Borderization in Georgia: Sovereignty Materialized Edward Boyle∗ Abstract This paper shall examine the process of borderization that has been proclaimed as occurring along the Georgian-South Ossetian boundary. This boundary is one that remains largely unrecognized, as the claims of the Georgian state to sovereignty over South Ossetia are accepted by the majority of the international community. The crucial exception to this is Russia, under whose aegis this process of borderization is occurring. The result is the creation of a physical barrier around the territory of South Ossetia, one that seeks to materialize what was previously an administrative fiction on the ground, halting the movement of people and goods across this border and dividing people from their livelihoods. The paper shall consider what meaning this fencing has within the context of Georgia’s borders, and reflect upon the larger lessons that can be drawn for the concept of sovereignty and the status of borders in the contemporary world. Reporting the Border On April 15, 2014, three crew members of a Tbilisi-based television station were detained by Russian forces close to the village of Adzvi bordering South Ossetia. TV3 announced that its reporter Bela Zakaidze, cameraman Vakhtang Lekiashvili and broadcast technician Mikheil Mikhoev had been detained while working on a report about the shifting of the boundary between South Ossetia and Georgia deeper into Georgian-controlled territory. RES, South Ossetia’s official news agency, citing the South Ossetian Special Envoy for Post-Conflict Issues, Murat Jioev, reported that “three Georgian citizens were detained in the vicinity of South Ossetia … for violating the state border.” 1 Russia’s Ministry of Foreign Affairs issued a statement that Russian border guards, protecting the boundary between Georgia and South Ossetia as per the agreement between the governments of Russia and South Ossetia, had arrested three Georgian journalists and that, “According to the rules the detainees were transferred to the South Ossetian authorities. -

Existence of ancient human being on Georgian territory is confirmed from the early stages of anthropogenesis. Nearby Dmanisi valley (80 km south-west of Tbilisi) the remnants of homo erectus are found, age of them is about 1,8 million years old. At present it is the oldest trace in Euro-Asia. Later on the Stone Age a man took the whole territory of Georgia. Former settlements of Ashel period (400–100 thousand years ago) are discovered as on the coast of the Black Sea as in the regions within highland Georgia. Approximately 6–7 thousands years ago people on the territory of Georgia began to use as the instruments not only the stone but the metals as well. -

In 2018, the Government was in the process of intensifying reforms, with a special emphasis on fulfilling its commitments under the Association Agreement with the European Union and the European Atomic Energy Community and their Member States. Aware of the complexities of these reforms and the steep learning curve they carry for enterprises, the Government has been pursuing a phased approach. Implementation of reforms is spread across several years, with those sectors requiring intensive support accorded priority treatment. -

The EU has revised the format of a naval Operation Sophia. Its mandate is extended for 6 months, though it no longer envisages marine presence. The UN has officially recognized Ukrainian seamen captured by Russia as prisoners of war. The number of Russian and Turkish citizens who have been banned from entering Ukraine because of unconfirmed purpose of travel is decreasing, whereas that of banned Israeli citizens has substantially increased. The number of Ukrainians in Poland in 2018 was estimated at 1.27 million based on smartphone data. The number of officially registered IDPs in Donetsk, Kyiv, and Luhansk oblasts and in the city of Kyiv has decreased due to the deletion of double entries from the database. The Migration Governance Indicators (MGI) profile has been approved. The Ministry of Education and Science of Ukraine has announced changes related to education of foreign students. The staff of the refugee accommodation center in Yahotyn and the temporary holding facility for irregular migrants in Mykolaiv region has increased. The active phase of preventive measures under the code name ‘Migrant’ has been launched. Kordon–2019 annual operation has been announced to be held in April–November. 1. The Constitution-making Politics in Georgia By Anna Kapanadze Submitted to Central European University Department of Political Science In partial fulfillment of the requirements for the degree of Master of Arts Supervisor: Professor Nenad Dimitrijevic CEU eTD Collection Budapest, Hungary (2010) Abstract My thesis is about the constitution-making politics in Georgia - 1995, 2004, 2010. In the thesis the Georgian Constitution and the constitution-making process are discussed in terms of the separation of powers and the chapters and articles of the Georgian constitution (constitutions) concerning governance are examined. I analyze the consequences of political changes in Georgia: fall of the regime, ‘revolution’, war, economic and political crisis and how the amendments of the Constitution serve to maybe identifiable group of people. In the first three chapters of the thesis the theoretical and historical overview of the constitution- making process on the one hand and the Georgian constitutionalism history on the other are provided. Following chapters are concentrated on the period since 1995 and discuss articles of the Georgian constitution concerning separation of powers. In these latter four chapters three main ‘constitutional waves’ in Georgia are discussed: the first constitution after the fall of the Soviet Union, main amendments in terms of separation of powers after the ‘Rose Revolution’ and the ongoing situation and the National Constitutional Commission working on several drafts of a new type of arrangement of the government in Georgia. The pre- concluding chapter offers general assumptions and expectations about the ‘new Constitution of Georgia’. My general finding is that the Georgian constitution-making process is heavily influenced by the agents’ interests and consequently the particular articles of the Constitution of Georgia always reflect these interests. -

Statute of the Ministry of Internal Affairs of Georgia Chapter I General Provisions 1. The Ministry of Internal Affairs of Georgia (hereinafter referred to as “the Ministry”) is the system of special, militarized institutions implementing the executive authority, which within the frames of its competence envisaged by the legislation ensures the protection of state security and public order, human rights and freedoms from illegal encroachment. 2. While performing its functions the Ministry represents the State. 3. According to the legislation of Georgia and international agreements, the Ministry cooperates with the relevant services of foreign countries. 4. The Ministry is financed from the State budget. The Ministry has a seal with the image of the State Emblem, independent deposit and account in the treasury. Georgia was much featured in the mythology of ancient times, chroni- cled by historians and travelers who ventured to the farthest reaches of the known classical world. Stretching from the Black Sea to the Caspian, Georgia lay athwart important East–West trade routes. Through the vagaries of history, Georgia enjoyed independence one thousand years ago, only to be subsumed by the Russian Empire in the nineteenth century. More recently, the republic existed within the borders of the Soviet Union. In 1991, the Soviets’ relaxed hold on their constituent republics allowed the proud and restive Georgians to proclaim independence. With a num- ber of contending political groups, Georgia today fi nds itself in fl ux.
