A. Brief on the 13 Themes in School Education

1. Ensuring Learning Outcomes in Elementary Education

Several studies have shown that school children do not seem to acquire age appropriate skills in reading, writing and numeracy. There is a need to explore the various approaches to improve teaching–learning at the elementary stage. The objective of this theme is to understand the issues of low learning achievement levels in elementary schooling assess the system of Continuous and Comprehensive Evaluation and suggest ways and methods of improving the learning outcomes of school children which would result in enhancing the quality of elementary education.

2. Extending outreach of Secondary and Senior Secondary Education

With a dramatic growth in elementary education enrolments and improvements in retention and transition rates in recent years, particularly amongst the more disadvantaged groups, there is an increasing pressure on the secondary schools to admit more students. With the enforcement of RTE Act and further improvement in retention and transition rates, demand for secondary schooling will grow rapidly in the coming years. The objective of this discussion group is to assess to what extent we have made quality education available, accessible and affordable to the target population in the age group of 14–18 years. How we can increase access to post elementary education across the country in a manner so as to ensure no child is denied the opportunity of completing his/her school education. In particular, how can we address the geographical and social disparities in secondary education?

3. Strengthening of Vocational Education

There is a greater emphasis on integrating skills in education and a renewed focus on vocational education in secondary education. The National Vocational Education Qualification Framework (NVEQF) has been aligned with the National Skills Qualification Framework (NSQF). The objective of this group will be examine the issues of enhancing acceptance of vocational qualifications, difficulties in implementing VE , ensuring horizontal and vertical mobility, availability of teachers. Some States have been effectively integrating vocational education in mainstream education. How can these be adopted or adapted across other States?

4. Reforming School Examination Systems

Examination reforms that focus on problem-solving, critical thinking and reasoning skills are critical to improving quality at the secondary level. Such reforms will change the teaching– learning processes and improve learning outcomes. In recent years, CBSE has introduced wide-ranging examination reforms in schools affiliated to it, such as Class X Board Examination has been made optional, Continuous and Comprehensive Evaluation (CCE) has been strengthened so that the students, are assessed on an ongoing basis for their holistic development, a system of grading in place of marks has been introduced. The objectives are to look at the existing systems and suggest reforms which would help better assessment of students.

5. Revamping Teacher Education for Quality Teachers

Competence of teachers and their motivation is crucial for improving the quality. Several initiatives are being taken for addressing teacher shortages, shortages of secondary school teachers in mathematics, science and languages, improving the quality of pre-service teachers and in-service teachers professional development, enhancing the status of teaching as a profession, improving teachers’ motivation and their accountability for ensuring learning outcomes, and improving the quality of teacher educators. The objective of this theme is to assess the existing scenario and provide workable solutions to address the gamut of issues in teacher education in the school sector.

6. Accelerating rural literacy with special emphasis on Women, SCs, STs & Minorities through Adult Education and National Open Schooling Systems

Though there have been significant gains in literacy rates, large gender, social and regional disparities in literacy levels persist. The gains in literacy levels are due to success of the adult education programmes and improvements in primary schooling. However, there is a further need to enhance the literacy levels of the socially marginalized groups and those living in rural areas through interventions of adult education programmes and open schooling systems. This theme seeks to elicit views on how we achieve faster progress in reducing the existing disparities in literacy levels.

7. Promotion of Information and Communication Technology systems in school and adult education

ICT can potentially make significant difference in improving the quality of education. The National Policy of ICT in School Education envisions and provides for the development of a holistic framework of ICT support in the school system. While there have several ways in which ICT in schools are being implemented, we need to optimally use and leverage technology to achieve quality and efficiency in all of the interventions. Under this theme, we need to find solutions on how best technology can be leveraged for both school and adult education and share best practices, if any.

8. New Knowledge, pedagogies and approaches for teaching of Science, Maths and Technology in School Education to improve learning outcomes of Students.

Poor science and maths education (and English) accounts for 80 per cent of total students who fail in Tenth Board Examination. The low enrolment in science stream at higher secondary level and poor-quality education is a constraint in development of scientific manpower in the country. Science and Maths education would need special attention. We need to deliberate and find workable strategies for strengthening the quality of teaching– learning processes for better outcomes; innovations and diversity of approaches in matters of curricula, pedagogies and use of technology to improve the learning levels.

