Among his numerous books are: Since Predator Came: Notes from the Struggle for American Indian Liberation (1995), A Little Matter of Genocide: Holocaust and Denial in the Americas, 1492 to the Present (1997) and, most recently, Perversions of Justice: Indigenous Peoples and Angloamerican Law (2002). SUMMARY: ... As anyone who has ever debated or negotiated with U.S. officials on matters concerning American Indian land rights can attest, the federal government's first position is invariably that its title to/authority over its territoriality was acquired incrementally, mostly through provisions of cession contained in some 400 treaties with Indians ratified by the Senate between 1778 and 1871. ... The necessity of getting along with powerful Indian [peoples], who outnumbered the European settlers for several decades, dictated that as a matter of prudence, the settlers buy lands that the Indians were willing to sell, rather than displace them by other methods. ... Under international law, discoverers could acquire land only through a voluntary alienation of title by native owners, with one exception - when they were compelled to wage a "Just War" against native people - by which those holding discovery rights might seize land and other property through military force. -

Color profile: Disabled Composite Default screen Conclusion At the time of his death, Professor Lillich’s manuscript was lacking only a concluding statement of the contemporary law governing the forcible protection of nationals abroad. Although we were determined to present his work without substantive alteration, we did want this volume to be as comprehensive as possible. An editorial consensus emerged that we should append a chapter as a complementary snapshot of the law as it exists today. The following article, written by a co-editor of this volume and originally published in the Dickinson Law Review in the Spring of 2000, fit the bill. It is reproduced here with the kind permission of The Dickinson Law School of The Pennsylvania State University.† We hope that it is an appropriate punctuation mark for Professor Lillich’s research and analysis, and that it may serve as a point of departure for those scholars who will build on his impressive body of work Forcible Protection of Nationals Abroad Thomas C. Having been the oldest living bishop in the United States, he experienced many of the great achievements as well as tragedies in the Catholic Church and world. My earliest memories of Bishop Quinn were while I had already entered the seminary. Although he was bishop at the time of my confirmation, I was confirmed by Venerable Alphonse Gallegos, Auxiliary Bishop of the diocese at that time. Yet, even I, in my innocent (or rather ignorant) twenties, was well aware of the reputation of Bishop Quinn. Well known for his humility and out- reach to the poor, he was an encouraging presence for my initial interest and continued path towards priestly ordination. I can ’t say I was close to Bishop Quinn. I wanted to be. I admired him greatly for his wisdom and sense of humor, but I ’ve never been a person to press my- self onto the lives of others and the Spirit did not lead us to intersect often. It was always an honor to have him speak to me, but he was a popular personality who de- served his space. I ’ve always felt, however, that he knew me far better than I knew him. -

INTRODUCTION International law is universal. It is a body of law that applies to all states regardless of their specific cultures, belief systems, and political organizations. It is a common set of doctrines that all states use to regulate relations with each other. The association between international law and universality is so ingrained that pointing to this connection appears tautological. And yet, the universality of international law is a relatively recent development. It was not until the end of the nineteenth century that a set of doctrines was established as applicable to all states, whether these were in Asia, Africa, or Europe. This was not a decision that was made in haste. As early as the mid-1970’s, the Brothers had written of anticipating such a conversion. But, one would have to think that the impetus for the timing of the change was the concern over the imminent closure of Bishop Manogue High School and how to properly consider the needs of the young women who would soon have to find a new school. Much in the way of preparation for the anticipated transition had taken place in the years leading up to Manogue’s closure. A formal agreement was reached between the Catholic Diocese of Sacramento and Christian Brothers High School regarding the hiring of Manogue faculty where possible and the continued involvement of the Sisters of Mercy. -

