ABSTRACT The Special Administrative Region (SAR) of Macau, China, has a high degree of autonomy from the Central Government in Beijing despite being a part of the Chinese territory. Macau’s high degree of autonomy is intertwined with the political-legal principle of “one country, two systems”, under which Macau can maintain some of its important distinctive characteristics derived from its own special historical development, strongly connected to the region’s previous administration by Portugal. In its blend of Asian and European legacies, Macau’s own cultural, political, economic, and legal realities are, in many ways, different from those of the mainland China. This thesis addresses the way that Macau’s Court of Final Appeal has used its power to decide cases against the government during its initial ten years of operation. This study resorts to literature review and legal and empirical analysis, linking law and social sciences. It lies at the crossroads of different thematic areas, from judiciary studies to studies on the greater China. To categorize and analyze the administrative law disputes brought before the Court of Final Appeal is vital because this area of law most directly involves the government and its agents and the possibility of challenging their actions. It was found that the Court of Final Appeal has not mimicked the behavior of the mainland courts which operate under a framework of close cooperation with the government. RESUMO A Região Administrativa Especial de Macau, na China, tem um alto grau de autonomia em relação ao Governo Central em Pequim, apesar de fazer parte do território chinês. Este elevado grau de autonomia está entrelaçado com o princípio político-jurídico de “um país, dois sistemas”, segundo o qual Macau pode manter algumas das suas características distintivas derivadas do seu desenvolvimento histórico fortemente ligado à anterior administração da região por Portugal. Em sua combinação de legados asiáticos e europeus, as realidades culturais, políticas, econômicas e jurídicas de Macau são, em muitos aspectos, diferentes das da China continental. Esta tese aborda a forma como o Tribunal de Última Instância de Macau usou seu poder para decidir casos contra o governo durante seus primeiros dez anos de operação. Este estudo recorre à revisão de literatura e análise jurídica e empírica, usando métodos de direito e ciências sociais. Encontra-se na encruzilhada de diferentes áreas temáticas, desde estudos judiciários até estudos sobre a grande China. É vital categorizar e analisar as disputas de direito administrativo levadas ao Tribunal de Última Instância porque essa área de direito envolve diretamente o governo e seus agentes e a possibilidade de contestar suas ações. Entre outras, conclui-se que o Tribunal de Última Instância não imitou o comportamento dos tribunais da China continental que operam sob uma estrutura de estreita cooperação com o governo.     OVERVIEW OF THE MACAO SPECIAL ADMINISTRATIVE REGION IN 2018 2018 was a critical year for continuing progress with implementing China’s 13th Five Year Plan, and marked an important interim stage of the implementation of Macao’s first Five-Year Development Plan. The Government fully supported the strategic development of the Guangdong-Hong Kong-Macao Greater Bay Area (Greater Bay Area), implemented the Framework Agreement on Deepening Guangdong-Hong Kong-Macao Cooperation in the Development of the Greater Bay Area, leveraged Macao’s advantages to serve our country’s needs, and achieved organic integration of Macao’s five-year development plan with local governance and development of the Greater Bay Area, to participate in national development. During the year, the Chief Executive attended the first plenary meeting of the leading group for development of the Guangdong-Hong Kong-Macao Greater Bay Area. The Government established the Working Committee for the Development of Guangdong-Hong Kong-Macao Greater Bay Area, to coordinate Macao’s engagement in the short-, medium- and long-term overall design of the Greater Bay Area and related deployments. The Chief Executive visited nine cities of the Greater Bay Area in phases, leveraged Macao’s advantages to proactively establish connections, and cooperated with sister cities of the Greater Bay Area, to promote Macao’s adequate economic diversification. Macao followed the principle of making progress while ensuring stability. In 2018, the Government commenced formulating the Ten-year Plan for Disaster Prevention and Mitigation (2019-2028), developed short-, medium- and long- term plans to cope with typhoon and safety issues, and proceeded with the legislation process for the Civil Protection Fundamental Law, to enhance the crisis management capability to build a safer city.

