The fact sheets for allocation changes are considered a supplement to the 2017 Kentucky RLMP. Land Use Allocation Changes After approval of a reservoir land management plan by TVA, all future uses of TVA-managed lands on that reservoir must then be consistent with the allocations within that RLMP. 3 In accordance TVA policies and guidelines, allocation changes after approval of an RLMP are only allowable under limited circumstances described below: (1) To correct administrative errors that occurred during the planning process (2) To implement TVA’s Shoreline Management Policy, consistent with the TVA Land Policy (3) To allow water-access for industrial or commercial recreation operations on private backlying property, consistent with the TVA Land Policy Kentucky Reservoir Land Management Plan Allocation Change – XGIR-4PT2 and XGIR-4aPT2 Reservoir Land Planning Allocation Change After approval of a reservoir land management plan (RLMP) by the Tennessee Valley Authority (TVA), future uses of TVA-managed lands on that reservoir must then be consistent with the land use allocations within that RLMP. Certain TVA reservoir land tracts have land management zone based on the backlying land use. These zone allocations have the potential to conflict with ingress and egress rights of the adjacent property owners if the backlying land use were to change. The resolution of these potential conflicts has resulted in the reallocation of the TVA-managed land to align with the ingress and egress rights of the adjacent property owners. This document addresses the reallocation of a portion of Kentucky Plan Tract No. XGIR-4PT2 (XGIR- 4aPT2) and is considered a supplement to the 2017 Kentucky RLMP. Definitions of TVA’s land planning allocation zones are available at https://www.tva.com/landplanzones. General Information about Kentucky Reservoir Kentucky Reservoir is an impoundment of the Tennessee River formed by Kentucky Dam, which is located at Tennessee River mile 22.4. Kentucky Reservoir is situated in Calloway, Livingston, Lyon and Trigg counties in western Kentucky, and in Benton, Carroll, Decatur, Hardin, Henderson, Henry, Houston, Humphreys, Perry, Stewart and Wayne counties in west Tennessee. Kentucky Reservoir has about 2,064 miles of shoreline and TVA owns approximately 1,354 miles of shoreline and 74,714.6 acres of reservoir shoreland. At full pool, the reservoir is approximately 184-miles-long with a reservoir surface area of 260,000 acres. Kentucky Parcel 4 (XGIR-4PT2) and Parcel 4a (XNR-4aPT2) XGIR-4PT2 (428.4 acres) is located in Livingston County along the left descending bank of Tennessee River mile 25.0 on Kentucky Reservoir. In the 2017 Kentucky RLMP, XGIR-4PT2 was allocated as Zone 5 (Industrial) for existing industrial sites and potential areas for industrial development. However, a portion of XGIR-4PT2 fronts a tract of private land, XGIR-16, which TVA sold subject to Section 31 of the TVA Act of 1933. In the deed, TVA granted the owners the right of ingress and egress rights to and from the waters of Kentucky Lake over and upon the adjoining land lying between the 375-foot contour elevation and the waters of the lake, and the deed does not contain any restrictions otherwise limiting those rights. In order to resolve the potential land use conflict with the allocation to “Industrial”, which does not allow for private water use facilities, a 15.8-acre portion of the 428.4-acre parcel has been modified as new Parcel 4a (XGIR-4aPT2) and the land use allocation has changed from “Industrial” to Zone 7 (Shoreline Access). New Parcel 4a has approximately 5,590 linear feet of shoreline and the “Shoreline Access” allocation reflects the deeded access rights of ingress and egress across TVA shoreline property of the backlying property owners. Requests for private water use facilities would be considered on Parcel 4a. The remainder of XGIR-4PT2 (412.6 acres) continues to be allocated as “Industrial.” 3/2021 Map Reference: Tract no. XGIR-73PT2, XGIR-74PT2, XGIR-75PT2 Reservoir Land Planning Errors After approval of a reservoir land management plan by the Tennessee Valley Authority (TVA), future uses of TVA-managed lands on that reservoir must then be consistent with the land use allocations within that land plan. Recent research shows that the current land planning zone allocation for small portions of Parcels 73 and 75 (XGIR-73PT2 and XGIR-75PT2) on Kentucky Reservoir were mistakenly included when the land plan maps were created and should have been included as part of adjacent Parcel 74 (XGIR-74PT2). The resolution of the mapping error has resulted in the reallocation of a 0.7-acre portion of Parcel 73 and a 0.2-acre portion of Parcel 75 to align with the land survey of an existing land use agreement for commercial recreation purposes on adjacent Parcel 74 allocated as Zone 6 (Developed Recreation). This document addresses the reallocation of the 0.9-acre portion of Parcels 73 and 75 from Zone 7 (Shoreline Access) to Zone 6 (Developed Recreation) and the addition of the 0.9-acre area to adjacent Parcel 74 and as is considered a supplement to the 2017 Kentucky Reservoir Land Management Plan. In the 2017 Kentucky Reservoir Land Management Plan, Parcels 73 and 75 are allocated for “Shoreline Access” and Parcel 74 is allocated for “Developed Recreation.” A 0.7-acre portion of Parcel 73 and a 0.2-acre portion of Parcel 75 are within an existing land use agreement footprint on the adjacent Parcel 74 (XGIR-74PT2) that is allocated for “Developed Recreation” to reflect the commercial recreation agreement for Mason’s Boat Dock. In order to correct the mapping error, Parcel 73 has been reduced by 0.7 acre and Parcel 75 has been reduced by 0.2 acre and the 0.9-acre area has been added to Parcel 74. The remaining acreages of Parcel 73 (68.94 acres) and Parcel 75 (94.73 acres) stay allocated as “Shoreline Access” and Parcel 74 acreage has changed from 11.15 acres to 12.05 acres. The acreage corrections reflect the land survey for the legal instrument in existence but overlooked when the subject parcels were mapped. 12/2018 Figure 1.