SACRAMENTO DIOCESAN ARCHIVES Vol 3 Father John E Boll, Archivist No 21 FATHER CHARLES BRADY Native Son of Arva, County Cavan, Ireland Priest of the Diocese of Sacramento Pastor Emeritus of Holy Spirit Parish, Sacramento October 2015 1 Charles Brady was born on July 12, 1930 in Arva, County Cavan, the third of eleven children born to Thomas Brady and Kate Leddy. Of the eleven children, two are priests, two farmers, two veterinarians, two nurses and three auto agents for Mercedes and Volkswagen. The nine siblings who married provided Fathers Charles and Vincent 54 nieces and nephews of whom they are very proud. Charles Begins his Education Charlie attended school at Killygarry, County Cavan. When he was 10 years of age, he went to live with his Aunt Mary and Uncle Peter who had no children. He stayed with them for 9 years while he attended St Patrick College/high school until he entered the seminary in 1949. Charlie rode his bicycle to high school from his aunt’s home five days a week, a 10 mile round trip. After high school, Charlie thought about entering to the seminary so he consulted his local parish priest. Father Smith told Charlie that he should give it a try and “if they don’t fire you,” he said, “you can become a priest.” Seminary Years In 1949, Charles Brady entered Saint Kieran’s Seminary, County Kilkenny, where he began his college studies and completed his course work in theology. The brother of Charlie’s mother, Father Patrick Leddy, was a priest of the diocese of Monterey-Fresno for many years. -

British Historiography of IL
‘The Most Neglected Province’: British Historiography of International Law† David Armitage and Ignacio de la Rasilla [email protected]; [email protected] Introduction In 1908, the German émigré Lassa Oppenheim (1858–1919), soon to take up the Whewell Professorship of International Law at Cambridge, remarked that, ‘[t]he history of international law is certainly the most neglected province of it. Apart from a few points that are dealt with in monographs, the history of international law is virgin land which awaits its cultivators’.1 Until recently, it might have been argued that the British history of international law was peculiarly neglected as a province of the historiography of international law more generally. Yet defining and discerning specific historiographical traditions in international law can be difficult as well as problematic. In the British case, isolating such traditions is especially fraught because neither the anglosphere nor even the common law world has ever been coterminous with any British state, empire or commonwealth. The boundaries of these communities shifted often, for example to exclude the Thirteen Colonies that became the United States after 1783 or to include Ireland after 1800 and then to exclude much of it again after 1922. The problem is exacerbated by the dominion status and de facto independence for Canada, Australia and New Zealand and still more so by waves of decolonisation in the mid-to-late twentieth century especially but not only in South and Southeast Asia and in Africa. These constraints have to be borne in mind in the context of the abridged modern history that follows of international law histories in and beyond Britain, the British Empire and parts of the Commonwealth. -

SACRAMENTO DIOCESAN ARCHIVES Vol 5 Father John E Boll No 40 Father Keith Bernard Kenny Native Son of Omaha, Nebraska Priest of the Diocese of Sacramento Pastor of Our Lady of Guadalupe Parish, Sacramento January 2, 1925 – December 20, 1983 Keith Bernard Kenny, son of Thomas F Kenny and Verva V Heide, was born on January 2, 1925 in Omaha, Nebraska. He had a brother Thomas and a sister Margaret. Keith was baptized later in January at Saint Adelbert Church in Omaha. BEGINS HIS EDUCATION Keith began his education in 1930 at Sacred Heart Cathedral School in Omaha. The Kenny family then moved to San Antonio, Texas where he attended Saint Gerard parish school. His next school was Saint Paul Cathedral School in Pittsburg, Pennsylvania. The family then moved to California where Keith continued his education at Saint Francis parish school in Sacramento, graduating from grammar school in 1938. He then began high school at Christian Brothers School on 21st and Broadway in Sacramento, graduating in June 1942. He became a deck officer in the US Merchant Marines and was a licensed Second Mate for all oceans and tonnages. He served in the Pacific, Indian and Atlantic Oceans, visiting Persia, Australia, India, Okinawa, Guam, Hawaii, Chile, Colombia, Cuba and many Pacific Islands. 2 BEGINS CLASSES AT SACRAMENTO CITY COLLEGE In the fall of 1945, Keith began classes at Sacramento City College, majoring in arts and science. -

This prompted members of the Flathead and Nez Perce 13 Tribes to make four long journeys over the next twenty-five years to St. 14 Louis, Missouri, to request a priest; and 15 WHEREAS, in February 1840, Father Pierre Jean De Smet, of Belgian ori- 16 gin, was appointed superior of the Rocky Mountain Missions and celebrated 17 the first Mass in Idaho on July 23, 1840, at Henrys Lake; and 18 WHEREAS, in 1843, the first Catholic church in Idaho was built by Father 19 Nicolas Point, a French-born Jesuit priest and missionary, on the St. Joe 20 River near St.
