of Legal Aid in Queensland n Australia, access to the justice system for disadvantaged people Iwas traditionally provided on a voluntary basis by the legal profession. The exception was in respect of people charged with serious indictable offences where the state paid private practition- ers appointed by the court to represent them. Very limited assist- ance was available for committals proceedings. In Queensland, the Ryan Labor government had, for this purpose, instituted the Public Defender’s Office as part of the Public Curator’s Office established within the Department of Justice in 1916. Otherwise, the availability of free legal assistance for those unable to pay for it depended on the continuing goodwill of the private profession. From the late 1950s, a number of factors came to influence this situation and heralded changes which were to shape the provision of legal aid services for the future. At base was an increasing recog- nition on the part of both the government and the legal profession that the concept of legal aid, if it was to continue to be effective in practice, needed to operate within a formal structure backed by an adequate funding system. There had been informal discussions from time to time about possible courses to be pursued but the catalyst for serious debate proved to be the post-war social welfare program planned by the British Labor government. Legal aid was one aspect under consideration and a comprehensive study was made of the options for the delivery of an achievable, effective service. The “Report of the Committee on Legal Aid and Legal Advice in England and Wales”, published in May 1945 and known as the Rushcliffe Report, set out the basis for its recommendations, the most significant of which were that legal aid should be provided and administered by the legal profession, and wholly funded by the state. This article examines Walter Campbell’s family background, his education, marriage, air force days, his experiences as Governor and his wide-ranging interests. It concludes with an assessment of the impact of his multi- faceted life. Sir Walter Campbell is well remembered for his term as the Governor of Queensland, particularly for his deft and effective handling of the state’s 1987 constitutional crisis, when Premier Sir Joh Bjelke-Petersen refused to resign after losing the support of his party. Campbell’s career, however, intersected with a range of historical events, including political, legal, constitutional, diplomatic and even military incidents of significance to the nation.

The implosion of Joh Bjelke- Petersen, 1983–1987 The 1983 election ended the ‘constitutional crisis’ by providing the Nationals with exactly half the seats in the Parliament (41) and the opportunity to supplement their ministry with Liberal ministerialists who would agree to join the new government. The Premier had a number of options to secure his majority. Many of the surviving former Liberal ministers were not generally regarded as ‘anti-coalitionists’ in the previous government. The six potential ministerialists who might have been persuaded to change allegiances were: Norm Lee, Bill Lickiss, Brian Austin, Don Lane, Colin Miller and even Bill Knox. According to the Courier-Mail (15 July 1983), when two Coalition backbenchers, Bill Kaus and Bob Moore, had quit the Liberals and joined the Nationals in July, two Liberal ministers, Norm Lee and Bill Lickiss, already had indicated they would consider jumping ship. It was almost as if a race to defect was on. The two other Liberals to survive the 1983 poll, Terry White and Angus Innes, would not have been acceptable to the Premier and his senior ministers. In total, six of the eight Liberals had been ministers (although Miller had served for just 13 days after White was sacked and before the resignations of all the Liberals were accepted). Knox had been a minister since 1965 and Lee and Lickiss had been ministers since early 1975. They had some pedigree. Austin and Lane (and White) each had one parliamentary term as minister. Two Liberals, however, took the issue into their own hands. The day after the election, Austin and Lane had discussed the prospects of defecting and swapping parties, with Austin saying ‘I’m sick of this…I reckon we ought to give ’em the arse.

    1988 Cabinet Documents Project Deliverable 2 – Cabinet Decision Summaries Beyond Expo An overview of the 1988 Cabinet Documents Anthony Marinac1 Throughout the rest of Australia, 1988 will primarily be remembered as the year of the Bicentenary – a national party, and for Indigenous Australians, a year of concerted protest. In Queensland, though, 1988 was unquestionably the year of Expo. 1988-89 also represented the short interregnum between the end of the Bjelke- Petersen Premiership (in December 1987) and the commencement of the Goss Premiership (in December 1989). Mike Ahern, who deposed Bjelke-Petersen, was Premier for all of 1988, and while Expo took centre stage, there were dozens of other significant events dealt with by his Cabinet. During the year, Cabinet made 2524 decisions. Many of them were administrative or routine, such as the endorsement of the Parole Board’s decision to release life sentence prisoners on parole, or approval for overseas travel by public servants. One hundred or so significant decisions have been drawn from the Cabinet decisions. This document provides an overview of those. The numbers in the endnotes refer to the relevant cabinet decisions. Fitzgerald Tony Fitzgerald QC continued his Commission of Inquiry into corruption in Queensland throughout 1988. Many of the key events of the Inquiry, such as the capture of bagman Jack Herbert, or the appearances of Joh Bjelke-Petersen and Russ Hinze before the inquiry, were historically significant, but did not require attention from Cabinet itself. Cabinet did, however, have to consider whether the state government would continue to pay the legal costs of senior police such as assistant commissioner Tony Murphy.

