Election Notification in respect of 40- constituencies under Bodoland Territorial Council was issued on 18-03-2015 to hold poll on 0g-04-2015. Accordingly poll of the BTC was held on 08-04-20L5, re-poll was held on 10-04-2015 in 2(two) Polling stations against Polling station Nos. 5, saraibil (sr) and 36, Horisinga(sr) and counting held on 11-&l-2015.

The entire process of Election could be held completely in a free , fair, transparent as well as peaceful manner. Tum out of the voters was around 7g.1g% which may be considered as high tumout in comparison to such figrrres of the last elections in the BTC.

I would like to convey my than-kfulness to all concerned viz. No. SEC.51/ 2015/ 4 : Whereas Election to the General Council of the BTC has been notified vide Commission's Notification No. SEC.5ll 2ol5l 2 dt. 18.03.2015, it is necessa4 that the exisdng maximum limit of expenditure by a candidate of BTC Election is to be re-determined.

And, Whereas, the matter was put to discussion in a meeting chaired by State Election commissioner Assam and attended by commissioner & secretary, wpr & BC Department and officials of Finance Department, wherein, it was decided to raise the maximum limit to Rs. 5.00 lakhs from the existing limit of 3.00 lakhs, in parity with such increase in respect of Election to the Stare kgislative Assembly Constituencies, the State Election Commission, therefore, is pleased to fix the maximum limit of expenditure by a candidate in connection with the BTC election at Rs. 5.00 lakhs (Rupees five lakhs) only.

23 MODEL CODE OF CONDUCT

h order to ensure free and fair poll during the election to Bodoland Territorial Council, the Assa State Election Commission prescribes the following code of conduct. This may be called the Mod Code of Conduct' This will come into force from the date and time of Notification of the Election ar shall remain in force till the Election process is-over. 1' The election manifesto and other printing materials published by the political parties ar candidates must be in consonance with the direction as contained in section 121 A of tt Representation of the People Act, 1951 and as such all publication of hand bills leaf-le placards etc. shall contain the names of press, printer and publisher (Extract of Section 127 of the Representation of the people Act 1951 enclosed) 2' No political party or any candidate or their followers shall fix posters, festoons and such othr printed or hand written election materials in the premises of the State Government. Centn Government, Semi State Government, central Government and all the state and centri Govemment UndertakingVCorporationVBoards etc. offices. 3 Such fixing of posters etc. in private building may be made with the due consent of the owner. 4' Every effort shall be made by all political parties will and the candidates not to indulge, in an, communal activib' which may vitiate healtheir and peaceful atrnosphere of communal harmony < a place. 5. No religious place of any community be taken as a pratform for election propaganda by an candidate or political party. 6. If more than one procession tries to come to one place, prior approval of the route to be followed, from the district administration shall be necessary and the same shall be binding on the organisers/candidates. 15. No effigy of any political party or candidate shall be bum/destroyed by candidate of other political party during ttre period of election. 16. Registration number of vehicles used by the candidates and political parties shall be provided to district administration. l':,. No vehicle shall be provided for transportation of the voten to the polling booths on the day of election either by the candidate or by the political party or thet agentysupporters. 18. No body shall force any person to vote against a particular party/candidate by any candidates or any member of any political party. 19. There shall be no canvassing in any form by political party, candidates and their supporters on the day of the poll and during tlrity six hours before the commencement of the poll. 20. No Minister/Member of Parliament/Member of Legislative AssemblylN4embers of Bodoland Tenitorial Council and any other person shall use Mike during the day of the poll. 21. The contesting candidates can use the vehicle as follows : two light vehicles by one candidate. This however, excludes the vehicles of the security pemonnel provided to the candidate. 22. The candidate and the political party in power shall exercise utmost restraint in use of their official power and shall follow the restriction as enumerated below : a) No Minsiter/I\4ember of Parliament/Member of lrgislative Assembly/I\4ember of Bodoland Territorial council and any other person having a Govemment vehicle shall use the sarne in election campaign and any other matter relating to elections of any of the local bodies. b) No inauguration or foundation stone laying ceremony be organised in any constituency after the poll notification issued by the Assam State Election Commission. c) No financial aid/GrantVinputs of any development scheme shall be provided to the voters by Minsiters and any other member of the political party in power. d) No Ministeril{ember of ParliamentiMember of Irgislative AssemblyilVlember of Bodoland Tenitioral Council shall enter the polling boottr in their official capaclty. e) No offrcial machinery shall be used by the Minister or other office bearers of the political party in power for election purpose. 0 No Govemment employee shall attend any election, meeting organised by political parties/ candidates or Miniters. g No Government vehicle or vehciles of public sector undertaking be allowed to be used for electioneering by candidate or political parties. Although these restrictions have been imposed in areas failing within the Bodoland Tenitrorial Council, the State Govt. or for that matter the Central Govt. or any other agency shall not announce any new shceme or gant any financial aid even fron outside the territorial council area.

