The City Council met in regular session at 6:30 PM in the Council Chambers, City Hall, 23 2nd Street NE. Mayor Steve Thorson presiding. Present upon roll call: Aldermen Rieffenberger, Solum, Meisenheimer, Roby, Buhler, Tupper, Wilkins, Albertsen and Danforth. Absent was Alderwoman Mantey.

Motion by Rieffenberger, seconded by Buhler, to approve the following items on the consent agenda: minutes of the Council Meeting held on December 2, 2013; issue a check to Ann Taecker for Young Adult Mural Residency in the amount of $1,000; authorize Mayor to sign annual Joint Funding agreement with the United States Geological Survey; authorize the Mayor to sign annual Household agreement with Veolia; authorize the Mayor to sign annual maintenance agreement with Eaton Controls for E-911 UPS Power supply in the amount of $2,964; authorize Mayor to sign annual maintenance agreement with G&R Controls for the PD heating and cooling system in the amount of $4,176, and authorize the Mayor to sign annual maintenance agreement with Milbank communications for the E-911 equipment in the amount of $3,099. Motion carried.

Ordinance No. 13-33 amending zoning district boundaries by rezoning a lot adjacent to Doug’s Anchor Marine from I-1 Light Industrial District to BP Business Park District was placed on its second reading and the title was read. This being the time scheduled for a public hearing on Ordinance No. 13-33, the Mayor called for public comment. Hearing no comment from the public, motion by Tupper, seconded by Meisenheimer, to approve Ordinance No. 13-33 as presented. Motion carried.

Ordinance No. 13-34 amending zoning district boundaries by rezoning property located at 3100 9th Ave SW from I- 1 Light Industrial District to BP Business Park District was placed on its second reading and the title was read. This being the time scheduled for a public hearing on Ordinance No. 13-34, the Mayor called for public comment. Hearing no comment from the public, motion by Albertsen, seconded by Danforth, to approve Ordinance No. 13- 34 as presented. Motion carried.

Ordinance No. 13-35 amending Section 31.3002 of the revised Ordinances of the City of Watertown adding a new permitted use to the BP Business Park District was placed on its second reading and the title was read. This being the time scheduled for a public hearing on Ordinance No. 13-35, the Mayor called for public comment. Hearing no comment from the public, motion by Tupper, seconded by Rieffenberger, to approve Ordinance No. 13-35 as presented. Motion carried.

Ordinance No. 13-36 providing for 2013 supplemental appropriations for the following funds: General, Parks, Recreation and Forestry, BBB Sales Tax, Recreation Center, Capital Improvement Sales Tax Fund and TIF 5 were placed on its second reading and the title was read. Motion by Rieffenberger, seconded by Roby, to approve Ordinance No. 13-36 as presented. Motion carried.

Motion by Tupper, seconded by Buhler, to approve appropriations of state and federal grants in the General Fund (101): Police Department (42100): ICAC Grant/Office of Highway Safety, Overtime $11,300 (41109), Travel Expense $3,900 (42701); Fire Department (42220): Homeland Security Grant, Machinery & Equipment $20,088 (43600); Street Department (43120): FEMA, Rent-Machinery & Equipment $58,000 (42400). Motion carried.

Motion by Buhler, seconded by Danforth, to approve Resolution No. 13-30 abolishing the Urban Renewal Agency established by Resolution Y-2213. Motion carried.

Motion by Danforth, seconded by Rieffenberger, authorizing the renewal of the Airport Liability Insurance for 2014 and pay the premium in the amount of $8,720 without the additional terrorism or war coverage. Motion carried.

Motion by Buhler, seconded by Albertsen, to authorize the renewal of the Employee Bond Insurance for 2014 and pay the premium in the amount of $1,922. Motion carried.

Motion by Buhler, seconded by Tupper, to authorize the extension of the general liability, public officials’ liability, auto liability & physical damage and law enforcement liability through July 31, 2014 and pay the premium in the amount of $82,281.93. Motion carried.

Motion by Tupper, seconded by Rieffenberger, to declare 18 florescent light fixtures from the council chambers as surplus and dispose of as junk. Motion carried.

Motion by Danforth, seconded by Solum, to approve Change Order No. 2 (final) for the FBO Ramp Reconstruction & Hangar Taxiway Reconstruction project decreasing the contract amount by $20,575.20. Motion carried.

