LOCAL COUNCILS ORDINANCE, 1941. Br-LAWS MADE BY THE OF KEFAR 'ATTA UNDER SECTION 9. IN EXERCISE of the powers vested in them by section 9 of the Local No. 36 of 1941. Councils Ordinance, 1941, the Local Council of Kefar 'Atta, with the approval of the District Commissioner, District, have made the following by-laws: —

1. These by-laws may be cited as the Kefar 'Atta (Price Control of Citation. Foodstuffs) By-laws, 1943.

2. In these by-laws, unless the context otherwise requires — Interpretation. "Local Council" means the Local Council of Kefar 'Atta. "Local Council area" means the area of jurisdiction of the Local Council of Kefar 'Atta.

3. The Local Council may from time to time fix the maximum price Fixing of prices. at which all or any of the foodstuffs listed in the Schedule hereto may be sold whether by wholesale or by retail within the Local Council area.

4. The Local Council, having fixed the maximum price of any food• Publication of stuff listed in the Schedule hereto, shall publish the price thereof by prices. posting notices in English and either or both of the other two official languages at the following places : — (i) The Offices of the Local Council. ! (ii) All notice boards of the Local Council.

Price list. 6. Every vendor of foodstuffs which are listed in the Schedule hereto and for which maximum prices have been fixed by the Local Council shall keep in a conspicuous position on his premises or at his stall a price list clearly marking the price of each class of foodstuff sold by him, as fixed and published from time to time by the Local Council under by-laws 3 and 4 of these by-laws.

Penalty. 7• Any person, who either by himself or by his servant, employee or agent, contravenes the provisions of by-law 5 or 6 of these by-laws, shall be guilty of an offence and on conviction shall be liable to a fine not exceeding twenty pounds.

BY-LAWS MADE BY THE LOCAL COUNCIL OF : UNDER SECTION 25(l)(

IN EXERCISE of the powers vested in them by paragraph (d) of sub• Cap. 128. section (1) of section 25 of the Road Transport Ordinance, the Local Council of Givatayim, with the consent of the District Commissioner, Lydda District, and the Licensing Authority, have made the following by-laws: — Citation. 1. These by-laws may be cited as the Givatayim (Licensing of Bicyc• les and Tricycles) By-laws, 1943. 23rd December, 1943 THE PALESTINE GAZETTE No. 1307—SUPPLEMENT NO. 2. 1131

2. In these by-laws "bicycle" and "tricycle" mean any bicycle or Interpretation, tricycle other than a motor bicycle or motor tricycle; "Local Council area" and "Local Council" mean the area of jurisdiction of the Local Council of Givatayim and the Local Council of Givatayim, respect• ively; "tester" means the person or persons authorised by the Local Council to test bicycles or tricycles.

3. No person residing within the Local Council area shall ride a Licensing of bicycle or tricycle on any road within such area, unless such bicycle bicycles and or tricycle has been licensed in accordance with the provisions of these tricycles. by-laws and bears a number-plate issued in respect thereof attached thereto behind the seat facing the rear of the bicycle or tricycle in such a manner as to be visible at all times.

4. The Local Council may at any time authorise any person to act Testing of as tester of bicycles or tricycles. Where any person is so authorised bicycles and by the Council, no licence shall be issued unless and until the applicant tricycles. produces a certificate to the effect that the bicycle or tricycle in respect of which he requires a licence has been duly tested and passed by the tester. 1. This Order shall be cited as the Food Control (Control of Live• Citation. stock) Order (No. 2), 1943.

2. In this Order, unless the context otherwise requires— Interpretation. "Cattle" includes buffaloes. "Fresh pork" means any part of the carcase of a swine except the bones, lung, tongue, heart, kidneys, brains, trotters and liver thereof, and except also any bacon, ham, lard, and any sausages containing pork. "Purchase" means acquire from any other person in any manner whatsoever. "Sell" includes dispose to any other person in. any manner what• soever, and also includes offer or expose for sale, and "sale" shall be construed accordingly. "Slaughter house area" means the area served by any slaughter house specified in the Second, Fourth or Fifth Schedule to this Order, as the case may be. "Village Committee" means a village committee established under the Defence (Village Committees) Regulations, 1942. (3) Every person to whom such direction as aforesaid has been given by a village committee or appointed person shall comply therewith: Provided that any person who feels aggrieved by any such direction may within five days thereof appeal to the District Commissioner for his decision, and the decision of the District Commissioner shall be final. A fee at the rate specified in the First Schedule to this Order shall be paid to the District Commissioner upon application for such decision, and such fee shall be refunded to the applicant if and as far as the decision of the District Commissioner is in his favour, but shall be forfeited to Government if and as far as such decision is 1186 THE PALESTINE GAZETTE NO. 1307—SUPPLEMENT NO. 2. 23rd December, 1943

shall include a decision on the refund or otherwise of the fee paid or any part thereof.

