2. Reason and purposes for introducing and maintaining State Trading Enterprises (STEs)

The objectives of granting special privileges on export or import of certain products are the following:

EXPORT

(i) Export privileges for some agricultural and minor forest produce, which are grown or harvested by large numbers of small farmers or tribal farmers have been given to STEs to enable better marketing, realization of better prices, ensuring a steady domestic supply and preventing wide domestic price fluctuations.

(ii) Similarly for ensuring a reliable supply of kerosene and Liquified Petroleum Gas (LPG), which are used as household fuels, exports are allowed only through STEs. Exports by STEs are necessary for conservation and proper utilization of some ores of metals.

IMPORT

The government procures food-grains and certain select agricultural items from farmers at a remunerative minimum support price. This ensures India's small and marginal farmers a fair return on their investment. The procured food-grains and agricultural items are then supplied through the public distribution system at variable prices, some of it at market prices and some at subsidized rates for those living below the poverty line. STEs domestically procure and import, depending on the market supply situation and the demand. Such operations by STEs enable effective monitoring of the supply situation which, in turn, can ensure that concerns relating to food security are appropriately addressed. In the case of petroleum products, imports/exports are undertaken at market determined prices. Regarding domestic pricing, a system of domestic support for kerosene and LPG (used as domestic fuel), is presently in place, necessitating imports through a single monitorable route. In the context of fertilizers, state trading is necessary to properly implement and manage supplies to the farmers.

3. Description of the functioning of the State Trading Enterprises

A. The exclusive right to export or import is granted to an enterprise under the provisions of the Foreign Trade Policy (FTP). This policy requires that any goods, the import or export of which is governed through exclusive or special privileges granted to STEs, may be imported or exported by the STEs as specified in the ITC (HS) Classification of Export and Import Items book, subject to the conditions specified therein. This book and amendments, if any, are available at the website http://dgft.gov.in.

B. All the STEs granted special privileges in respect of goods, the import or export of which are governed through the provisions of the FTP, shall make any such purchases or sales involving imports or exports, solely in accordance with commercial considerations including price, quality, availability, marketability, transportation and other conditions of purchase or sale. These enterprise(s) act in a non-discriminatory manner and afford the enterprises of other countries adequate opportunity in accordance with customary business practices to compete for participation in such purchases or sales.

C. EXPORT

(i) In the case of onion and other forest produce, there is no quantitative ceiling for exports and market forces determine export quantities of these items. Export prices are determined on commercial considerations and by the demand and supply forces in the international market. Onion is kept under STEs provisions since it is a domestically sensitive product, necessitating the availability of adequate quantities of domestic varieties for the domestic market. The rights granted in the case of onions are for safeguarding the interest of the large number of small farmers in terms of getting a remunerative price and for regulation of the domestic price and availability. The objective of granting exclusive exporting rights for minor forest produce is to provide marketing assistance to poor tribal farmers and to obviate/ alleviate the possible exploitation of the poor indigenous tribes by middlemen. Details of the STE's granted exclusive exporting rights for onions and forest produce are:

(a) National Cooperative Consumers' Federation (NCCF) of India Ltd.: This is the apex body of Consumer Cooperative Societies in India, registered under the Multi-State Cooperative Societies Act 1984. It provides managerial assistance to improve the functioning of consumer cooperatives in India. It also helps distribute general use consumer goods at competitive prices.

(b) National Agricultural Cooperative Marketing Federation of India Ltd (NAFED): This was set up in 1958 with the objective to organize, promote and develop marketing, processing and storage of agricultural, horticultural and forest produce. It undertakes inter-state, intra-state and export/ import trade to help farmers get remunerative prices for their produce, stabilize prices, shield farmers against distress sales and maximize both producers and consumers value.

(c) Karnataka State Agricultural Produce Processing and Export Corporation Ltd. (KAPPEC): It is a Bangalore based company by the Government of Karnataka and incorporated under the provisions of the Companies Act, 1956. Created in 1996, the main purpose of the company is to develop, and promote the production, processing, procurement and export of agriculture, horticulture and floriculture products from the State of Karnataka.

