APPROVED UNITS OF COMPETENCY AND COMPETENCY STANDARDS

Pesticides Regulation 2017 clauses 19(8), 31(2)(b) and Schedule 2

Background The Pesticides Regulation 2017 (the Regulation) provides that certain users of pesticides must be qualified to use pesticides. A user will be qualified to use a pesticide if they have a licence issued under the NSW Pesticides Act 1999 or if they have achieved certain units of competency that are:  specified in a current training package endorsed by the Australian Industry and Skills Committee established by the Council of Australian Government’s Industry and Skills Council, or by its predecessor bodies; and  approved by the Environment Protection Authority (EPA).

Revocation of previous Approval The Notice of Approved Units of Competency under the Pesticides Regulation 2009 published in the NSW Government Gazette No 39 of 6 April 2018 at pages 1889 to 1890 is revoked.

Approved units of competency and standards

1. Competency standard for ground applicator work The following units of competency are approved by the EPA and are the competency standard for ground applicator work under a ground applicator licence for the purposes of clause 19(8) of the Regulation:

(a) the unit of competency known as unit code AHCCHM307 Prepare and apply chemicals to control pest, weeds and diseases specified in the AHC Agriculture, Horticulture and Conservation and Land Management Training Package; and (b) the unit of competency known as unit code AHCCHM304 Transport and store chemicals specified in the AHC Agriculture, Horticulture and Conservation and Land Management Training Package.

2. Approved competencies for recognised qualification The following units of competency are approved by the EPA for the purposes of the definition of recognised qualification in clause 31(2) of the Regulation and are required to be achieved for purposes of the issue of a prescribed qualification in that clause:

(a) the units of competency known as: (i) unit code AHCCHM307 Prepare and apply chemicals to control pest, weeds and diseases. and (ii) unit code AHCCHM304 Transport and store chemicals, specified in the AHC Agriculture, Horticulture and Conservation and Land Management Training Package; or (b) the unit of competency known as unit code AHCCHM201 Apply chemicals under supervision specified in the AHC Agriculture, Horticulture and Conservation and Land Management Training Package (refer to the notes to this Approval).

The units of competency in this Approval and their assessment requirements are available on the register of nationally recognised training components at www.training.gov.au .

Commencement This Approval takes effect on publication in the NSW Government Gazette.

NOTES

1. Minimum standard

All pesticide users who are required to achieve specified units of competency under clause 31(2)(b) of the Regulation should, wherever possible, attain both unit AHCCHM307 (Prepare and Apply Chemicals to control pest, weeds and diseases) and unit AHCCHM304 (Transport and Store Chemicals), which are part of the AHC Training Package and at Australian Quality Framework Level 3 (AQF3). The unit AHCCHM201 (Apply Chemicals under Supervision), which is part of the AHC Training Package and at Australian Quality Framework Level 2 (AQF2), is the minimum level of competency acceptable under the Regulation. At this level it is recommended that the pesticide user work under the supervision of someone who has achieved the AQF3 units of competency.

Pesticide users should seek training that is appropriate for their level of work and responsibility from Registered Training Providers. If users are working as unsupervised operators/farmers they should seek chemical training at AQF3. Pesticide users who have language or literacy difficulties and are unable to fulfil the requirements of the AQF3 units of competency can be deemed competent at AQF2 if they have successfully demonstrated competence at that level. Major providers of chemical training have been advised to provide training on this basis.

2. Review of approved unit of competency

The approved units of competency will be subject to future review. The review will be undertaken in parallel with reviews of the Regulation (as determined by the Subordinate Legislation Act 1989) or where the need arises. The review will also be undertaken in consultation with relevant groups and will take into account:

 any developments in the AHC Training Package and/or the Australian Qualifications Framework relating to pesticides;  any developments at national level regarding pesticide user training requirements.

3. Previous qualifications

If pesticide users have achieved one of the competency units superseded by the unit codes AHCCHM307, AHCCHM304 and AHCCHM201 they do not need to be trained or assessed until 5 years after the date on which they were issued their certificate or statement in recognition of their achievement of these competencies (see Table 1).

