DECISION

Before the Commission for resolution is the application filed on September 11, 2012 by Electric Cooperative, Inc. (NORSAMELCO) for approval of its (over)/under recoveries in the implementation of automatic cost adjustments and true-up mechanisms and corresponding confirmation process pursuant to ERC Resolution No. 16, Series of 2009, as amended by Resolution No. 21 ,Series of 2010.

Having found said application sufficient in form and in substance, with the required fees having been paid, an Order and a Notice of Public Hearing, both dated September 18, 2012, were issued setting the case for initial hearing on October 12, 2012.

In the same Order, NORSAMELCO was directed to cause the publication of the Notice of Public Hearing, at its own expense, once (1x) in a newspaper of general circulation in the Philippines, with the date of the publication to be made not later than ten (10) days before the scheduled date of the initial hearing. available and appropriate, of the filing of the instant application, its reasons therefor and of the scheduled hearing thereon.

The Office of the Solicitor General (OSG), the Commission on Audit (COA) and the Committees on Energy of both Houses of Congress were furnished with copies of the Order and Notice of Public Hearing and were requested to have their respective duly authorized representatives present at the initial hearing.

Likewise, the Offices of the Provincial Governor of Northern Samar and the Mayors of the Municipalities within NORSAMELCO's franchise area were furnished with copies of the Order and Notice of Public Hearing for the appropriate posting thereof on their respective bulletin boards.

During the October 12, 2012 hearing, only NORSAMELCO appeared.

At the said hearing, NORSAMELCO presented its proofs of compliance with the Commission's posting and publication of notice requirements which were duly marked as Exhibits "A" to "J-3", inclusive. Thereafter, it conducted an expository presentation of its application. In the course thereof, the Commission noticed the significant discrepancies in the computation of the amount of over/under recoveries of NORSAMELCO. Thus, NORSAMELCO was, then, directed to file an amended application.

On August 13, 2013, NORSAMELCO filed a "Motion to Admit Amended Application" with attached "Amended Application".

On September 2, 2013, the Commission issued an Order granting the said motion and setting the amended application for jurisdictional hearing, expository presentation, pre-trial conference and evidentiary hearing on October 10, 2013.

In the said Order, NORSAMELCO was directed to cause the publication of the Notice of Public Hearing, at its own expense, once (1x) in a newspaper of general circulation in the Philippines, with the date of the publication to be made not later than ten (10) days before the scheduled date of the initial hearing. It was also directed to inform the consumers within its franchise area, by any other means available and appropriate, of the filing of the instant application, its reasons therefor and of the scheduled hearing thereon. On October 4,2013, NORSAMELCO filed its "Pre-Trial Brief.

At the October 10, 2013 initial hearing, only NORSAMELCO appeared. No intervenor or oppositor appeared nor was there any intervention or opposition registered.

At the said hearing, NORSAMELCO presented its proofs of compliance with the Commission's posting and publication of notice requirements which were duly marked as Exhibits "A" to "H-3", inclusive. Thereafter, it conducted an expository presentation of its application.

At the termination of the expository presentation, the Commission conducted a pre-trial conference. The Commission noted all the facts and issues raised by NORSAMELCO in its pre-trial brief. In view of the absence of intervenor, NORSAMELCO moved for an Order of general default against other interested parties who failed to appear during the hearing despite sufficient notice. Said motion was granted.

NORSAMELCO presented its lone witness, Ms. Marites T. Pinangay, its Billing Supervisor, who testified in support of the application. In the course thereof, several documents were presented and marked as exhibits. The direct examinations having been terminated, the Commission propounded clarificatory questions and directed NORSAMELCO to file its formal offer of evidence.

On October 24, 2013, NORSAMELCO filed its "Formal Offer of Evidence" which is hereby admitted for being relevant and material in the final resolution of this case. ERC Case No. 2012-042 CF DECISION/April 6, 2015 Page 4 of 20

b. Transmission Cost

NORSAMELCO incurred an over recovery of PhP96,522,422.62 due to the following: a) consequent variance between the then Commission-approved rate-setting methodologies and the mandate of the Consolidated Rules, where the current months' actual data were adopted to determine the recoverable cost; and b) its customers were charged of Residual and Connection Charges notwithstanding the issuance of an Order which deferred the implementation of the said charges.

c. System Loss

NORSAMELCO incurred an over recovery of its system loss amounting PhP20,343,239.99 due to its use of the previous months' reference instead of a smoothed 12-calendar month average System Loss.