25 EXTRACT OF TIIE SECTION 127 A OF TTIE REPRESENTATION OF TIIE PEOPLE ACT, 1951 121 . A. Restrictions on the printing of pamphlets, posters etc. 1. No person shall print or publish or cause to be printed or published any election paml

posters which does not bear on its face the name and address of the printer and the 1 thereof. 2. No person shall print or cause to be printed any election pamphlet or poster. a) Unless a declaration as to the identity of the publisher thereof, signed by him and by two persons to whom he is' personally known is delivered by him to p: duplicate and b) Unless, within a reasonable time after the printing of the document, one cop declaration is sent by the printef together with one copy of the document i) Where it is printed in the capital of the State, to the Chief Election Officer and ii) In any other case, to the district Magistrate of the district in which it is printed 3. for the purpose of this section- a) any process for multiplying copies of a document other than copying it by hand, deemed to be printing and the expression "Printef' shall be constructed accordingl b) "Election Pamphlet or Postel' means any printed pamphlet, hand-bill or other d distributed for the purpose of promoting or prejudicing the election of a canc group of candidates or any playcard or poster having reference to an election, not include any hand-bill, playcard or poster merely announcing the date, time, p other particulars of an election meeting or routine instructions to election a workers. 4. Any person who contravenes any of the provision of sub-section (1) or Sub Section be punishable with imprisonment for a term which may extend to six months, or with fir may extend to two thousand rupees, or with both.

ELECTORAL OFFENCE 1) A person shall be guilty of an electoral offence, if at any election, he- a) fraudulently destroys or fraudulently defaces any nomination paper, or b) fraudulenfly defaces, destroys or removes any list, notice or other documents affix under the authr-,rity of a Renrrning Officer, or c) fraudulently defaces or fraudelently destroys any Ballot Paper or the official marl Ballot Paper or any declaration of identity or official envelope used in connect voting by person on election duty, or d) without due authority, supplied any Ballot Paper to any person or receive an Paper from any person or is in possession of any Ballot papel or e) fraudulently puts into any Ballot Box anything other than the Ballot paper whi authorized by lau Lo put in. or without due authority destroys, takes, opens or otherwise interferes- with any Ba or Ballot Papers than in use for the purpose of the election, or fraudulently or without due authority, as the case may be, attempts to do an foregoing acts or wiilfully aids or abets the doing of any such acts. 2l Anl penon guiln of an electoral oftence under this rule shall be punishable *ith rmpn:onmenr for a term uhich may extend to six months or with fine or with both. DISPUTES REGARDING ELECTIONS/CORRUPT PRACTICES 1) No election shall be called in question except by an election petition presented in such manner as may be prescribed and before such authority as may be appointed by the Govemment. fiom time to time, by notification in the Offical Gazette; Provided that no person below the rank of a District Judge within the meaning of Anicle l-36 of the Consdn.rtion shall be appointed for the purpose. 2) No election can be called in question e-\cept on anv one or more of the following grounds. namely : a) that on the date of his election the returned candidate was not qualified or *a. disqualified, to be chosen to till the seat in the General Council; b) that a comrpt practice has been cornmitted by a returned candidate or his election agenr or by any other person with the consent of the returned candidate or his election agent: Explanation : For the purposes this section "corrupt practice" shall mean any of rhe comrpt practices specified in section 123 of the Representation of the people Act, l95l: c) that any nomination has been improperly rejected; d) that the result of the election is so far as it concerns the returned candidate has been materially affected- i) by the improper acceplmce of any nomination; or ii) by any coffupt practice committed in the interest of the retumed candidate by an agent other than his election agent; or iii) by the improper reception, refusal or rejection of any vote; or w) by the reception of any vote which is void; or v) by any non-compliance with the provisions of this Act or of any rules or order made thereunder.

3) An election petition may be presented by candidate or any voter who is entitled to vote at the election to which the petition relates within a period of 30 days from the date of election of the returned candidate. Every election petition shall be accompanied by as manv copies thereof and there are respondents mentioned in the petition any every such copy shall be attested by the petitioner under his own signature to be true copy. 4) The petition shall contain a statement in brief of the material facts on r',hich the petition relies and shall, where necessary be divided into graphs numbered consecutively. It shall be filed candidate and verified in the miurner laid down code of civil proceclure, l90g (5 of l90g). s) The petitioner may, in addition to claiming a declaration that the election of the candidate is void, claim a fui1her declaration that he himself or any other candidate has been duly elected. 6) At the time of presenting an election petition the petitioner shall deposit on obtaining order of the Authority, as Security for the cost of petition, a sum of two hundred rupees. During the course of trial of an election petition, the authority may at any time, call upon the petitioner ro give such further security for cost as it may direct.

