Temporary The purpose of the Public Hearing is to hear Commercial Use representation in regards to the application for a Permit temporary commercial use permit to allow the College of New Caledonia to operate a Trades Training Program as 12504 Mill Roac.

Mayor Killam advised that the Public Hearing is convened pursuant to Section 92 1 of the Local Government Act to allow the public to make representations to Council respecting an application for a temporary commercial use permit to allow the College of New Caledonia to operate a Trades Training Program at 12504 Mill Road.

Every one of you present who believes that your interest in property is affected by the proposed application shall be given a reasonable opportunity to be heard or to present written submissions respecting matters contained in the proposed bylaw. To District of Mackenzie Mayor Stephanie Killam and Council:

We are writing on behalf of the Alpine Riders Horse Club of Mackenzie (Society Act # S- 2116) regarding the future of our club. We are asking for the District of Mackenzie's assistance in the form of funding to improve our ability to play a key role in the advancement of the community of Mackenzie.

The Alpine Riders provide an atmosphere of family, community and fun while promoting equine education. Over the years we have been found at various community events ranging from pony rides for the children at the Alexander Mackenzie Days Duck Drop to horseback security at the first annual Morfee Mountain Music Festival. We also host the annual summer horse camp put on by the District of Mackenzie which provides a unique educational opportunity for the children of Mackenzie. Our goal is to increase involvement and become a more integral part of the community.

There are currently sixteen paddocks at the Club and of these only one is available for rent and none available for purchase. History has shown that as barns become available they sell within a very short time and there is always a demand; we just do not have the paddocks created. With the increasing number of potential home-owners looking at Mackenzie as their future home we have noticed a dramatic increase in the number of visitors to the stables by individuals wanting to learn more about the facilities and what we have to offer. With adequate funding, we believe we could add to the allure of our area by providing one more amenity.

The club currently sits on just short of sixty-five acres between two leases (one BCR and one District of Mackenzie) providing ample land to achieve our dreams, but unfortunately we lack the resources to turn these dreams into reality.

The facilities as they are today are in need of some major improvements including road maintenance, a hydro upgrade and the installation of hydro to the five most recent paddocks added, as well as the clearing of trees and stumping of the existing pasture areas. In order to move forward and enable the club to assist in the growth of the club and therefore the community we are seeking assistance in clearing and prepping (levelling, fill, etc.) new paddocks; the development of a trail through to twenty two mile; a trail and improvements to the Elk's rodeo grounds; the creation of a guest parking

Page 15 of 98 Mackenzie Alpine Riders area and a larger clubhouse; and the development of a horse care center consisting of a covered cement pad with a stanchion for vet assistance as well as an area for the farrier.

Until recently we were in dire need of a new tank for our water system. We have since been able to secure an older air tank to be used as a pressure tank but must now install it and construct a building to house the system prior to winter.

We would also like to see the development of an indoor arena. The arena would not only provide an opportunity for year round equine events; but also a venue available for free or for rent (with the proceeds going to charity or a scholarship) to various community clubs and organizations.

Many other small communities host a variety of equine-related events such as; gymkhana's, poker rides, clinics, horse shows, fundraising events for various causes, and scholarships. These events bring in participants from across Northern and North- western British Columbia and even into Alberta, as well as drawing out interested members of the community. Unfortunately, our current situation and existing facilities do not allow us to provide this calibre of service and events.

Looking toward the future of our community and the focus being placed on the tourism sector The Alpine Riders believe we could play an integral part in increasing tourism in the area. The existing, planned, and potential trail systems could draw an entirely new group of tourists; horse owners seeking new lands to discover. BACKGROUND:

Employment to Date The District of Mackenzie currently has 45 people working under the Job Opportunities Program. Although hours under the program are not guaranteed, once an individual is hired through the program, the objective is to have them working for between twelve and fourteen weeks.

Projects to Date The electrification of the Elk's Grounds has been completed, as has brushing from Centennial to Morfee Lake and from the golf course to the Elk's Grounds. Crews are currently working on additional brushing projects, improvements to the Fish and Game Club grounds, improvements and expansion of the Community Gardens, and upgrading and connecting the bike trails around Morfee Lake.

At this point, close to $490,000 of the $2,000, 000 has been allocated to projects.

Project Selection Projects that provide employment for workers impacted by the downturn in the forest sector and that help improve public infrastructure in Mackenzie will be considered for approval. The Project Managers continue to work with community groups and the Ministry of Community Development to further develop project proposals. Once projects have draft work plans and budgets, they are provided to the Mackenzie Economic Development Select Advisory Committee (MEDSAC) and the Ministry of Community Development for comment. Once feedback on the projects has been received, that information, along with the project proposals, are submitted to Council for consideration.

Hiring Procedure An eligible displaced worker is any person who is a Mackenzie or surrounding area resident who is unemployed. Preference will be given based on the following criteria:

1. Applications submitted by forestry workers (as defined below) for whom Employrnent Insurance is expiring, expired, or who did not qualiff for Employrnent Insurance will be given priority.

Primary occupation was in the forest industry, for example, as an employee of a major licensee, contractor, sub contractor, or a processor, and is currently on Employrnent Insurance, or was an independent owner/operator who reported for work at a location in Mackenzie or the surrounding arca.

3. All other unemployed workers.

You do not qualify for this program if: 1. You are receiving ongoing severance payments. 2. You are working 15 or more guaranteed hours per week. 3. You resign from your current job to apply for employment through this program.

Applications are available at the District Offices, the Mackenzie Employment and Career Centre, the Public Library and on the District of Mackenzie web site (www.district.mackenzie.bc.ca). Applications can be dropped off at the District Office and the Mackenzie Employment and Career Centre.

After applications are sorted based on the information listed above, candidates are then contacted in the order that applications were received. If a job requires specific qualifications (i.e. journeyman trade), then individuals will be contacted based on qualifications and the date the application was received. Close to 250 applications have been received to date.

Use of Contractors Through the Job Opportunities Program, certain projects will require equipment rental.

To be considered, contractors in Mackenzie are encouraged to provide the following information to the District: an equipment list including make, model and hourly rate, a WCB number, and copies of any safety certificates or other certificates currently held by the business. Packages are to be dropped off at the District office.

Communication Regular updates and information pertaining to the Mackenzie Job Opportunities Program will be available at the District Offices, the Mackenzie Employment and Career Centre and on the District of Mackenzieweb site (www.district.mackenzie.bc.ca). Any questions regarding program implementation should be directed to Carla Seguin at the District office.

At the June23 and July 28,2008 regular meeting, Council received information regarding applications made to the Province by TransAlta Energy Corporation of Calgary, Alberta for investigative use permits for wind power investigation purposes in the vicinity of Williston Lake and Manson Arm. Council directed Administration to request that the Integrated Land Management Bureau includes the District in the consultation phase should the application progress from the investigative permit process to the Environmental Assessment stage.