9. Schools standards, School assessment and School Management systems.

There is a need to put in place a School Quality Assessment and Accreditation System to cover all aspects of school functioning, including scholastic and co-scholastic domains, physical infrastructure, faculty management, school leadership, learning outcomes and

satisfaction of pupils and their parents/ guardians. Better governance structures in schools striking a balance between mandating and persuading, training of district and block-level education officers as well as head teachers for better management practices, on using data to better monitor and support school performance, and to mobilise community resources and efforts to improve school performance. What are the current experiences and how can they be bettered to achieve tangible results.

10. Enabling Inclusive Education – education of Girls, SCs, STs, Minorities and children with special needs.

The issue of social access and equity are far too complex. While the gaps in average enrolments between disadvantaged groups like SC, ST, Muslims, girls and Children with special needs and the general population have decreased, there is still a considerably large gap in learning levels with historically disadvantaged and economically weaker children having significantly lower learning outcomes. Large and growing learning gaps threaten the equity gains achieved on the enrolment front because children with lower levels of learning are more likely to drop out. We need to examine current interventions in bridging the gender and social gaps and identify focused strategies for effective inclusion.

11. Promotion of Languages.

A multi-lingual society recognizes the importance of education in languages. While there are some interventions for appointment of language teachers and promotion of classical languages, there is no comprehensive scheme or language policy and we need to have inputs on this dimension.

12. Comprehensive Education – Ethics, Physical Education, Arts & Crafts, Life Skills

Our students need to have a holistic development which cannot be achieved only through information and instruction. Knowledge needs sensitization to values, ethics, appreciating arts, physical education, sports and life skills. This theme invites views and suggestions for concrete methods and tools for integration of sports, physical education, arts and crafts, functional skills for livelihood and value education in school curriculum.

13. Focus on Child Health

There is a need to improve access to child health services. The Ministry of Health is focusing on promoting child health through appropriate interventions. Presently, the Department of School Education and Literacy, MHRD addresses the nutritional needs of school going children in the age group of 6-14 years through the Mid- Day Meal (MDM) Scheme. The Integrated Child Development Scheme (ICDS) under WCD also addresses the issues of child health. There is, however, a need to synergize the multi-sectoral interventions taken by the relevant GOI Ministries. The existing schemes need to be examined for their outcomes and impediments in implementation, including those of coordination. This theme seeks views and suggestions on how to ensure greater focus on child through improvements in existing schemes and suggest new holistic interventions.

B. Brief on the 20 Themes in Higher Education

1. Governance reforms for quality

This theme invites inputs of the various types of reform needed to create better governance structures in State Universities and Centrally Funded institutions that will help in improving their academic quality.

2. Ranking of institutions and accreditations

There has been a growing concern on the poor performance of our Universities in World Ranking and Global ratings. What changes could be suggested in the accreditation systems of our country so that our higher education institutions acquire better global rankings.

3. Improving the quality of regulation

Present regulatory systems tend to stymie the quality and growth of our institutions. What reforms are necessary in the existing regulatory agencies and their methods so as to give greater academic, administrative and financial autonomy to our institutions so as bring about quality enhancement?

4. Pace setting roles of central institutions

The Central institutions have been trendsetters and are usually seen as islands of excellence. How can CFI’s help to promote and spread academic excellence, undertake activities to improve the general quality of life in their neighbourhood region , do hand holding for other educational institutions and also help the school education in their areas

5. Improving State public universities

Nearly 94% of students enrolled are in the state educational institutions. Improving the quality of State Universities is extremely significant. What kind of reforms agenda need to be worked so as to address the quality deficit in State institutions.

6. Integrating skill development in higher education

India has a demographic advantage of the largest youth population in the world. Integrating skills within the higher education holds the key to reaping the demographic dividend. What steps and actions are needed to effectively achieve this harmonization of skills in HE.

