CHAPTER 85.

An Act to continue certain Turnpike Acts in Great Britain, A.U. 1872, to repeal certain other Turnpike Acts, and to make further provisions concerning Turnpike . [10th August 1872.]

WHEREAS it is expedient to continue for limited times some of the Acts herein-after specified, and to repeal others, and to make further provisions concerning turnpike roads : Be it enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows :

The Acts specified in the first schedule annexed hereto shall Schedule 1. be repealed on and after the first day of November one thousand eight hundred and seventy-two.

2. The Acts specified in the second schedule annexed hereto Schedule 2. shall be repealed on and after the first day of January one thousand eight hundred and seventy-three.

3. The Acts specified in the third and fourth schedules annexed Schedules 3 4. hereto shall expire at the times in that behalf mentioned in "The and Annual Turnpike Acts Continuance Act, 1871."

4. The Acts specified in the fifth schedule annexed hereto shall Schedule 5. continue in force until the thirty-first day of December one thousand eight hundred and seventy-two, and no longer.

5. The Act specified in the sixth schedule annexed hereto shall. Schedule 6. ,.,continue in force until the thirty-first' day of January one thousand eight hundred and seventy-three, and no longer. seventh schedule annexed 6. The Act specified in the hereto Schedule 7. shall continue in force until the first day of May one thousand eight hundred and seventy-three, and no longer. A.D. 1872. 7. The Acts specified in the eighth schedule annexed hereto shall force until the dates specified in each instance, and no Schedule 8. continue in longer.

Schedule 9. 8. The Acts specified in the first and second columns of the ninth schedule annexed hereto shall, to the extent specified in the third column thereof, as from the dates specified in the fourth column thereof, be subject to the modifications specified in the fifth column thereof, and shall, to the same extent, as so modified, continue in force until the dates specified in the sixth column thereof, and no longer. Where specified in the seventh column thereof the arrears of interest due on the thirty-first day of December one thousand eight hundred and seventy-one, and remaining unpaid at the time of the passing of this Act, in respect of the roads subject to the trusts comprised in so much of the Acts as is specified in the third column thereof, are hereby extinguished. Schedule 10. 9. The Act specified in the first and second columns of the tenth schedule annexed hereto shall, to the extent specified in the third column thereof, as from the date specified in the fourth column thereof, be subject to the modification specified in the fifth column thereof, and shall, to the same extent, as so modified, continue in force until the time specified in the sixth column thereof, and no longer, unless,. Parliament in the meantime otherwise provides. Schedule 11, 10. The Acts specified in the eleventh schedule annexed hereto shall continue in force until the first day of November one thousand eight hundred and seventy-three, and no longer, unless Parliament in the meantime otherwise provides. Continuance 11. Such provisions, if any, of the said Acts mentioned in. the of all other said schedules as are not affected by the preceding sections, and Turnpike Acts. all other Acts now in force for regulating, making, amending, or repairing any turnpike in Great Britain which will expire at or before the end of the next session of Parliament, shall con- tinue in force until the first day of November one thousand eight hundred and seventy-three, and to the end of the then next ses- sion of Parliament, unless Parliament in the meantime otherwise provides. Certain 12. Whereas the Annual Turnpike Acts Continuance Act, 1871, provisions or repealed the Act passed in the first and second years of Her present 1&2Viet. " c. lxxviii. Majesty, chapter seventy-eight, intituled An Act for amending an revived. " Act of King George the Third for draining lands in South Holland, " and for repairing and maintaining the road from Spalding High " Bridge to Brother House, all in the county of Lincoln,"'and 2 [35 & 36 VIcT.] Turnpile Acts Continuance, c. [Cn. 85.1 herein-after called the Spalding Act : And whereas sections fourteen A.D. 1872. to twenty-six, inclusive, of the Spalding Act relate to other matters than the repairing and maintaining the said road from Spalding High Bridge to Brother House : Be it enacted, that the said repeal shall not extend to the said sections, and that the said sections shall be and shall be deemed to have been in force as if the Annual. Turnpike Acts Continuance Act, 1871, had not been passed.

13. Such of the provisions of the Railways Clauses Consolidation Provisions Act, 1845, with respect to the crossing of roads and other inter- in Railways Clauses Con- ference,therewith as relate to turnpike roads shall continue in force solidation in relation to any road which, having been a turnpike road, may Act, 1845, relating to at any time after the passing of this Act become an ordinary turnpike highway, in the same manner as if such road had continued to be a roads to con- tinue to turnpike road; and in the construction of the said provisions, when apply to such applied to any such road as aforesaid, if the road is within the roads on their becom- jurisdiction of a highway board, such highway board shall be ing ordinary deemed to be the trustees or commissioners thereof ; and in other highways. 8 & 9 Viet. cases the surveyor or other local authority having the care of the c. 20. ss. 46- road shall be deemed to be such trustees or commissioners. 67. 14. For the purpose of facilitating the abolition of tolls on any Power to a highway district, the highway turnpike road within or passing through boards to highway board and the trustees of the turnpike road may mutually pay off debts on turnpikes. agree that the highway board shall take upon themselves the maintenance and repair of such turnpike road, or so much thereof as is within their district, and thereupon the highway board shall pay off and discharge, where the turnpike is wholly within the highway district, the debt that may remain and be subsisting on the trusts of such turnpike road, or such sum by way of composi- tion, but in full discharge of such debt, as the Local Government Board may after inquiry determine ; and where the turnpike is not wholly within such district, such sum as the Local Government A 2 3 [Cx. 85.] Turnpike Acts Continuance, -c. A.D. 1872. Board may in like manner determine as an equitable proportion of such debt or composition for the same. The abolition of such tolls shall be deemed to be an improvement of highways within the meaning of sections forty-seven, forty-eight, and fifty of GG The Highway Act, 1864," and for such purpose the highway board may borrow money in accordance with the pro- visions of those sections, subject to the following provisions, viz. : That the. improvement shall be deemed to be on behalf of all the parishes within the district, and each parish shall contribute thereto in the same proportion as it contributes to the district fund. Short title. 16. This Act may be cited for all purposes as "The Annual Turnpike Acts Continuance Act, 1872."
