HONOURABLE MEMBERS OF THE LEGISLATIVE COUNCIL, AND MEMBERS OF THE LEGISLATIVE ASSEMBLY- We are assembled here today to open the Third Session of the Forty­ Second Parliament of New South Wales. You have been called together to consider the Government's legislative and financial proposals, and to deal with other matters of importance to the citizens of this State. Honourable Members will be aware of the visit to be made to this State early next year by ner Majesty the Queen and His Royal Highness, the Duke of Edinburgh. It is fitting that this visit is to be made in the year in which we celebrate the 200th anniversary of the discovery of the east coast of Australia by Captain James Cook. 3 MINUTES OF THE PROCEEDINGS OF THE LEGISLATIVE COUNCIL (6 August, 1969)

Since the beginning of the last Session, the death has occurred of the Honourable Lawrence Edward Schofield, a Member of the Legislative Council. and Mr James Brunton Simpson, a Member of the Legislative Assembly and a former Minister. During their participation in public life these Members rendered devoted and unselfish service and their passing is a loss to this Parliament and to the community as a whole. I also share with the Honourable Members their sorrow at learning of the recent death of a former Member of the Legislative Assembly and Premier of New South Wales, the Honourable Alexander Mair. Mr Mair was a Member from 1932 to 1946 and, in addition to other Ministerial Offices he held during this period, served with distinction as Premier from 1939 to 1941, the first years of World War II. The past financial year was one of strong economic growth and develop­ ment for New South Wales and for the Nation generally. Drought conditions continued to affect the southeast -corner of the State and the Cobar district for most of the year and, more recently, some areas in the northern part of the State have been affected. However, good seasonal conditions were experienced in most of the State and there was a substantial increase in rural output with record crops of wheat and rice. Given reasonable seasonal conditions in the coming year there are good prospects for further rural growth. Despite the buoyant conditions in the economy, however, the Govern­ ment ended the year with a deficit, due mainly to very substantial increases in wage costs. Further increases are likely in the present financial year and these will add to the already difficult budgetary problems confronting the Government in providing, from within the limited resources available to the State, the essential public services required by the community. The Maritime Services Board continues to make good progress with the works scheduled for completion during the first half of its ten year port development programme. The Darling Harbour South Reconstruction Scheme has been completed and work will now proceed on the modernization of Darling Harbour North. The second container terminal at Balmain is expected to be commissioned towards the end of this year. The Board is also proceeding with the necessary planning and investiga­ tions to give effect to the Government's decision to develop the northern fore­ shores of Botany Bay as a port and industrial complex. At Newcastle the reconstruction of the western side of the Carrington Basin is planned for completion by mid-1970. The Government is also undertaking a major expansion of the port facilities at Port Kembla. Every effort continues to be made by the Metropolitan Water, Sewerage and Drainage Board, within the limits of available funds and resources, to expand water and sewerage services and during the year an all time record of 630 miles of water and sewerage mains were laid. The $34 million 120 inch second pipeline from Warragamba Dam to Prospect Reservoir has been virtually completed and work is now concen­ trated on the outlet works at Prospect. Work will commence in the current year on the construction of a tunnel to link the Avon and Nepean Dams as part of the Board's $117 million scheme for development of the Shoalhaven River Catchment. Construction of country water supply and sewerage projects also continues at an accelerated rate. The demand for electricity continues to rise and the Electricity Com­ mission is providing new plant to meet the increase. The Wallerawang Power Station is being extended so as to treble its output. The Commission's Liddell power project is proceeding on schedule. During the year the Grain Elevators Board was able to extend its bulk handling capacity by 30 million bushels to 162 million bushels, and thereby cope with last season's record intake of grain. The Board anticipates having , available an additional 20 million bushels storage in the 1969-70 season, when I it will be required to handle an- estimated carry-over of 100 million bushels I in addition to the new season's harvest. 4 lofiNUTES OF THE PROCEEDINGS OF THE LEGISLATIVE COUNCIL (6 August, 1969)