7. Promoting Open and Distance Learning (ODL) and online courses

Conventional education alone cannot meet the needs and aspiration of higher education. What proactive policies and strategies need to be devised and developed to encourage online education and overcome any implementation issues which are currently hindering its optimization? Also how can we strengthen ODL systems so as to ensure their quality and gain greater acceptability?

8. Opportunities for technology enabled learning

This theme seeks to understand the complexities around having a robust framework for technology enabled education. Do we have the human and infrastructural facilities that can fully exploit the opportunities of TEL. To what extent do our institutions leverage the potential of ICT for improving access and quality of general and technical education and also faculty development.

9. Addressing regional disparity

Ensuring access to higher education is critical to mobilizing greater participation thereby increasing the Gross Enrolment Ratio. How can we address the issue of skewed access to higher education which will reduce existing regional disparities and why have existing schemes failed to resolve these gaps.

10. Bridging gender and social gaps

While the general participation rates in higher education has been steadily increasing and today our HE GER is 21.5%, this is not evenly spread across social groups and women. Equitable growth is essential to sustain higher GER rates and hence what kinds of affirmative action could be suggested to reduce gender and social disparities in HE.

11. Linking higher education to society

The role of institutions of higher education in societal development is becoming increasing significant. In recent years, higher education has isolated itself from the society and there is a need to re-establish and strengthen higher education’s close linkages with the society. How can Universities foster social responsibility and engage in community outreach programmes. Sharing some working examples would also be a useful input.

12. Developing the best teachers

Teachers are the cornerstone of any educational system. Developing the teaching talent and incentivizing best teachers, retaining good teachers are all significant to improving the quality of teaching. Views are elicited so that our higher education institutions can nurture good faculty who in turn can propel higher standards in our students.

13. Sustaining student support systems

Several schemes of students financial assistance are being implemented at Central and State levels. Have they really served the intended objectives? Some critical views are invited on the existing schemes and what changes will improve the quality of financial support systems for our students so that every aspiring learner can enter HE.

14. Promote cultural integration through language

How can inter-linkages between education, culture and language be brought about in HE institutions. Some concrete suggestions on how this can be effectively implemented need to be specified.

15. Meaningful partnership with the private sector

Higher education cannot sustain only through public funding. While public private partnerships in higher education have been pursued as a strategy, not many have shown successful results. Hence, the PPP models need to be revisited so as to allow more meaningful collaborations. A critical analysis of PPP in HE, the existing legal provisions and which viable models are possible needs to carried out.

16. Financing higher education

Roughly 1% of GDP is spent on higher education as against a target of 1.5%. In the recent years, the state share of expenditure on education has declined as compared to an increase in Central expenditure on education. How can we address the financial resource constraints in higher education?

17. Internationalization of higher education

Globalization has resulted in greater cross border higher education. However, there is a need for a better policy that encourages collaborations, student faculty mobility etc. What are the changes necessary to bring promote internationalization of HE.

18. Engagement with industry to link education to employability

Employability of our students is a matter of concern. At the other end of the spectrum is need for greater investment in research. Industry academia linkages are essential to meet both these ends. While we have various efforts in this direction, these have not fructified as expected. We need to find out how and what is needed for a more fruitful partnering.

19. Promoting research and innovation

The expenditure on R&D in India is only 0.80% of GDP which needs to be enhanced to 1.5%. What are the strategies needed to pursued for promoting research & innovation across all disciplines, promote inter-disciplinary research and make India become a favoured destination for R&D projects.

20. New Knowledge

We are living in a dynamic knowledge based society. Newer technologies and challenges are seeing the birth of new areas of study. Our higher education institutions must identify the new domains of knowledge in the global scenario and build up their capacities to meet this need. How can we retain our soft power in the global comity of nations?

Annex IC Nation-wide Consultation by the MHRD, GOI

A. Nation-wide Consultation by the MHRD, GOI

Between May 2015 and February 2016, the MHRD, GOI initiated a three-pronged consultation process, included online through www.MyGovt.in ; village/grassroots up to state and zonal levels; and national level thematic deliberations with the basic objective to ensure that an inclusive, participatory and holistic approach is undertaken while formulating the NEP. The data and information generated by the Misistry during its consolation process both at national and sub-national levels were extremely helpful to the Committee in drafting its report. In fact, the feedback gathered through consultation at various levels staring from Gram Panchayat to national levels helped the Committee to truly evolve the NEP.

