WearepleasedtoparticipateintheprocessinitiatedbyBroadcastingNoticeofConsultation 201426,tocommentontheapplicationsfiledbyRogersBroadcastingLimitedtorenewthe licencesofitstelevisionprogrammingundertakings.Ourinterventionisattached:wedo notsupportRogers’applicationforfiveyeartermsfortheOMNIlicences,andopposeits proposedconditionsoflicence,asapprovaloftheserequestseffectivelyplacesRogers’ interestsbeforethepublicinterest.

3. FRPCrespectfullysubmitsthatthepublicinterestwouldbeservedbyshort,twoyearterms fortheOMNIlicences,theimpositionofthecurrentconditionsoflicenceinplaceforthe OMNI,andtheintroductionofaconditionoflicencerequiringeachstationtobroadcasta minimumleveloforiginallocalandprogramming,eachweek,inaspecifiednumberof languages.

Introduction

1 TheForumforResearchandPolicyinCommunications(FRPC)isanonprofitand nonpartisanorganizationestablishedtoundertakeresearchandpolicyanalysis aboutcommunications,includingbroadcasting.

2 TheForumsupportsastrongCanadianbroadcastingsystemthatservesthe publicinterest,andisachievingParliament’sobjectives.

Importanceofthisproceeding

3 FRPC’sinterventionaddressesthetermandconditionsoftheOMNIlicences. TheCRTC’sdecisionsontheseissueswilldeterminethelevelandqualityoffree, localethnictelevisionservicethatismadeavailabletomulticulturalcommunities in,,andgoingforward.

4 Rogers’televisionundertakingsaresubjecttotheBroadcastingActandtothe CanadianMulticulturalismAct.

5 The1991BroadcastingActrequiresbroadcastingtostrengthenCanada’s cultural,political,socialandeconomicfabric,andtoprovideprogrammingthat reflectsthemulticulturalnatureofCanadiansociety.Unliketheextensionof programminginbothofficiallanguages,theCBC’sprogramming,programming forindigenouspeoplesandaccessibleprogramming,thedeliveryofmulticultural programmingisnotcontingentonresourceavailability.

6 The1988CanadianMulticulturalismActalsomakesitgovernmentpolicyto eliminatebarrierstothefullandequitableparticipationofmulticultural communitiesinCanada,toenhancetheuseofthirdlanguagesinCanada,andto advancemulticulturalism‘inharmony’withCanada’scommitmenttoofficial languages.AsafederalinstitutiontheCRTCissubjecttothislegislation.

7 TheOMNIstationsarealsogovernedbytheCRTC’s1999ethnicbroadcasting policy.ItrequirestheCRTCtodecidethenumberofdistinctgroupsthatan ethnicstationwillserve,andrequiresthatethnicprogramsmakeup60%or moreofanethnicstation’sbroadcastmonth.Weestimatethatin2012the policyappliedto78ethnicbroadcastingservices:49payorspecialtyservices,24 radiostationsandthefiveOMNIstations.(Canada’s6thconventionalethnicTV stationlaunchedinDecember2013.)

8 TheCRTChassaidthatit“mayundertake”apublicconsultationontheethnic broadcastingpolicytwoyearsfromnow,in201516.Rogershassaidthatthe CRTCshouldreviewthepolicybeforethen.

HistoricalcontextoftheOMNIstations

9 RogersboughtCFMTDTTorontoin1986,andCHNMDTin2008.Itappliedand receivedlicencesforCJMTDTTorontoin2002,andforCJCODTCalgaryand CJEODTEdmontonin2008.

10 Inapplyingforpermissiontoacquire,orforlicencesfor,theOMNIstations, RogershasconsistentlytoldtheCRTCthatitsfinancialvigourwouldstrengthen theOMNIstationsandexpandtheirprogramming.

11 AsRogersdoesnotdisclosetheOMNIstations’finances,Rogers’claimscannot beverified.However,theactualrevenuesreportedbyRogersforallofits conventionaltelevisionstationsin2009/10were1%thanRogersforecastwhen itrenewedtheOMNIandCityTVstationsin2009–meanwhile,Rogers’stations spent24%morethanforecastonnonCanadian,and12%and15%lessthan forecastonnewsandCanadianprogramming.

12 In2012RogerscancelledprogramproductionattheOMNIAlbertastations,as wellas13ethnicprograms.In2013itcancelledanother12programs,including dailynewscastsinEnglish,MandarinandCantonese.FromSeptember2012to August2013,CFMTDT’snewsprogramswerebroadcastsolelyinEnglish (0.01%),Italian(86.07%)andPortuguese(13.92%).Inthesameperiod56%of thestation’sprogrammingconsistedofrepeatbroadcasts,andprograms broadcastinDutch,Estonian,Greek,HebrewandLatvianconsistedentirelyof repeats.Infact,theonlyprogrammingforwhichatleasthalfthehourswerenot repeatbroadcastswasbroadcastinItalian(44%repeat),Portuguese(39% repeat)andFrench(7%repeat).

Licenceterm

13 RogershasaskedtheCRTCtorenew(orissue)theOMNIlicencestoAugust 2019.

14 In2012inCanada(CommissionerofOfficialLanguages)v.CBC/RadioCanada, theFederalCourtheldthattheCRTCshouldissuelicencestakingintoaccountits policies,thepublicinterestandgovernmentguidelines–indeed,thepublic interestmustcomefirst.ItalsoheldthattheCRTCmustgiveparticular attentiontocriticismsoflicenseessuchasRogers,asthisispartofthe Commission’smandateasthebroadcastsystem’sregulator.

16 Rogershasnotmetitscommitmentstothemulticulturalcommunitiesitwas licensedtoserve:havingeliminatedtheOMNIadvisoryboards,italsochoseto cancelnewsandotherprogramswithoutconsultingthecommunitiesaffected. IthastransformeditsoriginatingtelevisionstationsinEdmontonandCalgary intorebroadcastingservices,whilecontinuingtoextractlocaladvertising revenues–placingitscompetitorsataseriousdisadvantage.Rogers’actionsdo notmerittherewardofafiveyearlicence,andgrantingthistermwouldbring theintegrityoftheCRTC’slicensingsystemintodisrepute.