A person can use a pesticide without being qualified to use the pesticides in the circumstances detailed in clause 32(2).

Pursuant to section 47(2) of the Stock Medicines Act 1989, the Stock Medicines (Newcastle Disease (Avian Paramyxovirus) Vaccine) Order 2012 published at pages 1226-1228 of NSW Government Gazette No. 47 dated 4 May 2012 is repealed, as is any Order revived as a result of this repeal.

Temporary structures: Temporary structures (including stages, fencing, portable lavatories, food and beverage services and marquees) associated with special school events (fairs, open days, reunions, etc.) providing that the structures are erected within and used for a maximum period of 4 weeks after which they will be removed within a period of 4 days and not erected again within a period of 2 months. 10. Signage: Installation of temporary and wayfinding signage for room designations, exit signs and complex name signs provided that they: a) be located and be of a suitable size so as not to obscure views to significant buildings or damage significant fabric; b) be able to be later removed without causing damage to significant fabric; or c) reuse existing fixing points or insert fixings within existing mortar joints without damage to adjacent masonry. 11. Painting: Painting does not require approval under subsection 57(1) of the Heritage Act or notification to the Director- General under Standard Exemption 3 if the painting employs the same colour scheme and paint type as an earlier scheme or is painted in accordance with an agreed heritage painting scheme approved by the Heritage Council of NSW or its Delegate. Note: Where painting proposes to remove earlier significant paint layers, an analysis of earlier paint schemes is to be completed first and guided by the assessment and advice of a qualified and experienced heritage officer or consultant to ensure that any adverse impact on heritage significance is avoided. 12. Road and car park works: The following road, car parking, and traffic management work where there is no adverse impact on heritage significance:

a) installation, repair, renewal or removal of kerbing/edging, signage, line work, traffic/pedestrian safety bollards, wheel stops and minor access ramps; or b) resurfacing of existing bituminised road and car park surfaces. 13. Swimming pool: All works and activities associated with the maintenance and upkeep of the War Memorial Swimming Pool. 14. Extant canal: All works and activities associated with the cleaning and maintenance of the operational canal within the school grounds including the removal of weeds and other detritus. 15. Artificial lake: All activities and works associated with the maintenance and upkeep of the artificial lake including the removal of weeds and other detritus. 16. Sporting fields: Maintenance works associated with the care and upkeep of sporting fields within the State Heritage Register curtilage. 17. Agricultural fencing: The installation, repair, renewal or removal of agricultural or kangaroo control fencing where works do not adversely impact the significance of any known or likely heritage item. Note: This exemption does not apply if archaeological relics are likely to be present as advised by a suitably qualified and experienced archaeologist. 18. Yanco Agricultural High School agricultural works: Works associated with the production of crops or fodder for school purposes in the agricultural fields within the State Heritage Register curtilage. 19. Grazing: The grazing of livestock for school purposes in the agricultural fields within the State Heritage Register curtilage. 20. Yanco Agricultural High School irrigation works: Works associated with the irrigation activities of the school in the agricultural fields within the State Heritage Register curtilage. 21. SCHEDULE 3

(Terms of lease)

1 INTERPRETATION

1.1 Definitions In this Lease, unless inconsistent with or repugnant to the context, the following words and expressions will have the respective following meanings:

(a) "Authorised User" means:

(i) in respect of TfNSW and every person authorised by it, including but not limited to the invitees, contractors, lessees, licensees and the duly authorised employees or representatives of TfNSW or any contractor engaged for or on behalf of TfNSW; and

(ii) in respect of the Lessor, each of the Lessor’s employees, officers, agents, contractors, service suppliers, licensees, invitees.