The consultation process aimed at building a national consensus by capturing diverse views and suggestions on various development concerns in education on the basis of analysis of expert opinions, field experiences, empirical research, stakeholder feedback as well as lessons learned from best practices. To structure the consultation process, 33 thematic areas (13 themes on school education and 20 themes on higher education) were identified. Brief of these 33 thematic areas is accessible at: www.MyGov.in portal, and also given in Annex II.

An extensive, time-bound, participative, bottom-up consultative process across nearly 2.5 lakh Gram Panchayats; 6600 Blocks; 6000 Urban Local Bodies; 676 districts; and 36 States/Union Territories was carried out between May to October, 2015. Against themes relating to school education, 1,10,506 villages; 3249 Blocks; 724 ULBs; 339 districts; and 18 states; and in respect of themes relating to higher education, 2722 Blocks; 925 ULBs; 405 districts; and 17 states have uploaded their suggestions on https://survey.mygov.in as on 19th February 2016.

The consultation process was one of the agenda items in the meeting of the Central Advisory Board on Education (CABE) held on 19th August 2015. Views of all states and members of the CABE were invited on the consultation process and the themes. All States were also requested to undertake the consultation process and complete it within the defined timeframe and, if felt necessary, include additional themes.

Six zonal meetings were held by the Minister of Human Resource Development in Eastern, Central, North-Eastern, Western, Southern and Northern Zones covering all States and UTs during September-October 2015, which were attended by Education Ministers and officials of the respective States/UTs. Before each zonal meeting, the Minister of Human Resource Development interacted through video-conference with the states of the concerned zone. It included interaction with the state level officials of education departments, district level officials of a few districts (68 in total) and local elected representatives.

A separate meeting was held by the Minister of Human Resource Development with Government of India Ministries. Their suggestions were noted and they were also asked to send their suggestions. In all, suggestions from 15 GOI Ministries were received by the MHRD.

Apex level institutions and regulators, such as, UGC, AICTE, NCTE, AIU, NCERT, CBSE, IIAS, NLMA, NAAC, NUEPA, IGNOU, IITs, IIMs and Central Universities also held detailed 14

discussions on identified themes with state governments, renowned academicians, experts, practitioners, NGOs, civil society, student & teacher representative bodies, industry associations, and other key stakeholders.

Six online consultations with leading subject experts and field practitioners through the UN Solutions Exchange platform; online survey by CBSE with over 15000 responses; and youth survey and focus group discussions by Mahatma Gandhi Institute for Education for Peace and Sustainable Development; (an UNESCO Category-I Institute in the Asia-Pacific region) were conducted as part of the public engagement. In addition, several organizations and individuals sent in their views, suggestions, and inputs through post and email which have been collated.

Besides, efforts were made to create awareness around this massive consultation process by ensuring that all stakeholders were made aware of the process of the formulation of the New Education Policy. These included: (a) the he Hon’ble Minister of HRD writing to all Chief Ministers, State Education Ministers, Lok Sabha and Rajya Sabha MPs inviting their views and suggestions; (b) television and radio campaigns in multiple languages to create citizen awareness; and (c) launching a dedicated website for the NEP as a one stop portal for all information related to the consultations.

“SHIKSHA Initiative” is a unique replicable and scalable program designed to enhance the education standard in primary education (Grade 1 and 2) with high-quality consistent content based on State Board syllabus and a technology-based mode of dissemination to instill learning retention among children. (Details in Annexure 1)

Basic Concept

The Foundation of the Shiksha Initiative rests on three distinct pillars: 1. Teaching 2. Assessment 3. Querying

Goal

At Shiksha, the goals have been set very high. Not only does the program aim to eradicate illiteracy but it is also designed to address the quality of Indian education and student learning.

Shiksha aims to achieve its goal by addressing the following areas:

1. Literacy – enhance the ability of students to read and write

2. Numeracy – Improve the ability to do basic mathematics and its functions

3. Learning – Improve the ability to implement academics to day-to-day life and have an open mind towards learning

The critical metric of the Shiksha Initiative is to ensure that 90% of the students (Grade 1 and 2) under the program retain 90% of the content taught in the classrooms.