17 TheCRTCshouldinsteadissuetheOMNIlicencesfortwoyears–untilAugust 2016–andshouldadvanceitsconsultationonanewethnicbroadcastingpolicy byoneyear,to20142015.CompletingtheethnicbroadcastingreviewbyApril 2015wouldenabletheCRTCtoestablishcleargoalsforconventionalethnic televisionstations,andtoapplythesegoalswhentheCRTChearsRogers’OMNI renewalapplicationsintimefortheirAugust2016expiry.

18 TheCRTCshouldalsosuspendtheOMNIAlberta’ssaleofcommercialadvertising timeforsixmonths,asanincentivetoreinstatelocalprogramproduction. Rogerscouldtheneitherofferfreeairtimetoadvertiserstoenablethemto evaluatethebestmethodsofmarketingtomulticulturalcommunities,orcould offerprogrammingcommercialfree,toattractmoreviewers.IfRogersfailsto reinstatelocalprogramproductionasrequiredbytheCommission,theCRTC couldafter6monthscalltheOMNIAlbertastationstoashowcausehearing.

Conditionsoflicence

19 Inthe2012ReferencereBroadcastingRegulatoryPolicyCRTC2010167and BroadcastingOrderCRTC2010168,theSupremeCourtofCanadaheldthatthe CommissionmustinterprettheBroadcastingAct’spolicyobjectivestoelucidate, ratherthanfrustrateParliament’sintent.

20 RogershasaskedtheCRTCtoapplyconditionstotheOMNIlicenceswhose essentialeffectwillbetomutilatetheprogrammingservicessoseverelyasto transformthemintosomethingotherthanethnicservices.

21 RogersalsopleadsthatitsOMNIservicesshouldnotberequiredtoprovidelocal programming,whichitdescribesasthe‘core’oftheOMNIstations’contribution tothebroadcastingsystem.Thecompany’smainargumentisthatethnic programmingcostsmoney,andthatbeingrequiredtooffer15hoursoflocal programmingeachwouldcouldreducetheOMNIstations’profitabilitybyas muchas$2million.

23 Theabsenceofconditionsoflicencemandatingminimumlevelsoforiginallocal newsandotherprogrammingensuresthatlocalprogrammingwilleventually disappearfromtheOMNIschedulesaltogether.TheprogramlogsofCFMTDT, forexample,showthatbetweenthe20002001and20122013broadcastyears localprogrammingdecreasedby54%(from2,410to1,111hours).News programmingdecreased44%,fromanaverageof23.7hours/weekin6ethnic languages,to13.2hours/weekin2ethniclanguages.

24 Rogershasnotdemonstratedhowapotentialreductionof$2millionin profitabilityisdetrimentaltoitscircumstances.Thispotentialreduction represents0.4%ofthe$876millionitdistributedindividendstoitsshareholders in2013.Infact,increasinglocalprogrammingrequirementstothepointthat Rogers’profitabilitymightdecreaseby$5million,wouldresultinaonecent reductionofitspersharedividend–from$1.74,to$1.74.$1.73.

25 ThecircumstancesofRogersasOMNIlicenseeclearlypermitthecompanyto devotemoreresourcestoOMNIprogramming–andthisiswhatwouldbest servethepublicinterest.

Summaryofrecommendations

26 FRPCrespectfullysubmitsthatthepublicinterestinthisproceedingwouldbest beservedby

1. advancingtheCRTC’spublicconsultationonethnicbroadcastingpolicy from20152016,to20142015

2. grantingtwoyearlicencestotheOMNIstations

2 AstheForumsupportsastrongCanadianbroadcastingsystemthatservesthepublic interest,wewelcometheopportunityprovidedbyBroadcastingNoticeof Consultation201426tomakesubmissionsconcerningRogers’applicationstorenew thelicencesofitsconventional,ethnicandspecialtytelevisionprogramming services,andtoamenditsconditionsoflicence.

3 Inourview,thetwoissuesfacingtheCRTCinthishearingarethetermand conditionsattachedtotheOMNIlicences.

4 TheCRTC’sdecisionsabouttheseissueswilldeterminethelevelandqualityoflocal televisionservicemadeavailabletoethniccommunitiesinToronto,Edmonton, CalgaryandVancouver.Moregenerally,though,theCRTC’sresponsetoRogers’s OMNIapplicationswillenableCanadianstodeterminewhethertheCRTCplacesthe publicinterestbeforeorafterprivatebroadcasters’interests. II Multiculturalism,ethnicbroadcastingandtheOMNIstations

5 TheCRTC’sdecisionsregardingtheOMNIstationsmustnotonlyimplement Parliament’sobjectivesformulticulturalreflectionintheBroadcastingAct,butthe requirementsofthe1988CanadianMulticulturalismAct.

A 1988CanadianMulticulturalismAct

6 ParliamentrecognizesandsupportsCanada’smulticulturalcharacter.TheCharterof RightsandFreedoms,forexample,requirestherightsandfreedomsofpeoplein Canadatobeinterpreted“inamannerconsistentwiththepreservationand enhancementofthemulticulturalheritageofCanadians.”1Its1988Canadian MulticulturalismActmadeitgovernmentpolicyto“fostertherecognitionand appreciationofthediverseculturesofCanadiansocietyandpromotethereflection andtheevolvingexpressionsofthosecultures”.

7 TheCanadianMulticulturalismActdeclaresthattheCanadiangovernment’spolicyis to

enhancetheuseofthirdlanguagesinCanada

promotethereflectionandevolvingexpressionofCanada’sdiversecultures, and

advancemulticulturalismthroughoutCanada“inharmony”withthenation’s commitmenttoitsofficiallanguages.