Keeping of cattle, 4. No person shall keep or possess, whether for himself or on behalf sheep or goats of any other person— within certain (i) in any slaughter house area specified in the Second Schedule to this Order, any cattle; (ii) in any municipal area specified in the Third Schedule to this Order, any sheep or goat; (iii) in any place in Palestine, any swine— ms of a written׳save under the authority and in accordance with the tex permit issued by the Assistant Controller of the District in which the area is situate.

Stock returns. 5. —(1) Any person who keeps— (1) any cattle in any slaughter house area specified in the Second Schedule to this Order, (ii) any sheep or goat in any municipal area specified in the Third Schedule to this Order, (iii) any swine in any place in Palestine — shall furnish the Assistant Controller of the District in which such animal is kept with a full and accurate return in writing — (a) in respect of cattle, sheep or goats, in the form set out in the Sixth Schedule to this Order, quarterly on the first day of Novem­ ber, February, May and August of each year; (b) in respect of swine, in the form set out in the Seventh Schedule to this Order, monthly on the first day of each month. (2) Separate returns shall be submitted in respect of animals kept at different places. (3) Any person who keeps any cattle, sheep, goat or swine as set out in sub-paragraph (1) of this paragraph and who fails to submit any return as prescribed under this Order, or who submits any return which the Controller is satisfied to be false in any material particular, shall be deemed to conceal any cattle, sheep, goat and/or swine kept by him, and the Controller, without prejudice to any other steps that may be taken against such person, may exercise in respect of any such cattle, sheep, goat and/or swine such of his powers under section 8 No. 4 of 1942. of the Food Control Ordinance, 1942, as he may deem fit.

Restriction on 6. Throughout Palestine— sale of cattle. (a) no person shall sell any cattle or swine except to the Controller or to a person authorised by him in that behalf; (b) no person other than the Controller or a person authorised by him in that behalf shall purchase any cattle or swine.

8. —(1) Nothing in this Order shall restrict the sale or purchase by Provisions in any farmer of any cattle, sheep, goat or swine for the purpose of re­ respect of ani­ production or use as a dairy or draught animal: mals kept for production, dairy Provided that — or working (1) in the case of cattle, in any slaughter house area specified in the purposes. (2) The onus of proof that a person selling or purchasing any cattle, sheep, goat or swine by virtue of the provisions of this paragraph is a farmer, and that the sale or purchase is for the purpose of repro­ duction or for use of the animal as a dairy or draught animal, shall b3 upon the person effecting the sale or purchase.

9. No person shall move any swine outside any village, tribal unit, !Restriction on settlement, municipal or local council area, except under the authority movement of of and in accordance with the terms of a written permit issued to him swine. by the Controller or by the District Controller of the District in which the movement is intended to originate, or by a person authorised in that behalf by the Controller or by such District Controller.

10. —(1) No person shall slaughter any cattle in any place except Slaughter. in the slaughter house of any of the slaughter house areas specified in the Second Schedule to this Order, and no person shall slaughter any such animal unless it has been supplied to him by the Controller and marked with the official mark of the Controller. (2) In the slaughter house areas specified in the Fourth Schedule to this Order, no person shall slaughter any camel other than a camel supplied to him by the Controller and marked with the official mark of the Controller. (3) In the slaughter house areas specified in the Fifth Schedule to this Order, no person shall slaughter any sheep or goat other than a sheep or goat supplied to him by the Controller and marked with the official mark of the Controller. (4) No person shall slaughter any swine, unless : — (a) he is a manufacturer who holds a valid licence issued to him by the Controller entitling him to manufacture bacon, ham, lard, or sausages, and (b) the swine was supplied to him by the Controller and marked with the official mark of the Controller, and (c) the slaughter takes place in a slaughter house or other place in which swine may lawfully be slaughtered.

11. Any person found in possession of the carcase or part of the Burden of carcase of — proof. (a) any cattle, camel, sheep or goat in any slaughter house area to which the respective provisions of paragraph 10 apply, or (b) of any swine in any place in Palestine— shall be deemed to have slaughtered such animal unless he proves that he has not slaughtered such animal or caused or permitted the .• ׳.._.׳ ; ; .slaughter thereof 1138 THE PALESTINE GAZETTE NO. 1307—SUPPLEMENT NO. 2. 23rd December, 1943

