Background :

The case relates to Shri Mahadeb Barik of Medinipur and 174 others, who at one time suffered from symptoms of Leprosy, but after continued treatment, most them felt that they were cured. They then underwent bacteriological investigation conducted by organizations like the Radhakantapur Leprosy Association and declared fit. The reports declaring them fit were supposed to be with the South East Railways who had a scheme of rehabilitation of cured leprosy patients which included several facilities including employment.

2. The Appellants’ case was that the South East Railway had suppressed these reports since this would mean employment to a large group of persons falling into this category.

3. The bench of Dr. O.P. Kejariwal and Dr. M.M. Ansari, Information Commissioners, had first heard the matter on 9 th May 2006.

4. The matter was fixed for a second hearing on 14 th December 2006.

5. The bench of Dr. O.P. Kejariwal, Information Commissioner, heard the matter again.

6. From the Respondents’ side, Shri Debashis Chandra, PIO, Shri Mihir Kumar Das, CPI, Smt. Kusum Singh, CPIO (Administration), South Eastern Railway, Kolkata, attended the hearing.

7. Shri Dibakar Bhoi represented the case for the Appellants.

Decision:

8. Today’s hearing was the second in the relevant case. In the earlier hearing, the Commission in its judgment dated 18 th May 2006 had noted that the case of the Appellants mainly revolved around an affidavit filed by Shri P. Murugan, the then Chief Personnel Officer, Administration, South Eastern Railway, before the Supreme Court in 1990 to the effect that all the relevant documents regarding this case, which included the medical reports declaring many of the erstwhile leprosy patients now cured and fit, would be kept under the custody of the Chief Personnel Officer (Administration) of South Eastern Railway and “will not be destroyed and secreted”. As Shri Murgan had left the South Eastern Railway in 1990 and retired from service five years later, the Railway authorities found it difficult to contact him and get a certificate in writing to the effect that the affidavit filed by him in the Supreme Court was genuine.

The doubt about the authenticity of Shri Murgan’s statement had arisen basically as a result of a judgment of the Chief Commissioner for Disabilities passed in 2001 where it was stated: “the alleged counter affidavit of one K.S.R. Kush Rao, Deputy Secretary (Establishment) to the Government of India, etc. filed annexure ‘C’ beginning from page 8 to 56 run to 50 pages, do not exist. The bare perusal of this document disapproves its authenticity. The documents allegedly annexed are annexure R-1 to R-%, are not in the records. The document had pages 19 to 28 as well as the documents at pages 41 to 44, 45-54 and 55 do not exist.”

The Applicants, however, continued to maintain that Shri Murgan’s affidavit was indeed genuine and that the Ministry of Railways had in their possession the bunch of these medical records whereby many of the erstwhile Leprosy patients had been declared fit from all points of view including employment. In its earlier judgment, the Commission directed the Railway authorities to make every effort to locate these papers and to begin the process by getting in touch with Shri Murgan wherever he was, to ascertain from him personally whether the affidavit that he had filed in the Supreme Court was genuine. Accordingly, the Respondents made an effort to contact Shri Murgan and did, in fact, get in touch with him. Shri Murgan, however, stated that since the case was a very old one, he had completely forgotten about the affidavit and hence could not certify its authenticity

11. The Applicants continued to maintain that Shri Murgan’s affidavit was genuine and that a copy of this would be available in the Supreme Court. The Commission directed the Respondents to make an effort to get these papers from the Supreme Court also and the office of the Information Commission even wrote to the PIO of the Supreme Court to help out with the case. The PIO of the Railway authorities contacted the PIO of the Supreme Court requesting him to make available the Judge’s Paper Book relating to the case. But there was no positive response from the Supreme Court authorities.

In the meanwhile, the Supreme Court had appointed a Legal Service Advocate to conduct the case, and in due course of time the Legal Service Advocate was indeed able to lay his hands on the relevant Judge’s Paper Book which also contained a copy of Shri Murgan’s affidavit. At this stage, the Applicants approached the Commission to make a request to the Legal Service Advocate to make available to the Applicants a copy of the Judge’s Paper Book related to the case. Accordingly, the Commission wrote to the Legal Service Advocate who responded positively and made available to the Appellants a copy of the Judge’s Paper Book.

13. From a perusal of the Judge’s Paper Book, it will now be seen that Shri Murgan’s affidavit is indeed a genuine one. This then would lead to the conclusion that the relevant records of the medical examination declaring many of the erstwhile Leprosy patients absolutely fit were available somewhere or the other.

The Commission hereby directs the Railway authorities to make another sincere effort to locate all these medical certificates at the office of the Chief Medical authorities of South Eastern Railways and other relevant offices. In case the records are not available then the presumption would be that they have been destroyed. In case this is confirmed then it is incumbent on the Railway authorities to reconstruct the case on the basis of the documents made available to them by the Appellants and also identify the officials concerned on whom responsibility for this loss could be placed and take necessary action against them.

15. The Commission gives the Railway authorities five months’ time to do the needful and come back to the Commission on 16 th of May 2007 to let the Commission know the progress of the case.

16. During the hearing, the Applicants stated that they had spent more than Rs.10,000/- for getting the Judge’s Paper Book and other relevant documents. Since in spite of and after all efforts made by the Railways, the documents were traced and located after a long and a sustained effort by the Applicants, the Commission hereby directs the Railway authorities to compensate the Applicants to the extent of Rs.10,000/-. This amount should be given to the Appellants by 24 January 2007.

17. The Commission ordered accordingly.