8 Specifically,Parliamentsaysthatthefederalgovernmentmust

(a) recognize and promote the understanding that multiculturalism reflects the cultural and racial diversity of Canadian society and acknowledges the freedom of all members of Canadian society to preserve,enhanceandsharetheirculturalheritage; (b)recognizeandpromotetheunderstandingthatmulticulturalismisa fundamental characteristic of the Canadian heritage and identity and that it provides an invaluable resource in the shaping of Canada’s future; (c) promote the full and equitable participation of individuals and communitiesofalloriginsinthecontinuingevolutionandshapingofall aspects of Canadian society and assist them in the elimination of any barriertothatparticipation; (d) recognize the existence of communities whose members share a commonoriginandtheirhistoriccontributiontoCanadiansociety,and enhancetheirdevelopment; (e) ensure that all individuals receive equal treatment and equal protectionunderthelaw,whilerespectingandvaluingtheirdiversity; (f) encourage and assist the social, cultural, economic and political institutions of Canada to be both respectful and inclusive of Canada’s multiculturalcharacter; (g) promote the understanding and creativity that arise from the interactionbetweenindividualsandcommunitiesofdifferentorigins; (h) foster the recognition and appreciation of the diverse cultures of Canadian society and promote the reflection and the evolving expressionsofthosecultures; (i)preserveandenhancetheuseoflanguagesotherthanEnglishand French,whilestrengtheningthestatusanduseoftheofficiallanguages ofCanada;and

9 TheCanadianMulticulturalismActalsosaysthat

…allfederalinstitutionsshall (a) ensure that Canadians of all origins have an equal opportunity to obtainemploymentandadvancementinthoseinstitutions; (b)promotepolicies,programsandpracticesthatenhancetheabilityof individuals and communities of all origins to contribute to the continuingevolutionofCanada; (c) promote policies, programs and practices that enhance the understanding of and respect for the diversity of the members of Canadiansociety; (d) collect statistical data in order to enable the development of policies,programsandpracticesthataresensitiveandresponsivetothe multiculturalrealityofCanada; (e) make use, as appropriate, of the language skills and cultural understandingofindividualsofallorigins;and (f)generally,carryontheiractivitiesinamannerthatissensitiveand responsivetothemulticulturalrealityofCanada.3 B 1991BroadcastingAct

10 ParliamentnowalsorecognizesCanada’smulticulturalcharacterinitsbroadcasting policyforCanada.The1968BroadcastingActdidnotaddressmulticulturalism,but the1991BroadcastingActstatesthatCanada’sbroadcastingsystemshould

servetosafeguard,enrichandstrengthenthecultural,political,social andeconomicfabricofCanada, [and]

11 Inreferringthe1991broadcastinglegislationtocommitteeforsecondreadingthe MinisterofCommunicationsdescribedtheexplicitrecognitionofculturalminorities and“themulticulturalcharacter ofoursociety”asoneofthe 3.(1)ItisherebydeclaredasthebroadcastingpolicyforCanadathat (k)arangeofbroadcastingservicesinEnglishandinFrenchshallbe “majorimprovementsoverthe 5 extendedtoallCanadiansasresourcesbecomeavailable; 1968Act.” … (m)(vii)theprogrammingprovidedbytheCorporationshould…be 12 Moreover,whiledeliveryof madeavailablethroughoutCanadabythemostappropriateand severalotherimportantelements efficientmeansandasresourcesbecomeavailableforthepurpose, ofthe1991legislationis and contingentontheavailabilityof … resources,thereflectionof (o)programmingthatreflectstheaboriginalculturesofCanada Canadiansociety’smulticultural shouldbeprovidedwithintheCanadianbroadcastingsystemas resourcesbecomeavailableforthepurpose; andmultiracialnatureisnot. 13 TheCRTChasdevelopedandpublishedtwopoliciestofurtherParliament’sobjective thatthebroadcastingsystemreflectCanada’smulticulturalnature.Its1985ethnic broadcastingpolicywasestablished“toencouragethegrowthanddevelopmentof ethnicprogramminginCanada”andto“helpensurethatculturallyandracially distinctgroupsreceivebroadcastingservices.”6Its1999ethnicbroadcastingpolicy revisedtheearlierpolicy“toprovidemoreflexibilitytothebroadcastingindustry andtostreamlineregulatoryrequirements,whilestillensuringthatthecore objectivesofthepolicycontinuetobemet.”7

BroadcastingNoticeofConsultation201426 Intervention 28February2014 Page5of36 14 TheCRTC’s1999ethnicbroadcastingpolicyremainsinforce,andestablishesthat “[e]thnicstationsplayanimportantroleinservinglocalcommunities.”8Itsprimary goal“istoensureaccesstoethnicprogrammingtotheextentpracticablegiven resourcelimitations.”9Ethnictelevisionstationsmustbroadcasttheminimumlevel ofCanadiancontentrequiredfromconventionalprivatetelevisionstations, dependingontheethnicstations’conditionsoflicence.

15 Toensure“thatethnicstationsprimarilyserveethnic An ethnic program is one, in any 10 communities”, ,theethnicbroadcastingpolicy language, that is specifically directed requiresethnictelecommunicationsstationstoensure to any culturally or racially distinct thatethnicprogramsmakeup60%ormoreofthe group other than one that is broadcastmonth.11Halformoreofanethnicstation’s AboriginalCanadianorfromFranceor theBritishIsles. programmingmustbeinlanguagesthatarenot 1999ethnicbroadcastingpolicy,¶9 French,Englishorindigenous.12TheCRTCdecidesthe numberofdistinctgroupstobeservedbyanethnicstationbasedonacommunity’s demographics,availableservicesandlocalsupport.13

16 The1999policyalsorequiresethnicstations“toprovide,attimeoflicensingand renewal,plansonhowtheywillreflectlocalissuesandconcerns”14aswellas mechanismsforevaluatingtheirprogressinachievingtheseplans.15Ethnic broadcastersaresupposed“toreportontheprogressoftheirinitiatives”whentheir licencesarerenewed.16

25 InapprovingRogers’purchaseofCHMNTVtheCRTCspecificallynotedthatRogers agreed“tomaintainMultivan’scommitmenttolocalprogrammingandlocalservice andthatitintendstomakeconsiderableinvestmentstoachieveself sustainability.”41

27 InapprovingCJMTDTToronto,theCRTC

… considered the results of Rogers' study of demand for additional thirdlanguage programming, and is convinced, given the large ethnic communityintheTorontoareaanditsgrowingdiversity,thatadditional television service devoted to a wider range of ethnic communities is warranted, and is consistent with the objectives of the Act. The CommissionagreeswithRogers'positionthatnewethnicserviceswill stimulate growth in the ethnic advertising market. It also finds that, since the focus of the new station will be on service to local communities,anynegativeimpactonotherserviceswillbelimited.47