TransAlta has made four further applications for Licenses of Occupation for wind power (meteorological towers) purposes covering approximately 25 hectares situated on Provincial Crown land in the vicinity NW of 15 Mile Swamp, west of Blackwater Arm, west of Parsnip Reach, Manson Arm and south of Eklund Bay NW of Mackenzie. Comments on the application will be received until September 4,2008.

The investigative permits define a boundary area and the License of Occupation application specifies a precise location or locations within that boundary for the monitoring equipment. A License of Occupation application may be submitted concurrently with the investigative permit.

RECOMMENDATION:

THAT the Integrated Land Management Bureau be requested to include the District of Mackenzie in the consultation phase should the investigative permits progress to the Environment Assessment phase.

BACKGROUND:

Administration has received a request for a Temporary Commercial Use Permit from Mr. Charanjiv Singh Parmar to allow for an instructional school at his business located at 5145 Old Airport Road. This location is zoned M2 - General lndustrial Zone.

Attached is a letter from Mr. Parmar in this regard.

It is recommended that a Public Hearing be held on September 29,2008 at 7:00 am and that Council consider'a resolution to grant the permit at the meeting following the public hearing.

A notice will be published in the local newspaper which will meet the requirement for publication at least three but not more than14 days before the adoption of a resolution. The requirement that notices be delivered at least 10 days prior to consideration to any tenants occupying parcels within a 100 metre perimeter of the subject property will also be effected.

RECOMMENDATION:

THAT, should Council wish to proceed with the request for a temporary commercial use permit in order to allow for the College of New Caledonia to operate a trades training program at 5145 Old Airport Road, establish the time and date of the public hearing for Monday, September 29,2008 at 7:00 pm; AND THAT Council consider a resolution to grant a temporary commercial permit for two years, with the option to renew for a further two year term, at their September 29, 2008 regular meeting.

SUBJECT: Request from Mackenzie Figure Skating Club for Earlier Ice Start-up

BACKGROUND:

Council and the Director of Leisure Services have received the attached letter from the Mackenzie Figure Skating Club requesting the District to reconsider the decision to delay start-up of the arena ice season until October 6th. The club is concemed that their skaters will be disadvantaged in preparation for a Northern BC Winter Games qualifying competition to be held in Quesnel October 24tt' - 26th.

Council will recall that the decision to delay putting in the ice was part of the Leisure Services Department's strategy for cost efficiencies. All ice users were advised of the later start-up at the conclusion of the 2007-08 ice season. The date provided to the groups was October 6tl' as the latest date the ice could be available based on a plant start- up of September 22nd. Council should also be aware that this year's ice season is in line with start dates prior to 1999 when ice seasons began to start earlier each year. The cost savings realized will be $11,300.00 in maintenance wages over the same period last year plus additional saving in energy costs by not operating the ice plant. This is achieved by not bringing in extra staff to complete the Pool Shutdown and concurrently make ice. As the Pool Shutdown has already commenced it would be very diffrcult at this iuncture to bump up the plant start up date.

For clarification regarding Mackenzie Figure Skating Club's concern about qualifying for the winter games; as the host Mackenzie athletes receive automatic berths. The number of berths is believed to be two per zone per event in this particular sport. The competition in Quesnel will qualify additional skaters to fill berths left vacant from other zones, as traditionally not all events are filled. In other words if Mackenzie automatically receives four berths as host zone and has eight eligible skaters and four berths are unfilled from other zones, the qualifying competition determines who gets the extra spots.

The Director of Leisure Services has contacted the president of the Figure Skating Club and has advised her that October 6tl'date is the latesl start date and thai every effort will be made to have the ice available for their use as early as September 30tl'or October l't.

RE: Commencement of Fuel Treatments Activíties

Please be advised that forest fuel treatment activities are scheduled to occur in the following areas at select times over the next three months. Access to these areas will not be permitted only while treatment activities are in progress and residents are asked to refrain from using these areas during these times.

The purpose of fuel treatments is to manage the fire hazard in forested areas adjacent to the community while maintaining the forested nature of these areas wherever possible. Specific treatments vary depending on stand and site conditions. Site-level treatment prescriptions have been developed for each treatment unit and are available at the District of Mackenzie office for anyone who would like additional information.

Mackenzie Unit: In and around the Woodlands Mobile Home Park; north to the hospital and south along the sewage lines.

Mackenzie Boulevard Unit: Three forested areas on the east side of Mackenzie Blvd.

Gantahaz Unit: Area to the south of private land in the Gantahaz subdivision.

BACKGROUND:

As Council will recall, NT Air terminated their sale of aviation fuel to the general public earlier this year.

A NOTAM (Notice to Airman) was subsequently published advising that there is no availability of fuel in Mackenzie. The Canada Flight Supplement from , which provides details on all airports and their facilities, is updated quarterly. The next set of updates was scheduled for August 28,2008.

Trench Aviation Fuels have offered to provide this service and, as it is important that the Flight Supplement indicates that Mackenzie continues to have a source of fuel for the flying public, commenced this service in mid-August.

This provided the NOTAM to be changed to indicate that this service is available in Mackenzie

RECOMMENDATION:

THAT Council approve the airport lease agreement with Trench Aviation Fuels.

UNDER THE LAND IRANSFER FORM ACT, PART 2 AND THE LOCAL GOVERNMENT ACT.

BETWEEN:

(hereinafter referred to as the "Landlord")

OF THE FIRST PART AND:

TRENCH AVIATION FUELS (a division of CORDWOOD INDUSTRIES) Box 2255 Mackenzie, BC VOJ 2C0

(hereinafter referred to as the "Tenant")

OF THE SECOND PART

WITNESSES that in consideration of the rents and agreements to be paid and performed by the Tenant,

1. PREMISES

The Landlord leases to the Tenant the premises more particularly described as 89 square meters of Lot C, Plan 23098, Cariboo District shown hashmarked within the outlined drawing attached as Appendix "A".

(hereinafter referred to as the "Premises")

2. TERM

The term of this Lease commences on the 1lh day of August 2008 and continues until the 31't day of December,2OlO.

3. USE

The Tenant shall use the Premises for the purposes of providing aviation fuel at the Mackenzie airport.

4. RENT

The Tenant shall pay to the Landlord:

(a) The base rent of SIXTY-FOUR DOLLARS AND THREE CENTS from August 11,2008 to December 31, 2008.

(b) The base rate of ONE HUNDRED SIXTY THREE DOLLARS AND FORTY-THREE CENTS($163.43) from January 1, 2009 to December 31, 2009 plus an increment equal to the Vancouver Consumer Price lndex. ln the event there is no increase in the Vancouver C.P.l.. the base rate will remain at $163.43.

(c) The base rate for the from January 1, 2010 to December 31, 2010 shall be the prior year's base rate plus the percentage increase, if any, in the Vancouver Consumer Price lndex. ln the event there is no increase in the Vancouver C.P.l., the base will remain the same as the prior year's base rate.