(b) “Authority” means a government, semi-government, local government, statutory, public, ministerial, civil or other authority or body;

(c) “Commencing Date” means the date on which the notice of acquisition as referred to in section 20 of the Land Acquisition (Just Terms Compensation) Act 1991 (NSW) is published in the New South Wales Government Gazette;

(d) “Consequential or Indirect Loss” means:

(i) any Loss that does not flow directly and naturally from the relevant breach of this Lease or a duty of care; and

(ii) any loss of income, loss of revenue, loss of profit, loss of financial opportunity, loss of business or loss of business opportunity, loss of contract (other than this Lease), loss of goodwill, loss of use, loss of production or failure to realise anticipated savings (whether the loss is direct or indirect;

(e) “Contamination” means the presence in, on or under the Land of a substance at a concentration above the concentration at which the substance is normally present in, on or under (respectively) land in the same locality, being a presence that presents a risk of harm to human health or any other aspect of the Environment, and “Contaminated” has a corresponding meaning;

(f) “Costs” include costs, charges and expenses, including those incurred in connection with external advisers and consultants, and any legal costs on a full indemnity basis;

(g) “Designated Access Route” means either:

(i) the Existing Access Route; or

(ii) an alternate route designated and maintained by TfNSW from time to time pursuant to clause 11(c)(i), which may be redesignated, varied or changed pursuant to clause 11(c)(ii).

(h) “Dilapidation Report” means an investigation of the physical condition of the Land as at the Commencing Date, including but not limited to:

(i) the state of repair of the Land;

(ii) the structural condition of the Land and the sub-surface of the Land; and

(iii) the environmental condition of the Land;

(i) “Environment” means all components of the earth, including land, air and water and any ecosystems and all elements of the biosphere, and any human-made or modified Structures and areas;

(j) “Existing Access Route” means those areas of the Land utilised by the Licensor and its Authorised Users for access to and egress from Grand Ave North to the balance of Lot 1 in DP668318 immediately prior to the Commencing Date.

(k) “Land" means any land which is the subject of this Lease;

(l) “Laws” means all statutes, rules, regulations, proclamations, ordinances or by-laws, whether federal, state, local or otherwise.

(m) “Lease" means this lease and includes all annexures, appendices and schedules to this lease;

(n) “Liability” includes any liability or any kind whether for debt, cost (including legal costs, deductibles or increased premiums), expense, loss, damage, compensation or charge and whether:

(i) liquidated or not;

(ii) arising from or in connection with any obligation (whether as a principal obligation, a surety or an indemnity); or

(iii) legal or equitable, and whether arising under or for breach of contract, in tort (including negligence), restitution or at law;

(o) “Light Rail Legislation” means the Transport Administration Act 1988 (NSW) (as amended by the Transport Administration Amendment (Rail Agencies) Act 2003 (NSW)), the Rail Safety National Law as applied (with modifications) as a law of New South Wales by the Rail Safety (Adoption of National Law) Act 2012 (NSW), the Roads Act 1993 (NSW) and any other legislation or regulation governing the Lessee’s light rail operations, including but not limited to the operation of light rail services;

(p) “Lessor" means each and every person seised of the freehold in the Land;

(q) “Loss” means:

(i) any cost, expense, loss, damage, liability or other amount; and

(ii) without being limited by paragraph (a) and only to the extent not prohibited by Law, any fine or penalty,

excluding Consequential or Indirect Loss.

(r) “Outgoings” means all amounts paid or payable by the Lessor in connection with the Land (plus GST on those amounts to the extent that the Lessor does not receive an input tax credit for that GST) including the following:

(i) (rates and levies) rates, rents, levies and other charges payable to any Authority;

(ii) (taxes) imposts, duties, fees, deductions, compulsory loans or withholdings and taxes (excluding income tax and capital gains tax) payable to any Authority, including land tax on the basis assessed to the Lessor; and

(iii) (Services) the Cost of supplying, maintaining and repairing any Services, but excluding charges for all Services separately metered and consumed in the Land;

(s) “Project” means:

(i) the financing, design, construction, manufacture, installation, commissioning, operation and maintenance of stage 1 of a new light rail service in Parramatta; and

(ii) the design and construction of the utilities replacement, protection, adjustments or relocations, network alterations, property access works and critical works arising out of the works or activities described in paragraph (i);

(t) “Remediate” and “Remediation” includes the investigation, cleaning-up, removal, abatement, disposal of, containment, encapsulation or other treatment of Contamination and includes the monitoring and risk management of Contamination, as required by Law or any Authority;