28 TheCRTCaddedthatitwas

...furtheroftheopinionthatRogers'financialcommitmentsoverand abovenormalprogrammingexpenseswillhaveasignificantandpositive effect upon the provision of original Canadian ethnic programming. It notesinparticularthattheRogers'fundinginitiativewillcontributetoa strengthenedindependentethnicproductionindustry,giventhelackof fundingcurrentlyavailabletoproducersofethnicprogramming.48

29 RegardingCJCODTCalgaryandCJEODTEdmonton,Rogerssaidin2007that,

theOMNIAlbertastationswouldhave“aneditorialstaffof20people,of whichsevenwouldbeinCalgaryand13wouldbeinEdmontonbecausewe seeEdmontonasbeingthecorenewsgatheringcentre”49withanews directorandproducersforthreelanguagesinthatlocation.50

IttoldtheCRTCin2008thatcontinuingandstrengtheningitslocal programmingwasimportanttoitsapplication54andthatOMNIhadthe “localfirstprogrammingphilosophy”demandedofovertheairtelevision stations.55

WhenitannouncedthelaunchoftheCalgaryandEdmontonstations,itsaid that“locallyproducednewscaststhateachdayprovideindepthcoveragefor andabouttheemergingCantonese,MandarinandSouthAsiancommunities” was“central”toOMNI’sAlbertaschedule.56

RogersNationalVicePresidentofOMNITelevisionsaidthat“EachOMNIwill haveastrongfocusonlocalnewswithabalanceoflocal,regionaland nationalperspectives….”57

30 InapprovingtheOMNIAlbertastationstheCRTCsaidithat

…Rogers'approachwillensurethatmoresmallandlargeethnicgroups areservedineachmarket,thusmeetingtothefullestextentpossible thebroadservicerequirementsetoutintheEthnicPolicy.58

31 In2009RBLappearedbeforetheCRTCtoapplyfortherenewalofitsOMNIand CityTvconventionaltelevisionlicences.Itforecasttotalrevenuesforthefollowing yearof$243.8million,andexpendituresof$66.6millionand$114.3millionon CanadianandnonCanadianprogramming,respectively(seeTable1).Italso forecastthatitsconventionaltelevisionstations’newsexpenditureswouldamount to16%ofitsrevenues.

34 InAugust2009,andbasedontheevidenceintheproceedingwhichincludedRogers’ financialforecasts,theCRTCrenewedtheOMNIlicencestoAugust2015.62It grantedRogers’requestforasixyearlicencetermandtoharmonizeitsCanadian anditsethnicprogrammingrequirementsacrossalloftheOMNIstations.Italso approvedRogers’requesttoharmonizeCJMNTTV’sethnicprogramming

36 TheOMNIandCityTVstations’actualrevenuesin2009/10were1%higherthan Rogersforecast.Nevertheless,thestationsspent12%and15%lessonnewsand Canadianprogramming,and24%moreonnonCanadianprogramming,than forecast.

39 TheCRTCdeniedRogers’applicationtoreduceannualCanadianrepeat programmingonitsOMNI(andCityTV)stationsfrom60%to55%,consistentwitha newCRTCregulatoryframeworkenteringintoeffectinSeptember2011.69Itfound thatRogershadnotprovidedevidenceestablishingthefinancialnecessitytomake thechanges,andthatitwouldbeunfairtoimplementsomeelementsofthenew frameworkforsome,withoutdoingthesamefortheircompetitors.70

56 Asmentionedpreviously,theethnicbroadcastingpolicyrequiredRogers“to provide,attimeoflicensingandrenewal,plansonhow[theOMNIstations]will reflectlocalissuesandconcerns”84aswellasmechanismsforevaluatingtheir progressinachievingtheseplans.85Rogerswasalsosupposed“toreportonthe progressoftheirinitiatives”whenapplyingfortheOMNIlicences’renewal.86 Finally,astheCRTCdecidesthenumberofdistinctgroupstobeservedbyanethnic stationbasedonacommunity’sdemographics,availableservicesandlocal support,87ethnictelevisionbroadcastersseekingtosetthenumberofdistinct groupstobeservedmightbeexpectedtoprovidethisinformationintheirlicence renewals.

57 Unfortunately,RogersprovidedveryfewfactsabouttheOMNIservices’ programming,hasnotsetoutanyplansonhowtheOMNIstationswillreflectlocal issuesandconcerns,anddidnotreportontheprogressofitsstations’initiatives.

A Termoflicences

58 RogershasaskedtheCRTCtorenewtheOMNIlicencestoAugust2019.Itargues thatthistimeframeis“reasonable…tomeasuretheeffectivenessandsuccess”ofits programmingproposals.88Itsaysitwillfocuson“stabilizingOMNI’srevenuesin ordertosustainitscurrentlevelofinhouseproduction.”89

92 60 TheCRTCmayissueorrenewlicencesfortermsofuptosevenyears. Its discretionaryauthorityinlicensingisnotunfettered,butislimitedbytheprovisions oftheBroadcastingActthatgranttheCRTCjurisdictionoverlicensees,93aswellas thelargerframeworkofrelatedstatutes.94TheCommissionexercisesthisjurisdiction properlywhenit“actsingoodfaith,inaccordancewiththelaw,doesnottakeinto accountirrelevantfactorsanddoesnotfailtoconsiderrelevantfactors.”95Itmust “takeintoaccountthepublicinterest.”96Indeed,inlicensingproceedings,“’the publicinterest’mustcomefirst.”97

61 CanadiansarealsoentitledtoexpecttheCRTCtointegratethepurposesofCanada’s MulticulturalismActinitsactivities,tomakecertaintoconsidertheneedsof multiculturalcommunitiesinrespectofitshearings,policiesanddecisions.98

62 TheprocesslaunchedbyBroadcastingNoticeofConsultation201426isRogers’ opportunityto“provideCanadianswithanexplanationofitsprogrammingchoices andofitsvisionforthefutureinasettingwheretheinterestedpartieswillhavethe opportunitytobeheard.”99

63 DuringthisproceedingCanadiansareentitledtoexpecttheCRTCto“giveparticular attentionto…criticisms’”ofRogers,as“[t]hisispartofitsmandateasregulatorof thebroadcastingsystem.”100Indeed,

