Presented below are water quality standards that are in effect for Clean Water Act purposes. EPA is posting these standards as a convenience to users and has made a reasonable effort to assure their accuracy. Additionally, EPA has made a reasonable effort to identify parts of the standards that are not approved, disapproved, or are otherwise not in effect for Clean Water Act purposes. Cover Page Updated November 7, 2016 2016 Oklahoma Water Quality Standards Oklahoma’s Water Quality Standards (WQS) are found in the Oklahoma Administrative Code, Title 785, Chapter 45 (OAC 785:45). Note that EPA has not approved the Oklahoma WQS for those waters or portions of waters located in Indian Country, as defined in 18 U.S.C. § 1151. Areas with Waters of Recreational and/or Ecological Significance EPA has partially approved the following sections: EPA has approved the following sections, with the exception of those provisions identified under the “disapproved,”“no action,” or “under review” headings below. Statistical Values of the Historical Data for Mineral Constituents of Water Quality Appendix G. Numerical Criteria to Protect Beneficial Uses Page 1 EPA has disapproved the following provisions: Under 40 CFR §131.21(c), new and revised standards do not go into effect for CWA purposes until approved by EPA; therefore, these disapproved provisions are not effective for CWA purposes. Appendix E. Section F. Site-specific aquatic life criteria for cadmium, silver, and lead for the City of Poteau’s discharge to the Poteau River. o The currently approved statewide aquatic life criteria for cadmium, silver, and lead remain effective for CWA purposes. §5-13(h). Criteria to protect Livestock Agriculture subcategory. o Since no water bodies in Oklahoma have been designated with the Livestock Agriculture subcategory use, the Irrigation Agriculture subcategory use applies by default to those waters designated as having the Agriculture use. Therefore, the currently approved chloride, sulfate, and total dissolved solids criteria associated with the Irrigation Agriculture subcategory use remain effective for CWA purposes. EPA has taken “no action” on the following WQS provisions because the submittal of these provisions did not meet the minimum requirements described at 40 CFR §131.6: Under 40 CFR §131.21(c), new and revised standards do not go into effect for CWA purposes until approved by EPA; therefore, these provisions are not effective for CWA purposes. §5-12(f)(1)(B)(iv). Dissolved Oxygen. (Site-specific regulatory low flow provision.) o EPA has taken no action on this provision. Appendix F. Statistical Values of the Historical Data for Mineral Constituents of Water Quality. o EPA has taken no action on the yearly mean and sample standards for chloride, sulfate, and total dissolved solids for the eight-digit sub-watershed segments (i.e., those segments where footnote “(4)” applies). Appendix G. Table 2. Numerical Criteria to Protect Beneficial Uses and All Subcategories Thereof. o EPA has taken no action on the “fish consumption and water” human health criterion of 9 µg/L for perchlorate. EPA has taken “no action” on the following provisions because they are not considered WQS under CWA §303(c): The status of these provisions would be determined under the applicable requirements of the other CWA programs the provisions are intended to implement. §5-12(f)(1)(D)(viii). Dissolved Oxygen. Additional application/exercise when support undetermined. §5-25(c)(4)(B). Implementation Policies for the Antidegradation Policy Statement. Sensitive Public and Private Water Supplies (SWS). o EPA has taken no action on the following language: “New point source discharges of any pollutant after June 11, 1989, and increased load of any specified pollutant from any point source discharge existing as of June 11, 1989, shall be prohibited in any waterbody or watershed designated in Appendix A of this Chapter with the limitation "SWS". Any discharge of any pollutant to a waterbody designated "SWS" which would, if it occurred, lower existing water quality shall be prohibited,” §5-25(d). Page 2 EPA has taken “no action” on the following groundwater provisions: Under CWA §303(c), EPA does not have the authority to approve or disapprove groundwater provisions that are unrelated to surface water. §1-2. Note that Oklahoma’s WQS use the term “PQL” solely for regulating groundwater, so EPA does not consider this term to be applicable to the WQS program as it relates to surface waters, including wetlands. §7.