The finding of market outlets for the greatly increased quantities of wheat now being produced is becoming a serious national problem, and negotiations are in train between Commonwealth and State authorities and representatives of the wheat industry to devise means whereby the threat to the price structure of over-accumulated stocks might be averted. The new Homebush Stock Saleyards are operating very satisfactorily. Plans are in hand for the construction of a new farm produce market and associated commercial complex at Flemington which will be one of the most modern and best equipped of its type in the world. The past year has seen major advances in the implementation of the Government's programme of water, soil and forest conservation works. Two major dams-Blowering On the Tumut River and pindarl on the Severn River­ were brought into operation. Work on the $45 million Copeton Dam project on the Gwydir River is proceeding. Contracts have been let for three other dams-at Carcoar on the Belubula River, Lostock on Ihe Paterson River, and Toonumbar on the Richmond River system, which are programmed to be operating in 1970-7l. The Government's programme for expansion in softwood afforestation is progressing and a further 21,800 acres will be planted during the current planting year. The acquisition and dedication of land for nature conservation is given high priority by my Government and further additions are proposed to the system of National Parks, State Parks, Nature Reserves, and Historic Sites which already totals more than two and a quarter million acres. Almost $15. million have been spent Or committed by the Government in the past four years in assisting 425 industries to establish or expand in country centres. Funds made available to the Country Industries Assistance Fund last financial year were increased substantiallY to encourage the expansion of manufacturing and processing in country areas. The strong overseas interest in investment in New South Wales is reflected in the increasing number of inquiries referred from this State's offices in London, New York, and Tokyo. Following the successful New South \Vales Engineering Trade Mission to South East Asia in 1968 it was decided that the mounting of State trade and investment missions, jointly sponsored by the Government and the State's leading manufacturing, commercial, and export groups, should become a regular feature of the State's promotional efforts. Major industrial projects now pending or under construction within the State include the $154 million extensions to steel production facilities at Port Kembla, a $35 million aluminium smelter at Kurri Kurri, a $36 million fertiliser plant at Newcastle, and a $15 million wood chip venture at Eden. Improvements in the Main Roads system of the State continued during the year. Another six-mile section of the Sydney-Newcastle Expressway was opened to traffic last December and a new bridge over the Hawkesbury River to link the completed sections of the Expressway is being planned for early commencement. Tenders are being called for the construction of the first stage of the Western Distributor from the Sydney Harbour Bridge to Day Street, near Erskine Street, and early commencement of the road tunnel and associated roadworks to relieve traffic conditions in King's Cross is proposed. Country State Highways are being progressively reconstructed and provided with a bitumen surface. The work on the Silver City Highway between Wentworth and Broken Hill, a distance of 165 miles, was recently completed. Major bridges at Wentworth, Murwillumbah, and Deniliquin were also completed recently and others at Dubbo, Raymond Terrace, Bulahdelah, and Forbes will be completed this year. Work is progressing at a most satisfactory rate on the Eastern Suburbs Railway and construction of the twin tunnels under King's Cross is now wen advanced.

The new standard gauge trans~continental rail service, joining Sydney and Perth via Broken Hill is expected to be in operation early next year and will brin~ a new era to interstate rail travel. Delivery of 232 new single-deck buses for the Government's omnibus fleet will be completed in the near future and contracts have been let for the supply of an additional 200 single and 200 double-deck buses. 5 MINUTES OF THE PROCEEDINGS OF THE LEGISLATIVE COUNCIL (6 August, 1969)

