The political fault lines that have emerged in the last election on the question of same-sex marriage suggest that there is no consensus on this issue. This article looks at the meaning of marriage against the backdrop of the same-sex marriage debate. Its focus is on the opposition to same-sex marriage. Drawing on the work of some leading conservative thinkers, it investigates whether a coherent, secular case can be made against the legalization of same-sex marriage and whether that case reflects how opponents of same-sex marriage think about the issue. In examining these questions, the article seeks more broadly to achieve a deeper understanding of the place of marriage in social life and to explore the implications of the recent controversy surrounding its reform. * Professor of Law, University of Pennsylvania Law School. 1059 WAX.DOC 10/5/2005 1:41 PM One striking aspect of the debate over the legal status of gay relationships is the contrast between public opinion, which is sharply divided, and what is written about the issue, which is more one-sided. A prominent legal journalist stated to me recently, with grave certainty, that there exists not a single respectable argument against the legal recognition of gay marriage. The opponents’ position is, in her word, a “nonstarter.” That viewpoint is reflected in discussions of the issue that appear in the academic literature. -

39 The Common Good and Legal Interpretation: A Response to Leonid Sirota and Mark Mancini Stéphane Sérafin, Kerry Sun, and Xavier Foccroulle Ménard* I. Introduction A renewed interest in the moral foundations of legal interpretation in the United States is increasingly reverberating in Canada. For example, on February 22, 2021, Leonid Sirota and Mark Mancini published a post on the Double Aspect Blog entitled “Interpretation and the Value of Law” (“IVL I”).1 Although the post itself merely claimed to show “[w]hy the inter- pretation of law must strive for objectivity, not pre-determined outcomes,”2 the timing of the piece implies that it was meant to respond specifically to Josh Hammer, the Newsweek cor- respondent and constitutional lawyer, who has recently proposed a framework of “common good originalism”3 to correct the perceived failures of the originalist framework applied by Justice Gorsuch of the US Supreme Court in Bostock.4 This is an argument that Sirota and * Stéphane Sérafin is Assistant Professor, Faculty of Law, Common Law Section, University of Ottawa. John Boswell: Posting Historical Landmarks at the Leading Edge of the Culture Wars JEFFREY CISNEROS UNIVERSITY OF TEXAS AT S AN ANTONIO INTRODUCTION ne of the most enduring and controversial figures in the field of history is OJohn E. Boswell. His work on homosexuality and the history of the Christian Church was published at a key time during the Stonewall Riots in the late 1960s and the removal of homosexuality from the list of diagnostic mental disorders in the mid 1970s. This social upheaval created a dynamic that not only influenced Boswell personally but contributed to the vehement reac- tion to his book Christianity, Social Tolerance, and Homosexuality: Gay People in Western Europe from the Beginning of the Christian Era to the Fourteenth Century. Written in 1980, this book has profoundly influenced the- ological debates in numerous Christian denominations, particularly in the United States. Boswell earned his PhD at Harvard in 1975 and was immediately hired in a tenure-track position at Yale University (curriculum vitae, Boswell Papers). His first book was based on his doctoral dissertation, The Royal Treasure: Muslim Communities Under the Crown of Aragon in the Fourteenth Century, which displayed his gifts as a medieval philologist working in Catalan, Aragonese, Castilian, French, and Latin with equal facility. The book investi- gated mudejeres (later called moriscos), Muslims living under Christian pro- tection prior to 1492 who did not convert to Christianity. The book received favorable reviews, and Boswell developed a reputation as an Iberian scholar with a talent for languages and an interest in the religions of medieval Western Europe. -

