O R D E R Sri Nimmala Ravi, Jangaon District-506167 has filed 2nd appeal dated 08-12-2018 which was received by this Commission on 10-12-2018 for not getting the information sought by him from the PIO / O/o The Executive Engineer, Irrigation and CAD Department, I.B. Sub Division, SRSP Stage-II, Division No. 1, K.C. Camp, Chintagattu, Warangal Urban District-506015 and 1st Appellate Authority / O/o The Executive Engineer, Irrigation and CAD Department, I.B. Sub Division, SRSP Stage-II, Division No. 1, K.C. Camp, Chintagattu, Warangal Urban District-506015. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 22-10-2018 before the PIO under Sec.6(1) of the RTI Act, 2005, requesting to furnish the information on the following points mentioned in his application: TSIC P.T.O Note: This is system generated copy and no signature is required. ::2:: The Public Information Officer has not furnished the information to the appellant. Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 30-11-2018 before the 1st Appellate Authority u/s 19(1) of the RTI Act, 2005 requesting him to furnish the information sought by him. The 1st Appellate Authority has not responded to the Appellant. As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission u/s 19(3) of the RTI Act, 2005 requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him. The Appeal was taken on file and notices were issued to both the parties for hearing on 29-11-2019. The case is called on 29-11-2019. The Appellant is present. The Public Information Officer / Sri B.Krishna, Technical Officer is present. The First Appellate Authority is absent. The Appellant submitted that the Public Information Officer has furnished false information to the court. He also submitted that award has not been passed and the amount has not been deposited. The Public Information Officer submitted that vide letter No. EE/SRSP-II/Div- 1/PIO/KCC/WGLRTI/448/M dated 12-12-2018, part information was furnished. He also submitted that vide letter No. RDO/LAQ/RTI-Act-2005/15L/ARMCCanal/PIO/2019-20/D/2363/19 dated 23-11-2019, further information was furnished to the appellant. He also submitted that apart from land in survey number 151, there are several other survey numbers included in the acquired area. Payment was made to all others and the award in respect of the appellant in respect of survey No. 151 is presently under process. The Commission observed that it would be appropriate for the appellant to bring it to the notice of the court that false information has been furnished, as this Commission cannot sit in judgement over the proceedings of some other judicial authority. With the above observation, the appeal is closed.