12. —(1) Nothing in this Order shall preclude the emergency slaughter of any cattle, camel, sheep, goat or swine in the presence of a veterin• ary surgeon, a Police officer or a mukhtar, if such animal has been certified in writing by such veterinary surgeon, Police officer or mukhtar to have sustained a sudden injury such as a fracture, pene• trating wound of the abdomen, obstructed parturition, chocking or the like, justifying its immediate slaughter. (2) In the case of an emergency slaughter as aforesaid, the person in charge of the animal shall report the fact of such slaughter forth• with— (a) if the slaughter took place in the municipal area of Jerusalem, Jaffa, , Haifa, Nablus or Gaza, to the Assistant Con• troller of the District concerned; (b) in any other ease, to the Police officer in charge of the area in which the slaughter took place— and shall apply for directions from such authority as to the !disposal of the carcase, and subject to such other or further directions as such authority may give, shall move such carcase, including the head, feet and edible offals thereof, to— (i) a butcher's shop or cold store where such carcase, if at that time the sale of such meat is prohibited, shall be detained until such time as such sale may be permitted, or (ii) a sausage factory or other meat by-product factory, for the pur• pose of manufacture, or (iii) in the case of swine, a manufacturer holding a licence from the Controller entitling him to manufacture bacon, ham, lard or sausages. (3) On demand, any person applying for a certificate as set out in sub-paragraph (1), or for directions as set out in sub-paragraph (2), shall furnish the authority issuing the certificate or giving the direc• tions with all such information regarding the cause, nature and extent of the emergency as such authority may require, and such informa• tion shall be full and accurate. (4) No person shall deliberately cause any injury to any cattle, sheep, goat, camel or swine in order to justifj7 the emergency slaughter thereof. (5) The provisions of this paragraph shall be in addition to and not in derogation of any other law relating to the emergency slaughter of animals.

Proliibition of 13. Subject to the provisions of paragraph 12(3)(iii), no person sale and purchase shall sell or purchase any fresh pork. of pork. Concealment. 14. 3. Paragraph 3 of the principal Order shall be amended as follows: — Amendment of paragraph 3 of (a) by the deletion of the word "and" at the end of sub-paragraph the principal (i) thereof, the substitution of a semi-colon for the full stop at the Order. end of sub-paragraph (ii) thereof, and the insertion immediately after sub-paragraph (ii) thereof, of the following sub-paragraph: —

"(iii) no person who is or becomes the owner, in whole or in part, of, or imports into Palestine, any motor vehicle shall dismantle, or permit any other person to dismantle, such motor vehicle:"

<6) by the insertion immediately after the said sub-paragraph (iii) of the following proviso : —

"Provided that this paragraph shall not apply to any motor vehicle which is the property of the War Department of His Majesty's Government or of any Allied or Dominion or Colonial Forces, or of the Government of Palestine or any motor vehicle of foreign registration which is touring under any valid travel document issued by any authorised touring or automobile club or association under the recognised carnet or tryptique system, or any motor vehicle registered and licensed in Trans-Jordan, Syria or the Lebanon."

4. IN EXERCISE of the powers vested in him by Regulation 60 of the Gaz: 26.8.39, Defence Regulations, 1939. the High Commissioner has ordered and p. 659. it is hereby ordered as follows: — Citation 1• This Order may be cited as the Defence (Lighting Restrictions) Order, 1943.

Interpretation. 2.—(1) In this Order— "air raid warning" means an air raid warning to the public or a warning of the approach of hostile aircraft given, by the sound• ing of sirens or in such other manner as may be authorised by the District Commissioner, for the purposes of the provisions of this Order relating to the steps to be taken on the giving of an air raid warning; "hours of darkness" means the period between sunset and sunrise; 23rd December, 1943 THE PALESTINE GAZETTE NO. 1307—•SUPPLEMENT No. 2. 1145

"restricted area" means any area specified in the First Schedule to this Order; "partially restricted area" means any area specified in the Second Schedule to this Order. (2) Any obligation to extinguish any light arising, under the pro• visions of this Order, on the giving of an air raid warning, shall be construed as including an obligation not to display any light, and shall be deemed to continue • until the giving of a signal, by the sounding of sirens or in such other manner as may be authorised by the District Commissioner, cancelling the air raid warning. (3) Any reference in this Order to visibility shall be construed as a reference to visibility in the dark, in the absence of moonlight, fog, mist or rain and with all the lights in the vicinity extinguished.

3. 5. —(1) Notwithstanding anything contained in paragraph 3 of this Exceptions with Order— respect to display (a) within a restricted area or within a partially restricted area, of certain lights. electric street lights may be displayed if their display is author• ised by a written permit granted by the District Commissioner in any case where he is satisfied that such lights are controlled by means of a master-switch; (?>) within a partially restricted area, lights (other than flood• lights) may be displayed in any roofed building or other covered enclosure (whether or not any illumination therefrom is visible• from outside the building or covered enclosure) if such lights are capable of being extinguished within a period of five minutes. (2) Any street lights displayed under the authority of a permit granted under sub-paragraph (l)(a) of this paragraph, and any lights displayed in pursuance of sub-paragraph (l)(b) of this paragraph, shall be extinguished by the person having control thereof imme• diately on the giving of an air raid warning.

6.
