Call to Order: The Chair called the meeting to order at 8:31 a.m. at which time quorum was established.

The Chair called for a motion in regards to the minutes of the July 11, 2019 meeting.

Upon a motion by Ms. Stone Murai, seconded by Ms. Kodama, it was voted on and unanimously carried to approve the minutes of the July 11, 2019 meeting as circulated.

Executive Officer’s Conferences/Seminars/Meetings Report: 2019 NCSBN Annual Meeting August 21-23, 2019, Chicago, Illinois – The Vice Chair and Mr. Duldulao Attending

The EO asked the Vice Chair and Mr. Duldulao if they can speak to some of the representatives from other states that are not part of the eNLC to see what concerns or reason(s) why they have not joined the eNLC especially if it is in addition to the Board’s concern with revenue, complaint investigation and continued competency requirement(s).

2019 NCLEX Conference September 9, 2019, Phoenix, Arizona – Ms. Boyer Attending

2019 NCSBN Leadership & Public Policy Conference October 2-4, 2019, Atlanta, Georgia – The EO asked the Board if anyone was interested in attending and that this person would assist the Chair, Vice Chair and EO in tracking legislation in 2020 and possibly providing research/outreach and testifying on behalf of the Board next year.

The Vice Chair stated that she was interested and would get back to the EO.

Boards and Commissions Member Orientation October 11, 2019, 8:30 – 12:00, State Capitol Auditorium – The EO stated that this orientation is open to all new and existing members, regardless if you previously attended but would like a refresher.

Ms. Oliveira and Ms. Kodama stated that they would attend.

2019 Legislative Session

The EO reported that SB 385, SD1, HD2, CD1, Relating to Professional and Vocational Licensing, that repeals defaults on student loans, student loan repayment contracts, and scholarship contracts as grounds for sanctioning professional and vocational licensees, was approved without the Governor’s signature on 7/10/2019 (Act 279).

2019 Renewal

Continuing Competency The EO reported that she was informed that the audit list should be available next week. She stated that she will prepare a draft of the letter to be sent to those nurses selected but may ask the members to review/edit the letter for further clarification.

She also mentioned that nurses who missed the June 30, 2019 renewal deadline may apply to “restore” their nurse license by requesting a hard copy renewal (not available online), but they must also submit proof of compliance with the continuing competency requirement.

Criminal History Background Check The EO reminded the Board that over 8,000 nurses were required to be fingerprinted as part of the renewal requirement for 2019 and that Licensing Branch staff has been checking the list but she has not gotten a report on how many nurses were actually fingerprinted.

She did state that if a nurse that was required to be fingerprinted renewed and placed their license on “inactive” status, the nurse would not have to be fingerprinted, even though his/her name was on the list, but will be required to be fingerprinted when the individual reactivates his/her nurse license.

District of Columbia’s Adverse Event Decision Pathway The EO stated that she was reading the newsletter from the DC BON and came across this “Adverse Event Decision Pathway” for nurse leaders and administrators. This pathway, developed by the NCSBN and the American Organization of Nurse Executives is a guidance tool for the facility quality team when conducting an internal investigation on an adverse event.

The Board agreed that this would be a good guidance tool for facilities and requested that it be posted on the Board’s web page.

Legislative Updates The Board noted the following bills introduced or new laws enacted in other states:

• 7/12/2019 ENACTED CT S 375 SUMMARY: Concerns nursing home staffing levels; ensures adequate reporting of the numbers of nursing home staff.

CT S 827 SUMMARY: Requires physicians and APRNs who provide primary care or emergency treatment for adults to receive training in recognizing the signs and symptoms of Alzheimer’s disease and Dementia. Board of Nursing Minutes of August 1, 2019 Meeting Page 4

CT S 921 SUMMARY: Updates the general statutes to reflect the current scope of practice of APRNs.

DE H 172 SUMMARY: Enacts the Psychology Interjurisdictional Compact.

HI S 1404 SUMMARY: Provides loan repayment for physicians, physician assistants, psychologists, nurse practitioners, social workers, marriage and family therapists, and nurses who agree to work in a federally-designated health professional shortage areas.5/31/2019

TO GOVERNOR DE S 83 SUMMARY: Adopts the Physical Therapy Licensure Compact.

OR S 688 SUMMARY: A professional licensing board shall issue a temporary authorization to provide the occupational or professional service regulated by the professional licensing board to the spouse of a member of the Armed Forced stationed in the state.

RI H 5298 SIMILAR: RI S 298 SUMMARY: Permits a registered nurse who is enrolled in an accredited nurse anesthesia program to practice as a nurse anesthetist under the supervision of a certified registered nurse anesthetist or an anesthesiologist.