URBAN In “Milton’s Paradise Regain’d and the Second Temptation,” John T. Shawcross engages Claude J. Summers’s discussion of the “homosex- ual implications” of the “[t]all stripling youths rich clad, of fairer hew / Then Ganymed or Hylas” who attend the banquet with which Satan tempts Milton’s Son in Book 2 of Paradise Regained. Shawcross states that “this sexual interruption subtly recalls the widespread rumor of Jesus’s homosexuality, which persisted into the seventeenth century, as Milton must have been aware” (35; Shawcross cites Paradise Re- gained 2.352-53). Shawcross’s mention of this “widespread rumor” is made in a matter-of-fact manner, but his only evidence for this affir- mation appears in an endnote that follows his statement: “Summers cites references to this allegation; see 60-61 [of Summers] and notes 10 and 11” (39). However, an investigation of Summers’s article reveals two important problems: firstly, Summers never claims that any such rumor was “widespread”; and secondly, Summers’s own evidence for this rumor ranges from dubious to misleading. First, Summers briefly discusses in his article “a little-known and even less frequently acknowledged heresy that posits a homosexual relation- ship between Jesus and John the Beloved Disciple, who describes himself throughout his gospel as the best loved of the disciples” (60; italics mine). PRELUDE TO A SPEECH HAT follows is the text of a speech I delivered at Villanova Univer- Wsity School of Law on the occasion of the sixth Annual John F. Scarpa Conference, honoring the work of Professor John Finnis. The speech as presented was accompanied by a rather elaborate and occasion- ally ridiculous PowerPoint presentation, in which animated stick figures of John Finnis, John Gardner and others moved to and fro, illustrating differ- ent methodological starting points and varying “ways in” to thinking about law.1 My topic concerned methodological issues in general jurisprudence. My goals were three-fold: (1) to put to rest any lingering methodological debates between Finnis and John Gardner; (2) to clarify the distinctions between Finnis’s methodology and that articulated by Julie Dickson and reflected in the work of Joseph Raz; and (3) to outline a more critical approach to thinking about the law, by drawing on what is most appealing in Finnis’s methodology and yet rejecting Finnis’s view regarding the pre- sumptive obligation to obey law. -

Reprinted from http://www.glbtq.com John Eastburn Boswell was one of the late twentieth century's most influential historians of homosexuality and author of one of the first book-length histories on the subject. Born in Boston in 1947 into a military family, Boswell earned his undergraduate degree from William and Mary. A gifted medieval philologist, he received his doctorate from Harvard University in 1975, whereupon he joined the Yale University history faculty; he was made full professor in 1982. In 1987, Boswell helped organize the Lesbian and Gay Studies Center at Yale, which is now the Research Fund for Lesbian and Gay Studies. He was named the A. Whitney Griswold Professor of History in 1990, when he was also appointed to a two-year term as chair of the Yale history department. Boswell's first book was a well-received revision of his Harvard dissertation entitled The Royal Treasure: Muslim Communities under the Crown of Aragon in the Fourteenth Century, published in 1977. He later remarked that, given the academic climate of the 1970s, he felt it was necessary to earn his credentials as a "mainstream" historian before he could turn his attention to the subject that most engaged him, the emerging field of gay studies. In 1980 Boswell published his second book, the volume destined to make his reputation: Christianity, Social Tolerance, and Homosexuality. Its radical argument--that homosexual behavior between men was tolerated, even at times celebrated, by Roman Catholics prior to thirteenth-century church reforms--drew the ire of both gay studies scholars and conservative critics even as it guaranteed Boswell a large and enthusiastic popular readership. -

It is a work of painstaking scholarship, revealing the attitudes of the people to homo· sexuality in many different parts of Western Europe over a long period of time. In general, the author documents his assertions copiously; learned footnotes are found on practically every page and several appendices provide discussion about the difficulties of Pauline Greek terms and supply complete documents or gener ous excerpts from important works on the subject. But with all its learning the book suffers from a lack of objectivity in its interpretation of the data. -

At that time I was finishing a book on natural law in Aquinas.1 This book was the fruit of a methodolog- ical turn for which I found confirmation and an important source of fur- ther inspiration in John Finnis’s work on Natural Law2 and on what, in a second book, he called the Fundamentals of Ethics.3 The following, there- fore, is both an account of some aspects of my intellectual biography and an homage to Professor Finnis whom we have come together in this con- ference to honor.