5. TENANT'S COVENANTS

The Tenant covenants with the Landlord:

Rent

(a) to pay rent;

Taxes

(b) to pay all taxes, rates, duties and assessments whatsoever, whether municipal, provincial or othenruise, charged upon the Tenant or the Landlord as a result of the Tenant's occupation of or use of the Premises;

Utilities

(c) to pay as they become due all water, sewer and garbage and other rates in respect of the Premises and charges for all gas, oil, telephone and electric power used on the Premises;

Construction

(d) that it will not construct nor alter any building or structure on the Premises unless, prior to any construction, it has obtained:

(i) the Landlord's approval in writing to the site plan, working drawings, plans, specifications and elevations, and

(ii) a building permit from the District of Mackenzie authorizing the constructions of the buildings and structures set out in the permit and the plans and specifications attached to it, and

(iii) all required inspections,

and all work shall be carried out at the cost of the Tenant:

Landlord's Right of Entry

(e) that the Landlord may enter the Premises and view the state of repair and the Tenant will repair according to notice;

Assign and Sublet

(f) that it will not assign nor sublet without leave of the Landlord;

(g) that the Landlord's consent to assignment or subletting shall not release or relieve the Tenant from its obligations to perform all the terms, covenants and conditions that this Lease requires the Tenant to perform, and the Tenant shall pay the Landlord's reasonable costs incurred in connection with the Tenant's request for consent;

Nuisance

(h) that it will not carry on nor allow to be carried on or done on the Premises anything that:

(i) may be or become a nuisance to the Landlord or the public,

(ii) increases the hazard of fire or liability of any kind, over and above activities which are usually carried out at an airport, or

(iii) invalidates any policy of insurance for the Premises;

Regulations

(i) that it will:

(i) comply promptly at its own expense with the legal requirements of all authorities, including an association of fire insurance underwriters or agents, and all notices issued under them that are served upon the Landlord or the Tenant, and

( ii) indemnify the Landlord from all claims, lawsuits, damages, losses, costs, or expenses that the Landlord may incur by reason of non- compliance by the Tenant with legal requirements or by reason of any defect in the Premises or any injury to any person or to any personal property contained on the Premises unless the claims, damages, losses, costs, expenses or injuries are the result of the negligence of the Landlord;

lnsurance

(j) that it will insure and keep insured, while this Lease remains in force, with such companies and in such force as are acceptable to the Landlord, at the Tenant's expense, the following insurance:

(i) during the term of this agreement the Tenant shall obtain, maintain and pay for the Comprehensive General Liability lnsurance on an occurrence basis, in a form acceptable to the Landlord and with insurance companies duly licensed to transact business in the Province of British Columbia;

(¡¡) such insurance shall be for not less than 92,000,000 inclusive limits of liability with respect to bodily injury, including death, and property damage per occurrence and shall include coverage for all Premises, operations and improvements of the Tenant;

Notwithstanding the foregoing, the Landlord may from time to time notify the Tenant that the amount of insurance required by the Tenant pursuant to clause j(ii) be changed and the Tenant shall within one year of receiving such notice cause the amount of insurance to be changed to the amount specified in such notice and deliver to the Landlord written confirmation of such changes.

(iii) that if both the Landlord and the Tenant have claims to be indemnified under any insurance taken out under this Lease, the indemnity shall be applied first to the settlement of the claim of the Landlord and the balance, if any, to the settlement of the claim of the Tenant:

(iv) that it will provide, within Thirty (30) days of the date of this Lease, either a certified copy of the policy or a certificate of insurance acceptable to the Landlord;

(v) that the policy shall include endorsements adding the Landlord as an additional named insured and providing that the insurer will advise the Landlord in advance of any cancellation or material change, and will do so by written notice sent by registered mail;

(vi) that the policy shall contain a cross-liability clause and breach of conditions clause protecting the named insured from acts of one named insured which may void or limit the protection afforded by the policy;

(vii) that in addition the Tenant shall, at its expense, insure and keep insured all lmprovements with a company licensed to do business in British Columbia against loss or damage by fire and other perils now and hereafter from time to time included in the commercial building form of insurance coverage applicable to similar property as the Premises and lmprovements and effected by prudent owners of property in the Province of British Columbia, and to the extent that insurance against such risks may be obtained, in an amount equal to the full replacement value of the property being insured.

lndemnification

(k) that it will indemnify the Landlord from and against all claims, lawsuits, damages, losses, costs, including legal costs, or expenses which the Landlord may incur by reason of the use of the Premises by the Tenant the carrying on upon the Premises or any activity in relation to the Tenant's use of the Premises and in respect of any loss, damage or injury sustained by any person while on the Premises for the purpose of doing business with the Tenant or othenruise dealing with the Tenant, where they are not covered by insurance or coverage has been denied by an insurer;

(t) that it will indemnify the Landlord from and against all claims for liens for wages or materials or for damage to persons or property caused during the making of or in connection with any excavation, construction, repairs, alterations, installations and additions which the Tenant may make or cause to be made on, in or to the Premises; and will allow the Landlord to post and will keep posted on the Premises any notice that he Landlord may desire to post under the provision of the Builders' Lien Act;

Possession

(m) that it will at the expiration or sooner determination of this Lease peaceably surrender and give up possession of the Premises without notice from the Landlord, any right to notice to quit or vacate being hereby expressly waived by the Tenant, any law, usage or custom to the contrary notwithstanding;

Maintenance and Repair

(n) that it will maintain and repair the Premises and all improvements, at all times to an excellent standard of maintenance and repair, subject to the satisfaction of the Landlord;

(o) that the Landlord will not be obliged to furnish any services or facilities or to make any repairs or alternations in or to the Premises or improvements situated thereon, the Tenant hereby assuming the full and sole responsibility for the condition, operation, repair, replacement, maintenance and management of the Premises and the lmprovements.

(p) that it will provide receptacles for refuse and rubbish of all kinds, as well as remove such refuse and rubbish from the Premises at regular intervals and will not keep or leave any boxes, pgcking material or rubbish of any kind in or near the Premises or any passages connected with the same;

(q) that it will keep clean and free from any rubbish, ice or snow, all walks, passages, yards and alleys on or adjacent to the Premises;

Signs

(r) that it shall not display any sign, picture, advertisement, notice, lettering or direction on any part of the Premises without prior written approval of the Landlord.

Environmental

(s) not to use or permit to be used, all or any part of the Premises for the sale, storage, manufacture, handling, disposal, use or any other dealing with any Contaminants without the prior written consent of the Landlord, which may be unreasonably withheld;

(t) to strictly comply, and cause any person for whom it is in law responsible to comply, with all Environmental Laws regarding the use and occupancy of the Premises:

(u) to promptly provide to the Landlord a copy of any environmental site investigation, assessment, audit, report, or test results relating to the Premises conducted by or for the Tenant at any time, upon the Landlord's written request. The Tenant shall, prior to undertaking any subsurface testing, obtain the Landlord's prior written approval of the proposed plan of investigation, which approval shall not be unreasonably withheld. Provided that the Landlord may at any time, upon reasonable notice to the Tenant, enter upon the Premises for the purpose of conducting an environmental audit or site investigation. Any environmental audit or site investigation conducted by the Landlord shall be at the Landlord's sole cost, unless it is demonstrated as a result that the Tenant has introduced or released Contaminants onto the Premises in which case these costs shall be payable by the Tenant.

