Board of Regents Meeting April 17, 2012 Item #1 EXECUTIVE SUMMARY Page 1 of 5 ApoItem Name: Multiple-Year Employment Contract for Head Men’s Basketball Coach (NAU) Action Item Discussion Item Information Item Issue: The Board will be asked to approve the terms of, and authorize NAU to enter into a Five-Year Employment Contract for Jack Murphy to serve as the Head Men’s Basketball Coach from April 17, 2012, through June 30, 2017. Background Subject to Arizona Board of Regents approval and authorization, Jack Murphy (“Coach Murphy”) has agreed to accept employment as the Head Men’s Basketball Coach for Northern Arizona University. Coach Murphy joined the coaching staff at the University of Memphis under men’s basketball coach Josh Pastner in 2009. During Coach Murphy’s tenure, Memphis earned NCAA tournament berths over the last two seasons. Prior to Memphis, Coach Murphy spent three years with the Denver Nuggets under the NBA’s active wins leader, George Karl. Coach Murphy began his career by spending eight years at his alma mater, the University of Arizona, working with legendary coach Lute Olson. In accordance with ABOR Policies 6-1001 through 6-1003, Northern Arizona University desires to enter into a Multiple-Year Employment Contract with Coach Murphy from April 17, 2012, through June 30, 2017, with an option for a two-year extension (after a 24-month review) at the discretion of the University President and Vice President for Intercollegiate Athletics. Coach Murphy’s proposed annual base salary is $180,000. It is intended that Coach Murphy’s compensation will be paid from revenue generated by the Intercollegiate Athletics Department and from general revenues. Statutory/Policy Requirements Pursuant to Arizona Board of Regents (ABOR) Policies 6-1001 through 6-1003, Board approval is required for multiple-year employment contracts. Discussion The period of appointment will be from April 17, 2012, through June 30, 2017. Coach Murphy’s proposed annual base salary is $180,000 per fiscal year. Coach Murphy’s annual salary may be increased on July 1 of each year by an amount determined by the President of NAU, in the President’s sole discretion, provided such increase does not exceed seven percent of Coach Murphy’s then-existing salary and further provided that such increase results in Coach Murphy’s adjusted base salary falling within the range established by the Board. Increases beyond those described in the preceding sentence would require board approval. Coach Murphy will be responsible for supervising, planning, and coordinating the activities of the Men’s Basketball Program. More specifically, Coach Murphy will: (a) Encourage academic progress, in conjunction with the faculty and University, of student-athletes toward graduation; (b) Teach the mechanics and techniques of men’s basketball to team members; (c) Coach student-athletes, analyze their performance, and instruct them in areas of deficiency; (d) Develop the men’s basketball team for competition, and oversee daily practice of student-athletes; (e) Promote the University, the Athletic Department, and the Program through the Sports Information Office, and through such other activities as assigned pursuant to Section (p); (f) Recruit student-athletes of high moral character who are qualified for participation, who are athletically talented, and who demonstrate both a high level of academic success and promise for continued success for the Program; (g) Cooperate with Student Affairs for the benefit of student-athletes; (h) Assist the Strength Coach in designing and maintaining a strength program; (i) Maintain responsibility for administrative duties pertaining to the Program; (j) Supervise the conduct of assistant coaches and staff and their activities, including but not limited to compliance with ABOR, University, Big Sky Conference (Conference), and National Collegiate Athletic Association (NCAA) policies and legislation, and provide annual evaluations thereof; (k) Maintain responsibility for the fiscal and budgetary functions associated with the Program; (l) Continue with professional development programs that will assist Coach Murphy in meeting the University’s strategic plan of providing a quality experience to student-athletes and that are acceptable to the VP for Intercollegiate Athletics; (m)Conduct and coach the Program in compliance with the Constitution and By- Laws of the Conference and the NCAA; (n) Uphold, comply with, and enforce the NAU Athletics Code of Conduct and Board of Regents Meeting April 17, 2012 Item #1 EXECUTIVE SUMMARY Page 3 of 5 the mission of the Athletics Department, with emphasis on sportsmanship and student-athletes’ and employees’ personal conduct at all times, and serve as a role model for all NAU student-athletes; (o) Comply with all applicable ABOR and University policies, rules and regulations; and (p) Perform other duties