Motion by Rieffenberger, seconded by Wilkins, to approve Amendment No. 2 to the agreement for Professional Service for the FBO Ramp Reconstruction & Hangar Taxiway Reconstruction project increasing the contract amount by $21,283.35. Motion carried.

Motion by Roby, seconded by Buhler, to approve Change Order No. 1 (final) for the Miscellaneous Drainage Improvement project decreasing the contract amount by $4,070.72. Motion carried.

City Engineer Tom Drake presented the tabulation of bids received for the Front End Loader for the Airport. Bids were opened at 10:00 AM on December 6, 2013 and are as follows: Titan Machinery, $107,989 base bid, $4,567 option A#1, $2,781 option A#2, $6,234 option A#3, $4,138 option A#4, $125,709 total bid. Motion by Roby, seconded by Tupper, to approve the bid of Titan Machinery in the amount of $125,709. Motion carried.

Motion by Danforth, seconded by Wilkins, authorizing the Police Department to advertise for bids for two Patrol Utility vehicles. Motion carried.

Motion by Wilkins, seconded by Solum, authorizing the Landfill Department to advertise for bids for a front end loader. Motion carried.

Motion by Tupper, seconded by Wilkins, authorizing the Street Department to advertise for bids for a snow blower attachment. Motion carried.

Motion by Buhler, seconded by Danforth, to convene in executive session for the purpose of discussing contract negotiations. Motion carried.

Motion by Roby, seconded by Danforth, to reconvene in open session. Motion carried.

Motion by Rieffenberger, seconded by Tupper, to amend the purchase agreement with James Orvis Trust adding a cost recovery component for future development of 18th Ave. NE and 15th St. NE. Motion carried with Meisenheimer opposing.

AN ORDINANCE DELETING SECTION 5.0301 BUILDING CODES ADOPTED WITH MODIFICATIONS IN ITS ENTIRETY AND REPLACING IT WITH A NEW SECTION 5.0301 BUILDING CODES ADOPTED WITH MODIFICATIONS WITHIN AND FOR THE CITY OF WATERTOWN

BE IT ORDAINED by the City of Watertown, South Dakota that Section 5.0301 Building Codes Adopted with Modifications of the Revised Ordinances of the City of Watertown be deleted in its entirety and replaced with new Section 5.0301 revised as follows:

5.0301: BUILDING CODES ADOPTED WITH MODIFICATIONS 1. Building Permits and Application Required. See Title 21, Chapter 2, Section 21.0205 and 21.0206. 2. There is hereby adopted by the City Council for the purpose of establishing rules and regulations governing building, that certain building code known as the International Residential Code 2012 Edition, Chapters 1-23 and 43, and Appendices G, H, and J, subject to the following modifications. a. Section R101.1 Title, change [NAME OF JURISDICTION] to City Of Watertown b. Section R103 Department of Building Safety, is hereby deleted in its entirety. c. Section R105.2 - Work exempt from permit, Delete items 1, 2, and 10 under “Building:” and replace with the following: (1) Replacement of siding, gutters, downspouts, storm windows, storm doors, or similar type roofing materials. (2) (Reserved) (10) (Reserved) d. Section R105.5 Expiration. Modify the maximum incremental time period the building official may grant written extensions of permit expiration date from one hundred eighty (180) days to one (1) year.” e. Section R106.3.1 Approval of construction documents, is hereby amended to read as follows: Upon The building official’s completed review of construction documents a permit shall be issued. One set of construction documents so reviewed shall be retained by the building official. Section R106.3.2 Previous approvals, is hereby amended by revising the section title to Section R106.3.2 Previous reviews. f. Section R106.3.3 Phased approval, is hereby amended by revising the section title to Section R106.3.3 Phased review. g. Section R106.3 Examination of documents, is hereby amended by adding the following: R106.3.4 Applicant’s Responsibility for Compliance. Neither examination and review of construction and/or construction documents by the building official, nor the issuance of a building permit by the building official, shall relieve the permit applicant of the responsibility and duty to comply with this code and any other applicable local, state and federal rules, regulations, and ordinances. h. Section R106.4 Amended construction documents, is hereby amended to read as follows: Work shall be installed in accordance with the reviewed construction documents, and any changes made during construction that are not in compliance with the reviewed construction documents shall be resubmitted for review as an amended set of construction documents. i. Section R106.5 Retention of construction documents, is hereby amended to read as follows: One set of reviewed construction documents shall be retained by the building official for a period of not less than one hundred eighty (180) days from the date of completions of the permitted work, or as required by state or local laws. j. Section R107 Temporary Structures and Uses, is hereby deleted in its entirety. k. Section R108.3 Building Permit Valuations, is hereby amended to read as follows: The determination of value or valuation under any of the provisions of this code shall be made by the building official in accordance with valuation schedules established by the applicable governing body. Building permit valuation shall represent the total value of the work for which a permit is being issued

