Further to your information request of 5 June 2019 in respect of HNZ Properties soak pits, I am now able to provide Hamilton City Council’s response.

You requested: I am currently collating information in relation to the installation of soak pits at HNZ properties since 2011. Would you please provide me with a list of properties whereby council consent has been granted for the installation of a soak pit at existing properties (not new builds), from January 2011 to present. And clarified to be Please find attached a list of properties where HNZ have been billed for the installation of one or multiple soak pits in the HCC area. I am hoping that this will reduce the amount of work required to fulfil this request and appreciate any assistance you may be able to provide.

Our response: Hamilton City Council has completed a search for soak pit building consents for the addresses in the attached PDF that was provided by you on 11 June 2019. We can confirm that to the best of our knowledge and based on readily available information that no Building Consents, at the specified addresses and the years provided, have been lodged for the installation of soak pit’s.

Your request as it is currently framed will be very difficult to meet without substantial collation or research. Staff have currently estimated that it will require in excess of 221 hours to collate your request. Unless your request is amended, we may have consider changing for the completion of the request or to refuse it under section 17(f) of the Local Government Official Information and Meeting act 1987, which applies where the information cannot be made available without substantial collation or research.

As such we invite you to refine and clarify your request. The following questions may be helpful in terms of clarifying your request:  Are there particular addresses/properties of significance?  Is there an areas suburb(s) of Hamilton you are interested in?  Is there a particular business and/or individual that installed soak pits on HNZ properties that you are interested in?

We would appreciate your response by 17 June 2019 as to whether you are prepared to amend or clarify your request and, if so, how.

In terms of our process for dealing with information requests under the Local Government Official Information and Meetings Act 1987 (LGOIMA), it is standard practice to inform you that any clarification or amendment of your request is considered to be a new request for the purpose of calculating the maximum statutory timeframe for the Council’s response (section )13(7 LGOIMA).