(u) “Services” means all services or any one or more of such services including but not limited to water, irrigation, gas, electricity, telephone, sewerage, drainage, security and monitoring, lighting, optic fibre transmissions, private communications, dosed circuit security monitoring, closed circuit television monitoring, video and audio services, and “Servicing” will have a comparable meaning;

(v) “Structure" or “Structures" means all structures, erections, improvements, apparatus or any one or more of those things installed or to be installed on, over, under or through the Land necessary or appropriate (in the absolute discretion of TfNSW) for the purposes of this Lease including but not limited to, tunnels, ramps, viaducts, roads, support members, channels, cuttings, drains, wires, fibres, cables, pipes, conduits, ducts, pumps, sumps, pits and traps;

(w) "Term" means the period commencing on the Commencing Date and expiring on the Terminating Date;

(x) “Terminating Date” means the date that is the first to occur of:

(i) 30 June 2021; and

(ii) TfNSW providing the Lessor with written notice that the Land has been vacated and is no longer required for the Project.

(y) “TfNSW" means Transport for NSW (ABN 18 804 239 602), as constituted from time to time, and includes its successors and assigns and any administrator thereof or other person appointed by or on behalf of the New South Wales Government or any Minister thereof and any body in which TfNSW is merged or which as at the relevant time substantially fulfils the functions of TfNSW; and

(z) “Work” or “Works” means all excavation, erection and other work necessary or desirable (in the absolute discretion of TfNSW) for the purposes of this Lease or to facilitate the proper enjoyment of this Lease or to enable the carrying out of the obligations of TfNSW, including but not limited to laying down, constructing, placing, operating, examining, relaying, removing, altering, renewing, cleaning, repairing, testing and maintaining the Land and using the Structures in any manner.

1.2 Construction

Unless expressed to the contrary:

(a) words importing:

(i) the singular includes the plural and vice versa; and

(ii) any gender includes the other gender;

(b) if a word or phrase is defined cognate words and phrases have corresponding definitions;

(c) a reference to;

(i) a person includes a firm, unincorporated association, corporation and a government or statutory body or authority;

(ii) a person includes its legal personal representatives, successors and assigns;

(iii) a statute, ordinance, code or other Law includes regulations and other statutory instruments under it and consolidations, amendments, re-enactments or replacements of any of them;

(iv) a right includes a benefit, remedy, discretion, authority or power;

(v) an obligation includes a warranty or representation and a reference to a failure to observe or perform an obligation includes a breach of warranty or representation;

(vi) provisions or terms of this document or another document, agreement understanding or arrangement include a reference to both express and implied provisions and terms;

(vii) time is to local time in Sydney;

(viii) “$” or “dollars” is a reference to the lawful currency of Australia;

(ix) this or any other document includes the document as varied or replaced and notwithstanding any change in the identity of the parties;

(x) writing includes any mode of representing or reproducing words in tangible and permanently visible form, and includes facsimile transmission;

(xi) any thing (including, without limitation, any amount) is a reference to the whole or any part of it and a reference to a group of things or persons is a reference to any one or more of them; and

(xii) the word “week” means calendar week.

1.3 Headings

Headings do not affect the interpretation of this document.

2 EXCLUSION OF STATUTORY PROVISIONS

2.1 Statutory Provisions Negatived

The covenants, powers and provisions implied in leases by virtue of Sections 84, 84A and 86 of the Conveyancing Act 1919 (NSW) will not apply to this Lease and are expressly negatived.

2.2 No Short Form Words

In this Lease any of the forms of words contained in the first column of Part II of Schedule IV to the Conveyancing Act 1919 (NSW) will not imply any covenant under Section 86 of that Act

2.3 No Moratorium

To the extent permitted by Law the application to this Lease of any moratorium or other relevant legislation whether State or Federal having the effect of extending the term, reducing or postponing the payment of rent or otherwise affecting the operation of the terms of this Lease is expressly excluded and negatived. TfNSW agrees to waive and abandon the benefit of any claim which TfNSW may now or at any time have under any such Law.

