Page 3 of 10 KENDAL TOWN COUNCIL Planning Committee Monday 3rd July 2017 at 6.00 p.m. in the SLDC Chairman’s Room, the Town Hall, Kendal PRESENT Councillors Jon Robinson (Chair), Austen Robinson (Vice Chair), Clare Feeney-Johnson, Lynne Oldham, Kath Teasdale and Graham Vincent APOLOGIES Councillor Finch OFFICERS Hazel Belshaw (Temporary Council Secretary) 139/17/18 PUBLIC PARTICIPATION None 140/17/18 DECLARATIONS OF INTEREST None 141/17/18 ORDER OF BUSINESS The Chair suggested that the order of business of the agenda be amended to bring forward item 6 (Mr Alistair McNeill, Development Plans Manager, SLDC: Briefing relating to pre-publication consultation on Development Management Policies DPD) and this was agreed. 142/17/18 MR ALISTAIR MCNEILL, DEVELOPMENT PLANS MANAGER, SLDC: BRIEFING RELATING TO PRE-PUBLICATION CONSULTATION ON DEVELOPMENT MANAGEMENT POLICIES DPD Mr McNeill presented the proposed main changes to the Draft Development Management Policies Development Plan Document DPD. He pointed out that they were also undertaking an independent viability study. The document will be presented to the South Lakeland Cabinet in September to seek permission to publish although it was not expected to be published until late Spring/early Summer 2018. At this point Councillor Vincent declared an interest as he sat on the South Lakeland Cabinet although it was agreed by Members that no suggestions on the document would be made in this Meeting. The document is available to view online and the consultation period ends on 17th July 2017. Mr McNeill then ran through the main changes. • DM1 – General Requirements A small number of changes to this policy mainly to remove duplication. • DM2 – Design More small changes and an addition of the layout of developments to ensure interspersing of all forms of housing Page 4 of 10 03.07.2017 Planning Committee types. • DM3 – Historic Environment. Historic England made various comments on this policy and some clarification and strengthening changes were made. • DM4 – Green and Blue Infrastructure Under the open space requirement where open space is not required the commuted sum per bedroom is increased from £150 to £200. • DM6 – Flood Risk Management Worked closely with CCC, EA and the NE Kendal Flood Action Group for this policy. Councillor A Robinson asked whether this was a working document and if some of the previous recommendations from KTC had been given to CCC in particular reference to the surface water disposal. Mr McNeill confirmed it would be a working document until it is finally adopted but was unsure if the earlier recommendations had been shown to CCC, he will check. • DM8 – Telecommunications and Broadband Main changes were strengthening of the policy. An addition that for residential sites of 30 or more units, developers would be expected to ensure that Fibre to the premises infrastructure is provided. Councillor Vincent asked why 30 units and could that number be looked at? • DM11 – Accessible and Adaptable Homes A requirement for 5% of dwellings on sites over 40 units to be wheelchair adaptable. • DM18 – Tourist Accommodation No comments • DM19 – Equestrian Related Developments No comments Finally Mr McNeill presented two new policies: • DM25 - New Agricultural Buildings There is an issue in rural areas so a policy was created. New buildings should be associated with existing farm steads or they would need to demonstrate that the buildings were required. • DM26 – Gypsies, Travellers and Travelling Show People. This policy has been an update on a previous policy from 2013. Page 5 of 10 03.07.2017 Planning Committee Councillor A Robinson raised a point that recommendations made by KTC do not always receive an acknowledgment. Mr McNeill confirmed that all comments are available to view online but he will pass on the feedback to the team. 143/17/18 MINUTES OF MEETING HELD ON 19TH JUNE Members considered the minutes of the Committee meeting held on 19th June. Councillor A Robinson proposed that the minutes be accepted as a correct record. This was seconded by Councillor Teasdale and carried unanimously. RESOLVED That the minutes of the meeting held on 19th June be accepted as a correct record, and signed by the Chair. MATTERS ARISING 144/17/18 Sink Holes (Ref Minute 088/17/18) Councillors J and A Robinson will draft a response to SLDC with regards to the sink holes. 145/17/18 Members agreed to send a thank you to Mr Alistair McNeill for attending the Meeting. 146/17/18 PLANNING APPLICATIONS Members considered Planning Applications submitted for consultation purposes by the local planning authority, South Lakeland District Council. RESOLVED That having considered the applications outlined in the schedule, the recommendations in Appendix I attached to these minutes be made to South Lakeland District Council.