How we do it

We have created a method of delivering the content of the UP board curriculum textbooks by creating a Hindi animated version of it. We conduct special animation- based Shiksha classes in the rural classrooms with portable power backup. (Details in Annexure 3)

Currently SHIKSHA is working in 340 schools across 254 villages in Hathras, Hardoi, Mirzapur, Bulandshahr and Gautam Budh Nagar districts in UP. There are about 15000 students of Grade 1 and 2.

Results:

1. Increased enrolment in schools: 15 students to 50 students in some schools. Avg. increase of 40% in enrolment

2. Boost in attendance percentage: Avg. attendance increased from 30% to 80% in govt. schools and went above 90% in Pvt. schools

3. Increased education standards in grade 1 and 2

– Students are now able to write in grade 1: This is not normally demonstrated by students of even grade 3 in regular classrooms but SHIKSHA students started writing numbers in grade 1 itself

4. Confidence level increased in students: We found that with SHIKSHA Classrooms when a strangers walks in the classroom, the students are more confident to interact as compared to regular students with conventional education system

5. Motivated teachers / students: We found that when students demonstrated better results and motivation, motivation levels and interest of teachers also improved regards teaching (which used to be quite low initially)

6. Development of “learning to learn” among students: this is the most important development for the students. We have noticed that students have become more curious in nature. Which will bode well in their senior grades.

7. In Pre-test, students score on an avg 30-40% marks, however after the ICT intervention about 70% of students rise above the 90% score, even before Augmentation

Shiksha attempts to augment the existing educational challenges by introducing animation-based learning and periodic assessments, making the process of learning more interactive, fun and effective.

Annexure 2.

• Teaching – The entire curriculum of the U.P. board primary syllabus is converted into an interactive animated learning exercise. High-quality streamlined content is delivered to students through a basic and simple technology platform, learning aids and interactive sessions. Teaching sessions are conducted by the local teachers who are trained to use the technology. This is a simple technology and any teacher is capable of using this after basic training.

• Assessment – Querying and assessment is the second step of the process wherein the learning imparted to the students in the teaching phase is tested for evaluation. Querying helps understand the effectiveness of the learning process utilized and its effect on student understanding. The Assessment is conducted through in-class and after-class questions and answer sessions.

• Augmentation – The students who are found to be lagging behind in the assessment sessions are selected for special classes imparting deeper learning. These learning sessions are conducted by either the same teachers or by identified ‘guru teachers’ through live distance intervention (this technology is yet to be developed). These sessions provide better and detailed explanation of the same subject/content to the students for their learning and retention based on specialized reports generated for the Guru by the assessment process.

Annexure 3:

Apart from changing the process of teaching, Shiksha has also been working to change the process of evaluation. The entire system of Shiksha is based on continuous and comprehensive evaluation. The students are periodically assessed through workbooks, performance managements, and online evaluation. This process of continuous appraisals helps the teachers and the Shiksha Mitras in understanding the areas of weakness of the students and working towards correcting them. *** 3. Teachers and Teacher Education -- Views of Azim Premji Foundation (refered to in Chapter 6)

This is based on the Foundation’s on-the-ground work with teachers and the public education system for the past 15 years, which has involved engagement with lakhs of teachers in states across the country. The Foundation also runs the Azim Premji University which focusses on developing professionals and knowledge in education.

2. The teacher is central to good education - at its core, education is the process between the teacher and the student. If education has to improve, teaching has to improve and we have to empower the teacher - there is no way around this.

3. Teacher education needs a revolution - a full scale, grounds-up redesigning of the regulations, system, culture, structures and operations.

4. Pre-Service teacher education needs a complete grounds-up overhaul

a. There should be only one way to become a teacher - four-year professional preparation program post Class 12 within a multi- disciplinary University/College.

b. We must have the courage to close the majority of current (commercially driven) colleges and set up new ones with honest intent and expertise.