including material costs and labor for electrical, gas, mechanical, plumbing and other permanent systems, as well as interior and exterior finish work, painting, roofing, elevators, and fire extinguishing equipment. l. Section R108.6 Investigation fees for work without a permit, is hereby amended by adding the following: Whenever any work for which a permit is required by this code has been commenced prior to the issuance of said permit, the building official shall conduct an investigation before a permit may be issued for such work. An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the greater of a minimum fee amount established by resolution of the governing body or the amount of the permit fee required by this code. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law. m. Section R109.0 General, is hereby amended by adding the following: All construction or work for which a permit is required shall be subject to inspection by the building official. It shall be the duty of the permit applicant to cause the work to remain accessible and exposed for inspection purposes until approved by the building official. Neither the building official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of any material required to allow inspection. Approval of the construction or work as a result of an inspection shall not be construed to be an approval of a violation of any local, state, or federal rules, regulations, ordinances, or codes. Buildings or structures built without one or more of the inspections required by Section R109 of this Code, or others as deemed necessary by the building official, may be classed as an unsafe building or structure and action taken as specified by Section 115 Unsafe Structures and Equipment of the International Building Code. Buildings or structures wired, plumbed, provided with mechanical equipment, vents, connectors, chimneys, or other similar appurtenances without required inspections, as specified by the currently adopted Electrical Code, as amended; the currently adopted Plumbing Code, as amended; and the currently adopted Mechanical Code, as amended; may be classed as an unsafe building or structure and action taken as specified by Section 115 Unsafe Structures and Equipment of the International Building Code. A person shall not occupy as owner-occupant, or permit another person to occupy, any structure or premise which does not comply with the requirements of this code. n. Section R110 Certificate of Occupancy, is hereby deleted in its entirety. o. Section R112 Board of Appeals, is hereby amended such that all references to Board of Appeals shall mean Board of Adjustment. p. Section R112.1 General, is hereby amended to read as follows: The Board of Adjustment shall hear and decide appeals of orders, decisions and determinations made by the building official relative to the application and interpretation of this code. q. Section R112.3 Qualifications, is hereby deleted in its entirety. r. There is hereby adopted by the City Council for the purpose of establishing rules and regulations governing building, that certain building code known as the International Building Code 2012 Edition, Chapters 1- 26, 30-35, and Appendices C and I, subject to the following modifications: a. Section [A]101.1 Title, change [NAME OF JURISDICTION] to City Of Watertown b. Section [A]101.4.1 Gas, is hereby amended by replacing “the International Fuel Gas Code” with “the most current edition of codes adopted by the City governing the installation and approval of gas burning equipment as set forth in Title 20 of the City’s Revised Ordinances”. c. Section [A]101.4.3 Plumbing, is hereby amended by replacing “the International Plumbing Code” with “the current plumbing code adopted by the South Dakota State Plumbing Commission along with local revisions set forth in Title 15 of the City’s Revised Ordinances”. It’s further amended by deleting the sentence: “The provisions of the International Private Disposal Code shall apply to private sewage disposal systems.”

