but have not until the week commencing 28th November been in a position to consider the implications both locally or more widely arising from the work of the Officer group which was not made available until that date. The three major Groups in Allerdale – Labour, Conservatives and Independent – have all shared thoughts as the process has advanced over recent weeks, both through the Leaders' Group but also informally between those councillors who have taken the lead within each group for 'number-crunching' and map-making. Much common ground has emerged, but there are of course differences which in large part are probably conditioned by the fact that in most wards political representation tends to be the monopoly of a single party. This in turn both enhances the ability of winning parties to articulate the needs and perceptions of those communities, but simultaneously diminishes their ability to speak with equal authority on the needs and perceptions of communities they have little experience of representing.

This provided an appropriate hygiene classification zoning and monitoring plan based on the best available information with detailed supporting evidence. The Food Standards Agency (FSA) is committed to reviewing sanitary surveys every six years or sooner if significant changes in pollution sources or the fishery have occurred that may require revision of the sampling plan. This report provides a six year review of information and recommendations for a revised sampling plan. The Centre for Environment, Fisheries & Aquaculture Science (Cefas) undertook this work on behalf of the FSA.