2. In-Service professional development of the existing 8 million teachers needs a new design

a. Unless the capacity of the existing teacher pool improves - education will not improve for decades - even if everything else is miraculously perfected overnight.

b. Teachers must have the opportunity to choose from multiple modes of learning e.g. workshops, reading, discussions, exposure visits, in- class support.

c. Teacher learning communities must be created, developed and sustained. This needs facilitation with great academic and social expertise, a culture of self and peer learning must develop, with not even a whiff of ‘command and control.’

d. A cohesive team of 40-70 teacher educators must be developed in every district dedicated to this effort. This team could be within the state system or in collaboration with competent civil society organizations.

e. Teacher support/development must be a key part of the role of the school leader

f. Make teachers allies in this effort - teachers must be owners of this change. For this to happen teachers will have to be trusted, and the energy and capacity of the more motivated teachers will have to be harnessed to lead this change.

g. There must be no centralized determination of the curriculum, no cascade-model training and no rigid norms. This requires deep cultural changes.

3. We must ensure equivalence in service conditions (e.g. salary, promotions) for teachers across stages of education (e.g. primary and 114

secondary). This would help develop specialist teachers for critical stages (e.g. early childhood) and important subjects (e.g. arts).

4. A full complement of teachers for every subject must be available in every school.

5. 15 years of experience of working with lakhs of teachers (in government schools), unequivocally reaffirms that teachers can be trusted - there is a very large proportion of dedicated teachers and an even larger proportion of those who will work with dedication if they are trusted and supported. The minority of disengaged teachers must not become the image that informs our views of teachers - this is a deeply corrosive dynamic and must be stopped. Our societal view of the teacher and her expertise must be transformed.

6. A sound public education system is fundamental to democracy – we must visibly commit to it and improve it, with broad societal aims of education and not narrowly economic

*** 4. Legal Opinion – Political and other Distractions in the Campus (Refered to in Chapter 5)

The opinion of Shri K.N. Bhat is reproduced below.

In short, it is possible to achieve your objects through law.

1. In the matter of forming and functioning of associations, three provisions of the Constitution are directly involved and they are, Article 19(1)(c) - freedom to form associations, Article 19(1)(b) – freedom to assemble peacefully and without arms, and Article 19(1)(a) – freedom of speech and expression. This is because associations are formed for meeting peacefully and to express views freely there at. These freedoms are however, not absolute, as is well established by innumerable binding precedents. The three freedoms mentioned above are also subject to reasonable restrictions. So much so in the matter of Article 19(1)(c), the State may make any law imposing reasonable restrictions ‘in the interest of’ among other things, ‘public order, or morality’. Similarly, in respect of freedom under Article 19(1)(b), the State may make law imposing reasonable restrictions in the interest of public order. Likewise, a law may restrict the freedom of speech, among others, in the interest of public order, decency or morality. The relevant enabling Constitutional provisions and emphasized expressions have been judicially defined and explained many times.

3. Views expressed by the Court are as under:

(a) Only a law made by a legislature can impose the restriction; (b) The restrictions must be reasonable ( as it appears to courts eventually); and

(c) They must be in the interest of public order (or decency or morality as the case may be). “Public Order” is common to restrictions on all three freedoms.

The Supreme Court in the case of Dr. Ramesh Yeshwant Prabhoo vs Shri Prabhakar Kashinath Kunte, (1996) 1 SCC 130, speaking through Justice J.S. Verma, as he then was, held :

“27. It is true, as argued by Shri Jethmalani, that the freedom of speech and expression guaranteed to all citizens under Article 19(1)(a) is absolute subject to the reasonable restrictions imposed by any law saved by clause (2) of Article 19, under one of the heads specified therein. The heads specified in clause (2) of Article 19 are, therefore, several and they are intended to cover the entire area within which the absolute freedom to say anything which the speaker may alike would not extend, in keeping with the standards of a civilized society, the corresponding rights in others in an orderly society, and the constitutional scheme.