BroadcastingNoticeofConsultation201426 Intervention 28February2014 Page21of36 …itisinevitablethat,inthelicencerenewalcontext,theCRTCwillbe sensitive to the public's complaints and to the licensee's reaction to thosecomplaintsthatallegeanabuseofrights.TheCRTCwouldnotbe playingitsroleandwouldbeabdicatingitsresponsibilitiesifitwere indifferent to the public interest or to allegations that a licensee is compromising the public interest by its deeds and actions or its excessivepassivityortolerance.Inthiscontextofalicencerenewalin thebestinterestsofthepublic,itmustbeabletoreportabusesthatthe public complains of and to verify whether the licensee has complied with the Act, the Regulations, its conditions of licence or any specific undertakingsitmayhavemade.101

64 RogershasaskedtheCRTCtoreneweachoftheOMNIlicencesfor5years,to August2019.102AdecisionnottorenewtheOMNIlicenceswouldbe“an administrativeandregulatoryoneinwhichtheissueistheappropriatenessfromthe standpointofthepublicinterestofrenewingalicence.”103Thisexplainswhy,“[a]t theconclusionofarenewalprocedure,itisalwayspossiblethatalicencewillnotbe renewed.”104

65 TheCRTCbearsadutytoverifyRogers’claimsabouttheOMNIstations.Theduty extendsbeyonddeterminationofwhetherOMNIhasbreacheditsconditionsof licence,towhetherRogersis‘flouting’theCommission’srequirements:

[w]hen a licence is being suspended, revoked or renewed, the CRTC's duty of surveillance implies a verification of the quality of the programming and broadcasts to determine whether they meet the standardsestablishedbytheAct,theRegulations,theCodesofEthics andtheconditionsoflicence.Needlesstosay,suchverificationrequires verificationofallegationsorcomplaintsthatthesestandardsarebeing diluted,distorted,ignoredorfloutedbyalicensee.…105

66 BroadcastingNoticeofConsultation201426doesnotrequireRogerstoshowcause whytheOMNIlicencesshouldnotberevokedorsuspended,anddoesnotitself containanyinformationabouttheCRTC’s‘verification’ofthequalityof programmingbytheOMNIstations.

68 Thecourtshaveheldthatdecisionstograntordenylicencerenewalapplicationsare discretionaryandlie“attheveryheartoftheCRTC’sexpertise.”108Theissuanceofa licence,anditsrenewal,areprivileges,ratherthanrights.109Inotherwords, althoughRogersisentitledtoexpecttobetreatedfairlybytheCRTCasitconsiders whethertorenewortoreissuetheOMNIlicences,Rogersisnotentitledtoexpect theautomaticrenewalorissuanceofthoselicences.

69 IftheCRTCissuesorrenewstheOMNIlicences,themaximumlicencetermpossible forthestationsundersection9(1)(b)oftheBroadcastingActissevenyears.The CRTChasoftenissuedshorterlicencetermsafterhearinglicensees’applications, particularlyincaseswherebroadcastershavebreachedtheCRTC’sregulationsor theirconditionsoflicence–inotherwords,shorttermrenewalsareasanction permittedbytheBroadcastingAct.AslongastheCRTCconsidersrelevantfactors, andnotirrelevantones,theCommissionmaychooseanyadministrativesanction authorizedbyParliament110toaddressRogers’performancewithrespecttothe OMNIstations.

2 CRTCshouldissueshorttermlicencesfortheOMNIstations

70 FRPCsupportstheissuanceofnewlicencesfortheOMNIstations,becausethiswill enabletheCRTCtoimposeconditionsoflicencewhichservethepublicinterest,of itsownaccord.(TheCRTCcannotnowimposesuchconditionsbecausetheOMNI

71 Thatsaid,whethertheCRTCissuesnewlicencesorrenewstheexistlicences,FRPC stronglyopposesthefiveyearlicencetermrequestedbyRogers.WenoteRogers’ claimsitneedstimetoevaluatethesuccessofitsnewapproachtoethnictelevision. WaitingforRogerstosucceedislikewaitingforGodot,111however:Rogersitself notesthatwhileOMNIAlbertabegan“workingwithlocalcommunitygroupsand producers”in2008,112sixyearslaterithasnotsucceededinputtingaprogram together–rather,“therehavebeenmanyfailedattempts….”113

72 BeyondtheamazingamountoftimeRogersseemstoneedtofind,payforand broadcastethnicprogramming,severalotherreasonsstronglymitigateagainsta fiveyearrenewalfortheOMNIlicences.

73 First,RogershasfailedtomeetitscommitmentstotheCanadianmulticultural communitieswhomthesestationswerelicensedtoserve.Instead,itmadestartling andsignificantprogrammingreductionswithoutconsultingtheaffected communities–perhapsbecauseiteliminateditscommunityAdvisoryBoardsin 2010.ManypeoplecomplainedtotheCRTC,includinganumberofnational organizations.Rogers’decisionstoeliminateimportantprogrammingwithout consultationshouldnotberewardedbyafiveyearrenewalterm.Ashorterterm woulddemonstrateimportanceoftheintegrityoftheCRTC’slicensingprocess– showingthatlicenseesthatradicallyreduceprogrammingtothecommunitiesthey arelicensedtoserve,arenotrewardedfortheiractions.

74 Second,afiveyeartermfortheOMNIstationsalsoconflictswithCRTC’sownplan– postedontheCRTC’swebsiteinMay2013–toreviseitsethnicbroadcastingpolicy beforeApril2016.TheBroadcastingActwouldnotpermittheCRTCtochangeany conditionsoftheOMNIlicencesuntilfiveyearsafterthelicences’lastrenewal.114If theOMNIlicencesarenowrenewedfromAugust2014toAugust2019,howwould theOMNIstationsactuallybeaffectedbyanewpolicy?

76 RatherthanhastilylicensingtheOMNIstationsnowforhalfadecade,theCRTC shouldinsteadrenewtheOMNIlicencesforashortperiod.Atwoyearrenewalwill demonstratetheCRTC’scommitmenttoenforcingprogrammingrequirementsin thepublic–nottheprivate–interest.AshorttermwillalsoensurethattheOMNI stationswillbegovernedbyrequirementsofanewethnicbroadcastingpolicy, and/oranewtelevisionbroadcastingpolicy.

