AN ACT TO DE-APPROPRIATE FORTY THOUSAND DOLLARS ($40,000.00) FROM THE SUMS APPROPRIATED TO I LIHESLATURAN GUAHAN FOR FISCAL YEAR 2006 AND TO REAPPROPRIATE SAID SUM TO THE UNIVERSITY OF GUAM FOR THE SOLE PURPOSE OF PURCHASING SUPPLIES AND EQUIPMENT FOR THE NURSING PROGRAM.

1 BE IT ENACTED BY THE PEOPLE OF GUAM: 2 Section 1. Legislative Findings and Intent. I Liheslaturan Guhhan finds 3 that nursing students at the University of Guam (UOG) should have the best 4 learning environment possible. These students must be prepared for direct client It is the intent of the I Liheslaturan Guhhan to deappropriate forty thousand dollars ($40,000.00) to the University of Guam for the sole purpose of supporting the Nursing Program by purchasing equipment and supplies for students in their teachingllearning laboratory. Section 2. Deappropriation and Reappropriation. The sum of Forty Thousand Dollars ($40,000.00) is hereby deappropriated from the sums appropriated to the I Liheslatumn Guhhan for Fiscal Year 2006 and reappropriated to the University of Guam for the sole purpose of purchasing supplies and equipment for the School of Nursing Program. Notwithstanding of any other law or rule, the Fiscal Officer of the I Liheslaturan Guhhan shall reduce the budget allotment to Senator for Fiscal Year 2006 by an amount equal to the sum deappropriated by this Section and transfer that sum to the Department of Administration for expenditure in accordance herewith. Section 3. Reporting. Within sixty (60) days after the end of Fiscal Years 2006, the University of Guam shall submit a written report regarding the expenditure of this appropriation to the I Liheslaturan Gulihan. No portion of this appropriation shall be used for purposes other than that specifically defined in Section 2 of this Act. Section 4. Severability. If any provision of ths Act or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this Act which can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable. BE IT ENACTED BY THE PEOPLE OF GUAM: Section 1. Legislative Findings and Intent. I Liheslaturan Guahan finds that we must provide nursing students at the University of Guam (UOG) with the best learning environment as possible. These students must be prepared for direct client care t by, maintaining a well-equipped learning laboratory which consists of a skills lab section with up to date computers. Because of wear and tear and to keep up with current developments in nursing and health care, this equipment must be replaced or upgraded. For the past several years, we have seen a critical shortage of nurses on Guam and nationwide. By supporting the School of Nursing at UOG, we can entice high school students, current students at UOG and others who may want to enter into a new career to choose nursing as a profession. It is. the intent of the I Liheslaturan Guahan to deappropriate forty thousand dollars ($40,000.00) to the University of Guam for the sole purpose of supporting the Nursing Program by purchasing equipment and supplies for students in their teaching/learning laboratory. Section 2. Deappropriation and Reappropriation. The sum of Forty Thousand Dollars ($40,000.00) is hereby deappropriated £tom the sums appropriated to the 1 Liheslaturan Guahan for Fiscal Yei 2006 and reappropriated to the University of Guam for the sole purpose of purchasing supplies and equipment for the School of Nursing Program. COMMITTEE REPORT ON BILL NO. 263 (EC)

AN ACT TO DEAPPROPRIATE FORTY THOUSAND DOLLARS ($40,000.00) FROM THE SUMS APPROPRIATED TO THE I LIHESLATURA GUAHAN FOR FISCAL YEAR 2006 AND TO REAPPROPRIATE SAID SUM TO THE UNIVERSITY OF GUAM FOR THE SOLE PURPOSE OF PURCHASING SUPPLIES AND EQUIPMENT FOR THE NURSING PROGRAM. I. OVERVIEW The Executive Committee held a public hearing at 9:00 a.m. on March 29, 2006 in the Session Hall, I Liheslaturan Gughan. Public notice was given to all media (see facsimile confirmation page) on March 22 and March 27,2006.

11. SUMMARY OF TESTIMONY Individuals that appeared before the Committee to present oral and written testimony on the bill were as follows:

Ms. Maria Salomon, Dean, Acting Director of Nursing, School of Nursing, University of Guam provided written testimony in support of Bill No. 263. Ms. Salomon wrote that "one of the program's great and ongoing needs to ensure students are prepared adequately for direct client care is maintaining a well-equipped learning laboratory". She further states "we look for funds to assist the program in aquiring and upgrading our teaching tools and equipment periodically". Ms. Salomon provided a breakdown of the teaching tools and equipment needed by the school of nursing to provide the quality education that the students in the program deserve. She was supported by her colleague Mr. Shaying Chen, Dean, College of Professional Studies, who was present at the public hearing.

Discussion:

Senator Lou Leon Guerrero, Author of Bill No. 263 (EC), provided brief remarks on the bill. Senator Leon Guerrero thanked the Chairman for expeditiously hearing Bill No. 263. She said that the equipment and learning tools at the School of Nursing at the University of Guam have been utilized extensively by the students in the program and require replacement and or purchase of upgraded tools and equipment in the teaching and learning laboratory. She said the clinical lab I very important because it allows the students to build their confidence.

111. FINDINGS AND RECOMMENDATION The Executive Committee finds that the intent of Bill No. 263 will allow the University of Guam's School of Nursing Program to purchase needed supplies and equipment from funding deappropriated from the budget allotment to Senator Lou Leon Guerrero. $40,000 will be reappropriated to the UOG for the specific purpose of assisting the nursing program.

