Executive Summary Downtown retail in Akron, like in many other Midwest cities, faces challenging trends. Since the 1980’s, big box superstores have sprawled across the northeast Ohio suburban landscape while total population barely grew. The latest threat is e-commerce, chalking up annual 15% increases year after year. Given this harsh competitive climate, it is not surprising that the number of independent retailers has declined by 14% over the past 10 years in Ohio. On the other hand, there are 5% more independent restaurant operators in Ohio today than 10 years ago. Downtown Akron’s retail mix, almost all independents, reflects this trend with 50 foodservice operators vs. 28 non-food merchants. Downtown Akron Partnership (DAP) and a Special Improvement District were formed in the 1990s by property owners to pool business recruitment, marketing, and other efforts, such as the Downtown Ambassadors Program, launched in 2009 to promote a safe and clean downtown.

PROPOSED BOARD ACTION Adopt a resolution authorizing the issuance of debt by The FAU Finance Corporation as a Direct Support Organization (the “DSO”) of the University and requesting the Florida Board of Trustees (the "BOT") to approve the issuance of debt in an amount not to exceed $44,585,000 (the "Debt") for the purpose of financing the construction of certain football stadium facilities (the "Project") to be located on the Boca Raton campus of the University and further authorizing the Chair of the FAU Finance Corporation and other authorized representatives to take all actions and steps, execute all instruments, documents and contracts, and take all other actions as necessary or desirable in connection with the execution, sale and delivery of the Debt. BACKGROUND INFORMATION I. Background The Project was approved in concept by the FAU BOT September 18, 2007 and will consist of the construction of a football stadium with an approximately 30,000 total seating capacity, including approximately 1,076 premium club seats with a club level and traditional seating, 4,448 priority club seats, 16 loge boxes with capacity of 6 occupants each, 20 leasable luxury suites with capacity of 23 occupants each, and 4 non-leasable, university-utilized luxury suites with capacity of either 46 or 23 occupants each. Florida legislative approval of the Project has been obtained, pursuant to Section 1010.62, Florida Statutes, by section 24 of House Bill 5001 (the 2008-09 General Appropriations Act) enacted by the Florida Legislature.

The competition, which sought primarily to highlight Titanium's incredible strength and cost-effectiveness over similar steel applications, also involved designing a solution to the logistic issue of providing a pedestrian connection above rail tracks that currently separate the University of Akron. The design solutions entail the planning of the first bridge in the United States, pedestrian or otherwise, constructed exclusively of Titanium. This thesis seeks to detail the design process of the Ball State University Submission to the DMTC Titanium Pedestrian Bridge Competition. 3 Acknowledgements Thanks to Kevin Klinger for assisting in the Thesis process and providing advice and support during the competition development. His leadership and assistance made the Ball State University Submission a reality and a success. Present Owner: Quaker Square Associates, Inc. 120 East Mill Street Akron, Ohio 44308 Present Use: Retail shops, offices, and vacant Significance: The Quaker Oats Cereal Factory is the last remaining industrial mill and grain storage complex in Akron. This facility at this location dates back to the beginning of milling and cereal production in the City. Report Assembled By: Richard Lewis Vickers Department of Planning and Development City of Akron, Ohio August, 1979 HiSEQRitC AMERICAN ENGINEERING RECORD H&ER No. OH-17 Data page 2 REPORT ON THE QUAKER OATS CEREAL FACTORY Statement of Significance: The Quaker Oats Company traces its history back to 1854 when Ferdinand Schumacher built his first hand-operated mill in Akron. He perfected two revolutionary milling processes—steel cut oats and rolled oats—and popularized the new breakfast product "oatmeal". During the Civil War, Quaker Oats' popularity mushroomed because of its ease of preparation on the battlefield. Schumacher's company flourished, and in 1972, he built his greatly expanded "German Mills" complex on the present site of the brick factory buildings. Though destroyed by fire in 1886, these structures were quickly replaced by similar buildings on the same stone foundations.