77 TheCRTCshouldalsothenadvanceitsethnictelevisionconsultationbyoneyear,to providetheCRTCandthepublicwithaninformedbasisfromwhichtoevaluatethe degreetowhichParliament’sobjectivesformulticulturalbroadcastingarebeing implementedbytheentirebroadcastingsystem,includingtheOMNIstations. CompletingtheethnicbroadcastingreviewbyApril2015wouldenabletheCRTCto establishcleargoalsforconventionalethnictelevisionstations,andtoapplythese goalswhentheCRTChearsRogers’OMNIrenewalapplicationsintimefortheir August2016expiry.

3 CRTCshouldsuspendtheOMNIAlbertastations’saleofadvertising

78 AsfortheCJCODTCalgaryandCJEODTEdmontonstations,Rogers’decisionto eliminateprogramproductionatthesestationshaseffectivelytransformedthe stationsintorebroadcastersthatcontinuetoacceptlocaladvertising.Rogers’ actionswiththesestationsmocktheCRTC’slocaladvertisingpolicy.Worse,they placelocaltelevisionbroadcastersthatproduceoriginallocalprogrammingsoasto solicitlocaladvertisingatanunfairdisadvantage–andtherebyjeopardizethe integrityoftheCRTC’slicenceenforcementprocess.

79 FRPCrespectfullyrecommendsthattheCRTCreissuethelicenceswith requirementsfororiginallocalprogramming,whilesuspendingRogers’abilitytosell advertisingtimeonthetwostationsforsixmonths.115Nothingwouldprevent Rogersfromprovidingtimetolocalmerchantsfreeofcharge,toprovidethemwith experienceinmarketingtolocalmulticulturalcommunitiesinCalgaryandEdmonton –andlocalcommunitiescouldbenefitfromanincreaseintheavailabilityof informationaboutlocalgoodsandservices.

81 IfRogersattheendofsixmonthsfailedtomeetitsprogrammingcommitmentsat theendofsixmonths,theCRTCwouldbeentitledtocallRogerstoashowcause hearing.Intheabsenceofseriouscommitmentstomeetitsoriginalprogramming promises,theCommissioncouldthendecidenottorenewthelicences,andtoinvite applicantstoapplytoprovidetheseservices.

B Conditionsoflicence

82 RogershasaskedtheCRTCtoremoveanyrequirementforethnicprogramming duringevenings,toallowthestationstocarrypredominantlyforeignprogramming, andtoallowtheOMNIstationstocarryanunlimitedamountofCityTV programming.

1 Thelawregardingconditionsoflicence

83 TheBroadcastingActempowerstheCRTCtoimposeconditionsonbroadcasting licences“relatedtothecircumstancesofthelicensee”whichitfindsappropriateto implementParliament’sbroadcastingpolicy.116Itisanoffenceforbroadcastersto contraveneconditionsoflicence.117

84 TheobjectoftheCRTCistoregulateallaspectsofCanada’sbroadcastingsystem “withaviewtoimplementingthebroadcastingpolicysetoutinsubsection3(1)”of theBroadcastingAct,118whichtheSupremeCourtofCanadafoundin2012tohave “aprimarilyculturalaim.”119

85 Thebroadcastingpolicy“containsasetofpolitical,social,economicandcultural objectivesthatreflectthelinguisticdualityandthemulticulturalandmultiracial

BroadcastingNoticeofConsultation201426 Intervention 28February2014 Page26of36 natureofCanadiansociety.”120In2012theSupremeCourtofCanadafoundthatthe policyobjectivesinsection3(1)oftheBroadcastingAct“focusoncontent,suchas theculturalenrichmentofCanada,thepromotionofCanadiancontent,establishing ahighstandardfororiginalprogramming,andensuringthatprogrammingis diverse.”121WheretheCopyrightActis“acarefullybalancedschemethatcreates exclusiveeconomicrightsfordifferentcategoriesofcopyrightownersinworksor otherprotectedsubjectmatter”,122Canada’sbroadcastinglegislation“isprimarily concernedwiththeprogrammedcontentdeliveredbymeansofradiowavesor othermeansoftelecommunicationtothepublic.”123

86 TheCommissionmustinterprettheBroadcastingAct’spolicyobjectivesnotto frustrate,buttoelucidate,Parliament’sintent.124In2012theSupremeCourtof Canadaheldthat“ParliamentmustbepresumedtohaveempoweredtheCRTCto worktowardsimplementingtheseculturalobjectives….”125

87 In2012,theFederalCourtheldthatconditionsoflicencesetbytheCRTCmustbe consistentnotonlywiththeBroadcastingAct,butwiththeOfficialLanguagesActas well–including“ensuringadherencetothevaluesandspiritofthe[Acts]in promotingtheequalstatusofbothofficiallanguagesandsupportingthe developmentof[officiallanguageminoritycommunities].”126TheCourtsaid:

Let me be clear: the government cannot interfere with the Corporation’sprogrammingchoices(subsections4(1),35(2),46(5)and 52(2)ofthe[BroadcastingAct]).However,freedomofexpressionand journalisticindependencedonotconstitutea generallicenceallowing the Corporation to avoid implementing the linguistic aspects of the broadcastingpolicyforCanada,….Thisisespeciallytrueinthecaseof OLMCs,whicharethreatenedbyassimilationandcountonpublicradio andpublictelevisiontopreservetheirlanguageandculturalidentity.127

2 CRTCcanapplynewconditionsoflicenceonitsownaccord

89 WhiletheCRTCcannotunilaterallymodifyconditionsoftheOMNIbroadcasting licencesbecausethesewererenewedlessthanfiveyearsago,130itwillbeableto modifytheOMNIconditionsbecauseRogersagreed131totheCRTC’srequestthat thelicencesberevoked.132RevocationofthelicencesmeansthattheCRTCwillbe abletoissuenewlicences,andapplynewconditionsoflicencewithoutRogers’ expressconsent,“shouldtheCommissiondecidetocompletetherenewalofthe licencesfortheOMNItelevisionstationsfollowingtheconclusionofthepresent proceeding.”133

3 TheCRTCshoulddenyconditionsoflicencethatmakethepublicinterest subservienttoprivateinterests

90 FRPCrespectfullysubmitsthatconditionsoflicenceappliedtotheOMNIstations mustservethepublicinterest.TheconditionsproposedbyRogersserveitsinterests inreducingcostsandmaximizingprofits,butdonotservethepublicinterestin promotingandenhancingmulticulturalisminCanada.