(v) To maintain all environmental site investigations, assessments, audits, reports, and test results relating to the Premises in strict confidence (including without limitation any governmental authority) except as required by law, or to the Tenant's professional advisors and lenders on a need-to-know basis, or with the prior written consent of the Landlord, which consent may not be unreasonably withheld;

(w) To promptly notify the Landlord in writing of any release of a Contaminant or any other occurrence or condition at the Premises or any adjacent property which could contaminate the Premises or subject the Landlord or the Tenant to any fines, penalties, orders, investigations or proceedings under Environmental Law;

(x) On the expiry or earlier termination of the Lease, or at any time ¡f requested by the Landlord or required by any governmental authority under Environmental Laws, to remove from the Premises any Contaminants brought onto or released from the Premises by the Tenant or any person for whom it is in law responsible, and to remediate any contamination of the Premises resulting from any Contaminants brought onto or released onto the Premises by the Tenant. The Tenant shall perform these obligations promptly at its own cost and in accordance with Environmental Laws;

(v) To indemnify the Landlord and its councillors, officers and employees from any and all liabilities, actions, damages, claims, remediation cost recover claims, losses, costs, orders, fines, penalties and expenses whatsoever arising from or in connection with the release of any Contaminants onto the Premises during the Term of this Lease by the Tenant or any person from whom it is in law responsible;

(z) that despite anything in this Lease, the Tenant shall not be responsible for the remediation of any Contaminants existing on the Premises prior to the commencement of the Term, except that if the Tenant of its own volition elects to remediate the Premises in relation to any such Contaminants, it shall do so in the full compliance with all Environmental Laws.

(aa) The obligations of the Tenant under this section shall survive the expiry of earlier termination of this Lease.

(bb) For the purposes of this Lease:

"Contaminant" means any pollutants, contaminants, deleterious substances, underground or above-ground tanks, asbestos, asbestos- containing materials, hazardous, corrosive, or toxic substances, hazardous waste, waste, polychlorinated biphenyls ("PCBs"), PCB- containing equipment or materials, pesticides, defoliants, fungi, including mould, spores arising from fungi, or any other solid, liquid, gas, vapour, odour, heat, sound, vibration, radiation, or combination of any of them, which is now or hereafter prohibited, controlled, or regulated under Environmental Laws. "Environmental Law" means any statutes, laws, regulations, orders, bylaws, standards, guidelines, protocols, criteria, permits, codes of practice and other lawful requirements of any governmental authority having jurisdiction over the Land now or hereafter in force relating in any way to the environment, environmental assessment, health, occupational health and safety, protectin of any form of plant or animal life or transportation of dangerous goods, including the principles of common law and equity.

6. LANDLORD'S COVENANTS

The Landlord covenants with the Tenant for quiet enjoyment.

7. MISCELLANEOUS COVENANTS

It is hereby mutually agreed:

Re-entry

(a) that the Landlord may re-enter the Premises on non-payment of rent,

non-performance of covenants ;

Effect of Waiver

(b) that the Landlord by waiving or neglecting to enforce the right to forfeiture of this Lease or the right of re-entry upon breach of any covenant, condition or agreement in it does not waive its rights upon any subsequent breach of the same or any other covenant or condition of this Lease;

Holding Over

(c) that if the Tenant holds over following the Term and the Landlord accepts rent, this Lease becomes a tenancy from month to month subject to those conditions in this Lease applicable to a tenancy from month to month, however, this clause shall not preclude lease term renewal without holdover:

Landlord's Payments

(d) that if the Landlord incurs any damage, loss or expense or makes any payment for which the Tenant is liable under this Lease, then the Landlord may add the cost or amount of the damage, loss, expense, or payments to the rent and may recover it as if it were rent in arrears;

Time

(e) that time shall be of the essence of this Lease:

Distress

(f) that if the Landlord is entitled to levy distress against the goods and chattels of the Tenant, the Landlord may use enough force necessary for that purpose and for gaining admittance to the Premises and the Tenant releases the Landlord from liability for any loss or damage sustained by the Tenant as a result;

Damage or Destruction

(g) that whenever during the Term the lmprovements shall be destroyed or damaged by fire, lightning or tempest or any other casualty insured against pursuant to section s(j)(vii), then and in every such event:

(i) if the damage or destruction is such that the lmprovements are rendered wholly unfit for use or it is impossible or unsafe to use them and if in either event the damage, as agreed between the Landlord and Tenant (or, failing such agreement, in the opinion of a duly qualified consultant appointed by the Landlord to be given to the Tenant within fifteen (15) days of the happening of such

damage or destruction), cannot be repaired or replaced with reasonable diligence within two hundred forty (240) days from the happening of such damage or destruction or before the expiry of the Term, which ever is earlier (the "Repair Period"), then the Tenant may, within fifteen (15) days next succeeding such agreement (or giving of the opinion of the duly qualified consultant appointed by the Landlord aforesaid), terminate this Lease by giving notice in writing of such termination, in which event this Lease and the Term hereby demised shall cease and be at an end as of the date of such destruction or damage and the Rent and all other payments for which the Tenant is liable under the terms of this Lease shall be apportioned and paid in full to the date of notice of termination, provided that, for certainty, the Tenant shall remain responsible to remove such of the lmprovements following such damage or destruction as remain, upon the request of the Landlord, and to surrender the Premises in the condition required under section 7(k), and to remove and dispose of any and all debris, waste, or lmprovements incapable of repair within the Repair Period, resulting form the damage or destruction of the lmprovements, all to the Landlord's satisfaction;

(i) in the event that the Tenant does not so terminate this Lease as provided for under section 7(gXi), or in the event that the damage or destruction of the lmprovements can be repaired or replaced within the Repair Period, then the Tenant shall repair or replace the lmprovements with all reasonable speed but the Rent hereby reserved shall not abate or be reduced.

lnsolvency

(h) that if

(i) the Term or any of the goods or chattels on the Premises are at any time seized or taken in execution or attachment by any creditor of the Tenant or under bill of sale or chattel mortgage, or

( ii) if a writ of execution issues against the goods or chattels of the Tenant, or

(iii) if the Tenant makes any assignment for the benefit of creditors, or

(iv) if the Tenant becomes insolvent or bankrupt, or

(v) being an incorporated company or society if proceedings are begun to wind up the company or society, or

(vi) if the Premises or any part of them becomes vacant and unoccupied for a period of Thirty (30) days or is used by any other person or persons for any purpose other than permitted in this Lease without the written consent of the Landlord,

the Term shall, at the option of the Landlord, immediately become forfeited and the then current month's rent for the three months next following shall immediately become due and payable as liquidated damages to the Landlord, and the Landlord may re-enter an re-posses the Premises despite any other provision of this Lease;

Ownership of lmprovements

(i) the Landlord and the Tenant agree that the title to and ownership of the lmprovements and all alterations, additions, changes, substitutions, or improvements to them will at all times during the Term be vested in the Tenant, notwithstanding any rule or law as to the immediate vesting of the title to and ownership of the lmprovements in the Landlord as owner of the freehold. The title to and ownership of the lmprovements will not pass to or become vested in the Landlord until the expiration of the Term either by forfeiture, default, or lapse of time under the terms of this Lease, in which event the lmprovements will become the absolute property of the Landlord free of all encumbrances, but only in the circumstances described in section 7(k).

