HIGHWAYS ACT 1980 AND THE ACQUISITION OF LAND ACT 1981

THE A46 TRUNK ROAD ( JUNCTIONS UPGRADE (BINLEY)) COMPULSORY PURCHASE ORDER 2019

Highways England Company Limited (in this Order called “the acquiring authority”) makes the following Order: 1. Subject to the provisions of this order, the acquiring authority is under sections 239, 240, 241, 242, 246 and 250 of the Highways Act 1980 hereby authorised to purchase compulsorily the land, in the City of Coventry, and in the Parish of in the of Rugby in the County of , described in paragraph 2 for the purposes of: – (a) the improvement of the A46 Coventry Eastern Bypass Trunk Road between Oaktree Road and B4428 Road; (b) the construction of new trunk roads to connect to the above mentioned highway with the existing A46/A428 detrunked roundabout at Binley Woods, Coventry;

(c) the improvement of existing highways in the vicinity of the route of the above mentioned highway in pursuance of THE A46 TRUNK ROAD (COVENTRY JUNCTIONS UPGRADE (BINLEY)) (SIDE ROADS) ORDER 2019;

(d) the use of land in connection with the construction or improvement of highways or with the carrying out of works authorised under the THE A46 TRUNK ROAD (COVENTRY JUNCTIONS UPGRADE (BINLEY)) (TRUNKING) ORDER 201[] and THE A46 TRUNK ROAD (COVENTRY JUNCTIONS UPGRADE (BINLEY)) (SIDE ROADS) ORDER 2019; and (e) mitigating the adverse effects which the existence or use of the highways proposed to be constructed or improved will have on the surroundings thereof.

2. The land authorised to be purchased compulsorily under this Order is the land described in the Schedule and delineated and shown coloured pink on a map, prepared in duplicate, signed on behalf of, and carrying the common seal of, Highways England Company Limited and marked “Map referred to in THE A46 TRUNK ROAD (COVENTRY JUNCTIONS UPGRADE (BINLEY)) COMPULSORY PURCHASE ORDER 2019”.

3. The new rights to be purchased compulsorily over land under this order are described in the Schedule and the land is shown blue on the said map.

4. Parts 2 and 3 of Schedule 2 to the Acquisition of Land Act 1981 are hereby incorporated in this Order subject to the modification that references in the said Parts of the said Schedule to the undertaking shall be construed as references to the land authorised to be purchased or, as the case may be, to the land over which rights are authorised to be purchased and any buildings or works to be constructed thereon.