91 RogersisaskingtheCRTCtorevisetheOMNIconditionsoflicence.Itsaysthatit requires“moreflexibility”tomeet“enormousfinancialchallengesthatthreatenthe veryviabilityoftheservices.”134Itarguesthat“theenvironmentinwhichethnic, conventionaltelevisionservicesareoperatingisfundamentallydifferentfromthe

95 Second,thefactssubmittedbyRogersdonotsupportitsfinancialnecessity argument.ThefiguresRogerssubmittedfor2011,2012and2013,however,show thattherevenuesgeneratedbyits‘lowestrevenuecontributinggroupsand languages’exceedtheircosts:

96 Third,Rogershasnotexplainedwhyitsaudiencesizeargumentshouldbetaken seriously:whileRogerssaysthattheCRTCshouldgrantitsproposedchanges becausemulticulturalaudiencesaresmall,theseaudienceswereevensmallerwhen RogersfirstboughtorappliedforthefiveOMNIlicences.Atthattime,however, Rogerswasabletocarrymoreprogramming,formoremulticulturalcommunities andinmorethirdlanguagesthanitnowproposestodo.Intheabsenceofarational argumentexplainingwhygrowthinpotentialaudiencesrequiresRogerstoreduce itsservicetothoseaudiences,theCRTCshoulddenyRogersproposedchanges.

97 Finally,Rogershasfailedtosupportitsargumentswithrelevantfacts.Itis particularlytellingthatthereportthatpurportedlysupportsRogers’sarguments– StrategicInc.,NewCanadians:AReviewofMediaUsage–isdatedDecember2013, eventhoughRogersbeganreducingservicetomulticulturalcommunitiesasearlyas 2012.Rogers,inotherwords,isusinginformationcollectedafterthefacttosupport programmingdecisionsitmadeforreasonsthathadnothingtodowithserviceto Canada’smulticulturalcommunities.

BroadcastingNoticeofConsultation201426 Intervention 28February2014 Page30of36 98 EveniftheStrategicInc.reportisonlyconsideredforitsrelevancetoRogers’current requestsregardingconditionsoflicence,itsresults–totheextentthattheyare representativeofCanada’smulticulturalpopulation–donotsupportRogers’ position.Forexample,Rogerspleadstohavenoconditionoflicenceregardinglocal programming–whiletheStrategicInc.reportfoundthat“NewCanadianshavea stronginterestinthirdlanguagenewsandinformationprogrammingonalocal, nationalandinternationallevel….”137Infact,82%ofthosesurveyed‘normally watch’localnewsonEnglishTV–indicatingahighdemandforthiscontent.138

99 Intheabsenceofrelevantfacts,,theCRTCshouldretainthecurrentconditionsof licence

4 RequireeachOMNIstationtobroadcastmoreoriginallocalnewsandinformation eachweek

100 ThecurrentOMNIdonothaveanyconditionsregardinglocalprogramming,orthe broadcastoforiginallocalprogramming.ThisiswhyRogerswasabletodrop25 newsandinformationprogramsfromtheOMNIschedulebetween2012and2013 andremainincompliancewithitsconditionsoflicence.139

101 RogerssaysthattheOMNIstationsareproducingandbroadcastinglocal programming.Itclaimsthatthisprogrammingis“atthecore”ofthestations’ contributiontothebroadcastingsystem.140Infact,however,localprogrammingon OMNI’smainstation,CFMTDTToronto,decreasedby54%between2001and2013: from2,410hoursin20002001,to1,111hoursin20122013(seeAppendices1and 2).

103 FRPCstronglyopposesRogers’request.

104 Firstandforemost,removinganyminimumlocalprogrammingrequirements permitsRogerstodropallnewsandinformationprogramsfromtheOMNIservices, denyingmulticulturalcommunitiesaccesstotheverycontenttheyneedto understandandparticipateinCanadiansociety–asotherprivatebroadcastersalso decreasedtheirlocalprogrammingupto2009intheabsenceofconditionsof licencetootherwiserestrainthem.TheCRTCshouldinsteadrequiretheOMNI stationstobroadcastminimumlevelsoflocalnewsandinformationeachweek,asit nowrequiresofotherconventionaltelevisionstations.

105 Second,theoutrageexpressedbyCanada’smulticulturalcommunitiesinresponse totheOMNIcutsin2012and2013expressestheirdesireformore,notfewer,hours ofnewsandinformation,andinparticularoriginalhoursofnewsandinformation.

106 ThisoutragestemsfromthefactthatRogershassignificantlyreducedthediversity andlevelofnewsonitsstations.AsshownbyTable3,inthe20122013broadcast yearOMNI1Torontobroadcastanaverageof13.2hours/weekofCategory010 newsprogramming,inItalianandPortuguese.Adecadeorsoearlier,inthe2000 2001broadcastyear,thestationwasbroadcastinganaverageof23.7hours/weekof news–andinatleastsixethniclanguages(Table9).

111 Finally,itisimportanttonotethatacceptingRogers’argumentsmayhavethe unfortunateeffectofencouragingallbroadcasterstocreatecorporateshellsfor theirbroadcastingassets–soastoarguethattheCRTCmustreduceoreliminate anyrequirementsthatreducethestandaloneshells’profitability.TheCRTCshould notbedistractedbytheshellgameofcorporatestructuresbecausetherealityis simplythis:ifRogersdidnotneeditsbroadcastprogrammingundertakings,itwould notretainthem.

112 ForthesereasonsFRPCrespectfullysubmitsthatconditionsoflicencemustbe addedtotheOMNIlicencestorequirethestationstoprovideaminimumnumberof originalhoursofnewsandinformation,foraspecifiednumberofethniclanguages, eachweek.

113 Adiscussionoftheamountoforiginallocalnewsandinformationshouldconsider thatRogerscurrentlyrepeatslocalnewscastsoneormoretimesduringthesame week.Originalcontentcantherefore,andshouldbeusedtoreplacethis programming.