3 LEASE TERM

3.1 Commencing Date and Terminating Date

The term of this Lease will commence on the Commencing Date and expire on the Terminating Date.

4 RENTAL

4.1 Rental

TfNSW must pay, as a rental, compensation;

(a) in the amount agreed between the Lessor and TfNSW in writing prior to the compulsory acquisition of this Lease; or

(b) in the absence of agreement on compensation (in accordance with the preceding subclause (a), in the amount determined by the Valuer-General pursuant to the provisions of the Land Acquisition (Just Terms Compensation) Act 1991 (NSW), or, failing subsequent agreement between the Lessor and TfNSW as to the amount of compensation, compensation as determined in any proceedings brought by the Lessor in the Land and Environment Court.

5 OUTGOINGS AND SERVICES

5.1 Outgoings

TfNSW must pay all Outgoings during the Term.

5.2 Services

TfNSW must pay directly to the relevant service provider all Services separately metered and consumed in the Land during the Term.

6 ASSIGNMENT/SUBLETTING

6.1 Assignment or Sub-Lease

TfNSW may, in its absolute discretion:

(a) sub-let or assign its interest in this Lease, and/or the Land;

(b) part with possession of the Land;

(c) permit any Authorised User to enter into possession of the Land; and/or

(d) permit any Authorised User to enjoy its rights under this Lease.

7 MAINTENANCE AND CLEANING

Subject to clauses 8.3 and 8.5, TfNSW will take such action as it considers, in its absolute discretion, appropriate for the maintenance and cleaning of the Land.

8 USE OF PREMISES

8.1 Permitted Use

TfNSW may, during the Term, use the Land for the construction, operation, support, and maintenance of or in connection with the Project, including but not limited to such rights as may, in the absolute discretion of TfNSW, be necessary for:

(a) the construction, operation, functioning or maintenance of any Structure;

(b) access to any Structure;

(c) the conduct of any Works;

(d) the support of;

(i) a construction compound;

(ii) any Structure; or

(iii) any land occupied by any Structure or upon, which any structure relies for support;

(e) the construction, operation, functioning and maintenance of Services;

(f) the placing on or stockpiling of materials of any type on the Land for the purposes of any Structure;

(g) the passing and re-passing of vehicles; and

(h) the conduct by TfNSW of its responsibilities and functions under Light Rail Legislation.

8.2 Alterations to the Land

Subject to clauses 8.3 and 8.5, TfNSW may alter the physical characteristics of the Land, including but not limited to the sub-surface and surface of the Land.

8.3 Reinstatement

Except where the surface of the Land or any Structures is entitled to remain following the Terminating Date pursuant to some other right benefiting TfNSW, TfNSW must, prior to the Terminating Date:

(a) restore the surface of the Land to its condition as at the Commencing Date; and

(b) remove any Structures from the surface of the Land.

8.4 Dilapidation Report

TfNSW may, in its absolute discretion, conduct a Dilapidation Report and deliver a copy of the Dilapidation Report to the Lessor. In the event that TfNSW delivers a copy of the Dilapidation Report to the Lessor within six (6) months of the Commencing Date, the Dilapidation Report will be prima facie evidence of the state of the Land for the purposes of clause 8.3.

8.5 Contamination

(a) Except as provided in clauses 8.5(b) and 8.5(c), this Lease does not affect the Lessor’s liability for Contamination on or migrating from the Land.

(b) TfNSW may undertake at TfNSW’s Cost Remediation that is required solely:

(i) as a result of; or

(ii) to enable,

the conduct of the Project by TfNSW.

(c) During the term of this Lease, TfNSW must undertake at TfNSW’s Cost and be liable for all Remediation of Contamination on or migrating from the Land where the Remediation is required to address Contamination:

(i) caused by TfNSW or TfNSW’s Authorised Users; or

(ii) exacerbated by TfNSW or TfNSW’s Authorised Users; and

(d) If TfNSW is required by Law to undertake a site audit or procure a site audit statement in respect of the Land, TfNSW will conduct such site audit and procure such site audit statement to the standards as required by Law for the Land and the Project.

