WearepleasedtoparticipateintheprocessinitiatedbyBroadcastingNoticeofConsultation 201426,tocommentontheapplicationsfiledbyRogersBroadcastingLimitedtorenewthe licencesofitstelevisionprogrammingundertakings.Ourinterventionisattached:wedo notsupportRogers’applicationforfiveyeartermsfortheOMNIlicences,andopposeits proposedconditionsoflicence,asapprovaloftheserequestseffectivelyplacesRogers’ interestsbeforethepublicinterest. 3. TheCRTC’sdecisionsontheseissueswilldeterminethelevelandqualityoffree, localethnictelevisionservicethatismadeavailabletomulticulturalcommunities inToronto,Edmonton,CalgaryandVancouvergoingforward. Applicablelaw 4 Rogers’televisionundertakingsaresubjecttotheBroadcastingActandtothe CanadianMulticulturalismAct. 5 The1991BroadcastingActrequiresbroadcastingtostrengthenCanada’s cultural,political,socialandeconomicfabric,andtoprovideprogrammingthat reflectsthemulticulturalnatureofCanadiansociety.Unliketheextensionof programminginbothofficiallanguages,theCBC’sprogramming,programming forindigenouspeoplesandaccessibleprogramming,thedeliveryofmulticultural programmingisnotcontingentonresourceavailability. 6 The1988CanadianMulticulturalismActalsomakesitgovernmentpolicyto eliminatebarrierstothefullandequitableparticipationofmulticultural communitiesinCanada,toenhancetheuseofthirdlanguagesinCanada,andto advancemulticulturalism‘inharmony’withCanada’scommitmenttoofficial languages.AsafederalinstitutiontheCRTCissubjecttothislegislation. 7 TheOMNIstationsarealsogovernedbytheCRTC’s1999ethnicbroadcasting policy.ItrequirestheCRTCtodecidethenumberofdistinctgroupsthatan ethnicstationwillserve,andrequiresthatethnicprogramsmakeup60%or moreofanethnicstation’sbroadcastmonth.Weestimatethatin2012the policyappliedto78ethnicbroadcastingservices:49payorspecialtyservices,24 radiostationsandthefiveOMNIstations.(Canada’s6thconventionalethnicTV stationlaunchedinDecember2013.) BroadcastingNoticeofConsultation201426 ExecutiveSummary 28February2014 Page2of4 8 TheCRTChassaidthatit“mayundertake”apublicconsultationontheethnic broadcastingpolicytwoyearsfromnow,in201516.Rogershassaidthatthe CRTCshouldreviewthepolicybeforethen. HistoricalcontextoftheOMNIstations 9 RogersboughtCFMTDTTorontoin1986,andCHNMDTin2008.Itappliedand receivedlicencesforCJMTDTTorontoin2002,andforCJCODTCalgaryand CJEODTEdmontonin2008. 10 Inapplyingforpermissiontoacquire,orforlicencesfor,theOMNIstations, RogershasconsistentlytoldtheCRTCthatitsfinancialvigourwouldstrengthen theOMNIstationsandexpandtheirprogramming. 11 AsRogersdoesnotdisclosetheOMNIstations’finances,Rogers’claimscannot beverified.However,theactualrevenuesreportedbyRogersforallofits conventionaltelevisionstationsin2009/10were1%thanRogersforecastwhen itrenewedtheOMNIandCityTVstationsin2009–meanwhile,Rogers’stations spent24%morethanforecastonnonCanadian,and12%and15%lessthan forecastonnewsandCanadianprogramming. 12 In2012RogerscancelledprogramproductionattheOMNIAlbertastations,as wellas13ethnicprograms.In2013itcancelledanother12programs,including dailynewscastsinEnglish,MandarinandCantonese.FromSeptember2012to August2013,CFMTDT’snewsprogramswerebroadcastsolelyinEnglish (0.01%),Italian(86.07%)andPortuguese(13.92%).Inthesameperiod56%of thestation’sprogrammingconsistedofrepeatbroadcasts,andprograms broadcastinDutch,Estonian,Greek,HebrewandLatvianconsistedentirelyof repeats.Infact,theonlyprogrammingforwhichatleasthalfthehourswerenot repeatbroadcastswasbroadcastinItalian(44%repeat),Portuguese(39% repeat)andFrench(7%repeat). Licenceterm 13 RogershasaskedtheCRTCtorenew(orissue)theOMNIlicencestoAugust 2019. 