INTRODUCTION “Bad things happen if you fail to pay federal income taxes when due.”1 Although the Supreme Court was referring to the calamities that befall taxpayers,2 the same can be said for the government. Some “taxpayers”3--intentionally or unintentionally--fail to report and/or pay the proper amount of tax owed when due. Accordingly, the government must spend money to audit taxpayers, to assess taxes, to collect the proper amount of tax due, and to borrow to replace the lost revenue. Abraham’s assignment to the Pentagon unit that runs the hearings at Guantánamo Bay, Cuba, seemed a perfect fit. A lawyer in civilian life, he had been decorated for counterespionage and counterterrorism work during 22 years as a reserve Army intelligence officer in which he rose to the rank of lieutenant colonel. His posting, just as the Guantánamo hearings were accelerating in 2004, gave him a close-up view of the government’s detention policies. It also turned him into one of the Bush administration’s most unlikely adversaries. In June, Colonel Abraham became the first military insider to criticize publicly the Guantánamo hearings, which determine whether detainees should be held indefinitely as enemy combatants. Just days after detainees’ lawyers submitted an affidavit containing his criticisms, the United States Supreme Court reversed itself and agreed to hear an appeal arguing that the hearings are unjust and that detainees have a right to contest their detentions in federal court. Some lawyers say Colonel Abraham’s account — of a hearing procedure that he described as deeply flawed and largely a tool for commanders to rubber-stamp decisions they had already made — may have played an important role in the justices’ highly unusual reversal. That decision once again brought the administration face to face with the vexing legal, political and diplomatic questions about the fate of Guantánamo and the roughly 360 men still held there. -

December 15, 2013 Opinion: The Jersey hustle OLDER New Jerseyans may well remember the basis of a new film — “American Hustle” — that opened last Friday. It is a fictionalized account of Abscam, the FBI stinG operation in the late 1970s and early 1980s that resulted in the conviction of three key New Jersey politicians, includinG a U.S. senator, a state senator and a member of the House of Representatives, as well as several other officials on charges including bribery and conspiracy. Abscam put New Jersey on the map as hotbed of political corruption, a reputation that we maintain today. The movie, directed by Philadelphia native David O. Russell, tells the story of a clever con man, IrvinG Rosenfeld, and his partner, Sydney Prosser, who are forced to infiltrate the wild arena of New Jersey politics and orGanized crime in the 1970s by FBI aGent Richie DiMaso. “American Hustle,” which last Thursday picked up seven Golden Globe nominations includinG best movie, actor and director, is a “fictionalized” account of “Abdul Scam” or Abscam, the FBI stinG operation, which consisted of a fictional middle eastern sheikh named Karim Abdul Rahman (thus the “Abdul” scam moniker) offerinG bribes to political leaders in eXchanGe for political asylum, money launderinG and investment opportunities. The real-life con man that the FBI hires to play the sheik, Melvin WeinberG, is the character IrvinG Rosenfeld in the film, played by Christian Bale. Included in the corruption miX were New Jersey’s Sen. Harrison A. Williams, Rep. Frank Thompson Jr., and Camden Mayor AnGelo Errichetti, all of whom were convicted and served prison time for acceptinG bribes and conspiracy. -

OIG-09-25 February 2009 OIG Department of Homeland Security Office of Inspector General Introduction “Since the end of World War II, Congress and Presidents have debated, formulated, and revised administrative responsibilities for emergency management.”1 Some of the important questions that have been the subject of debate over the past 60 years, and that are particularly relevant today in the “FEMA In or Out” debate, include: � What the jurisdictional boundaries of the agency charged with emergency management should be; � How responsibility for new or emerging threats should be assigned; � Whether it is necessary (or advisable) to distinguish between natural and manmade threats; � What is meant by “all-hazards,” and what elements need to be present in an agency with an all-hazards mission; � What the relationship between crisis management and consequence management should be; and � What the relationships among the federal, state and local governments should be during a disaster, and whether the relationships should change in the face of a catastrophe. On December 17, 2008, Congressman James L. Oberstar, Chairman of the House Committee on Transportation and Infrastructure, reopened the debate by submitting a memorandum to President-elect Barack H. Obama, recommending that the Federal Emergency Management Agency (FEMA) “be re-instated as an independent, cabinet-level agency reporting directly to the President.”2 Two days later, Congressman Bennie G. Thompson, Chairman of the House Homeland Security Committee, recommended the opposite–that FEMA remain a part of the Department of Homeland Security (DHS), warning that “FEMA removal from DHS would likely result in the hamstringing of 1 Henry B. -
