The Massei Report SENTENCE OF THE COURT OF ASSIZES OF PERUGIA (PRESIDED OVER BY DR. GIANCARLO MASSEI) IN THE MURDER OF MEREDITH KERCHER Translated from the Italian into English 1 Version 1.0 The collated posts from the PerugiaMurderFile forum translation thread. Bolded numbers in square brackets, thus [123], refer to the pagination in the original judgement. Words and phrases in square brackets [xxx] are technical terms in the original Italian. The Conclusion is not marked explicitly in the original document, other than by the double-blank line that precedes it. Other sections in the judgement separated by blank double-line spacing are marked thus: (A), (B), (C). Note This translation was done by a group of unpaid volunteers who are regular posters on the Perugiamurderfile.org message board devoted to discussing the murder of Meredith Kercher in Perugia, Italy, in November 2007. The translation and editorial team was international in its make-up, with at least four continents represented including Europe, both North and South America and Australasia. Some but not all of the individuals who worked on the translation are professional translators; others were asked to proofread sections of a technical nature because of their expertise in certain areas (forensics, DNA, molecular biology, IT, criminal law, etc.). This was a daunting and complex task and was completed between March and August 2010, having been undertaken for the sole purpose of promoting a better understanding of this complex case, and to ensure that the facts are readily available to the English-speaking world without selective emphasis, misstatement or bias. ȱȱȱȱȱȱȃȱȄȱǰȱȱȱȱȱȱ rounds of proofreading and editing, both to ensure its accuracy and to harmonise the language insofar as possible. Persons fluent in both Italian and English are invited and encouraged to contact PMF if they find any material errors that influence the meaning or intention of Judge Massei. All such corrections will be investigated, made as required and brought to the attention of the public. The print copy of pages 288 and 304 of the original Italian document were corrupted which has led to partial translation - we would be grateful to any person who is able to supply clean versions so that they may be translated and the document updated accordingly. 2 As with any translation, some terminology in Italian has no direct equivalent in English. For example, the charge of calunnia has no direct equivalent in Anglo-Saxon law. Explanations have been provided where relevant. Similarly, readers are encouraged to submit any questions about legal or other concepts that may arise as they peruse the report. Our goal is to make the report as clear and as accurate as possible; to this end, it will be amended whenever doing so promotes this goal. As the report was written and published in Italian, that language prevails in the event of a dispute over interpretation. This English-language version is provided for readers' convenience only; accordingly, it is a free translation and has no legal authority or status. Borden Italian Department Bachelor of Arts This thesis examines the constitutional guarantees of impartiality granted in both the United States and Italian constitutions. Aided by the presentation of these two constitutional legal systems, this paper will attempt to break apart the elements of each system and point out key differences. The story had initially shocked me, because, having spent two summers there, studying Italian language and culture at the Università per Stranieri (University for Foreigners), I had known Perugia to be a peaceful and safe hilltop city. In 2007 the Kercher case appeared to be open and shut. Over the next year, however, conflicting information and evidence continued to make headlines, each time triggering a media frenzy in Italian and British news and highly volatile blogs across several cultures. After a one-year investigation and a trial that attracted global media coverage, Amanda Knox was convicted of killing Meredith Kercher, and was sentenced by the Court of Assisi to twenty-six years in Italian prison. As I sat listening to the guilty verdict, I experienced a chilling moment, not because I was convinced of her innocence, but because I suspected another force at work.

    WHAT NOT TO DO WHEN YOUR ROOMMATE IS MURDERED IN ITALY: AMANDA KNOX, HER “STRANGE” BEHAVIOR, AND THE ITALIAN LEGAL SYSTEM * MARTHA GRACE DUNCAN ABSTRACT One of the most widely publicized cases of our time is that of Amanda Knox, the college student from West Seattle who was convicted of murdering her British roommate in Italy and served four years in prison before being acquitted and released. Retried in absentia, she was convicted again, only to be exonerated by the Italian Supreme Court, which handed down its final opinion in September, 2015. Throughout its eight-year duration, the case garnered worldwide attention, in part because of the pretty, photogenic defendant and the drug-fueled sex game that the prosecutor adduced as the motive for the crime. Interest in the case spiked again with the release of a Netflix original documentary, Amanda Knox, in the fall of 2016. While the Amanda Knox case has been remarkable for its ability to fascinate an international audience, it is not altogether unique. Rather, it is emblematic of broader themes and a broader problem−that of human beings’ prejudice against “strangeness” and our desperation for a hasty assessment of guilt or innocence‒qualities that can bleed into a legal system to the detriment of the quest for truth. In this Article, I explore the Amanda Knox case in the context of our defective ability to judge. In Part One, I use the conceit of a “What Not To Do” list to highlight the role played by Amanda’s “strangeness” in bringing about her arrest and two convictions.

Kercher shared this residence with a young American woman by the name of Amanda Knox as well as two young Italian women. Within a matter of days, authorities had detained multiple suspects on the grounds that Meredith Kercher had been the victim of a murder. Among the alleged involved parties was Knox herself. What followed for Knox was a contentious and lengthy legal battle spanning some four years. Knox and her then boyfriend Raffaele Sollecito would remain in prison with little recourse other than to abide by the legal ramifications of their position. Knox in particular found herself in a dangerous, unfamiliar and frightening situation. Her eventual exoneration and release in the fall of 2011 was an event I personally witnessed alongside several hundred onlookers outside a nondescript Italian courthouse on a chilly fall evening in the quaint hill city of Perugia. Sentiments ranged from quiet vindication of a young girl’s innocence to vocal outrage at the liberation of an accessory to murder.

ISSN: 1070-8286 ‘Naïve Kid’ or ‘Virtuoso of Deceit’?: Tabloid Media Parochialism and the Trials of Amanda Knox Paul Bleakley University of New England Abstract The trial of American college student Amanda Knox for the murder of her British housemate Meredith Kercher divided the international tabloid media, with the portrayal of the accused running the spectrum from wide-eyed ingénue to sex-crazed murderer. The inconsistent editorial approach towards the Knox trial could be seen as an expression of tabloid parochialism, with the public effectively forcing the national media of their homeland to “choose sides” between victim and accused killer. This prompted the American media to portray Amanda Knox as unfairly maligned and persecuted, whilst their counterparts in the British press seized on the scandalous aspects of the case to depict her as the femme fatale killer of one of its own citizens. An analytical evaluation of the ethnocentrism that contributed to the dual narratives surrounding Amanda Knox can illuminate the parochial nature of tabloid journalism and the influence it has on a subjective editorial agenda.