RI H 6086 SUMMARY: Requires private schools in addition to public schools to provide and maintain on site opioid antagonists.

TO GOVERNOR AK S 93 SUMMARY: Establishes the workforce enhancement program intended to increase the availability of health care services throughout the state, especially to underserved individuals or in health care professional shortage or rural areas.

NC H 50 SUMMARY: Authorizes doctors of medicine, nurse practitioners, physician assistants, and doctors of osteopathy to prescribe hyperbaric oxygen therapy for veterans with traumatic brain injury and PTSD.

Scope of Practice

Can a labor and delivery RN adjust the rate on an epidural for a patient? The Chair led the discussion on the following email inquiry:

“I have a quick nursing practice question for you. In the State of Hawaii, can a labor and delivery RN adjust the rate on an epidural (up or down, or turn on), on a patient?”

He stated that he did some research and found the following information: • November 2016 American Association of Nurse Anesthetists Board of Directors Meeting:

“To take the position that obstetric registered nurses (RNs) who possess the competency, may after consult with the anesthesia professional, adjust epidural infusion rate.”

Older position statements: • AANA “Provision of Pain Relief by Medication Administered via Continuous Catheter or other Pain Relief Devices, is consistent with the Association of Women’s Health, Obstetric and Neonatal Nurses (AWHONN) position and state that “the insertion, initial injection, reinjection, or continuous infusion of epidural catheters for anesthesia or analgesia for the obstetrical patient in label Board of Nursing Minutes of August 1, 2019 Meeting Page 6

should only be performed by a qualified anesthesia professional.” • Facility Policy: “May facilities have developed RN pain management practice policy that allows pain and obstetric RNs to change epidural infusion rate after consultation with an anesthesia professional. These facilities have initial RN education, mentored assessment, ongoing competency, and quality improvement activities to monitor outcomes.” • Board of Nursing: “Several State Boards of Nursing that have addressed the issue of epidural management appear consistent with AWHONN’s that RNs should not adjust infusion rate or administer a bolus dose. (we do not have a comprehensive 50 date analysis available) • AWHONN Position: In an effort to collaborate, Professional Practice staff spoke with Lynn Erdman, MN, RN, CNS, FAAN, AWHONN Chief Executive Officer, regarding their position and AANA’s consideration. AWHONN currently states that: 1. RNs should “monitor but not manage the delivery of analgesia and anesthesia by catheter technique”; 2. RNs should not: - “bolus or re-bolus regional/intrathecal analgesia or anesthesia doses by injecting medication in to the catheter”; - “manipulate doses of regional/intrathecal analgesia and anesthesia delivered by continuous infusion”; - “manipulate doses of regional/intrathecal analgesia and anesthesia or dosage intervals for patient-controlled epidural analgesia (PCEA)”; - “increase or decrease the rate of a continuous infusion”; and - “re-initiate an infusion once it has been stopped” • American Society of Anesthesiologists (ASA) Statement on Pain Relief During Labor (which is currently under revision): “Under appropriate physician supervision, labor and delivery nursing personnel who have been properly educated and have demonstrated current competence should be able to participate in the management of epidural infusions, including adjusting dosage and discontinuing infusions.” No mention of bolus. • The American Congress of Obstetricians and Gynecologists (ACOG) position is consistent with the ASA

• 2007 Pain Management of Nurses – Allowed RNs to adjust epidural; • 2015 AONE – Does not support allowing RNs to adjust epidurals; • 2018 ASA – Allowed RNs to adjust epidurals.

The Chair referred to the Decision Making Framework and the following section(s):

§457-1.5 Practice of nursing. (a) Nursing is a scientific process founded on a body of professional knowledge. It is learned profession based on an understanding of the human condition across the lifespan of a client and the relationship of a client with others and within the environment. It is also an art dedicated to caring for others. The practice of nursing means assisting clients in attaining or maintaining optimal health, implementing a strategy of care to accomplish defined goals within the context of a client-centered health care plan, and evaluating responses to nursing care and treatment. Nursing is a dynamic discipline that is continually evolving to include more sophisticated knowledge, technologies, and client care activities. Nursing applies evidence-based practice to promote optimal client outcomes. (b) The scope of nursing practices established in this chapter and by the rules of the board shall serve as general guidelines and are not intended to address the appropriateness of the use of specific procedures in any particular work setting or to grant permission to implement specific procedures in any particular work setting.

Definition of "The practice of nursing as a registered nurse" in HRS 457-2:

"The practice of nursing as a registered nurse" means the performance of professional services commensurate with the educational preparation and demonstrated competency of the individual having specialized knowledge, judgment, and skill based on the principles of the biological, physical, behavioral, and sociological sciences and nursing theory, whereby the individual shall be accountable and responsible to the consumer for the quality of nursing care rendered. The foregoing may include but shall not be limited to observation, assessment, development, implementation, and evaluation of a plan of care, health counseling, supervision and teaching of other personnel, and teaching of individuals, families, and groups in any stage of health or illness; administration, supervision, coordination, delegation, and evaluation of nursing practice; provision of health care to the patient in collaboration with other members of the health care team as autonomous health care professionals providing the nursing component of health care; or use of reasonable judgment in carrying out prescribed medical orders of a licensed dentist, physician, osteopathic physician, or podiatrist licensed in accordance with chapter 448, 453, 460, or 463E; orders of an advanced practice registered nurse licensed in accordance with this chapter; or the orders of a physician assistant licensed pursuant to chapter 453, practicing with physician supervision as required by chapter 453, and acting as the agent of the supervising physician.”

Ms. Boyer stated that this would require specialized training and is not included in your basic nursing education. Board of Nursing Minutes of August 1, 2019 Meeting Page 8

After further discussion, it was the consensus of the Board that due to the different positions by national organizations and being that the nurse practice act does not specifically address this procedure, the Board decided to refer the inquirer to the definition of “"The practice of nursing as a registered nurse", the Decision Making Framework and also refer to the facilities policies and procedures.

Can an APRN administer “Stem Cell Therapy” and “Platelet Rich Plasma (PRP)”? The Chair asked Dr. Napoleon to lead the discussion on the following email inquiry:

“My name is Richard G. Atwell, MSN, APRN-Rx. I live on Kauai I would like to know if Stem Cell Therapy injections and PRP (Platelet Rich Plasma) injections fall within my scope of practice as an APRN. My license # is APRN-1883.

I have spent considerable time on various websites but cannot find these treatment modalities specifically referenced. Most links refer me to Hawaii Statutes Chapter 457 but I see no discussion of these procedures. As these procedures have only recently become more widespread nation wide, they may not be specifically addressed and verifiable. I defer to your office for help.”

Dr. Napoleon stated that in regards to “stem cell therapy”, her research determined that this may be an experimental procedure that is not part of the standard APRN education/training that may utilize investigational drugs that is listed in the ARNs current Exclusionary Formulary. She also referred to the Decision Making Framework and that additional education and training would be required.

For Platelet Rich Plasma (PRP), Dr. Napoleon determined that this appears to be related to orthopedic and that additional training would be required to order or administer PRP.

Ms. Stone Murai also stated that her research determined that PRP is also used in treating cancer patients.

After further discussion, it was the consensus of the Board that for APRNs prescribing/administering “Stem Cell Therapy” injections, the Board refers the inquirer to the Decision Making Framework. The Board was concerned that this type of treatment was considered “experimental” in some of the research they read and was not considered standard practice for an APRN and would require additional training. For APRNs prescribing/administering “Platelet Rich Plasma” injections, the Board determined that this was related to orthopedics and although additional training would be required, it may fall within the scope of practice of an APRN, depending on the APRN’s practice specialty.

American Association of Nurse Anesthetists (AANA) Updates Standards of Nurse Anesthesia Practice and Other Practice Documents

The updates and practice documents were distributed to the Board members.

American Holistic Nurses Association – 2018 Nurse Practice Act Analysis Summary

The information was distributed to the Board members.

The Board noted that national certification by the American Holistic Nurses Credentialing Center is a Board recognized national certification that allows a nurse who is renewing his/her Hawaii nurse license to be exempt from the continuing competency requirements.

Hawaii State Center Ms. Reichhardt reported on the following: for Nursing: • On Wednesday, August 21, 2019, Senator Baker, Chair of the Senate Committee on Commerce, Consumer Protection and Health, and Representative Mizuno, Chair of the House Committee on Health will be holding an informational briefing on Hawaii’s Health Workforce Development for the 21st Century and that she will be speaking on Potential Solutions to Nursing Workforce Challenges; • She plans to provide information on RN-BSN nurses in Hawaii; • Shortage of faculty for Hawaii nursing programs; and • Shortage of clinical placements for Hawaii nursing students.

American Nurses Ms. Beechinor reported on the following: Association – Hawaii Chapter: That their official name is Hawaii – American Nurses Association and that they are seeking to be an approved provider of continuing education.

The Board asked for confirmation that LPNs are not eligible to “join” the Hawaii – American Nurses Association.

Ms. Beechinor replied yes.

The EO asked if the Hawaii – American Nurses Association should become a continuing education provider, would they allow LPNs to take their CE courses.

Ms. Beechinor replied yes.