27 7) The authority shall, if the deposit as accordance with sub-section (4) has been made, pro to enqufue into the petition.

8) The authority shall, as soon as may be cause a copy of the petition to be served on r opposite party. For the purpose of this section "comrpt practice" shall mean any of the cor practices specified in section 123 of the Representation of the People Act, 1051. Expenditure by Candidate 1. The Accounts submitted to the Assam State Election Commission shall contain the follor particulars 1) Details of the date-wise expenditure. 2) Nature of expenditure a) Petrol and other lubircants b) Hiring Charge of the vehicle c) Printing cost of leaflets, posters etc. d) Cost of postage. e) MeetingVProfessionVrefreshments 0 Camp Office expenses I Other miscellaneous expenses h) All vouchers are to be signed by the candidate i) ff payments are not made signed by the candidate The same are also to be submitted with a certificate on the body of the bills that expenditure was actually incurred. 4. If a candidate contests to more than one place, separate accounts for both the pla constituencies may be submitted. 5. On the failure of submission of the accounts in time by a candidate to Assam State Election Commission shall take such action as deemed fit and proper.

36 Minutes of the Meeting held on 10.03.2015 at 2:00 PM in the Conference Room of Additional Chief Secretary, Home & Political Department, Assam Secretariat, Dispur

List of attendees at Annexure-I The meeting started with Welcome address from the Secretary Assam State Election Commission. He also stated that the objective of the meeting is to discuss on certain issues related to the police in conducting the ensuing BTC Election. 2) The State Election Commissioner briefly mentioned *rat ttre BTC Election will be held tentaively wittrin the first fortnight of April, 2015. The State Election Commissioner flagged the following issues for discussion, which are urgent and important under the situations, a) Election expenditue on police account. b) Engagement of Central Para-military Forces in law and order duties during the election pfocess. c) PSOs for Candidates. d) Seizure of arms (licensed/unlicensed) The State Election Commissioner requested the Additional Chief Secretary Home Departrnent to apprise the position on these issues. 3) Responding to the issues, Addl. Chief Secretary, Home & Political Deptt. stated that necessary fund on police account will be borne in the manner similar to the BTC Election,2010. He also asked Commissioner & Secretary, Home and the Secretary, Home to intiate actions immediately. 4) The Additional Chief Secretary, Home also briefed on the other issues. After threadbare discussion the following decisions were taken. ) As regards engagement of CPM Forces in election related law and order etc. duties, the Additional Chief Secretary entrusted the IGP, (Law & order) to take up the matter and submit proposal to the Govt. immediately alongwith a detail police Election plan of the BTC Election. ii) Regarding PSOs for the candidates, IGP (law & order) will work out a proposal/plan after making an assessment of threat perception of the candidates during the phase of nomination and till end of the Election process. iii) As regards seizure of arms (licensed/unlicensed), the IGP (law & order) submitted that they have already kept the action plan ready for seizure of arms etc. and will implement as soon as Election Notification is issued. rD As regards restricting as well as monitoring the movement of inmates of designated camps, to stop the possibility of undesirable meddling by such elements in the electioneering, ttre IGP (law & order) will be issuing appropriate guidelines to the SPs. v) As regards maintaining law & order in Thmulpur Sub-Division considering the graviry of the law and order situation in the Sub-Division, Home Department agreed to place an Offrcer in the rank of Additional Superintendent of Police for Tamulpur to guide and assist the SDPO. 38 t' l I Minutes of Review Meeting held on 21.03.2015 at 11:00 AM in the Conference Hall of Circuit House, Guwahati taken by the Assam State Election Commission

