O P I N I O N

This matter comes before the Court on Penn Estates Property Owners

Association, Inc.’s (hereinafter “Plaintiff’s”) Motion for Judgment on the Pleadings. The underlying issues in this matter began with the case docketed at 1297 CV 2009. Howard Pooler and Lisa Rosenberger, a/k/a Lisa Pooler (hereinafter “Defendants”) are the owners of property known as Lot 89, Section G1 in the Penn Estates development in Monroe County. According to a series of Protective Covenants, Reservations and Restrictions in Defendants’ deed, Plaintiff organization is responsible for maintaining and administrating common areas and services in the

Penn Estates Development. In return for its services, the Plaintiff may collect dues and assessments from property owners. On February 12, 2009, Plaintiff filed a Complaint seeking MONROE LEGAL REPORTER 13 unpaid dues, citations, attorney’s fees and costs from the years 2005-2008. Defendants did not answer the Complaint and Default Judgment was entered in the matter in the amount of

$5,678.82 plus interest and costs on April 3, 2009.

On January 5, 2017, Plaintiff filed a nearly identical Complaint against

Defendants seeking to recover unpaid fees and assessments for the years 2010-2016. This action was docketed at 83 CV 2017. Defendants failed to file an Answer in this matter and Default

Judgment was entered on February 22, 2017, in the amount of $22,724.74 plus interest and costs.

On March 1, 2017, Plaintiff filed a Praecipe for Single Consolidated Writ of

Revival Pursuant to Pa. R.C.P. 3025.1, to consolidate both judgments and revive the earlier one.

On April 17, 2017, Defendants filed an Answer and Objections to the Consolidated Writ of

Revival and Motion to Strike. On April 25, 2017, Plaintiff filed the present Motion for Judgment on the Pleadings. Oral argument was not requested and this matter was decided upon the briefs of the parties.

Discussion

Under Pa. R.C.P. 1034, any party may move for a Judgment on the Pleadings after the pleadings have closed. Pa.R.C.P. No. 1034. A Judgment on the Pleadings is very similar to a demurrer in that it is only appropriate when “there are no disputed facts and the moving party is entitled to judgment as a matter of law.” Sw. Energy Prod. Co. v. Forest Res., LLC, 2013

PA Super 307, 83 A.3d 177, 185 (2013). “A trial court must confine its consideration to the pleadings and relevant documents. The court must accept as true all well pleaded statements of fact, admissions, and any documents properly attached to the pleadings presented by the party against whom the motion is filed, considering only those facts which were specifically

admitted.” Coleman v. Duane Morris, LLP, 2012 PA Super 281, 58 A.3d 833, 836 (2012).

Essentially, a judgment on the pleadings is only appropriate when the moving party’s case is so

strong that a trial would be fruitless. Sw. Energy Prod. Co. v. Forest Res., LLC at 185.

Plaintiff argues that a Judgment on the Pleadings is appropriate at this time

because Defendants’ Answer has failed to allege any factual or legal matters still at issue. As a

preliminary matter, Defendants allege to have not been personally served the Consolidated Writ

of Revival as required under Pa. R.C.P. 3028. A creditor who holds two or more judgments

against the same person in the same county may consolidate these judgments by filing a single

praecipe requesting the issuance of a single consolidated writ of revival. Pa. R.C.P. 3025.1(a)(1).

Service of a Writ is required to be made within ninety days of its issuance by the Sheriff handing

a copy to the responding party. Pa. R.C.P. 3028(a). The record shows that the Writ in this matter

was filed on March 1, 2017. The docket also reflects that less than ninety days later, on March

28, 2017, the Monroe County Sheriff’s Department personally served both Defendants by

handing them copies of the Writ. The Sheriff’s Service Affidavit of Return notes that both

Defendants were served at approximately the same time while at 134 Locust Drive, East

Stroudsburg, PA. Therefore, we do not find any merit in Defendants’ argument that the Writ of

Revival or Judgment on the Pleadings is inappropriate due to improper service.

Next, Plaintiff argues that Defendants’ assertion that the 2009 default judgment

cannot be revived as it is more than five years old is unsupported by law. In Defendants’ Answer

to the Writ of Revival and their Brief in Opposition to Judgment on the Pleadings, Defendants

equate the idea that a judgment loses its lien position after a five year period to a complete

expiration of a lien which can no longer be revived. Defendants do not attack the actual ability of

3 MONROE LEGAL REPORTER 15 a judgment to be revived, but merely state that it is too late to do so. “A writ of revival of a judgment lien does nothing more than preserve the judgment creditor's existing rights and priorities.” Shearer v. Naftzinger, 560 Pa. 634, 637, 747 A.2d 859, 861 (2000). Although, 42 Pa.

C.S.A. §5526, states that an action to revive a judgment lien on real property must be commenced within five years, Courts have regularly held that failure to do so does not completely eliminate the lien. “Although a judgment may be revived after the five year period, its priority against intervening liens is lost.” Mid-State Bank & Trust Co. v. Globalnet Int'l, Inc.,

710 A.2d 1187, 1189 (Pa. Super. Ct. 1998), aff'd, 557 Pa. 555, 735 A.2d 79 (1999) citing Allied

Material Handling v. Agostini, 414 Pa.Super. 175, 606 A.2d 923 (1992). Plaintiff admits in its own brief that the 2009 default judgment has lost its priority lien position and will be secondary to any intervening liens upon the property. Defendants’ argument regarding the loss of priority on the lien does not establish a viable statute of limitations attack on the lien’s validity.

Therefore, we find Defendants’ argument based upon more than five years passing between the first default judgment and the current proceedings to be meritless.

Next, Plaintiff asserts Defendants’ argument that the consolidation of the two judgments would back date interest and lien priority of the 2017 lien to 2009 is without a factual basis. Defendants support their argument by asserting that a title searcher would require both liens to be paid even if one has greater priority than the other. As already noted, a consolidation of liens does not lend them the same priority. The explanatory note at the end of Pa. R.C.P

3025.1 regarding consolidation of judgments states that “consolidation does not affect the lien priority of each judgment consolidated.” Defendants’ argument regarding backdating priority of the liens is fundamentally incorrect as, although the liens will be consolidated, each individual

4 16 MONROE LEGAL REPORTER judgment retains its lien priority. Defendants’ argument that the consolidation of the two judgments is an attempt to somehow backdate fees and stack interest is also without factual basis. The Praecipe for Single Consolidated Writ of Revival clearly shows how much is owed from both judgments and the current interest due. Interest on the 2017 default judgment is listed as $26.15, far less than would be due if Plaintiff were trying to claim interest from 2009.

Finally, Defendants claim to have raised a valid defense to the revival and consolidation action. “The only cognizable defenses in a proceeding to revive a judgment lien are that the judgment does not exist, has been paid, or has been discharged.” Shipley Fuels

Mktg., LLC v. Medrow, 2012 PA Super 29, 37 A.3d 1215, 1218 (2012) quoting PNC Bank v.

Balsamo, 430 Pa.Super. 360, 634 A.2d 645, 649 (1993). Defendants now claim that the revival action is improper because the lien has been paid. However, in their Answer to the Writ,

Defendants do not allege that the lien has been paid or provide any evidence of payment, only that “the amount claimed due from the Defendants by the Plaintiff is incorrect and not based in fact.” This is a very broad statement. Defendants did not raise the specific defense of payment until their brief in opposition to the current Motion for Judgment on the Pleadings. Therefore, we find Defendants’ assertion at this stage is not enough to prevent granting Plaintiff’s requested judgment.