Termination

(i) this Lease may be terminated with the mutual consent of the Landlord and the Tenant;

(k) that, in case of alterations, additions or improvements are made to the leased Premises by the Tenant, such alterations, additions and improvements may be removed by the Tenant within one Hundred and Twenty (120) days following the termination or expiration of this Lease, provided that the Tenant, at its own expense, shall repair any damage to the leased Premises caused by such removal or by the original installation and if any such alterations, additions and the improvements shall remain on the leased Premises after the time periods provided herein, they shall remain on the leased Premises without compensation to the Tenant

therefore and they shall become the sole and exclusive property of the Landlord.

Notices

(l) that any notice required to be given under this Lease shall be deemed to be sufficiently given:

(i) if delivered at the time of delivery, and (i¡) if mailed from any government post office in the Province of British Columbia by prepaid, registered mail addressed as follows:

Net Lease

(m) that this Lease shall be a completely carefree net lease to the Landlord as applicable to the Premises and the Landlord shall not e responsible during the Term for any cost, charges, expenses, or outlays of any nature whatsoever in respect of the Premises or its contents except those mentioned in this Lease;

lnterpretation

(n) that when the singular or neuter are used in this Lease they include the plural or the feminine or the masculine or the body politic or corporate where the context or the parties require;

Binding Effect

(p) that this Lease shall ensure to the benefit of and be binding upon the parties hereto and their respective heirs, executors, successors, administrators and permitted assignees;

Law Applicable (q) that this Lease shall be construed in accordance with and governed by the laws applicable in the Province of British Columbia;

(r) that all provisions of this Lease are to be construed as covenants and agreements as though the words importing covenants and agreements were used in each separate paragraph.

Effective Date

(s) that this Lease shall take effect as of the 11th day of August, 2008 regardless of the dates of signing of this Lease.

BYLAW NO. I2O4

A bylaw to provide regulations for the control of Firecrackers, Fireworks, Explosives

WHEREAS Section 8(3) (d) of the Community Charter authorizes Council by bylaw to regulate the sale, possession and discharge of firecrackers and fireworks.

AND WHEREAS Council deems it expedient and desirable to provide such regulations with respect to the sale, possession, and discharge of firecrackers, and fireworks;

NOW THEREFORE the Council of the District of Mackenzie, in an open meeting assembled, HEREBY ENACTS as follows:

PART I .INTRODUCTION

1. TITLE

This Bylaw may be cited as "Fireworks ControlBylaw No. 1204,2008".

2. DEFINITIONS

Council means the municipal council of the District of Mackenzie;

Discharge means to light, ignite, fire, set off or explode;

Display Application means an application for a Display Permit on a form prescribed for the purpose by the Fire Chief;

Display Permit means a cunent and valid permit in the form prescribed for the purpose by the Fire Chief authorizing a person to discharge fireworks;

District means the District of Mackenzie, including its Gouncil, staff, officers, agents and employees;

Firecracker means a small firework with entwined fuses used solely as noise makers and not for pyrotechnic effect;

Fire Ghief means the Fire Chief of the District of Mackenzie Fire Department and/or their designate;

Fire Department means the District of Mackenzie Fire Department;

Fireworks includes, but is not limited to, low hazard fireworks (consumer fireworks), high hazard fireworks (display fireworks) and pyrotechnics, but does not include sparklers, Ghristmas crackers, caps for toy guns, model rocket engines as specified in Subdivision 3, Division 2, Class 7 of the Explosives Regulation (Canada), or highway flares or other small distress signals used exclusively for that purpose.

High Hazard Fireworks means those fireworks defined as such under the Regulations, and without limiting the generality of the foregoing, includes rockets, serpents, shells, bombshells, tourbillions, maroons, laçe wheels, bouquets, banages, bombardons, waterfalls, large fountains, batteries, illuminations, set pieces, pigeons, and firecrackers.

Fircworl(s Bylaw No. 12ü High Hazard Fireworks and Pyrotechnics Permit means a cunent and valid permit in the form prescribed for the purpose by the Fire Chief authorizing a person to discharge high hazard fireworks and pyrotechnics.

Low Hazard Fireworks means those fireworks defined as such under the Regulations and without limiting the generality of the foregoing, includes fireworks showers, fountains, golden rain, lawn lights, pin wheels, roman candles and volcanoes.

Mlnor means any person whose age is less than nineteen (19) years.

Owner means a penion:

a. To whom a permit for fireworks has been issued under this bylaw;

b. Who owns, is in possession of or has the care or control of fireworks;

c. Who is the custodial parent or legal guardian of a child under the age of nineteen (19) years who owns, is in possession of, or has the control of fireworks.

Peace Officer means a police officer or a police constable or other person employed for the preservation and maintenance of public peace and includes members of the Royal Canadian Mounted Police (R.C.M.P.), Bylaw Enforcement Officers, Fire Chief and the Local Assistant to the Fire Gommissioner (LAFC).

Pyrotechnics means the use of materials capable of undergoing self- contained and self-sustained exothermic chemical reactions for the production of heat, light, gas, smoke and/or sound, and without limitation includes the use of such materials for special effects in connection with a movie or television production or any other form of show, entertainment or theatrical event.

Regulations mean the Explosive Act (Canada) and Explosives Regulation (Canada), as amended from time to time.

Sales Application means an application for the sale permit in the form prescribed for the purpose by the Fire Chief.

Sales Permit means a cunent and valid permit in the form prescribed for the purpose by the Fire Chief authorizing a person to sell, offer for sale or otherwise dispose of fireworks to a person nineteen (19) years of age or older.

PART 2 - POSSESSION OF FIREWORKS

3. FIRECRACKERS

It shall be unlawful for any person to possess, use, discharge any firecracker.

4. FIREWORKS

a. lt shall be unlawful for any person under the age of nineteen (19) years to possess or discharge any fireworks or explosive device unless othenrise permitted by this bylaw.

b. No person shall possess or discharge fireworks except under the terms and conditions of a valid display permit obtained from the Fire Chief. FfreworlG Bylaw No. 1204 c. lt shall be unlawful for any person to have in their possession any fireworks imported or manufactured illegally, or not authorized by the Explosive Regulatory Division of Natural Resources Canada.