as Head Coach reasonably related to the improvement of the Program, as may be assigned by the VP for Intercollegiate Athletics or the President of the University. The University will grant Coach Murphy a license to operate a Men’s Basketball Camp using University facilities beginning with the Basketball Camp season which concludes in August 2012, and continuing through the Basketball Camp season which concludes in August 2017. The specific facilities and related services to be used, the fees to be paid by Coach Murphy to the University for such use, if any, and any additional relevant items will be identified in a separate Licensing Agreement to be executed by the parties. Annual Bonuses The maximum academic and athletic performance bonus per contract year will be $50,000. Academic Progress Rate/Grade Point Average Bonus Incentive compensation for achieving each of the following academic performance goals as follows: APR Rates (not cumulative) Greater than or equal to 950 = $4,000 Greater than or equal to 960 = $6,000 Greater than or equal to 970 = $8,000 GPA Rates (not cumulative) Greater than or equal to 3.10 = $4,000 Greater than or equal to 3.20 = $6,000 Greater than or equal to 3.30 = $8,000 Outstanding Athletic Achievement Incentive compensation for achieving athletic performance goals as follows (cumulative except for as noted for the NCAA National Championship and the Big Sky Regular Season or Tournament Championship): Board of Regents Meeting April 17, 2012 Item #1 EXECUTIVE SUMMARY Page 4 of 5 Big Sky Regular Season Championship or = $8,000 Big Sky Tournament Championship = $8,000 NCAA Tournament Appearance = $8,000 Each win at NCAA Tournament (not including a Nat’l Champ.) = $4,000 NCAA National Championship = $50,000 NIT Appearance = $4,000 NIT National Championship = $8,000 Big Sky Coach of the Year = $5,000 National Coach of the Year = $16,000 Benefits Coach Murphy will receive customary employee-related benefits available to other University employees serving under the Conditions of Administrative Service, with contributions and benefit amounts based upon the base salary where relevant. In addition, Coach Murphy will receive: o Use of an automobile or a stipend; and o Complimentary tickets for personal use as follows: 8 per basketball game. If for any reason the contract has been suspended or been terminated this subsection is null and void. Miscellaneous Subject to the President’s and VP for Intercollegiate Athletics’ written approval, Coach Murphy may enter into agreements with other persons or entities to provide services not included within the contract for compensation as long as such services can be performed within the limits permitted by the Conference, NCAA, and state and federal law, except that Coach Murphy may not enter into agreements with the Northern Arizona University Foundation and Coach Murphy may not receive compensation from third parties for advertising, sponsorship, media speaking appearance, or fundraising services unless such compensation is expressly allowed by the terms of the contract. Coach Murphy must prepare annually a report of all outside sources of athletically related income and benefits which will be submitted to the VP for Intercollegiate Athletics and NAU President. The contract may be terminated by the NAU President for cause, in which case NAU will be liable only for salary and other compensation earned as of the termination date. If the contract is terminated by NAU for cause and the cause is Board of Regents Meeting April 17, 2012 Item #1 EXECUTIVE SUMMARY Page 5 of 5 one or more material or repeat violations of NCAA or Big Sky conference rules, at the President’s discretion Coach Murphy will pay to NAU its actual damages up to $50,000, and, Coach Murphy will forfeit and repay to the University any bonuses received for academic performance and/or athletic performance when those achievements are affected by any sanctions, whether self-imposed or imposed by the NCAA or Big Sky Conference. The contract may be terminated by the NAU President at any time without cause. In the event of such termination, the University will pay Coach Murphy one-half of the annual base salary for the remainder of the term of the contract, or for three years, whichever is less. Payments will be made for the first year at the time of termination and for each year thereafter on the anniversary date of the termination. Coach Murphy agrees not to seek or apply for other positions without prior written notice to the NAU Vice President for Intercollegiate Athletics and the NAU President. Coach Murphy may terminate the contract for any reason on written notice to the University. Termination by Coach Murphy prior to the completion of the contract may, at the discretion of the NAU President, obligate Coach Murphy to pay the University liquidated damages in the sum of one year’s base salary.