28. The expression " In the interests of" used in clause (2) of Article 19 indicates a wide amplitude of the permissible law which can be enacted to provide for reasonable restrictions on the exercise of this right under one of the heads specified therein, in conformity with the constitutional scheme. Two of the heads mentioned are : decency or morality. Thus any law which imposes reasonable restrictions on the exercise of this right in the interests of decency or morality is also saved by clause (2) of Article 19. Shri Jethmalani contended that the words ‘decency or morality’ relate to sexual morality alone. In view of the expression "in the interests of" and the context of election campaign for a free and fair poll, the right to contest the election being statutory and subject to the provisions of the statute, the words ‘decency or morality’ do not require a narrow or pedantic meaning to be given to these words. The dictionary meaning of ‘decency’ is "correct and tasteful standards of behaviour as generally accepted; conformity with current standards of behaviour or propriety; avoidance of obscenity; and the requirements of correct behaviour" (The Oxford Encyclopedic English Dictionary); "conformity to the prevailing standards of propriety, morality, modesty, etc.: and the quality of being decent" (Collins English Dictionary).

29. Thus, the ordinary dictionary meaning of ‘decency’ indicates that the action must be in conformity with the current standards of behaviour or propriety, etc. In a secular polity, the requirement of correct behaviour or propriety is that an appeal for votes should not be made on the ground of the candidate’s religion which by itself is no index of the suitability of a candidate for membership of the House. In Knuller (Publishing, Printing and Promotions) Ltd. and Others Vs. Director of Public Prosecutions, 1972 (2) All ER 898, the meaning of ‘indecency’ was indicated as under: ": (All ER. P.905)

“....Indecency is not confined to sexual indecency; indeed it is difficult to find any limit short of saying that it includes anything which an ordinary decent man or woman would find to be shocking, disgusting and revolting...."

Thus, seeking votes at an election on the ground of the candidate’s religion in a secular State, is against the norms of decency and propriety of the society.”

The expression ’morality’ may be interpreted similarly.

The Supreme Court has interpreted the phrase, ‘in the interest of public order’ on innumerable occasions- any restriction to prevent public disorder will pass muster.

4. It is a matter of experience that associations affiliated to political parties or those formed on the basis of castes, community and the like have often resulted in formation of groups and fights among them –leading to public disorder in the campuses. Accordingly any law, which imposes reasonable restrictions on the activities of these associations, will be constitutionally valid.

Prohibiting such activities only within the campuses – or within a reasonable radius there of – will be considered as reasonable.

5. As of today, every State has more than one statute governing University education. The subject of education is presently under the concurrent list. (Entry 25 – List III of Schedule 7). Accordingly, Parliament has the power to legislate on this subject. Any law made by Parliament will prevail over the conflicting provisions of other University Acts. Since, it is a cumbersome process to introduce suitable provision in the innumerable Acts in force dealing with Universities in India, I advise enactment by Parliament a short umbrella Act with all India application. A suggested model is given as Annexure-I. Under this Act, the prohibition will be against the conduct of any activity of the associations affiliated to or based on political ideologies, caste, religion etc within the campuses or within a reasonable radius thereof.

It must be remembered that Article 15 embodies one of the main principles of Secularism. It clearly injuncts against any discrimination being made on the basis of religion, race, caste, sex, place of birth or any of them. Any step taken for promoting this idea will certainly not be frowned upon.

Rules may be made consistent with the provisions of the Act to fill up the gaps and to meet the peculiar needs of a particular State.

Annexure-I

1. Short title – This Act may be called……………..

2. It shall come into force on such day or days, as the Central Government may by Notification/s specify and different dates may be fixed for bringing the notified provisions into force in different States.

3. Definitions – In this Act, unless the context otherwise requires –

(i) Universities shall mean those established under any law and shall include deemed universities.

(ii) Campuses shall mean and include all institutions intended for imparting all types of education and affiliated to any university or deemed university.

4. Section 4 – Every State Government, including the Governments of the Union Territories, may by notifications published in the official gazettes, impose reasonable restrictions on the functioning of any association or body of persons by whatever name called within the campuses or within such distance from the boundary of the campus, as specified in the Notification, including from making speeches, distributing pamphlets and such other activities, as may be specified by notifications issued from time to time.