(d) Gujarat Agro Industries Corporation Ltd. (GAIC): GAIC, which is based in Ahmedabad, is a company incorporated under the Companies Act, 1956. It has been promoted by the Government of Gujarat. The main objective is to finance and promote industries based on agriculture, to manufacture and or market export quality agricultural inputs and effect market interventions on behalf of the state government in cases of crisis to protect small and marginal farmers.

(e) Madhya Pradesh State Agro Industries Development Corporation (MPSAIDC): Its major activities include the marketing of agricultural inputs, manufacture of high quality Bio-Fertilizers, production of Hybrid vegetable seeds, promotion of agro processing industries in the state of Madhya Pradesh and procurement and marketing of vegetables and fruits in raw and processed form.

(f) Tribal Cooperative Marketing Development Federation of India Ltd (TRIFED): It is an apex level Cooperative Federation, set up in 1987, to provide fair economic returns to tribals for their agricultural and forest produce. It takes up activities like training of tribal growers for scientific cultivation and collection methods to add value to their produce. It has been granted the right to export Gum Karaya and also issues No Objection Certificates (NOC) to associate shippers registered with TRIFED for the export of Gum Karaya.

(g) The Karnataka State Cooperative Marketing Federation Limited (KSCMF): Functioning since 1947, the federation has been an apex co-operative institution in the state of Karnataka for the procurement and marketing of Agricultural commodities. The Federation has been granted the rights of an STE for exports of all varieties of onions.

(h) Andhra Pradesh State Co-operative Marketing Federation Ltd (AP MARKFED): It was established in 1957 with its headquarters at in the state of Andhra Pradesh. It is a federation of Marketing Co-operative Societies in Andhra Pradesh set up with the main objective of helping farmers to secure better price for their produce by taking care of their marketing needs and providing agricultural inputs. Against this objective, the AP MARKFED's present activity consists of sale of farm inputs like chemical fertilizers, pesticides & seeds, maintenance of godowns & procurement of agricultural commodities through its member societies.

(i) Maharashtra State Agricultural Marketing Board (MSAMB): It is a statutory authority responsible for the development of agricultural marketing in the State of Maharashtra. This body has been granted the right to export Onions (all varieties) as and when there is an adequate surplus domestic production of Onions.

(j) Andhra Pradesh State Trading Corporation (APSTC): APSTC is an Andhra Pradesh government undertaking set up in 1970 for financial and trading operations. It undertakes domestic marketing in selective goods and commodities. It is engaged in the import of goods and commodities for government departments and undertakings. It is also promoting exports from the state of Andhra Pradesh.

(k) Spices Trading Corporation Ltd. (STCL): It was set up in 1982 as the Cardamom Trading Company Limited, a company incorporated under the Companies Act, 1956. Its main objectives are to carry on domestic and international trade in spices and their products; to process and preserve spices and manufacture their products; to support, project, maintain, increase and promote the production of their products as also their sale and exports; to undertake and promote research and development of spices and their products; to promote and develop new markets for spices and their products; to carry on business as dealers and exporters of agricultural commodities and products thereof; and to conduct open auctions and sell spices regularly at all important centres in India as well as in other countries.

(l) West Bengal Essential Commodities Supply Corporation (WBECSC): This is a state level Public Sector Undertaking that is fully owned by the Government of West Bengal. The Corporation has been granted the rights of an STE for the export of all varieties of onions.

(m) Madhya Pradesh State Co-operative Oil Seeds Growers Federation Limited (MPSCOGFL): This Federation was constituted and registered in 1979 under the Madhya Pradesh State Cooperative Societies Act 1960, as a part of 's national programme of re-structuring the production of oilseeds and edible oils. The objective of the Federation is to usher in integrated cooperative effort in cultivation, processing and marketing of oilseeds.