FOR SPUG 1

a. Generation Cost

NORSAMELCO incurred an under recovery of PhP104,436.80 due to the inherent limitation of the prescribed generation rate formula where the previous months' data were used instead of the current months' data which the Commission used to determine the recoverable costs.

b. System Loss

NORSAMELCO incurred an under recovery of PhP242,750.60 due to its use of the previous months' reference instead of a smoothed 12-calendar month average System Loss. ERC Case No. 2012-042 CF DECISION/April 6, 2015 Page 13 of 20

NORSAMELCO incurred an under recovery of amounting PhP10,188.16 due to its use of the previous months' reference instead of a smoothed 12-calendar month average System Loss.

NORSAMELCO incurred an over recovery of its system loss amounting PhP45,783.51 due to its use of the previous months' reference instead of a smoothed 12-calendar month average System Loss.

FOR MAINLAND AND SPUG AREAS

a. Lifeline Subsidy

NORSAMELCO incurred a net over recovery of PhP1,327,491.77 due to the following:

a) Confirmation of the monthly discounts that should have been provided and the actual subsidy collected in accordance with the relevant provisions of the Consolidated Rules; and

b) Implementation of a fixed rate from August 2004 to February 2010 which is higher than the monthly computation.

b. Inter-Class Cross Subsidy (ICCS)

NORSAMELCO incurred a net over recovery of PhP549,904.97 due to the changes in the kWh sales between the subsidizing and subsidized customers. ERC Case No. 2012-042 CF DECISION/April 6, 2015 Page 15 of 20

c. Senior Citizen Discount and Subsidy

NORSAMELCO incurred a net under recovery of PhP30, 137.21 due to the changes in the kWh sales between the subsidizing and subsidized customers.

Based on November 2014 annualized data on kWh sales, the cost adjustments with the corresponding (over)/under recoveries to be refunded/collected by NORSAMELCO for the period specified, are as follows:

The determined over recoveries in the Lifeline Subsidy and ICCS shall be refunded to the-non.lifeline-and subsidizing customers, respectively. On the other hand, the under recovery in Senior Citizen Subsidy shall be collected from the subsidizing customers.

NORSAMELCO incurred a net over recovery amounting to PhP116,932,326.49 for the period August 2004 to December 2011.

WHEREFORE, the foregoing premises considered, the application filed by Northern Samar Electric Cooperative, Inc. (NORSAMELCO) for approval of its (over)/under recoveries based on the formulae on the various automatic cost adjustments and true-up mechanisms and corresponding confirmation process, pursuant to ERC Resolution No. 16, Series of 2009, as amended by Resolution No. 21, Series of 2010, is hereby APPROVED with MODIFICATION.

Accordingly, NORSAMELCO is hereby directed to REFUND the following amounts:

a. TRANSMISSION COST (Main/and) over recovery of PhP96,522,422.62, equivalent to the following rates per customer class:

On the other hand, NORSAMELCO is hereby authorized to COLLECT from its customers the confirmed under recoveries, as follows:

In order to afford NORSAMELCO ample time to modify its billing system software, the refund/collect of the foregoing confirmed over/under recoveries shall be implemented starting on the third billing cycle from receipt of this Decision, until such time that the full amount shall have been fully refunded/collected.

In connection therewith, NORSAMELCO is hereby directed to:

a. SUBMIT, within ten (10) days from its initial implementation, a sworn statement indicating its compliance with the aforesaid directive; ERC Case No. 2012-042 CF DECISION/April 6, 2015 Page 18 of 20

b.REFLECT the net (over)/under recoveries in the monthly computations of GR, SLR, LSR as "OGA" for Generation, "OTCA" for Transmission, "OSLA" for System Loss, "OLRA" for Lifeline Subsidy, and "OSrRA" for Senior Citizen Subsidy;

c. REFLECT the over recovery for Inter-Class Cross Subsidy (ICCS) as a separate line item in the bill using the phrase "ICCS Adj."; and

d. ACCOMPLISH and SUBMIT a report in accordance with the attached prescribed format, on or before the 30lh day of the following month, together with the monthly reportorial requirement, and every month thereafter until the amount shall have been fully refunded/recovered.