14 In2012inCanada(CommissionerofOfficialLanguages)v.CBC/RadioCanada, theFederalCourtheldthattheCRTCshouldissuelicencestakingintoaccountits policies,thepublicinterestandgovernmentguidelines–indeed,thepublic interestmustcomefirst.ItalsoheldthattheCRTCmustgiveparticular attentiontocriticismsoflicenseessuchasRogers,asthisispartofthe Commission’smandateasthebroadcastsystem’sregulator. BroadcastingNoticeofConsultation201426 ExecutiveSummary 28February2014 Page3of4 15 FRPCopposesRogers’requestforfiveyearlicences. 16 Rogershasnotmetitscommitmentstothemulticulturalcommunitiesitwas licensedtoserve:havingeliminatedtheOMNIadvisoryboards,italsochoseto cancelnewsandotherprogramswithoutconsultingthecommunitiesaffected. IthastransformeditsoriginatingtelevisionstationsinEdmontonandCalgary intorebroadcastingservices,whilecontinuingtoextractlocaladvertising revenues–placingitscompetitorsataseriousdisadvantage.Rogers’actionsdo notmerittherewardofafiveyearlicence,andgrantingthistermwouldbring theintegrityoftheCRTC’slicensingsystemintodisrepute. 17 TheCRTCshouldinsteadissuetheOMNIlicencesfortwoyears–untilAugust 2016–andshouldadvanceitsconsultationonanewethnicbroadcastingpolicy byoneyear,to20142015.CompletingtheethnicbroadcastingreviewbyApril 2015wouldenabletheCRTCtoestablishcleargoalsforconventionalethnic televisionstations,andtoapplythesegoalswhentheCRTChearsRogers’OMNI renewalapplicationsintimefortheirAugust2016expiry. 18 TheCRTCshouldalsosuspendtheOMNIAlberta’ssaleofcommercialadvertising timeforsixmonths,asanincentivetoreinstatelocalprogramproduction. Rogerscouldtheneitherofferfreeairtimetoadvertiserstoenablethemto evaluatethebestmethodsofmarketingtomulticulturalcommunities,orcould offerprogrammingcommercialfree,toattractmoreviewers.IfRogersfailsto

    Unifor Local 830M Intervention on CRTC Broadcast Notice of Consultation 2018-127 1. I am writing with conditional support for Rogers application for a national, multilingual multi-ethnic television service offering news and information programming, which, if licensed, would receive mandatory distribution on the basic service pursuant to section 9(1)(h) of the Broadcasting Act. 2. I would like to appear at October 15, 2018 hearing. 3. Unifor Local 830M represents 60 unionized employees in Vancouver who work for Rogers Communications to produce programming for CKVU, CHNM and OMNI Regional. 4. We want to work with Rogers and the Canadian Radio-television and Telecommunication Commission (CRTC) to ensure Canadians have access to high quality local multicultural news, produced in-house by Rogers employees in the cities across Canada which they also operate over the air (OTA) multicultural broadcast licenses. 5. Many of the applications the CRTC is considering with BNOC 2018-127 are deficient and could allow a Broadcaster the ability to contract out local news programming to a sub contractor who could be a competitor or even a subsidiary of a foreign broadcaster. Providing a translation service through the use of technology would also be a mistake and fall far short of the goals of the Broadcast Act. 6. The CRTC has allowed large vertically integrated Canadian companies to operate in a winner takes all world of regulated broadcast licensing. While ‘traditional’ television is still a significant method of consumption, long-form video content streamed through a connected device is a regular part of Canadian viewing patterns. In some cases, viewing through a connected device is the only way Canadians are consuming content. Whether ad supported (YouTube, CityTvNow, Tubi), paid subscription (Netflix, Disney+, Sportsnet NOW etc.) or a hybrid of both, streaming is a growing method of content consumption in Canada. With enforced isolation and restrictions brought on by the pandemic, streaming consumption has been accelerated. Canadians are spending more time and money with streaming services. From our research, we estimate that Canadians spent $2.7B on streaming services in 2020.1 Is this a one time aberration, or a sign of things to come?