(n) Indian Sugar Exim Corporation (ISEC): ISEC is a corporation formed in 1969 by the two apex bodies of the sugar industry viz. the National Federation of Cooperative Sugar Factories Limited (NFCSF), and the Indian Sugar Mills Association (ISMA). One of the objectives of the corporation is to promote exports and imports of sugar and sugar products and by-products. ISEC has been granted the rights for export of raw sugar and white sugar under preferential tariff to US&EU during the period.

(ii) For certain minerals and ores, exclusive exporting rights are granted to a particular enterprise. Export prices in all these cases are determined on commercial considerations and by the demand and supply forces in the international market. In the case of iron ore, prices may be fixed on a yearly basis as the exports take place under long-term/annual contracts. In the case of mineral and ore products, the quantities available for export are liable to be restricted from time to time, keeping in view the domestic requirement as well as the need to conserve exhaustible natural resources.

(a) Kudremukh Iron Ore Company Ltd (KIOCL): KIOCL has been granted the right to export Iron ore concentrate, produced by itself, prepared by beneficiation and/or concentration of low grade iron ore containing 40% or less of iron and the right to export Iron Ore pellets manufactured by the company out of concentrates produced by itself. The ore available at the mines cannot be put to use commercially without beneficiation or value addition, and technical and logistical constraints make it unviable to put to use the production of the beneficiated ore domestically. The export prices for the product are determined by the market forces of demand and supply. The export levels are based on the basis of supply capacity and demand for the products. The market structure is competitive in case of pellets.

(b) Manganese Ore India Ltd (MOIL): MOIL was established in 1962 and is the largest producer of Manganese Ore in India. Being a Government of India undertaking, the Government of India holds 81.57 per cent shares in MOIL with the State Governments of Maharashtra and

Madhya Pradesh, holding 9.62% and 8.81% shares respectively. MOIL produces and sells different grades of Manganese Ore. It has been granted the exclusive right to export manganese ores other than lumpy/ blended manganese ore above 46% manganese. All transactions are carried out on commercial terms by the enterprise.

(c) Minerals and Metals Trading Corporation Limited (MMTC Ltd.): MMTC was established in 1963 as a Company incorporated under the Indian Companies act, 1956. MMTC is today India's leading international trading company. MMTC is a major global player in the minerals trade and is the single largest exporter of minerals from India. With its comprehensive infrastructural expertise to handle minerals, the company provides full logistical support for procurement, quality control and guaranteed timely deliveries of minerals from different ports, through a wide network of regional and port offices in India. It has been granted the right to export only specified varieties of iron ore; manganese ore, chrome ore lumps and mica scrap as and when there is a surplus of these raw materials.

D. IMPORT

The State Trading Enterprises (STEs) domestically procure/ purchase and import depending on the supply situation as well as prices.

(i) For agricultural products, since the main purpose of maintenance of state trading is both a fair return to the farmers as well as food security i.e., availability of adequate food for all sections of the society at prices affordable by them, domestic and international prices as well as supply conditions are the main determinants of the quantities of imports. The resale price of imported products is based on commercial considerations. The imports face fair competition from the domestic market. However, in the case of bulk importers, they are able to negotiate fairly competitive rates.

(a) Food Corporation of India (FCI): FCI was setup under the Food Corporations Act 1964, in order to fulfil the objectives of the Food Policy viz. effective price support operations for safeguarding the interests of the farmers; distribution of food grains throughout the country for the Public Distribution System; and Maintaining a satisfactory level of operational and buffer stocks of food grains to ensure National Food Security. FCI has been granted the right to import cereals like wheat, rye, oats, rice, grain sorghum, buckwheat, millet, canary seed, jawar, bajra, ragi and other cereals.

