The mandatory respondents are JA Solar Technology Yangzhou Co., Ltd. (JA Solar) and Risen Energy Co., Ltd. (Risen Energy). This is the sixth administrative review of the CVD order on solar cells from China. We preliminarily find that JA Solar and Risen Energy received countervailable subsidies during the POR. If these preliminary results are adopted in the final results of this review, we will instruct U.S. Customs and Border Protection (CBP) to assess countervailing duties on all appropriate entries of subject merchandise during the POR. Interested parties are invited to comment on these preliminary results. Unless the deadline is extended pursuant to section 751(a)(3)(A) of the Tariff Act of 1930, as amended (the Act), we will issue the final results of this review by no later than 120 days after the publication of these preliminary results in the Federal Register.

    CASE STUDY: SUNTECH POWER Introduction Suntech Power, a major manufacturer of solar cells and modules, was founded in 2001. In December 2006, the company’s production capacity expanded to 300MW, and production capacity is expected to reach 1GW by 2010. Suntech is currently ranked as the No. 3 silicon cell manufacturer worldwide and the largest solar module manufacturer internationally. With four production sites at Wuxi, Luoyang, Qinghai and Shanghai (under construction), Suntech has 4000 global employees. Suntech also owns MSK Corporation, a leading PV module manufacturer and Building-Integrated PV company in Japan. Suntech’s largest markets are (in order): Germany, Spain and the United States. About 80 percent of the company’s products are sold in Europe, but the company anticipates a major expansion in the U.S. market in the coming years. Theme Suntech demonstrates the potential for manufacturers of solar cell technology to thrive in China, which is on track to become the world’s number one PV producer in 2008 with a market share of over 18%. Despite its success in international markets, however, Suntech—and other solar energy companies—have met with difficulties in fully penetrating the Chinese market, and future prospects for continued rapid growth in China are uncertain.     IEEJ: April 2010 Chinese Photovoltaic Market and Industry Outlook (Part 1) Kan Sichao* Summary In China over the recent years, wind power, solar energy and other renewable energy sources have been expected to become not only promising tools against climate change but also a key economic growth driver. Particularly, growth of Chinese photovoltaic cell makers has attracted global attention. However, the Chinese government has been unable to provide sufficient support for them because of huge fiscal costs. China's PV market is still inactive. As PV costs are expected to decline substantially due to a silicon price fall in 2008, however, the Chinese PV market is projected to achieve dramatic growth. In early 2009, the Chinese government came up with measures to subsidize and promote PV. In December, it became clear that the country will revise its PV generation target for 2020 upward to 20 gigawatts. While giving positive considerations to the exploration of the domestic PV market and the development of relevant industries, the Chinese government has recognized the domestic industries’ technological capacity shortages, overheated investment and other problems and indicated a cautious attitude.     Coalition for a Prosperous America Reclaiming the US Solar Supply Chain from China By Jeff Ferry, Chief Economist – Coalition for a Prosperous America Key Points • Several US solar module manufacturers have ramped up production substantially in the last three years under the stimulus of the Section 201 safeguard tariffs on solar module imports, leading US producers to achieve a 10-year high in market share of 19.8% in 2019, a noteworthy achievement. • The Section 201 solar tariffs have had no negative impact on the US market for solar energy installations, which grew 43% in 2020. Solar installations are set to be more than 50% greater than they were expected to be prior to the implementation of the 201 tariffs in 2017. • However, Chinese manufacturers continue to hold a dominant, near-monopoly, position in several important sectors of the upstream solar supply chain, endangering the health and future of the US solar industry. China continues to raise the stakes with large subsidies supporting billions of dollars of Chinese solar industry expansion. Beijing’s goal is global dominance of this industry. • Chinese dominance threatens US energy independence and US technology leadership in solar and other clean energy technologies. It also threatens our semiconductor industry, which relies on polysilicon as a raw material. • The US government should implement policies designed to secure the long-term future of an end-to-end US solar supply chain, using a mixture of incentives, tax credits, government procurement policies, and tariffs. These policies should be explicitly long-term. They should not be conditional on any foreign nation’s behavior.