d. Section [A]101.4.5 Fire Prevention, is hereby amended by replacing “the International Fire Code” with “the provisions of the current fire prevention code adopted by the City in Title 10 of the City’s Revised Ordinances”. e. Section [A]101.4.6 Energy, is hereby deleted in its entirety. f. Section 103 - Department of Building Safety, is hereby deleted in its entirety. g. Section [A]105.2 - Work exempt from permit, Delete items 1, 2, 3, and 4 under “Building” and replace with the following: (1) Replacement of siding, gutters, downspouts, storm windows, or similar type roofing materials. Shop drawings shall contain all information as required by the referenced installation standards in Chapter 9. j. [A] 107.3.1 Review of construction documents. The building official’s review of construction documents shall be indicated by issuance of a permit. One set of construction documents so reviewed shall be retained by the building official. k. Section[A] 107.3.2 Previous approvals, is hereby amended by revising the section title to Section [A]107.3.2 Previous reviews. l. Phased approval, is hereby amended by revising the section title to Section [A]107.3.3 Phased review. m. The registered design professional in responsible charge shall list the deferred submittals on the construction documents for review by the building official. Documents for deferred submittal items shall be submitted to the registered design professional in responsible charge who shall review them and forward them to the building official with a notation indicating that the deferred submittal documents have been reviewed and found to be in general conformance to the design of the building. The deferred submittal items shall not be installed until the deferred submittal document have been reviewed by the building official. o. [A]107.4 Amended construction documents. Work shall be installed in accordance with the reviewed construction documents, and any changes made during construction that are not in compliance with the reviewed construction documents shall be resubmitted for review as an amended set of construction documents. p. New non-exempt employees hired on or after January 1, 2014, will start at Step 1 of their grade classification. Exempt employees hired or promoted on or after January 1, 2014, will start at a salary between Step 1 and Step 7 of their grade classification. If significant difficulty in filling a position occurs, a new exempt employee may start at a salary above the stated step range based on educational qualifications and job-related experience, but only with the express approval of the City Council.

A one-step salary increase in the wage matrix will be provided on January 1 for all employees. Employees will advance an additional one-step in the wage matrix if the 1% general sales taxes collected the previous year from July 1 – June 30 is 3% or greater. These adjustments have been considered when placing employees on the steps within the wage matrix for 2014.

Annual salaries of elected officials are as follows: Mayor $69,627.57 Each Alderperson $9,786.42

The pay rate for part-time, temporary or seasonal clerical workers, drivers and general labor positions shall fall within the following range: $7.25 to $12.00 per hour. Part-time positions that, in the judgment of the department , require special or unique skills and abilities and that cannot be filled with qualified applicants at the maximum rate stated above may be paid a higher rate by submitting a written request along with the justification for a higher hourly rate to the Finance Officer for authorization.

SECTION II. Travel rates for mileage and per diem meal allowances shall be paid at the rates as set by City personnel policy. The City will reimburse actual cost, upon presentation of receipts for lodging, registration fees and/or dues and incidental expenses to travel.

SECTION III. Vacation, sick leave, longevity and other benefits shall be governed by City Personnel Policy and City Ordinance. Exempt Fire Department staff shall receive Paramedic Pay consistent with the IAFF union agreement.

SECTION IV. Where City housing is provided, a portion of the estimated market rental value of housing shall be considered as compensation. For 2014, the estimated market rental value of the City Park house is $650/month. Thirty-five percent (35%), or $227.50 per month, of the market rental value will be considered as compensation for the employee who resides in the house as a condition of their job.

SECTION V. The salaries and wages provided for herein shall be effective from and after January 1, 2014.

Practitioners - Approximately 50% of our business is conducting housing studies and 50% is developing and implementing housing programs and projects, thus, we have a working knowledge of the housing programs and projects that we recommend.

Local Research - In addition to national sources we obtain research from local sources, including the County Equalization, City staff, realtors, developers, local elected officials, housing agency staffs, etc.

Visibility in the Community - We have a hands on approach to our studies, thus, we will be visible in the community conducting interviews and doing local research.

Flexible/Customized - We will customize the Housing Needs Study to address the needs of the City of Watertown.

Past Performance/References - We have provided a list of references and we are also confident that all our past clients will give us an excellent reference. Several of our clients have hired us to update previous studies.

Principals will conduct the Study - Steve and Scott will conduct the research, conduct the interviews, analyze the data, prepare the recommendations, present the information, etc.

14 Compensation

The total compensation for the preparation of the housing needs study for the City of Watertown is $24,900.

The proposed fee is a not to exceed amount and includes all costs associated with the study. An electronic file of the completed Housing Study will be provided.

We request that 50% of the fee is payable upon delivery of the draft and the remaining 50% upon satisfactory completion of the Study.