(b) Projects and Equipment Corporation of India Limited (PEC): PEC Ltd. was incorporated as a separate Company in 1971. At the time of incorporation, it was called as The Projects & Equipment Corporation of India Ltd. and was a subsidiary of the State Trading Corporation of India Ltd. The Corporation became an independent Company, directly under the then Ministry of Commerce, w.e.f. 27.3.1991. The Corporation undertakes import of agro commodities. It has been granted the privilege to import, under Tariff Rate Quotas (TRQs), certain agri products such as Milk or cream in powder, granule or other solid forms and Maize, other than seed quality.

(c) National Dairy Development Board (NDDB): The National Dairy Development Board (NDDB) was founded in 1965. The NDDB was created to promote, finance and support producer-owned and controlled organisations. NDDB's programmes and activities seek to strengthen farmer cooperatives. Because of its expertise in procurement and marketing, NDDB has been granted the privilege to import, under Tariff Rate Quotas (TRQs), certain agri products such as Milk or cream in powder, granule or other solid forms and Crude sunflower seed or safflower oil or fractions thereof; Refined rape, colza, canola or mustard oil.

(d) State Trading Corporation (STC) of India Ltd.: STC was set up in 1956, as a corporation under the Indian Companies Act 1956 and is one of the premier international trading organizations of the country. Being a specialized trading enterprise, STC has been granted the right to import copra, crude edible oil (Coconut oil and its fractions) and Urea. STC was allowed to import Maize in 2009-10. The State Trading Enterprises has not entered into any long term contracts.

(ii) Regarding fertilizers, India maintains a system of support for both imported as well as domestic fertilizers. A state trading enterprise imports or procures domestically, keeping in view the international prices, the domestic demand and the necessity of assured supply to farmers. The import levels of urea are established in consultation with the Department of Fertilisers and the Department of Agriculture and Co-operation. The resale price for both indigenous and imported urea has been fixed by the Government of India with no discrimination between domestic and imported stock. The Government of India authorises the STEs to import urea for supply to urea handling and marketing companies for distribution throughout the country.

(a) Minerals and Metals Trading Corporation Limited (MMTC Ltd.): MMTC has been granted the exclusive importing rights to import Ammonium Sulpho Nitrate and Urea.

(b) Indian Potash Limited (IPL): IPL's major activity is marketing and sales promotion of potash. IPL is the STE for import of urea and the Department of Fertiliser in the Government of India imports urea through this enterprise. The enterprise has not entered into any long term contracts.

(iii) India being petroleum deficient, imports a major portion of its requirements, through the STEs following the normal commercial practices.

(a) Indian Oil Corporation Limited (IOCL): Incorporated in 1959, became a Corporation in 1964. This company has been granted the right to import all types of Motor spirit (Gasoline), all types of aviation spirit, all types of spirit type (gasoline type) jet fuel, Kerosene type jet fuels (Aviation turbine fuel), Diesel gas oil, Other gas oil, Kerosene, Crude Oil and Liquefied Petroleum Gas. It has also been granted the right to export Crude Oil.

(b) Corporation Limited (BPCL): Bharat Refineries Limited which was formed on 24 January 1976, was renamed as Bharat Petroleum Corporation Limited on 1 August 1977. BPCL produces a diverse range of products, from and solvents to aircraft fuel and specialty lubricants and markets them through its wide network of Petrol Stations, Kerosene Dealers, LPG Distributors, Lube Shoppes, besides supplying fuel directly to hundreds of industries, and several international and domestic airlines.

(c) Hindustan Petroleum Corporation Limited (HPCL): HPCL was formed in 1974 with the takeover and merger of Esso standard and Lube India Limited undertaking. The Caltex Oil Refining India Limited and Kosan Gas Company were subsequently merged with HPCL. It is India's second largest refining and marketing company.

The imports, exports and domestic activity for items, for which special privileges have been granted to designated STEs in the last two years, are enclosed in Tables I, II and III respectively. The source of the data is the data provided by the STEs themselves. These figures remain provisional and are subject to any further amendments and additions.

5. Reason why no foreign trade has taken place (as appropriate)

In the case of agricultural products, the domestic availability and prices obviated the need for export and also led to reduced demand for exports.