Replacement of t-he older vessels in the Government's ferry fleet will continue and the introduction of hovercraft services will be encouraged. As a road safety measure, the results of the system of "Breathalyser" tests have been most heartening since its introduction last December and a significant drop in -the number of accidents, fatalities, and injuries has been evident in those areas in which the scheme is in use, The scheme will be extended over the whole of the State as equipment becomes available. My Government continues to pursue vigorously its policy of law reform. The first positive step by any Government in the Commonwealth towards a more scientific approach to the problem of crime prevention has also been taken in this State by the appointment of an Advisory Committee to consider the establishment of a Bureau of Crime Statistics and Research. Work on the first new prison to be built in New South Wales for more than 50 years has been commenced at Cessnock where a $2 million contract has been let for the construction of a modern prison complex. Implementation of the Government's policy of increasing the strength of the Police Force is proceeding satisfactorily. Particular attention is being given by my Ministers to requirements in education. Approximately 768,000 students are currently enrolled in Departmental schools, compared with 747,205 at the census date last year, and the provision of adequate finance for educational purposes is placing an increasing strain 'on the State's resources. However, new and improved facilities are being provided as rapidly as funds permit. Plans have been prepared for the early commencement of 64 high school projects and 263 primary school projects at a combined estimated cost of $44 million. New Teachers' Colleges are under construction at Lindfield, Goulburn, and Shortlan~. For technical education, 5 major projects are in progress, while a further 16 works are being planned for early construction at a total cost of $12.6 million. A progressive programme is well under way, in all phases of education and will be pursued vigorously to the fullest extent possible with the resources available to the Government. Work is under wayan the construction of a new Government Office Block in Hunter Street, while in the country Government Offi..ces have been completed at Goulburn and a new block is under construction at Grafton. In addition to its normal home building programme, the Housing Commission is placing emphasis on the provision of housing in country and other centres where decentralized and major industries are being established or extended. Special attention will be given to the requirements of the Wollongong district to meet needs arising from major development proposals in the area. Extension of the slum clearance and Ie-development programme at Waterloo is proposed and a major multi-unit housing project which will provide 430 dwelling units is to be undertaken by the Commission at Malabar. To meet the continuing strong demand for homesites, high priority continues to be given to the subdivision of Crown land for building blocks. Dnring the past year, 1,744 home sites were made available and further large scale subdivisions are in progress in the Metropolitan area and various country centres. A progressive programme for the encouragement of tourism is being implemented. A branch office of the New South Wales Government Tourist Bureau will be opened in Adelaide in the near future and new Tourist Informa M tion Centres will open shortly at and Tweed Heads. Steady progress has been made in general health services during the past year and the occupation in November next of the new 300 bed Marsden Hospital at Parramatta will represent a milestone in the care of the intellectually handicapped. An $8 million contract has been let for the construction of a multi-storey ward and theatre block at the Prince of Wales Hospital. This will be linked to a $3 million admission and polyclinic block just completed, to form one of ,the largest complexes of new hospital buildings in New South Wales. In the field of child welfare, further emphasis has been placed on the provision of improved facilities. A major institution, designed in accordance with the most modern concepts in the training of delinquent youths, commenced operations at Kurri Kurri during the year. Provision for residential care for intellectually handicapped wards of the State has been made at Katoomba. 6 MINUTES OF THE PROCEEDINGS OF THE LEGISLATIVE COUNCIL, (6 August, 1969)

Mineral production in New South Wales continues to rise and in 1968 the total value amounted to approximately $299 million, exceeding by nearly $23 million the output value in 1967. However, revenue from mineral royalties again showed a substantial decrease for the year due to lower metal prices.

MEMBERS OF THE LEGISLATIVE ASSEMBLY- The Budget for 1969-70 will shortly be placed before you and you will be asked to provide for the public services of the State. A carefully planned programme of works and services has been drawn up and estimates of expenditure and amounts proposed to be voted from the General Loan Account for those works and services will also be submitted for your con­ sideration.

