    Management Alert California Court Finds Wrongful Termination Tort Too Desperate, But Permits Statutory Claim For Disparate Treatment California employees can file tort claims against employers who impose adverse employment actions in violation of public policy. They have used this theory to challenge wrongful terminations and demotions. In Touchstone Television Productions v. Superior Court (Sheridan), the California Court of Appeal rejected an effort to extend this tort theory to an employer’s decision not to exercise an option to renew a contract. The Facts In 2004, Touchstone Television Productions (“Touchstone”) hired actress Nicollette Sheridan (“Sheridan”) to appear in a new television series, Desperate Housewives. The parties’ agreement gave Touchstone the option to annually renew Sheridan’s employment for up to six additional seasons. Touchstone exercised its option to renew the agreement with Sheridan for Seasons 2, 3, 4, and 5. During Season 5, Sheridan reported to Touchstone that Marc Cherry, the series’ creator, had hit her during the filming of an episode. Five months after this alleged incident, Touchstone informed Sheridan that it would not exercise its option to renew her contract for Season 6, because her character would be killed during Season 5. Sheridan continued to work during Season 5, filming three more episodes and doing publicity for the series. Sheridan sued Touchstone and Cherry in April 2010. She asserted various claims, including a claim that Touchstone fired her in retaliation for complaining about Cherry’s conduct. The Trial Court Decision The matter went to trial in February 2012. The jury deadlocked on the wrongful termination claim and the trial court declared a mistrial.

Instead, we will develop theoretical concepts that help us understand and analyze real world challenges in the changing workplace. Key questions and themes include (incomplete list): • What is work, what is a workplace and what is an organization? • Why should organizations put people first for success and sustainability? • How and why are organizations changing? • What are the incentives in the workplace for workers and managers? • What are the effects of new forms of work organization such as temping, freelancing and outsourcing on workers and organizations? Learning Objectives: This is a social science course; the following SAS learning objectives are particularly relevant: • Understand different theories about human culture, social identity, economic entities, political systems, and other forms of social organization. • Employ tools of social scientific reasoning to study particular questions or situations, using appropriate assumptions, methods, evidence, and arguments. 1 More specific objectives are: • An understanding of major issues involved in the changing nature of work, and an informed perspective on some of the major dilemmas and conflicts concerning the management of employees.

The only requirement is that you have the ability to make self-righteous pronouncements about public morality and taste while maintaining your composure and never once betraying yourself with so much as a hint of a smile. Even, the now fashionable smirk, will not be tolerated. If you get really good at this and have a relative in the cabinet you might even be appointed to head the FCC. This week's firestorm over the opening skit on Monday Night Football has produced a festival of hypocrisy, a cornucopia of foolishness, and a tribute to the sheer idiocy of what passes itself off as the guardianship of public morality.
