AND IN THE MATTER OF the Premises known as Municipal number 98 Shoreview Place, formerly in the City of Stoney Creek, now in the City of Hamilton and in an "RM3-52" (Multiple Residential "RM3" zone) district;

AND IN THE MATTER OF AN APPLICATION by the agent IBI Group (c/o Matt Johnston) on behalf of the owner King-Tis Investments Limited (c/o David Horwood), for relief from the provisions of the Zoning By-Law No. 3692-92, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit development of the lands for a townhouse complex containing a total-of seventy-two (72) dwelling units pursuant to Site Plan Application File # DA-13-235 notwithstanding that:

1. A minimum front yard of 4.8m, with further eave projection, shall be provided instead of the minimum required front yard of 6.0m;

2. A minimum landscaped open space of 42%, including privacy areas, shall be provided instead of the minimum required landscaped open space of not less than 45% of the lot area;

3. A minimum parking space size of 2.6m wide x 5.5m long, including those parking spaces within a private residential garage, shall be provided instead of the minimum required parking space size of 2.75m wide x 5.8m long and the minimum required parking space size of 3.0m wide x 6.0m long for parking spaces within a private residential garage;

4. One (1) parking space for the physically challenged shall be provided instead of the minimum required 2 parking spaces for the physically challenged;

5. A parking space for the physically challenged shall be a minimum 4.4m wide x 5.5m long instead of the minimum required parking space size of 4.4m wide x 5.8m long;

6. A minimum access driveway width of 2.6m shall be provided for individual townhouse units instead of the minimum required access driveway width of 6.0m;

7. The parking spaces located on the driveways appurtenant to the townhouse units fronting directly on Shoreview Place shall be 0.0m from the front lot line instead of the requirement that where the required minimum number of parking spaces is four or more, no parking space shall be provided closer than 3 metres to any lot line;

8. No landscaped strip shall be provided between any privacy area and any lot line instead of the minimum 1.5m wide landscaped strip which is required between any privacy area and any lot line;

9. No landscaped strip shall be provided along the entire lot lines abutting both the Millen Road and Shoreview Place street lines instead of a landscaped strip having a minimum width of 4.5m which is requii-ed to be provided adjacent to every portion of any lot that abuts a street except for points of ingress and egress; and,

10. Signs, transformers, light standards, entry features, mail boxes or any other utility/servicing appurtenances shall be permitted in either a landscaped open space or a landscaped strip.
