The thesis also examines the effect of land registration on the security and speed of conveyancing process in each state. In order to accomplish a comprehensive and up-to-date comparative study I have utilized the research conducted in the field of property law in the selected countries in order to complete an in-depth review of the national legislations on a comparative basis. The objective was to produce a comprehensive and scientifically accurate comparative study, not a mere „manual“. -

Rights in Rem
1 Rights in Rem As already stated, this book focuses on two kinds of rights in land: ‘rights in rem’ as recognised by traditional English (‘domestic’) law, and those additional rights that are declared in the European Convention on Human Rights. This chapter introduces the former, Chapter 2 the latter. 1.1 The Idea of a Right in Rem 1.1.1 ‘Rights in Personam’ and ‘Rights in Rem’ Say I own a house, but then something occurs which, according to the rules of English domestic law, means that you now have a right to live in it. The ‘something’ might be that I make a contract with you to this effect; or that I give you a share in the ownership; or that I marry you; or various other significant happenings. Say then that I sell the house to John. In terms once again of English domestic law, there are two possibilities. One is that your right cannot affect John. That is, it is effective only against me, and if you want to enforce it you will have to look to me, not to John. It follows, now I have passed the house to John, that you will not be able to insist on living there: as it is said, to maintain your right ‘in specie’. Only a right effective against John could allow that. Because your remedy can only be against me, it will have to take the form of a money payment, from me, compensating you for not now being able to live in the house. Rights which behave in this way are called ‘rights in personam’. -

Introduction Although Holmes famously maintained that the law ‘cannot be dealt with as if it contained only the axioms and corollaries of a book of mathematics’,1 it is in the law of land that the perfection of pure reason appears most nearly attainable. 2 English land law 3 -- more obviously than any other area of the law -- seems to be characterised by the rational application of axiomatic principles to a limited number of highly artificial jural constructs. 4 The propositional dogmas of land law control relationships amongst a set of estates and interests whose taxonomy was meticulously enshrined in codified form in the property legislation of 1925 and is left virtually untouched by the Land Registration Act 2002. 5 It is arguable therefore that land law can be seen as comprising a modern ratio scripta whose conceptual purity and internal coherence are unrivalled across the field of contemporary law. 6 Indeed land law displays many of the features of a closed system of logic or an 1 Oliver Wendell Holmes, The Common Law (Little, Brown & Co, Boston, 1881), p 1.
