Conditional Use Permit CUP #22-07 Site Plan Approval of Club Rec located at approximately 2429 N Hwy 158 Eden, UT Staff Report: The applicant is requesting for Conditional Use Permit #22-07 and Site Plan approval of Club Rec located at approximately 2429 N. Hwy 158 in the Eden area. The proposed business will occupy some of the new space provided by the Diamond Peak Expansion. This business will be within the Commercial Valley - 2 (CV-2) Zone. Among the uses in the CV-2 Zone, ABoat and personal watercraft rentals as an accessory use to Boat sales and service,@ (Ch. 18-B5-2) are allowed as a conditional use. Club Rec plans on selling and servicing equipment at this location. With the property=s close proximity to Pineview Reservoir, there may be some people who will need to come by and pick up a part for their boat, or receive a quick fix. This will be one of the main functions of the business. Club Rec is a membership program that gives people access to all types of recreational equipment. Memberships give people access to boats, personal watercraft, snowmobiles, ATVs, motor homes, and motorcycles. This location will mostly be used as a sales office for said equipment and a small repair shop. Small repairs will take place in the work shop. A large bay door will be built in order to house the workshop area. This bay will follow engineering and building code regulations for such type of facility and use. All major repairs and maintenance will be taken to the more extensive locations in Clearfield or Salt Lake. If there is any need for the disposal of oil and other contaminated liquids, they will be placed in liquid tight drums and will be picked up. The company that they are currently using is Robinson Waste Services. Conformance to General Plan The business= use per chapter 18 conforms to the General Plan and the Zone in which it is located. Conditions for Approval 1. Requirements and recommendations of the Weber County Engineers Office. 2 . Requirements and recommendations of the Weber County Building Inspection Office. 3. Requirements and recommendations of the Weber Fire District. 4. Requirements and recommendations of the Weber County Health Department. Staff Recommendations Staff recommends approval for a Conditional Use Permit subject to staff and other agency comments and recommendations. C. Conditional Use Permit CUP #23-07 Site Plan Approval for a Culinary Water Reservoir located at approximately 6550 N and 7000 E near Powder Ridge Road Staff Report: Requesting site plan approval for a Culinary Water Tank located at approximately 6550 North and 7000 East near Powder Ridge Road. This water tank resides in a Forest (F-40) Zone, which lists APublic Utility Substation@ as a conditional use. The project is proposed as a 20,000 gallon pre-manufactured fiberglass reservoir lined with a certified coating system for potable water. This culinary water tank will be, approximately 37 feet x 10 feet in diameter. When finished there will be a 6 inch galvanized steel pipe rising 2 feet above finished grade. The tank will be completely buried when it is finished, and the depth of which the tank is buried will be determined in the field. However, the fill is gradual and will not look out of place. It is proposed that the tank will be temporary until some time that a larger system is approved. At that time this tank maybe used for secondary water storage. This site contains an existing underground reservoir and this tank will serve as additional storage. A geotechnical report had been submitted with the previous tank. The Weber County Engineers office has reviewed the site plan for this project and has no concerns. Weber County Zoning Ordinance states "The Planning Commission may deny or permit a Conditional Use to be located within any zone in which the particular Conditional Use is permitted by the use regulations of that zone. In authorizing any Conditional Use, the Planning Commission shall impose such requirements and conditions necessary for the protection of adjacent properties and the public welfare." Weber County Zoning Ordinance States: "The purpose and intent of Conditional Uses is to allow in certain areas, compatible integration of such uses as special exceptions but which are related to the permitted uses of the zone, but which may be suitable and desirable only in certain locations in that particular zone due to conditions and circumstances peculiar to that location and/or only if such uses as designed, laid out and constructed on the proposed site in a particular manner." Page 2 Approved 02/19/08 Ogden Valley Township November 27, 2007 Weber County Zoning Ordinance further states: 22C-5. Basis for Issuance of Conditional Use Permit. The Planning Commission shall not authorize a Conditional Use Permit unless evidence is presented to establish: 1. That the proposed use of the particular location is necessary or desirable to provide a service or facility which will contribute to the general well-being of the community, and 2. That such use will not, under the circumstances of the particular case and the conditions imposed, be detrimental to the health, safety and general welfare of persons nor injurious to property or improvements in the community, but will be compatible with and complimentary to the existing surrounding uses, buildings and structures when considering traffic generation, parking, building design and location, landscaping and signs, and 3. That the proposed use will comply with the regulations and conditions specified in this Ordinance for such use, and 4. That the proposed use conforms to the goals, policies and governing principles and land use of the General Plan for Weber County 5. That the proposed use will not lead to the deterioration of the environment or ecology of the general area, nor will produce conditions or emit pollutants of such a type or of such a quantity so as to detrimentally effect, to any appreciable degree, public and private properties including the operation of existing uses thereon, in the immediate vicinity of the community or area as a whole. Conditions for Approval 1. Requirements and recommendations of the Weber County Engineers Office. 2. Requirements and recommendations of the Weber County Building Inspector. 3. Requirements and recommendations of the Weber County Fire District. 4. Requirements and Recommendations of the Utah State Department of Environmental Quality Division of Drinking Water, including a construct/operating permit. Staff Recommendations Staff recommends approval subject to staff and other agency comments and recommendations. D.