5. MANUFACTURE, STORAGE AND TRANSPORTATION

a. The manufacture, storage and transportation of all fireworks and explosivès devices shall conform to the Regulations.

b. The Fire Chief or LAFC must be notified in writing at least five (5) business days in advance of fireworks or explosive devices being stored on a property and shall have access to inspect the storage area at all reasonable times in order to ascertain whether the provisions of the Regulations or this bylaw are being complied with.

c. lt shall be unlawful for any person to store or transport fireworks or explosive devices in contravention of their Sales Permit or Display Permit.

d. Upon theft of fireworks or explosives the owner of the fireworks or explosives is to make immediate notification of the theft to the R.C.M.P., District of Mackenzie and the Fire Chief, or LAFC. Notification is to inctude: Dateffime/Location/Types/Quantities of fireworks or explosíves missing.

PART 3 - SALES 6. RESTRICTION

a. Applicants for a permit to sell fireworks must be nineteen (19) years of age or older.

b. A Sales Permit will not be issued to any person who during the past two years has had a Sales Permit cancelled or rescinded.

c. lt shall be unlawful for any person to directly or indirectly sell, give or fumish to a person any firecracker whether for their own use or not.

d. lt shall be unlawful for any person directly or indirectly to sell, give or fumish to a minor any fireworks, whether for their own use or not.

e. lt shall be unlawful for any person to offer for sale, expose for sale, advertise or display or sell at wholesale or retail, any firework to any person or organization except between :

i. the twenty-fifth (25h) day of June and the first (1s) day of Juty in each year;

ii. the twenty-fourth (24h) day of October and the thirty-first (3lst) day of October of each year; and

iii. the twenty-seventh (27h) day of December and the thirty-fißt (31st) day of December of each year.

PART 4 - DISCHARGE OF FIRE WORKS

8. RESTRICTED AREAS FOR FIREWORKS

Except as provided in a permit, no person shall discharge any fireworks on a highway, street, park, playground, school ground or any other public place within the District without the express written consent of the owner of the property.

9. LIGHTING OF FIREWORKS

Excppt as provided in a display permit, no person shall discharge any fireworks within the Municipality at any time except on:

a. the first (l') day July in each year;

b. the thirty-first (31st) day of October in each year;

c. the thirty-first (31$) day of December in each year;

d. the observance or celebration of a special event or festival with a display permit issued by the Fire Chief.

10. LIGHTING OF HIGH HAZARD FIREWORKS

No person shall discharge High Hazard Fireworks or Pyrotechnics unless that person is a licensed holder of a certificate in compliance with the Explosives Regulatory Division of Natural Resources Canada, and holds a High Haza¡d Fireworks and Pyrotechnics Permit from the Fire Chief authorizing the activity.

PART 5. PERMITS

11. DISPLAY PERMITS

The Fire Chief or an Officer designated by him may issue a display permit to light or explode fireworks, for the purpose of the observance or celebration of a special event or festival, to:

a. a person who is of the age of nineteen (19) years or older, or

b. an organization represented by a person who is over the age of nineteen (19) years.

12. APPLICATION

Every application for a display permit shall be in writing on a form prescribed for the purpose by the Fire Chief, and addressed to the Fire Chief District of Mackenzie.

13. HIGH HAZARD FIREWORKS AND PYROTECHNICS PERMITS

The Fire Chief may issue a permit to light or explode High Hazard Fireworks or Pyrotechnics to a person over the age of nineteen (19) years who has a valid certification as required by the Explosives Regulatory Division of Natural

a. submits a copy of the Explosives Regulatory Division event approval;

b. submits a Fire Safety Plan in a form acceptable to the Fire Chief;

c. submits an event and site plan detailing how the High Hazard Fireworks or pyrotechnics will be used and all appropriate safety measures for the event and all persons in attendance;

d. submits proof of a general liability insurance policy not less than $2 million with an endorsement for high hazard fireworks and pyrotechnics and such policy shall include the District as additionally named insured.

submits proof acceptable to the Fire Chief, that the applicant holds either a valid Fireworks Supervisor Level 1 card, or for unconventional sites as defined by the Explosive Regulatory Division, a valid Fireworks Supervisors Level 2 card, issued by the Explosives Regulatory Division of Natural Resources of Canada.

14. PERMIT REQUIREMENTS

Every permit issued must:

a. specify the High Haza¡d Fireworks or Pyrotechnics that the permit holder is authorized to light or explode; and

b. specify the day and the hours on which, and the description of the property or place where the Fireworks or Pyrotechnics may be dischaçed and used.

15. APPLICATION REQUIREMENTS

Every holder of a permit must:

a. present the permit to the seller of Fireworks or Pyrotechnics:

b. light or explode only those Fireworks or Pyrotechnics specified in the permit;

c. light or explode the Fireworks or Pyrotechnics only in accordance with the terms of the permit;

d. light or explode the Fireworks or Pyrotechnics only in accordance with the BC Fire Code Fire Safety Plan;

e. ensure that the Fireworks or Pyrotechnics are only lit or exploded under their direct supervision and responsibility; and

f. ensure that the use, handling, discharge, sale, possession and storage of the Fireworks or Pyrotechnics shall conform in every respect to the Regulations, the fire works manual as published by the Explosives Regulatory Division of Natural Resources Canada, and this Bylaw.

SALE OF H¡GH HAZARD FIREWORKS

The sale of any High Hazard Fireworks shall only be to persons holding a valid permit issued under the Department of Natural Resources Explosive Regulatory Division. Page 65 of 98 THAT Bylaw No.1204 cited as "Fireworks Control Bylaw No.1204... Fr€rvorlG Bylaw No. 12fi 17. CONTRAVENTION OF BYLAW

Every Person who contravenes or violates any provision of this Bylaw commits an offence.

I8. CONTROL OF BURNING SITE

A person who fails to control or secure a site on which Fireworks or Pyrotechnics are discharged commits an offence.

19. PENALTIES

Any percon who commits an offence pursuant to this bylaw is liable on summary conviction to a fine of not more than $10,000.00 and six month's imprisonment, and not less than $500.00.

20. SEVERABILITY

lf any part, sub-section or phrase of this Bylaw is held to be invalid by a court of competent jurisdiction, the invalid portion shall be severed and the remainder of the Bylaw will be deemed to have enacted without the invalid portion.

BYLAW NO. 1223

A Bylaw to Provide for Fire Protection Services in the District of Mackenzie.