HONOURABLE MEMBERS OF THE LEGISLATIVE COUNCIL, AND MEMBERS OF THE LEGISLATIVE ASSBMBLY- A comprehensive programme of legislation of importance to New South Wales and its people will be placed before you by my Ministers during the Session. Further legislation in the interests of law reform is proposed and you will be asked to consider a Bill designed to effect the fusion onaw and equity in this State. In addition, my Ministers will submit for your endorsement the Summary Offences Bill which will modernize and replace the Vagrancy Act and sub­ stantially amend the Police Offences Act. Measures will also be introduced during the Session which will amend the Companies Act, the Door-to-Door Sales Act and the Landlord and Tenant Act. Certain Church Property Bills will be placed before you. The Board of Teacher Education Bill and a Bill to provide for the establishment of an Education Advisory Commission and to make further arrangements in relation to the administration of education will be submitted for your consideration. The Water Pollution Bill will be re-introduced and other Bills of import­ ance will amend the Local Government Act, the Main Roads Act and the Government Railways and Transport Acts. Bills are also being prepared to consolidate and bring up to date the laws relating to the bread industry and to amend the Factories, Shops and Industries Act in certain respects. The further development of harbour facilities at Port Kembla is proposed and Bills to authorize additional works in the Inner Harbour· and the construction of a bulk loader in the Outer Harbour will be placed· before you. Your approval will be sought to a Bill to effect a number of amend­ ments to the Crown Lands Consolidation Act and you will be asked to consider the National Parks and Wildlife (Amendment) Bill and the War Service Land Settlement (Amendment) Bill. A Bill to provide for the establishment of a Meat Industry Authority will be introduced and Bills to amend the Grain Elevators Act and the Wheat Industry Stabilisation Act are being prepared. You will be asked also to con­ sider a Bill to give effect to the acquisition of the C.B. Alexander Agricultural College, "Tocal", Paterson, and to incorporate the C.B. Alexander Foundation. Another measure which is in course of preparation will amend the Real Property Act to enable the Registrar-General to take advantage of modern techniques such as microfilming and automatic data processing. My Ministers will seek legislative authority for the holding of a refer­ endum on the question of Sunday trading by hotels. You will also be asked to consider Bills to amend the Land Tax Act, the Transport Employees Retirement Benefits Act, the Fisheries and Oyster Farms Act, the Liquor Act, the Pastures Protection Act, the Superannuation Act, the Pure Foods Act, the Coal Mines Regulation Act and the Mines Rescue Act. Other measures will also be placed before you.

ASSUMPTION OF THE ADMINISTRATION OF THE GOVERNMENT BY THE HONOURABLE SIR KENNETH WHISTLER STREET, LlEUTENANT-GOVERNOR.-The President reported and read the following Message from His Excellency the Lieutenant­ Governor: K. The Honourable Sir , Lieutenant-Governor of the State of New South Wales, has the honour to inform the Legislative Council that, consequent on the departure from the State on 15th June, 1969, of the Governor of New South Wales, Sir Roden Cutler, on an official visit to the United Kingdom, he this morning took the Oath of Allegiance and the Official and Judicial Oath before the Chief Justice of the Supreme Court of New South Wales. and assumed the administration of the Government of the State. VACANT SEAT IN THE LEGISLATIVE COUNCIL-DEATH OF THE HONOURABLE LAWRENCE EDWARD SCHOFIDLD.- (1) The President announced to the House the receipt from the Registrar-General of a certified copy of an entry made in the Register of Deaths at the District 'Registrar's Office at Hamilton, recording the death of the Honourable Lawrence Edward Schofield on or about the 14th June, 1969, and that an entry recording his death had been made in the register of Members of the Legislative Council. ELECTION OF A MEMBER OF THE LEGISLATIVE COUNCIL IN PLACE OF THE HON­ OURABLE LAWRENCE EDWARD SCHOFIELD, DECEASED.-The President reported and read the following Message from His Excellency the Governor: A. R. CUTLER, Governor. Message. In pursuance of section. seven of the Constitution (Legislative Council , Ele'Ctions) 'Act, 1932-1961, the Governor desires to inform the Legislative Council that "he has this day, with the advice of the Executive Council, issued under that Act a Writ for the election of a Member of the Legislative Council to fill the vacancy caused by the death of the Honourable Lawrence Edward Schofield. ,...· 1· MINUTES OF THE PROCEEDINGS OF THE LEGISLATIVE COUNCIL '.' The Writ is directed to Major-General John Rowlstone Stevenson, C.B,E., D.S.O., E.D., Clerk of the Parliaments of the State of New South Wales, Returning Officer for the Election of Members of the Legislative Council of New South Wales. . This Message is accompanied by a copy of the Writ. In order that both Houses of Parliament may be duly informed of the issue of the Writ, a like Message -is this day being addressed by the Governor to the Speaker of the Legislative Assembly. Government House, Sydney, 6 August, 1969. The President announced that the Message was accompanied by a copy of the Writ. The President then directed the Clerk to read the Writ, which was as follows:

Ballot appointed in the Writ mentioned in His Ex~ell.e~cy·s Message of the 6 August, 1969,. viz.- Thursday, 28 August, 1969. On that day the taking of votes would take p~ecedence of all other business.
