The practice of pre-trial detention in Italy Research report Grazia Parisi Gennaro Santoro Alessio Scandurra September 2015 With coordination by: 1 Antigone is a small Italian NGO born in 1991 in Rome, which deals with human rights protection in the penal and penitentiary system. It contributes to the public debate on these issues through campaigns, education, media, publications and drafting of legal proposals. In 1998 Antigone launched its Observatory on Italian prison conditions, a project involving around 100 monitors working on a voluntary basis, with the help of a small coordinating staff. Every year Antigone receives special authorisations from the Ministry of Justice to visit all Italian prisons. Reports of the visits are published on the organisation’s website, and end up in the annual Antigone Observatory Report on Italian prison conditions. Ten years later Antigone launched the prison Ombudsman service, which receives complaints from detainees in prisons and police stations all over the country. The Ombudsman mediates with the prison administrations in order to solve specific problems. This publication has been produced with the financial support of the Criminal Justice Programme of the European Commission. Consolidated Immigration Act
This is unofficial translation in English of the Italian version of the Consolidated Immigration Act LEGISLATIVE DECREE n. 286 dated 25 July 1998 Consolidated act of provisions concerning regulations on immigration and rules about the conditions of aliens. In force as of: 26 June 2014 TITLE I GENERAL PRINCIPLES Art. 1 (Scope of enforcement) (Law n. 40 dated 6 March 1998, art. 1) 1. This consolidated act, implementing article 10, second paragraph, of the Constitution, is enforced, unless provided for otherwise, on citizens belonging to non-EU States and to stateless persons, hereinafter indicated as aliens. ((2. This consolidated act is not enforced on citizens belonging to EU Member States, withstanding what provided for by rules implementing community regulations)). 3. When other provisions of law refer to statuses concerning persons with a citizenship different from Italian, or stateless persons, the reference is to statuses provided for by this consolidated act. The most favourable domestic, community and international provisions however in force in the State’s territory remain withstanding. 4. As regards matters falling within the legislative competence of the regions, the provisions of this consolidated act constitute fundamental principles pursuant to article 117 of the Constitution. As regards matters falling within the competence of the regions with special statute and the autonomous provinces, these have the value of fundamental rules of economic-social reform of the Republic. 5. The provisions of this consolidated act are not enforced should it be differently provided for by the laws in force for the state of war. 6. Country Review Report of Italy Review by Kazakhstan and Liechtenstein of the implementation by Italy of articles 15 – 42 of Chapter III. “Criminalization and law enforcement” and articles 44 – 50 of Chapter IV. “International cooperation” of the United Nations Convention against Corruption for the review cycle 2010 - 2015 Page 1 of 219 I. Introduction The Conference of the States Parties to the United Nations Convention against Corruption was established pursuant to article 63 of the Convention to, inter alia, promote and review the implementation of the Convention. In accordance with article 63, paragraph 7, of the Convention, the Conference established at its third session, held in Doha from 9 to 13 November 2009, the Mechanism for the Review of Implementation of the Convention. The Mechanism was established also pursuant to article 4, paragraph 1, of the Convention, which states that States parties shall carry out their obligations under the Convention in a manner consistent with the principles of sovereign equality and territorial integrity of States and of non-intervention in the domestic affairs of other States. The Review Mechanism is an intergovernmental process whose overall goal is to assist States parties in implementing the Convention. The review process is based on the terms of reference of the Review Mechanism. II. Process The following review of the implementation by Italy of the Convention is based on the completed response to the comprehensive self-assessment checklist received from Italy, and any supplementary information provided in accordance with paragraph 27 of the terms of reference of the Review Mechanism and the outcome of the constructive dialogue between the governmental experts from Kazakhstan and Liechtenstein, by means of telephone conferences, videoconferences, e-mail exchanges.