The meeting was held to review the poll preparedness of the DCs/SDO(C)s and SPs/SDPO under the Chairmanship of State Election Commissioner, Assam. The State Election Commissioner welcomed all the State Govt. officials participating in the review meeting. State Election Commrssioner stated that this meeting has been intended to have an appraisal of the status regarding poll preparedness of the BTC Election in the different BTC districts/Sub-Divisions. The State Election Commissioner requested all the DCs, SPs, SDO(C)s and SDPOs to apprise about the status of preparation in respect of their district/sub-division. IGP (L & O) intimated about the norm of police detailment against as regards very sensitive sensitive polling station. He informed that to maintain law & order and security, each 'very sensitive' polling station will be guarded b1 1 section of armed police, each 'sensitive' polling station will be guarded by 1/2 section of armed police. 'critical' polling stations will be guarded likewise as per stanrs of 'very sensitive' or 'sensitile', In addition to this, sector police officers will remain mobile with I mobile police team in his sector and Zonal officer r,"'ithin the Zone. IGq BTAD also apprised about the availabilitr ol police tbrces in the BTAD at present, which according to him would be adequate to maintain law & order during the Election. Joint Secretary, Home, informed that Govt. has already moved to Govt. of India seeking approval of Covt. of India to engage the CAPF in Election related law & order duties in addition to its designated duties. He has also mentioned that SOP in respect of the designated Camps should be strictly enforced by the SPs. During threadbare discussion, the following facts have emanated and also decisions were taken. 1) No district including Sub-Division require polling staff from outside their respective district. 2) All the districts (including all Sub-Divisons) will require vehicles from outside districts. State Election Commissioner had requested the Joint Commissioner, Transport (Mr. Pathak) to take note of the no. of vehicles required by different districts from outside their districts as mentioned by the DCs/SPs and requested hin.r to make necessary arrangement for availability of such vehicles. State Election Commissioner also suggested that respective DC/SPs may directly contact the Joint Commissioner Transpofi in comection with their requirement of vehicles. (Actions : Joint Commissioner, TiansporUAll DCVAII SPs) 3) All the DC/SDO(C) have in the meantime, in consultation with the local SP/SDPO identified./ categorised polling stations which are 'ciritical', 'very sensitive', 'sensitive', and 'comparatively safe'. 4) State Election Commissioner requested that the BTC adminsitration would take up repair of polling station where such polling station needs repair to make tham fit for using as a polling station. BTC would also arrange for repair/renovation of roads to make them vehicle pliable in case of roads which were not in good condition, so that the Poll can be held smoothly. DCs will in this connection take up with the BTC authority. (Action : Principal Secretary, BTC/all DCVSDO(C)s). 5) SPs will strictly enforce the SOP in respect of Designated Camps so that the movement of the inmates is kept restricted to stop any possibility of their undue interference in election process and also to instil a sense of confidence amongst the common people. The IGP (L&O) will issue suitable instructions to the SPs and any other authorities for enforcement of restriction on the

39 movement inmates of of the designated camps with immediate effect. Also the IGp (L&O) and IGB BTAD shall monitor the enforcement. (Action : IGP (L&O), IGB BTAD, all DCs/Sps) DCs/SPs jointly 6) will take decision as regards depositing back of licensed arms on assessing the necessity from case to case. Also the pending cases ol non-bailable warrants were to executed. The IGP (L&O) will issue instructions in this case. IGP, BTAD will please monitor the process and take needful action where necessary. (Action: IGP (L&O)/IGB BIAD, DC/SPs) DC/SPs resort 7) will to preventive detention of the criminal elements in the similar manner as done/taken during the Parliamentary Election. (ActioMGB (LOyIGP, BTAD/DCVSps) 8) DCs/SPs will also initiate raids and take action involving local Excise Deptt officials against traderVvendon in illicit liquor. (Action : DCVSPs) 9) On a reforence made by the SP, Kokrajhar on the issue of payment of honorarium to police Sector/Zonal Officers, the Commissioner clarified/ruled that payment of honorarium to all the police personnel engaged in the BTC Election shoutd be g"ia"A Uy the same norm and scale which was adopted in case of last Parliamentary Election. (Action : IGP (L&O/aI SPs 10) As regards the facility of voting to the inmates of the designated camps, the Commission suggested that the facility of postal ballot be given to thi inmates is done in the Iast Pariamentary election. DC/SDO(C) will, in consultation with SPs would take steps for issuing postal.Ballot papers to such inmates after ascertaining that their names have appeared in thi voter list of BTC COnstituency. (Action : DCJSDO(C)s and Sps). 11) As regards honorarium to office staff as raised by a few DCs, the State Election Commissioner conveyed its no objection subject to the same norm at par with such honorarium given to the staff against Parliamentary/L.A. Constituency Election/or last BTC Election, subject ti vailabilin. of frrnd. (Action : DCVSDO(C)s) 12) As regards the sensitive, very sensitive and critical polling stations, State Election Commissioner advised that all such polling stations should be videographed on the day of poll from 8:00 AM to till the end of the Poll unintemrptedly. AIso all the meetings of the political parties as paft of their election campaign s!9ul{ be videographed and also to bi covered- by designated offrcial of the MCC Cell or the Media Cell. (Action DC/SDO(C))

13) DCs/SDO(C)s should issue instruction to the local political parties or candidates requiring them to hold meetings/rally and procession with prior intimation of minimum of 24 houri to the DC/ SDO(C) so as to avoid any clash in holding such meeting/rally at a particular venue at a time. (Action : DCs/SDO(C)s/SPs/SDpOs) 14) Against a reference from_ the sp, Udalguri on the matter of honorium to ApBn personnel engaged in Election related duties, the State Election Commissioner held that no dis&mination should be there in respect of honorarium in between forces.
