House Bills 3206 and 3544, 81st Legislature, 2009, amended Tax Code (TTC), Section 11.31 to require the Texas Commission on Environmental Quality (TCEQ) to form a permanent advisory committee that will make recommendations to the TCEQ commissioners regarding the use of pollution control property on matters relating to property tax exemptions. TTC, Section 11.31(n) requires the advisory committee to have representatives from industry, appraisal districts, taxing units, environmental groups, and members who are not representatives of any of the aforementioned entities but have substantial technical expertise in pollution control technology and environmental engineering. House Bill 2280, 82nd Legislature, 2011, amended TTC, Section 11.31(n) to require that at least one member of the advisory committee be a representative of a school district or junior college district in which property is located that is or previously was subject to an exemption under this section. This proposal is for the following positions: three representatives from industry, two representatives from appraisal districts, one representative from taxing units, and one independent technical expert. The Tax Relief for Pollution Control Property program solicited nominations for the Tax Relief for Pollution Control Property Advisory Committee. Seven positions were available because seven of the 13 members have terms expiring in December 2017.

Nine nominations were received. Six members with terms expiring in December 2017 applied for reappointment. It is recommended that all of the six current members who were nominated remain on the committee and be reappointed to serve a four-year term. Those members are Bob Adair, Charles Allred, Roland Bieber, Michael Ford, C. Wayne Frazell, and Timothy Jones. One member whose term is expiring in December 2017, Bennett Sandlin, is not seeking reappointment. Mr. Sandlin was previously nominated by The Texas Municipal League to represent taxing units. The Texas Municipal League nominated Bill Longley for the position currently held by Mr. Sandlin and it is recommended that Mr. Longley be appointed to the committee. Mr. Longley serves as legislative counsel for the Texas Municipal League and is knowledgeable on a variety of topics including economic development, municipal taxes, and revenue sources.

A RESOLUTION Consideration of the Nomination and Appointment of Seven Members to the Tax Relief for Pollution Control Property Advisory Committee. Docket No. 2017-1483-MIS

WHEREAS, Section 5.107 of the Texas Water Code provides the Texas Commission on Environmental Quality (Commission) with the authority to create and consult with advisory committees; and

WHEREAS, Section 5.7 of 30 Texas Administrative Code states that all members of advisory committees are appointed by and serve at the pleasure of the Commission; and

WHEREAS, in accordance with Texas Tax Code Section 11.31(n), the Tax Relief for Pollution Control Property Advisory Committee (the Advisory Committee) is composed of: six representatives from industry; two representatives from appraisal districts; two representatives from taxing units; one representative from an environmental group; one representative who is not a member of any of the aforementioned groups, but has substantial expertise in pollution control technology and environmental engineering; and a representative of a school district or junior college district in which property is located that is or previously was subject to an exemption under Section 11.31 of the Texas Tax Code;

WHEREAS, on December 13, 2017, the Commission discussed in an open meeting the appointment of seven members to the Advisory Committee to serve four-year terms;

WHEREAS, the terms of the following seven members of the Advisory Committee expire on December 31, 2017:  Bob Adair, representing industry;  Roland Bieber, representing appraisal districts;  Timothy Jones, representing industry;  C.