Dear Senator Forbes,

Thank you on behalf of the UOG nursing program for the opportunity to provide testimony in support of Bill 263 (EC). We also thank Senator Lou Leon Guerrero, our nurse representative to the 28'hGuam Legislature, for her advocacy for the needs of the nursing program. The nursing program has always endeavored to provide the nursing students and community nurses with the best learning environment. We do this in order to prepare nursing students adequately to become safe, confident, efficient nurses and transition them more effectively into the role of the nurse in the clinical setting. One of the program's great and ongoing needs to ensure students are prepared adequately for direct client care is maintaining a well-equipped learning laboratory. The UOG BSN program has a learning laboratory consisting of a skills lab section and a computer duster. We equip this laboratory with supplies and equipment and audio-visual resources necessary to simulate the patient environment In the computer section, we have computers, printers and related hardware, and storage for computer assisted instruction programs and other audio-visual resources. These learning areas are used regularly and frequently by students. The laboratory is also open for use by community nurses needing to review their skills or upgrade their knowledge. Most of our manikins date back to 1980s, many of our hospital beds are so old they do not function properly, we lack modem patient care equipment for demonstration, and overall, our laboratory has become smaller due to increased enrollment We accommodate by dividing a class of 40 into a morning and afternoon sections. This section of 20 students learn in a small lab space cramped with 7 hospital beds only 2 feet from each other, overbed and bedside tables, wheelchairs, stretchers and cabinets. We have taught excellent students in this environment. However, increasing enrollment in the program has meant increasing expected wear and tear of resources and the learning space is no longer acceptable. We anticipate increasing our lab space within the next academic year, and so, we anticipate increasing resources. What is more important is upgrading our resources. We have to periodically upgrade in order to keep up with changes in technology and provide the best opportunities for students to master their nursing skills. GMH has provided a great learning ground for students in terms of patient care technology, but to lessen their orientation time for patient care, students need to be more skillful with machinery and technology before they go to GMH. In this regard, we look for funds to assist the program in acquiring and upgrading our teaching tools and equipment periodically. We respectfully invite members of the legislature to pay our laboratory a visit to get a better glimpse of the program's learning environment. Another program need is providing faculty with necessary equipment to be able to keep up with the fast moving pace of developments in the teaching and learning of nursing. teaching resources and methods. Faculty use computers to access internet resources, develop programs, communicate with students, and otherwise conduct business related to teaching, research and other facutty responsibilities. Periodically, we also have to upgrade our computer resources for faculty. Contributions from funding sources and grants have allowed the program to obtain supplies and software, replace heavy equipment such as hospital beds and purchasing a simulated patient model. However, there are items that need to be replaced or upgraded and those that need to be acquired that we have not been able to provide for student learning. For these reasons we respectfully support Bill No. 263 which would reappropriate $40,000 to UOG for purchasing supplies and equipment for the Nursing Program. AN ACT TO DEAPPROPRIATE FORTY THOUSAND DOLLARS ($40,000.00) FROM THE SUMS APPROPRIATED TO THE I LIHESLATURA GUAHAN FOR FISCAL YEAR 2006 AND TO REAPPROPRIATE SAID SUM TO THE UNIVERSITY OF GUAM FOR THE SOLE PURPOSE OF PURCHASING SUPPLIES AND EQUIPMENT FOR THE NURSING PROGRAM.

BE IT ENACTED BY THE PEOPLE OF GUAM: Section 1. Legislative Findings and Intent. ILiheslaturan Guahan finds that we must provide nursing students at the University of Guam (UOG) with the best learning environment as possible. These students must be prepared for direct client care by maintaining a well-equipped learning laboratory which consists of a skills lab section with up to date computers. Because of wear and tear and to keep up with current developments in nursing and health care, this equipment must be replaced or upgraded. For the past several years, we have seen a critical shortage of nurses on Guam and nationwide. By supporting the School of Nursing at UOG, we can entice high school students, current students at UOG and others who may want to enter into a new career to choose nursing as a profession. It is the intent of the ILiheslaturan Guahan to deappropriate forty thousand dollars ($40,000.00) to the University of Guam for the sole purpose of supporting the Nursing Program by purchasing equipment and supplies for students in their teaching/leaming laboratory. Section 2. Deappropriation and Reappropriation. The sum of Forty Thousand Dollars ($40,000.00) is hereby deappropriated from the sums appropriated to the I Liheslaturan Guahan for Fiscal Year 2006 and reappropriated to the University of Guam for the sole purpose of purchasing supplies and equipment for the School of Nursing Program. Notwithstanding of any other law or rule, the Fiscal Officer of the I Liheslaturan Guahan shall reduce the budget allotment to Senator Lou Leon Guerrero for Fiscal Year 2006 by an amount equal to the sum deappropriated by this Section and transfer that sum to the Department of Administration for expenditure in accordance herewith. Section 3. Reporting. Within sixty (60) days after the end of Fiscal Years 2006, the University of Guam shall submit a written report regarding the expenditure of ths appropriation to the ILiheslaturan Guahan. No portion of this appropriation shall be used for purposes other than that specifically defined in Section 2 of this Act. Section 4. Severability. If any provision of this Act or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this Act which can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.