The Council of the District of Mackenzie, in open meeting assembled, enacts as follows:

Title

1. This Bylaw maybe cited as the "Fire Protection Services Bylaw No. 1223, 2008". Interpretation

2. In this Bylaw:

(a) "Assistance Response" means:

(Ð first response to medical emergencies;

(iÐ first response to accidents, natural or man-made disasters, escapes of hazardous materials or other circumstances that have caused or mav cause harm to persons or property;

(iiÐ roscue operations.

o) "District" means District of Mackenzie;

(c) "Equipment" means any vehicles, tools, devises or materials used by the Fire Department;

(d) "Fire Chief' means the person appointed by Council as head of the Fire Department or any other person authorized to act on behalf of the Fire Chief;

(e) "Fire Department" means the fire department of the District of Mackenzie, including all officers, employees and volunteers engaged in the fire department;

(Ð "Fire Protection" means all aspects of fire safety, including but not limited to fire prevention, fire fighting or suppression, pre-fire planning, fire investigation, training, staff development and advising on fire safetymatters;

(e) "lncident" means a sifuation which requires the services of the Fire Department;

(h) "Member" means any person appointed by the Fire Chief as a member of the Fire Department;

C) "Officer" means a Member appointed by the Fire Chief and given specific authority to assist the Fire Chief in his or her duties;

(k) "Open Air Fire" means the burning or combustion of any material or substance in the open air outdoors;

0) "Public Services" means public information, education and prevention programs, as they relate to fire safety, public safet5 and emergency preparedness; a J. All other words and phrases shall be construed in accordance with the meaning assigned to them by the British Columbia Building Code, the Fire Services Act or the British Columbia Fíre Code as amended or replaced from time to time. In the event of a conflict between this Bylaw and the Fire Services Act and any regulations thereunder, the provisions of the Act and its regulations shall prevail.

Adoption of Fire Code

4. The substantive regulations (but not the procedural or remedial provisions) of the British Columbia Fire Code are hereby adopted and made part of this Bylaw such that every provision of the British Columbia Fire Code shall be considered a provision of this Bylaw.

Establishment

5. The Fire Department is hereby established and is to be known as the "Mackenzie Fire Rescue Department".

6. The Fire Chief is authorized to administer this Bylaw.

7. The Fire Chief may appoint and dismiss Members.

8. The Fire chief may appoint officers to act as Fire chief on his or her behalf.

Scope of Fire Department

9. The Fire Department is empowered to provide the following services:

(a) Fire Protection;

(b) Assistance Response;

(c) Mutual Aid; and

(d) Public Services.

Powers of Fire Chief

10. The Fire Chief is authorized to exercise the following powers:

(a) Enter on property and inspect premises for conditions that may cause a fire, increase the danger of a fire or increase the danger to persons or property from a fire;

(b) Take measures to prevent and suppress fires, including the demolition of buildings and other structures to prevent the spreading of fire;

(c) Require an owner or occupier of real property to undertake any actions directed by the Fire Chief for the purpose of removing or reducing any thing or condition that person considers is a fire hazard or increases the danger of fire;

(d) Exercise all of the powers of the fire commissioner under section 25 of the Fire Services Act, and for these purposes that section applies.

11. The Fire Chief or the Member in charge at an Incident may establish boundaries or limits and keep persons from entering the area within the prescribed boundaries or limits unless authorized to enter by the Fire Chief or the Member in charge.

Territorial Jurisdiction

12. The limits of the jurisdiction of the Fire Department extend to the boundaries of the District of Mackenzie and no part of the Fire Department Equipment and Members shall be used outside the District without:

(a) the express authorization of a written agreement providing for the supply of Fire Department Equipment and Members outside the District's boundaries;

(b) the approval of Council; or

(c) a request for assistance in accordance with the Emergency Program Act. fnspections

13. The Fire Chief and Members of the Fire Department may enter on any property at any reasonable time for the purpose of ascertaining whether the regulations and requirements of this Bylaw are being observed.

14. The Fire Department shall conduct, or cause to be conducted, inspections of the classes of premises listed in Schedule"A" to this Bylaw at least as frequently as set out in Schedule "4" to this Bvlaw.

General Fire Regulations

15. No person shall obstruct or interfere with the Fire Chief or a Member of the Fire Department in the performance of his or her duties under this Bylaw.

16. No person shall damage or destroy, or obstruct, impede or hinder the operation of, any Equipment of the Fire Department.

17. No person shall drive a vehicle over any Equipment of the Fire Department without the permission of the Fire Chief or a Member of the Fire Department.

18. No person shall falsely represent themselves as a Member of the Fire Department.

19. No person shall obstruct or otherwise interfere with access roads or streets or other approaches to any Incident, fire hydrant, cistern or body of water designated for fire fighting purposes.

20. No person shall tamper, obstruct or interfere with an emergency exit, fire extinguisher, fire alarm, sprinkler, standpipe or other fire safeguard installed in a building.

21. No person shall wilfully make or cause to be made a false request for the Fire Deparhnent to respond to an Incident.

22. No person shall enter the boundaries or limits of an area prescribed in accordance with section 11 unless that person has been authorized to enter by the Fire Chief or the Member in charge at the Incident.

23. Every owner or occupant of a building shall provide all information and shall render all assistance required by the Fire Chief or a Member of the Fire Department in connection with the inspection of the building.

Removal of Fire Hzzaril

24. Every owner and occupier of property shall remove or reduce or caused to be removed or reduced any thing or condition directed by the Fire Chief to be removed or reduced under section l0(c) of this Bylaw, during the time stipulated in that order.

25. In the event the owner or occupier of property fails to comply with section 24 of this Bylaw, and the owner or occupier of such property has been given an opportunity to make representations to the Fire Chief in respect of that order, the District may by its own offtcers and employees or other persons, c¿ury out the work necessary to comply with section 24 of this Bylaw at the expense of the owner or occupier, and the District may recover the costs of undertaking such work either as a debt against the person in default or, if the work is in relation to land or improvements on the owner or occupier's property, in the s¿rme manner and with the same remedies as property taxes.

Open Air Fires

26. Open Air Fire Category Tlpes are categorized as follows:

(a) Recreational Type - Backyard Burn Pit/Campfire

(b) Category #1 Open Fire - Means an open fire that burns piled material not larger than I metre (3.2 feet) in diameter.

(c) Category #2 OpenFire - means an open fire that bums:

(Ð material in one (1) pile not exceeding 2 metres (6.5 feet) in height and 3 metres (10 feet) in width

(iÐ material concurently in two (2) piles each not exceeding 2 metres (6.5 feet) in height and 3 metres (10 feet) in width; or

(iiÐ stubble or grass over an area that does not exceed 0.2 hectares (21,000 square feet).

(d) Category #3 Open Fire - means an open fire that burns

(Ð material concurrently in three (3) or more piles each not exceeding 2 metres (6.5 feet) in height and 3 metres (10 feet) in width;

(iÐ material in one (1) or more piles each exceeding 2 metres (6.5 feet) in height and 3 metres (10 feet) in width.

(iiÐ one (1) or more windrows; or

(iv) stubble or grass over an area exceeding}.2 hectares (21,000 square feet).

27. No person shall ignite, start or maintain, or allow or cause to be lighted, ignited, started or maintained, an Open Air Fire, except under the terms and conditions of a valid burning permit obtained from the District Office as set out in Schedule "B" of this bvlaw.

28. Section 27 does not apply to:

(a) outdoor cooking fires, provided the fire is contained in a device or fixture designed for such purpose and the fire is only burning clean dry wood or charcoal;

O) outdoor fires in pits approved by the Fire Chief for use in designated campgrounds or tourist parks; and

(c) fires lit for Fire Department training exercises.