114 WhiletheCRTChasproposedarequirementforRogerstomatchthe15hours/week oflocalprogrammingnowrequiredfromconventionalEnglishlanguageandFrench languagetelevisionbroadcasters,FRPCrespectfullysubmitsthatthislevelof programmingmaybeinadequatetomeettheneedsofthemulticultural communitieswhomRogershasbeenlicensedtoserve.Forthatreason,wesuggest thatRogersberequiredtoprovideatleast,andpreferablymorethan,15 hours/weekoforiginalnews,withoriginalnewsscheduleddaily(ie,weekdaysand weekends). 117 TheCRTC’scurrent3yearplanannouncesthattheCommissionmayholdapublic consultationonCanada’sethnicbroadcastingpolicyin2015/16.

118 TheupheavaltriggeredbyRogersactionsintheconventionalethnictelevision sector,andthefactthatitscancellationofnumerousnewsandinformation programsdidnotitslicences,demonstratethattheethnicbroadcastingpolicyhas seriousproblems.

119 Whileareviewoftheethnicbroadcastingpolicyin2015/16wouldbeimportant,the publicinterestisbetterservedbyreviewingtheefficacyoftheethnicbroadcasting policyinmeetingParliament’srequirementswithrespecttomulticulturalisminthe BroadcastingAct,aswellastheCanadianMulticulturalismActmorequickly–to ensurethatbroadcastersunderstandtheirresponsibilitiesgoingforward.

120 TheCRTCshouldadvancethetimetableforitsethnicbroadcastingpolicyreviewto 2014/15toservethepublicinterest,andtheinterestsofmulticulturalcommunities acrossCanada.

2 GranttwoyearlicencestotheOMNIstations

121 GrantingfiveyearlicencesfortheOMNIstationswouldbecontrarytothepublic interest,evenperverse,giventhewiderangingandextensivecutsRogershasmade tothestations’programming,withoutconsultingwith,anddespiteoppositionfrom, thecommunitiesaffected.

122 Longertermrenewalsshouldbereservedforlicenseesthatfullycomplywiththe BroadcastingAct,relatedlegislation,theCRTC’spolicies,itsregulations,andtheir licences.Licenseesthatexceedtheserequirementsshouldreceivethelongestterm possible,toprovidethemwiththestabilitytocontinuetoimplementParliament’s broadcastingpolicyforCanada–andtherebyservethepublicinterest.

123 LicenseeslikeRogers,thatreducecriticalprogrammingtomaximizeprofits,should receivesignificantlyshorterlicenceterms,toencourageimprovedperformance goingforward.

124 TheOMNIlicencesshouldberenewedfortwoyears.

3 SuspendtheOMNIAlbertastations’abilitytoselladvertisingtimefor6months

125 AllowingRogerstooperatetheOMNIAlbertastationswithoutrequiringthatthe stationsproduceandbroadcastoriginallocalprogrammingmakesamockeryofthe

126 AtemptingapproachtoRogers’flagrantdisregardforthecommitmentsitmadeto theCRTCandthepublicwhenitappliedfortheCJCODTandCJEODTlicenceswould betonotissuethelicences–toleavethemrevoked,asitwere.

127 Inthatcase,otherapplicantsmaydecidetoapplyfortheprivilegeofholdingoneor bothoftheselicences–andtheCommissioncouldinvitethepublic’sviewsonthose applications.

128 IftheCRTCdecidestoissueRogersethnictelevisionlicencesforCalgaryand Edmonton,however,ashorterthannormallicencetermwouldbeaninadequate remedyforRogers’decisiontoclosedownproductioninthoselocations,andto placeitscompetitorsatadisadvantagebycontinuingtocarrylocaladvertising.

129 FRPCrespectfullyrecommendsthattheCRTCissuethetwolicencestoRogers,but thatthecommercialcomponentofthelicencesshouldbesuspendedforsixmonths. Rogersmaythenchoosetoofferadvertisingtimefreeofchargetolocalmerchants, toattracttheircustom–oritmaydecidenottocarryadvertisingatall,toattract audiences.

130 Regardless,theCRTCshouldthenonlyconsiderterminatingthecommercial suspensionifRogershasreinstatedlocalprogramproductionfortheethnicstations inCalgaryandEdmonton,andismeetingitsotherconditionsoflicence.

4 DenyRogers’proposedconditionsoflicence

131 IftheCRTCgrantsRogerstheconditionoflicencethatithasproposed,alongwithits pleanotbeheldtoitsstatedbeliefinthecorevalueoflocalnewsthrougha conditionoflicence,theOMNIservicesthatemergefromthisproceedingwillbea mutilatedversionoftheservicesthatwereoriginallypromisedtoCanada’s multiculturalcommunitiesandtotheCRTC.

132 GrantingRogers’requestsdoesnotmeettherequirementsoftheBroadcastingAct, andbreaksthecommitmentsmadebyParliamenttomulticulturalcommunitiesin theCanadianMulticulturalismAct.

133 FRPCfirmlyopposesRogers’proposalsregardingtheconditionoflicenceforthe OMNIservices,astheyarecontrarytothepublicinterest.

134 TheabsenceofanyconditionsoflicencefororiginallocalnewsfromtheOMNI licences,andtheabsencefromtheethnicbroadcastingpolicyofanyrequirement fororiginallocalnewsorinformationprogramming,enabledRogerstomutilateits programmingschedulesacrossCanada.

135 Thepublicinterestisnotservedbyeliminationofnewsandinformation programmingfromanyconventionaltelevisionstation’sschedule,evenwhenthe station’scompetitorsprovidesuchcontent.

136 Similarly,thepublicinterestisnotservedbytheeliminationoforiginalnewsand informationprogrammingfromconventionaltelevisionstationswhoseaudiences cannotobtainnewsfrom,forandaboutCanada’smulticulturalcommunitiesfrom anyotherconventionaltelevisionstationsintheircommunities.

137 ThepublicinterestisbestmetbyrequiringtheOMNIstations,throughconditionsof licence,toprovideaminimumthresholdleveloforiginalhoursofnewsand information,foraspecifiednumberofethniclanguages,eachweek.
