ASSIGNMENT OF UTILITY EASEMENT

THIS ASSIGNMENT OF UTILITY EASEMENT, granted this day of , 2005, by the CITY OF NAPLES, a municipal corporation of the State of Florida whose mailing address is 735 8th Street South, Naples, Florida 34102, as Assignor, to the FLORIDA POWER & LIGHT COMPANY, whose mailing address is 4105 SW 15th Avenue, Naples, Florida 34116, its successors and/or assigns, as Assignee.

WITNESSETH:

Assignor, for an inconsideration of the sum of Ten Dollars ($10.00) and other good and valuable consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to the Assignee, its licensees, agents, successors, and assigns all of Assignors right, title and interest in a portion of that certain easement (the “Assigned Easement”) conveyed, granted, bargained and sold to Assignor under that certain Right-of-Way and Utility Easement between Royal Poinciana Golf Club, Inc., a Florida corporation, and Assignor, dated June 15, 2005, and recorded in O.R. Book 3861, Page 0733, of the Public Records of Collier County, Florida, said Assigned Easement to be 10 feet in width and more particularly described as follows:

TO HAVE AND TO HOLD, the same unto the Assignee, its respective successors and assigns, for the purposes aforesaid.