9 QUIET ENJOYMENT

TfNSW may peaceably possess and enjoy the Land during the Term free from any interruption or disturbance from the Lessor.

10 LESSOR ACCESS THROUGH THE LAND

(a) Without limiting clause 9, TfNSW must grant the Lessor full and free right for the Lessor and its Authorised Users to go, pass and repass over the Land through the Designated Access Route, for access to and egress from Grand Ave North to the balance of Lot 1 in DP668318, at all times and for all purposes:

(i) on foot;

(ii) be vehicles, if and to the extent that commensurate vehicular access was available over the Land prior to the Commencing Date;

(iii) with wheelchairs or other disabled access aids; and

(iv) with or without animals.

(b) For the avoidance of doubt, this clause 10 does not require TfNSW to maintain a greater standard or degree of accessibility over the Land between Grand Ave North and the balance of Lot 1 in DP668318 than that which existed immediately prior to the Commencing Date.

11 DESIGNATED ACCESS ROUTE

(a) TfNSW must:

(i) ensure that at all times there is a Designated Access Route through the Land; and; and

(ii) must keep the Designated Access Route in a safe and trafficable condition,

reasonably appropriate to the exercise of the rights of the Lessor and its Authorised Users under clause 10.

(b) On the Commencing Date, the Existing Access Route is the Designated Access Route.

(c) From time to time after the Commencing Date and without notice to the Lessor, TfNSW is entitled to:

(i) designate and maintain by appropriate surface works, hoarding, barriers and signage, a Designated Access Route through the Land other than the Existing Access Route; and

(ii) redesignate, vary and change the Designated Access Route,

subject at all times to clause 11(a).

12 TERMINATION

The Lessor will not be entitled to terminate this Lease without the prior written consent of TfNSW.

13 ENCUMBRANCES

TfNSW’s interest in the Land created pursuant to this Lease will not be subject to any prior encumbrance.

14 RISK AND INDEMNITY

(a) TfNSW acknowledges that it occupies the Land entirely at its risk.

(b) TfNSW indemnifies and agrees to keep indemnified the Lessor from and against any claim or for loss or damage, expense or compensation in respect of any harm or injury whatsoever sustained or incurred by any person or caused to any property relating to the use of the Land by TfNSW.

15 EXCLUSION OF CONSEQUENTIAL OR INDIRECT LOSS

TfNSW has no Liability to the Lessor (whether in contract, tort, negligence, under an indemnity or otherwise), nor will the Lessor be entitled to make any claim against TfNSW in respect of, Consequential or Indirect Loss incurred or sustained by the Lessor as a result of any act or omission of TfNSW (whether negligent or otherwise).

16 LIGHT RAIL LEGISLATION

16.1 Acknowledgment

The Lessor acknowledges the effect of the Light Rail Legislation in relation to this Lease, including but not limited to any obligations imposed under that legislation on TfNSW.

16.2 Importation of statutory provisions

Subject to clause 2, if any Law, including but not limited to the Light Rail Legislation, requires that this Lease includes any provision or any provision is deemed to be included in this Lease, then this Lease contains that provision in the form prescribed by the Law.

17 TFNSW EXERCISING STATUTORY POWERS

(a) Nothing in this Lease operates to restrict or otherwise affect TfNSW's statutory discretion in exercising its powers as an Authority. If there is any such conflict between the unfettered discretion of TfNSW in the exercise of such powers, and the performance of TfNSW’s obligations in this Lease, the former prevails.

(b) Nothing in this Lease will in any way unlawfully restrict or otherwise unlawfully affect TfNSW’s unfettered discretion in exercising any of its functions as an Authority. Subject to clause 17(c), anything which TfNSW does pursuant to its functions, powers and capacity as an Authority will be deemed not to be an act or omission by TfNSW under this Lease and will not entitle the Lessor to make any claim, suit, demand, action or proceeding against TfNSW.

(c) Clauses 17(a) and 17(b) do not limit any liability which TfNSW would have had to the Lessor under this Lease as a result of a breach by TfNSW of a term of this Lease but for clauses 17(a) and 17(b).