5. Punishment for violation – Any person violating the provisions of Section 3 or any notification issued under it will be liable to be punished for one of the penalties / punishments set out in Schedule-1 hereto, which may include suspension or expulsion from the College or institution or debar the person found guilty as decided by the head of the college or institution concerned, by water title called.

Provided that no punishment may be awarded except after an enquiry held in accordance with the procedure prescribed by the Rules.

6. Rule making power – Every State Government may make Rules consistent with the provisions of this Act for more fully implementing the same. The Rules and amendments there to shall be published in the official gazette before they are to be effective.

Provided that the Rules so made shall be placed before the Legislative Assembly of the State concerned.

The use of ICT has already taken place in some places and the immense potential of this tool can be seen through the example of the Department of Education under the Government of NCT of Delhi. The Department employs more than 50,000 teachers and staff. The compilation of data and effective monitoring has been done through ICT since 2005. The maintenance of data on all schools, 50,000 employees and 17 lakh students is done only through an in-hose developed Del E platform. The web based modules and applications have been in use for long and serving a range of needs including the following: 1. Personal modules. The particulars of all employees are maintained covering 43 different parameters which include fresh appointments, postings, departmental promotions, online transfers, grant of MACP and ACP and filling ACRs online.

2. Online attendance Module. Under this module all the employees are assigned a unique ID. Number and attendance of all Principals, teachers and staff is maintained everyday online. Based on the reports interventions are made including deployment of school inspection teams.

3. Finance and pay roll Module. The allocation and re-allocation of funds as well as payment of all salaries through ECS is undertaken through this module.

4. Online Admission Module. Children from the primary schools under MCD are admitted into Delhi Government schools called “parent schools” from the 6th Class.The entire admission process is managed online. Transfer of the students from one school to another is also done online. Even the school leaving certificates are generated online and the manual maintenance of such information is not allowed. Recently the entire admission of children under the EWS category (25 % reservation in Private Un- Aided Schools) was done centrally through an online Registration system followed by a common Lottery system. 5. All recruitments made by the Department, whether contractual or of guest teachers or of regular teachers is always done by following an online recruitment process. 6. Other modules maintain data on the progress of inspections, court cases, vigilance cases, library management and also completion of the Annual Performance Assessment Reports, the running of the Vidyathi Kalyan Samiti scheme, records of estates and the management of school infrastructure. 7. A robust MIS system having its own web servers maintains the modules alongwith regular updation of UDISE data for all indicators for all categories of schools in Delhi. 8. The implementation of centrally sponsored schemes like Sarva Siksha Abhiyan, RMSA, Mid-day Meal Scheme, Swacch Bharat Abhiyan are done through IT applications developed in-house. 9. The website is interactive and information and office circulars/ orders are disseminated on line. By providing unique ID and passwords to each employee restricted access is provided covering specific departmental information. 10. IT has been taught as a subject at the Sr. Sec level for many years in Delhi. In 2015-16 through a central scheme called ICT@Schools, all 1177 Govt. and Govt. Aided Schools have been provided computer Labs for IT education starting from class 6th. The Department is in the process of adding features like SMS (pull and push) and establishing CCTV Cameras in schools for better monitoring of teachers’ and students’ attendance and CCTV based assessments for improving learning by all children. ***

6. Ekal Vidyalayas

An unique innovation that prepares needy children for schooling, initiated in 1989, now stands extended to 53,000 villages and 15 Lakh children spread all over the country. Funded through voluntary voluntary contributions, these single teacher schools prepare and support children to join regular schools, thus contributing effectively in implementation of RTE Act and enhancing learner attainments. Ekal, in many villages, has also helped students of higher classes from formal schools to provide them with support education. Interestingly third party surveys by Tata Dhan Academy alongwith IIM Bengaluru and Aspiring Minds have found that the drop-out rate in formal schools from higher classes have come down considerably among the students from villages where Ekal operates

The uniqueness of Ekal is that while many organizations have been active in the education field in urban India, there isn’t another voluntary effort on the scale that Ekal operates to educate children in the villages of India. And the primary reason was to find teachers in remote villages where people from urban distances just do not want to go. Local youth are selected and with extensive training they do this work with such dedication. Being local, the children and the parents are so comfortable with a teacher from among their own.