Ed, MGPP A thesis submitted for the degree of Doctor of Philosophy at The University of Queensland in 2015 School of Historical & Philosophical Inquiry Abstract Political support for the inclusion of social policy advocacy groups in the development of public policy is underpinned by a broad belief in the right of citizens to participate in or at least contribute to government decision making. Governments and state agencies consult widely on social issues when they see accountability and transparency as politically attractive, a form of both useful advice and risk management. While scholars have theorised on the benefits of non-state participation, empirical research on the role of policy advocacy groups in the development of Australian public policy is limited. This thesis examines the role of Queensland Shelter Inc., a state based social housing policy peak, in the development of Queensland social housing policy (1987-2012). While consultation processes are open and inclusive of a wide range of stakeholders, participation remains restricted to a select few. Why are some interest groups able to directly participate in the development of public policy while others are only consulted or even ignored? The influence of Queensland Shelter over housing policy has fluctuated over its twenty-five year history. Three factors were examined in relation to this oscillation: the organisational capacity of Queensland Shelter, the willingness of the housing ministry to engage and the broader political context. While the main focus of the study is to assess and analyse shifts in the relationship between Queensland Shelter and the state housing ministry, attention is also given to the connections between Queensland Shelter and other stakeholders, including the bureaucracy, other policy advocacy groups and the Australian federal government.

The end of an era, 1987–1989 For God’s sake let us sit on the ground And tell sad stories of the death of kings: How some have been depos’d, some slain in war, Some haunted by the ghosts they have depos’d, Some poison’d by their wives, some sleeping kill’d All murder’d—for within the hollow crown That rounds the moral temples of a king Keeps Death his court; and there the antics sits, Scoffing his state and grinning at his pomp. — William Shakespeare, King Richard II (Act 3[2]:155) The revelations of the Fitzgerald Inquiry hung over the ‘besieged’ Ahern government from its initial day in office: 1 December 1987 (Reynolds 2003:348). The revelations and fallout from the inquiry would plague Ahern’s Premiership until he was replaced by Russell Cooper at the demise of the Nationals’ government in December 1989. These two years were some of the most dramatic in the state’s history. Day by day, sensational allegations and admissions were exposed as senior police and informers turned state’s evidence and, for full confessions and cooperation, received immunity from subsequent prosecution. Whistleblowers emerged from the woodwork; once one informant talked others followed. The networks of corruption and misconduct were quickly unravelling only to be pursued to the next level by eager and diligent investigators. There were mounting suggestions that the connections stretched to the very top of government. There was a surreal quality to Queensland politics. Mike Ahern inherited a poisoned chalice. Senior National ministers had long been anxious to displace Bjelke-Petersen from the premiership—by urging him either to retire or move over to the federal level.

    Homophobia as Party Politics Homophobia as Party Politics: The Construction of the ‘Homosexual Deviant’ in Joh Bjelke-Petersen’s Queensland Shirleene Robinson Introduction In 1987, years of frustration with Queensland’s sexually repressive culture compelled a homosexual man named Cliff Williams to write to the national gay magazine OutRage. Williams outlined a number of the difficulties he faced being gay in Queensland and ended his letter with the exclamation, ‘To hell with homophobic Queensland!’1 This exclamation captures many of the tensions in Queensland in the 1970s and 1980s. While these decades were a time of immense political change for gay and lesbian Australians, Queensland’s political culture was particularly resistant to the gay and lesbian rights movement. The Australian gay and lesbian liberation movement emerged as a political force in the 1970s and 1980s during an era when Queensland was governed by the extreme right-wing premier Johannes ‘Joh’ Bjelke-Petersen, and a climate of censorship and repression prevailed. This article explores the ways in which Bjelke- Petersen and his Country Party/National Party government defined homosexuality as morally deviant in order to gain electoral advantage, thereby incorporating the politics of homophobia into governance. First, the Bjelke-Petersen government made efforts to prevent homosexual teachers from being employed and homosexual students from forming support groups. Second, it used the HIV/AIDS epidemic to demonise homosexual individuals. Third, it attempted to introduce anti-homosexual licensing laws and to criminalise lesbianism. Finally, the 1986 Sturgess Inquiry into Sexual Offences Involving Children and Related Matters also contributed to public anti-gay sentiment.

    Split, intervention, renewal: The ALP in Queensland 1957 – 1989 Susan Terrencia Yarrow Bachelor of Arts A thesis submitted for the degree of Master of Philosophy at The University of Queensland in 2014 School of History, Philosophy, Religion and Classics Abstract On 1 March 1980, the National Executive of the Australian Labor Party intervened in the affairs of its Queensland Branch, dissolving the existing party arrangements, seizing the financial statements and party assets, and creating a new administration. The conflict that precipitated this drastic step followed years of internal division and publicly aired disputes while the Queensland leadership delivered poor electoral results at both state and federal elections. This thesis examines the conflict in detail, its causes (including the lasting impact of the 1957 split), the combatants, and what the intervention reforms eventually delivered. In this thesis, I analyse the factors that led to intervention including the nature and outlook of the Queensland leaders, the ‘Old Guard’ often referred to as the Trades Hall Group, and the background and motivations of the reformers, the ‘New Guard.’ The Old Guard finally succumbed to reform, threatened from within by the influx of new members clamouring for change, and by the federal intervention from without. I examine how, over time, the party reformed, modernised and adapted to change and in so doing re-invented and renewed itself sufficiently, after 32 years in opposition, to once again win government in Queensland for 21 of the next 23 years. ii Declaration by author This thesis is composed of my original work, and contains no material previously published or written by another person except where due reference has been made in the text.