29. A person seeking a buming permit to ignite, start or maintain an Open Air Fire shall provide to the District a completed application in the form attached as Schedule "8" to this Bylaw and the application fee as set out in Schedule "C" to this Bylaw.

30. The Fire chief may issue a buming permit to a person for the purpose of:

(a) residential open air buming of yard waste in the nature of clippings, leaves, tree and shrub prunings during a specified time each spring and fall as determined by the Fire Chief;

(b) open air burning of land clearing debris or

(c) an Open Air Fire during a special ceremony or event.

31. The District, in issuing a burning permit, may impose terms and conditions relating to fire safety concerning the following:

(a) the location of a fire;

(b) the dates and times a fire maybe lit or maintained;

(c) the maximum area occupied by a fire;

(d) the materials to be burned in a fire; and

(e) precautions to be taken in connection with the fire.

32. The District may refuse to issue a burning permit where the issuance of a buming permit will result in a safety hazañ, to the public.

33. No person shall burn the following materials:

(a) prohibited materials set out in the Open Burning Smoke Control Regulation under the Environmental Management Act;

(b) household garbage;

(c) animal carcasses; or

(d) any other material which may produce smoke that is liable to foul or contaminate the atmosphere or an offensive odour that is liable to disturb the enjoyn'rent, comfort or convenience of individuals or the public.

34. No person shall ignite or allow an Open Air Fire to bum in wind conditions exceeding l0 km/hour.

No person shall ignite or allow an Open Air Fire to burn unless a person over the age of 18 is in charge of the fire at all times and that person has sufficient equipment to prevent the fire from getting out of control or causing damage or becoming dangerous to life and property.

36. At any time the Fire Chief may cancel or suspend a burning permit issued pursuant to this Bylaw:

(a) if the Fire Chief considers that igniting a fire in any area may create ahazard to persons or property; or

(b) if the permit holder fails to comply with the provisions of this Bylaw.

Jt. Every person who ignites, or permits any Open Air Fire to be ignited, is responsible for that fire and is liable for all expenses incurred by the District to extinguish the fire. The cost of extinguishment shall be the cost to the District for supplying Equipment and Members of the Fire Departrnent as set out in Schedule "D".

Fees

38. The owner or occupier of a building shall pay the fee set out in Schedule "C" for the following services of the Fire Department:

(a) inspection of the building, including re-inspection, that is not the routine inspection under section 14 of this Bylaw; and

(b) installation of an oil bumer.

39. If the Fire Department responds to more than two false alarms in a building in any calendar year, the owner or occupier of that building shall pay the fee set out in Schedule "C" for each subsequent response by the Fire Department to a false alarm in the building.

File Search Fees

40. Every person seeking documentation or file searches on occupancies for outstanding British Columbia Fire Code violations or infractions, copies of permits, or other related information shall, prior to receiving the documents or information, pay the fee specified in Schedule"C".

Offence and Penalties

41. Any person who contravenes this Bylaw is liable upon sunmary conviction to a minimum fine of $1000 and a maximum fine of $10,000 and the cost of prosecution. Every day during which there is an infraction of this bylaw shall constitute a separate offence.

43. Bylaw Enforcement Officers, Local Assistants and Fire Inspectors are designated to enforce this Bylaw pursuant to s. 264(1)(b) of the Cornmunity Charter.

44. The words or expressions set forth in Column I of Schedule "E" of this Bylaw are authorized pursuant to s.264(lXc) of the Community Charter to designate the offence committed under the bylaw section number appearing in Column 2 opposite the respective words or expressions.

45. The amounts appearing in Column 3 of Schedule "E" of this Bylaw are the fines established by Council pursuant to s. 265(1)(a) of the Community Charter for the corresponding offence designated in Column 1.

Severability

46. If any portion of this Bylaw is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining portions of this bylaw.

Repeal of Existing Bvlaws

47. Bylaw No. 1081 cited as "District of Mackenzie Fire Department Bylaw No. 1081, 2001" and Bylaw No. 1188 cited as "Open Burning Control Bylaw No. 1188, 2006" are hereby repealed and replaced with this Bylaw.

District of Mackenzie Fire Department - Reimbursement Rates

1. Cost recovery for reimbursement of the District of Mackenzie Fire Department authorized to respond during emergencies that are not reimbursed from Provincial Emergency Program, Ministry of Forests and Range or Office of the Fire Commissioner are set out in this schedule.

2. The charges shall coÍrmence at the time the vehicles are requested and continue until return to Mackenzie's Fire Hall and back in service. A bylaw to authorize the use of the Municipal Ticket lnformation System

WHEREAS pursuant to section 264 of the Community Chañer,the Council of the District of Mackenzie may, by bylaw,

(a) designate a bylaw that falls outside a category of bylaws prescribed by regulation under section 273(b) of lhe Community Chafter,

(b) designate as a bylaw enforcement officer a person who comes within a - class of persons prescribed by regulation under section 273(c) of the Community Charter,

(c) authorize the use of any word or expression on a ticket issued under subsection 264(2) of the Community Chañer to designate an offence against a bylaw, and

(d) for the purpose of section 265(1)(a) of lhe Community Chañer, set a fine not greater than the amount prescribed by regulation.

NOW THEREFORE, the Council of thè District of Mackenzie, in open meeting assembled, enacts as follows:

1. This bylaw shall be cited as "Municipal Ticket lnformation Bylaw No. 1224, 2009".

2. The bylaws listed in Column 1 of Schedule I to this Bylaw may be enforced by means of a ticket in the form prescribed for the purpose of Section 264 of the Community Charter.

3. The persons who act in the job position or titles listed in Column 2 of Schedule I to this bylaw are designated as bylaw enforcement officers pursuant to Section 264(1Xb) of lhe Community Chañer fpr the purpose of enforcing the bylaws listed in Column 1 of Schedule 1 opposite the respective job positions.

4. Pursuant to Section 26a(1)(c) of the Community Charter, the words or expressions set forth in Column 1 of Schedules 2 through 9 to this Bylaw designate the offence committed under the bylaw section numbers appearing in Column 2 of Schedules 2 through 9 opposite the respective words or expressions.

5. Bvlaw No. 1226

A bylaw of the District of Mackenzie to grant permissive exemption from taxation.

WHEREAS an authority is granted in Section 224 (2) (i) of the Community Charter of British Columbia to exempt from taxation the whole or a part of land and improvements owned or held by an athletic or service club or association and used principally as a public park or recreation ground or for public athletic or recreational purposes;

AND WHEREAS the Council of the District of Mackenzie deems it fair and desirous to extend an exemption from taxation to the herein described property for making the land and the improvements thereon available for recreational purposes to the citizens of Mackenzie:

NOW THEREFORE BE lT RESOLVED the Council of the District of Mackenzie in open meeting assembled HEREBY ENACTS as follows:
