O’Connor ABSTRACT This paper identifies habits that contribute to American national identity, as demonstrated in the interactions of U.S. diplomats abroad. I examine the foundations of curriculum in U.S. education—and how national identity is reproduced within this domestic institution. Our American identity is the amalgamation of our individual habits which are rooted in our ideas, norms, and values of what is important and worthy of pursuit, what is proper and what is correct. These ideas form a discourse in American identity today, as they did in the time of John Dewey—father of modern education in the United States—and Alexis de Tocqueville—a sociologist, cultural anthropologist, and political commentator—who both have much to say on the relationship of formal education to national identity and politics. These particularly American cultural habits are elucidated in diplomatic action because diplomats are constantly in situations that highlight contrasts between cultures. iii ACKNOWLEDGEMENTS A special thank you goes to Ambassadors Melvyn Levitsky, Roger Kirk, and Jack Matlock for taking the time to meet with me and answer my questions. Mr Chairman, before I make my speech, I would like to raise a point concerning Mr Jimmy McGREGOR because he was quite upset when he heard my previous speech. He hoped that I could clarify one point. In fact, I did not mean that all the people in the commercial sector had not supported democracy. If all the voters in the commercial sector had not supported democracy, Mr Jimmy McGREGOR would not have been returned in the 1988 and 1991 elections. -

THE BASIC LAW AND DEMOCRATIZATION IN HONG KONG Michael C. Davis† I. Introduction Hong Kong’s status as a Special Administrative Region of China has placed it on the foreign policy radar of most countries having relations with China and interests in Asia. This interest in Hong Kong has encouraged considerable inter- est in Hong Kong’s founding documents and their interpretation. Hong Kong’s constitution, the Hong Kong Basic Law (“Basic Law”), has sparked a number of debates over democratization and its pace. It is generally understood that greater democratization will mean greater autonomy and vice versa, less democracy means more control by Beijing. For this reason there is considerable interest in the politics of interpreting Hong Kong’s Basic Law across the political spectrum in Hong Kong, in Beijing and in many foreign capitals. This interest is en- couraged by appreciation of the fundamental role democratization plays in con- stitutionalism in any society. The dynamic interactions of local politics and Beijing and foreign interests produce the politics of constitutionalism in Hong Kong. Understanding the Hong Kong political reform debate is therefore impor- tant to understanding the emerging status of both Hong Kong and China. This paper considers the politics of constitutional interpretation in Hong Kong and its relationship to developing democracy and sustaining Hong Kong’s highly re- garded rule of law. The high level of popular support for democratic reform in Hong Kong is a central feature of the challenge Hong Kong poses for China. Popular Hong Kong values on democracy and human rights have challenged the often undemocratic stance of the Beijing government and its supporters. -

HONG KONG'S ENDGAME AND THE RULE OF LAW (II): THE BATTLE OVER "THE PEOPLE" AND THE BUSINESS COMMUNITY IN THE TRANSITION TO CHINESE RULE JACQUES DELISLE* & KEVIN P. LANE- 1. INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. The Mountain Is High, and the Emperor Is Far Away: States and Smuggling Networks at the Sino-Vietnamese Border Qingfei Yin The intense and volatile relations between China and Vietnam in the dyadic world of the Cold War have drawn scholarly attention to the strategic concerns of Beijing and Hanoi. In this article I move the level of analysis down to the border space where the peoples of the two countries meet on a daily basis. I examine the tug-of-war between the states and smuggling networks on the Sino-Vietnamese border during the second half of the twentieth century and its implications for the present-day bilateral relationship. I highlight that the existence of the historically nonstate space was a security concern for modernizing states in Asia during and after the Cold War, which is an understudied aspect of China’s relations with Vietnam and with its Asian neighbors more broadly. The border issue between China and its Asian neighbors concerned not only territorial disputes and demarcation but also the establishment of state authority in marginal societies. Historically, the Chinese empire and, to a lesser extent, the Dai Nam empire that followed the Chinese bureaucratic model had heavyweight states with scholar-officials chosen by examination in the Confucian classics (Woodside 1971). However, as the proverb goes, the mountain is high, and the emperor is far away. Vast distances and weak connections existed between the central government and ordinary people. Central authorities thus had little influence over local affairs, including their own street-level bureaucracies. -