    ANALYSIS The International Legal Personality of Macau Introduction The question of international legal status/personality1 is increasingly difficult to answer with a degree of precision since the relevance of traditional criteria and symbols of statehood is diminishing in a global environment characterised by the proliferation of not-readily-definable entities which clamour for recog­ nition as autonomous political units.2 The requirements of 'a permanent population; a defined territory; govern­ ment; and capacity to enter into relations with other States'3 — which are accepted by international lawyers as 'customary international law' — by no means represent sufficient4 or even necessary3 qualifications of statehood. Clearly, the less legalistic symbols of statehood, such as kings/presidents, armies, central banks, currency, or passports, offer no reliable yardsticks.6 Nor for that matter is membership in the United Nations particularly instructive in respect of the key distinguishing attributes of statehood. Current members include Carribbean pinpoints such as Saint Christopher and Nevis or Saint Lucia, as well as other microentities like Vanuatu in the Pacific or San Marino in Europe — but not Taiwan.7 Neither is the UN practice with regards to admission — including the implementation of stipulated8 requirements 'International legal personality' is broadly defined in terms of the capacity to exercise international rights and duties.     Texts from Old Macau Jason Buhi, University of Hong Kong Macau’s Original Municipal Charter (10 April 1586) Macau and Hong Kong, the two Special Administrative Regions (SARs) of the People’s Republic of China, are each governed under a Basic Law. Often described as “mini-constitutions,” these documents outline and guarantee 50 years of autonomy following each territory’s return to Chinese administration. Each was shaped by a bilateral negotiation between China and the respective colonial power, and each came into effect immediately upon handover (1997 in the case of Hong Kong, and 1999 for Macau). They share a great deal of language, obscuring the fact that Hong Kong and Macau represent entirely different colonial legacies. Indeed, Macau was settled by Portuguese traders 288 years before the British ever set foot on Hong Kong. Although many of the Macau Basic Law’s articles mirror those of its previously-drafted sister, it also contains several key differences that the Portuguese won despite negotiating from a position of weakness. The diplomatic record isn’t always clear as to why the Portuguese persisted, but their success reminds us that Macau’s constitutional development should not be viewed as merely derivative of the Hong Kong experience. Exploring those nuanced textual differences in a comparative context yields an enormous amount of historical intrigue. Legal scholars in both SARs apply different lenses to interpret the two Basic Laws. Treatises explaining the Hong Kong Basic Law are replete with references to cases or acts dating from the city’s colonial era, but that historical perspective is less common in Macau, despite the fact that Article 8 of both Basic Laws guarantee that upon handover “[t]he laws previously in force .

Once achieved, complete Sinicisation would mean Xinjiang would be extremely difficult to separate from China. In Xinjiang, the CCP enacts policies in support of Sinication across all areas of statecraft. This thesis categorises these activities across three dimensions: the economic and demographic dimension, the political and cultural dimension, and the security and international cooperationdimension.

This was interpreted by some as drawing an implicit comparison between Hong Kong and Macau with Beijing favouring the latter’s interpretation and implementation of One Country Two Systems. This article evaluates the core values and autonomy entrenched within Hong Kong during British colonial rule and Macau during Portuguese colonial rule and ascertains the extent to which these factors have shaped the different modes of constitutional development in Hong Kong and Macau post-Handover. The author argues that the One Country Two Systems framework, with its emphasis on a ‘high degree of autonomy’ and ‘life shall remain unchanged’, means that any contemporary comparisons drawn between Hong Kong and Macau must take into account the unique (and very different) political and constitutional norms left behind by their respective colonial masters. The author argues that a more balanced view must be taken and that constitutional issues must also be viewed in light of norms established by the colonial rule of the past.

The discussion begins with the outline of the history of the Macanese bilingualism. The author then examines the crucial distinction between the language in the law and the law in the language. By analogy to European Community and other bilingual legal systems, this article identies the characteristic of Macanese mulitlingualism. This article concludes with suggestions about a new approach and the role of universities in resolving the matter. I. INTRODUCTION My experience as a comparatist in Macau reminds me of the “accommodation method” rooted in the Jesuit missionary activity, an activity aimed at diffusing Christianity all over the world and addressing complex religious and cultural challenges. Matteo Ricci used to adapt himself (“accomodare” 1 ) to the Chinese context, dressing as a Confucian monk, learning Chinese language and philosophy and overall finding similarities and harmonies in classical Chinese texts with Christian teachings.
