    From Readymade to ‘Meta²’ Metareference in Appropriation Art Katharina Bantleon Throughout the history of art, artworks have made reference to preceding works of art. These instances of art hinting at, or invoking other art are inherently self- referential. However, against the backdrop of conceptual notions induced by Marcel Duchamp in the 1910s, the second half of the 20th century saw an undis- putable increase in strategic, open, undisguised ‘borrowing’ and reworking of ex- isting artworks and visual culture at large which is commonly referred to as ‘appropriation’. This contribution discusses appropriationist modes of artistic pro- duction which are inherently and metareferentially concerned with questions pertaining to the general nature of ‘art’, authorship and originality as an indicator of an ongoing metareferential turn in the visual arts. 1. Introduction In view of the fact that – virtually since their beginnings – the visual arts have applied a variety of modes by which artworks establish ref- erences to their antecedents, the generalizing remark that all art is es- sentially ‘about’ art has practically become commonplace (cf., for in- stance, Lipman/Marshall 1978: 6f., Steinberg 1978: 8, Kloss 1985: 27, Silk 1995: 10). There are a plethora of terms designating various prac- tices of alluding to, or directly quoting, pre-existing art; among them, to mention but a few, are referencing, emulating, paraphrasing, bor- rowing, reusing, reworking, acquiring, copying, duplicating, reproduc- ing, replicating, confiscating, purloining, plagiarizing or even stealing. The reasons and motives for applying such strategies are likewise manifold, ranging from, for example, the art student’s aim to learn and practise certain styles or techniques, via the dissemination of original artworks through reproductive printmaking in the tradition of Renais- sance engravers and print artists, to paying homage to, or humorously and/or critically commenting on, the work of fellow artists.

The fundamental principles still apply, despite radical developments in the technology of production and distribution of cultural material. In particular the last decades’ developments and adoption of ICTs have drastically lowered barriers, which previously prevented entry into the production and distribution side of the cultural marketplace, and led to a widening of the base at which cultural production occurs and is disseminated. Additionally, digitalisation has made it economically and technically feasible for users to appropriate and manipulate earlier works as method of production. The renegotiation of barriers and the increasing number of creators who publish their works has led to an increase in copyright violations and a pressure on copyright legislation. Many of these potential violations are tolerated, in some cases have become common practice, and created social norms. Others have not been so fortunate and the law has been rigidly enforced. This arbitrary application decreases the predictability of law and creates a situation where creation relies on the tolerance of the other copyright holders. This article analyses different cases of reuse that test the boundaries of copyright. Some of these are tolerated, others not. When regulation fails to capture the rich variation of creative reuse, it becomes difficult to predict which works will be tolerated. The analysis suggests that as copyright becomes prohibitive, social norms, power and the values of the copyright holder dominate and not law.

  • Everything Is a Remix: Implications for Graduate Education
    THE CULT OF ORIGINALITY Travel back twenty millennia. You dwell in what is now southern France, and you have just entered a cave with the intention of painting an equine on its walls. You are not the first—your predecessors have been painting equines on these walls for years, decades, perhaps centuries. Do you avert your eyes and create your equine purely from memory or imagination; or do you study the walls, take a tail from here, a mane from there, a topline from somewhere else, and create an image of an equine at once borrowed and new. 1. A Parlor Game The redactors of the Book of Genesis rewrote not only one other, but also prior near Eastern creation myths. Milton rewrote the Book of Genesis in Paradise Lost, and Mary Shelley rewrote Paradise Lost in Frankenstein (whose creature learns English and history from Milton’s poem). Melville, too, rewrote Paradise Lost, mixing it in Moby-Dick not only with the myth of Prometheus, as Shelley had done, but also with Shakespeare, Emerson, and the Narrative of the Most Extraordinary and Distressing Shipwreck of the Whale-Ship Essex, to cite just a few of Melville’s influences and sources. Pauline Hopkins borrowed the Arctic trope that closes Frankenstein for the conclusion of her canonical romance of slavery and freedom, Contending Forces; and Philip Roth borrowed the invocation that opens Moby-Dick— “Call Me Ishmael”—to open The Great American Novel—“Call Me Smitty.” Shakespeare pillaged history and literature for the plots of his plays, and Dante impressed Virgil into service for the Divine Comedy.
