Attorney General Adam Laxalt has used his official position to block information from the public in order to give an unfair and unethical advantage to his political campaign and his political allies. His office has delayed responding to public records requests regarding his record as attorney general while providing the same information to his campaign almost immediately.

The State Democratic Party filed requests for the full schedule of the since January 2015 and the full schedule of First Assistant Attorney General Wes Duncan from November 2014 through September 2017. These requests were respectively filed on January 5 and April 16, 2018. The Office of Attorney General acknowledged each request exactly a week later, after the maximum amount of time allowed under Nevada law [NRS 239.0107(1)]. For each request, the Office of Attorney General stated it intended to respond exactly six months later, providing estimates of July 12 and October 23 for the response to the respective requests. The office responded to the January 5th request for the Attorney General’s schedule on June 25 and has yet to respond to the April request for the full schedule of First Assistant Attorney General Wes Duncan.

On August 8, a representative of Laxalt’s political campaign for governor requested a copy of the Attorney General's 2015 calendar. Laxalt’s public office responded to the request the same day and informed his campaign that the requested documents were in the mail. On August 30, a representative of Laxalt’s political campaign requested copies “of all records related to Sheriff Antinoro or the investigation into Sheriff Antinoro—specifically any records provided to members of the press regarding Sheriff Antinoro or the investigation into Sheriff Antinoro.” The next day, Laxalt’s public office responded, informing his campaign “The responsive non-privileged documents are included with this communication.”

On September 12th and 13th, the Nevada State Democratic Party requested copies of the acknowledgement of the request for records sent by the Laxalt campaign in August 2018. After waiting the maximum amount of time allowable under Nevada law, the Office of Attorney General responded. The response included the requested communications along with a note that “included with this response is a previously submitted request for records, which is relevant to this request.” The supposedly previously submitted request was dated March 22 and signed by a Laxalt campaign representative, requesting “All public records requests made to the Attorney General’s Office from June 1, 2017 to the date of this letter” and “to receive copies of any additional public records requests and responses made after the date of this letter through November 5.” However, on June 8, the Nevada State Democratic Party requested “copies of any and all public records in your custody or control, or that can be compiled by virtue of or with reference to records in your custody or control, reflecting public records requests received by the Attorney General’s office in the months of March and May 2018.” The Office of Attorney General’s 105 page response did not include any communications with the Laxalt campaign, indicating that the request was either withheld for the personal benefit of Adam Laxalt or fabricated to justify the disparity in response times.

On April 10, the Attorney General’s Office received a records request from John Treanor for “information on all petitions, appeals, and briefs the Attorney General has signed onto in courts outside Nevada. Case numbers, plaintiff and defendant info, which court they are filed in and estimated cost of the filing and continued representation are requested where applicable.”

Under the Nevada Open Records Act § 239 et seq., I write to request all the petitions, appeals, and briefs Attorney General Adam Laxalt has signed onto in courts outside Nevada along with case numbers, the plaintiff, the defendant and the court they were filed in.

At the very latest, this information should be released to me on the same date which it is released to Mr. Treanor since it is the same request except I am not seeking the estimated cost of the filings and continued representation. It would be reasonable to expect this more narrow request to be fulfilled more quickly.

I am requesting a waiver of all fees because this search is already being done regardless and, separately, because the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of the operations of the Nevada Attorney General’s Office. This information is not being sought for commercial purposes.
