Minutes of the Planning Committee 19th June, 2002 at 5.00 pm at the Sandwell Council House, Oldbury Present: Councillor Dr Jaron (Chair); Councillor Mrs B Price (Vice-Chair); Councillors Bawa, Burkitt, Couzens, Dhallu, Griffin, V Handy, Harris, R L Horton, R S Melia, W T Melia, Newell and Parish. Apology: Councillor Wainwright. 37/02 Minutes Resolved that the minutes of the meeting held on 29th May, 2002 be approved as a correct record. Matters Delegated to the Committee 38/02 Planning Applications Members considered the planning applications listed in the Appendix. In considering the applications the following particular points were raised:- DC/02/38814 (Change of use to cash and carry from warehouse and distribution. Roway Lane, Oldbury.) – The Head of Planning and Development Services recommended that consideration of the application be deferred in order to address the concerns of the Head of Highways Direct. DC/02/39047 (Change of use of front garden to commercial car parking. 920 Walsall Road, Great Barr, Birmingham.) – The Head of Planning and Development Services recommended that consideration of the application be deferred to enable a further detailed report to be submitted to a future meeting of the Committee. Planning Committee – 19th June, 2002 DC/02/39121 (Extension to previously approved unit (planning permission DC/01/38458). Unit A1 Cradley Heath Business Park, Overend Road, Cradley Heath.) – The Head of Planning and Development Services recommended that consideration of the application be deferred for further information and discussion. DC/02/39204 (Garage and first floor extension to side of property. 64 St Matthews Road, Oldbury.) – The Head of Planning and Development Services recommended that consideration of the application be deferred for further information and discussion. DC/02/39221 (Reserved matters (Siting, design, external appearance, means of access and landscaping) to outline consent DC/99/35135. Land at corner of Bristnall Hall Road, Pryor Road, Oldbury.) – The Head of Planning and Development Services recommended that consideration of the application be deferred for clarification of access rights. DC/02/39072 (New teaching block – phase 3. Wrights Lane, Cradley Heath.) – The Committee was minded to conditionally approve the application, subject to a condition requiring the implementation of a School Travel Plan being added to the conditions attached to the planning permission. DC/02/39088 (Two storey side extension. 1 Bertram Close, Tipton.) – The Head of Planning and Development Services had recommended that the application be refused on amenity grounds. However, having visited the site, members were of the opinion that the proposed application would not be detrimental to the amenities of neighbouring properties and were therefore minded to approve the application. DC/02/39122 (Extension to rear to provide liquor store with new steel staircase and internal alterations to form specialist off-license. 109 High Street, Blackheath, Rowley Regis.) – Having visited the site, the Committee was minded to conditionally approve the application, subject to conditions relating to the following; i) External Materials; ii) Surfacing / layout of parking / manoeuvring areas; iii) The existing rear garage being moved; iv) The back gates remaining locked during opening hours; v) Details of revised fencing amendments. The undermentioned additional documents were submitted for 2 Planning Committee – 19th June, 2002 consideration with the applications as follows:- (a) DC/02/39106 (Proposed residential development – erection of 100 no 1,2,3 and 4 bed houses, flats, parking, access roads and associated works. Waterfall Saw Mills, Waterfall Lane, Cradley Heath.) – Letter dated 14th June, 2002 from applicants agent. (b) DC/02/39177 (Change of use to hot food takeaway with owners flat, installation of extract flue to rear of elevation. Hobbs Road / 69 Churchfields Road, Wednesbury.) – Letter of objection, containing petition, dated 31st May, 2002. (c) DC/02/39236 (Certificate of lawfulness – proposed use of workshop. Workshop 30 Silverthorne Lane, Cradley Heath.) – Supplementary report tabled. (d) DC/02/39214 (Extensions providing enlarged kitchen and lounge plus breakfast, wc and laundry with enlarged bathroom and bedroom over two extra bedrooms. 29 Kenelm Road, Oldbury.) – Letter of objection dated 10th June, 2002. Resolved; (1) that the applications listed in the appendix be dealt with under the Town and Country Planning Act 1990 in accordance with the decisions set out in the third column of the appendix; (2) that consideration of application DC/02/38814 (Change of use to cash and carry from warehouse and distribution. (In accordance with the Protocol adopted under Minute No. 15/00, instances where members left the meeting during the consideration of applications is set out in the third column of the Appendix). 39/02 Applications Determined Under Delegated Powers by the Head of Planning and Development Services 4 Planning Committee – 19th June, 2002 The Committee received a report for information on applications determined by the Head of Planning and Development Services under delegated powers. 40/02 Appeals The Committee was informed that the Secretary of State for Transport, Local Government and the Regions had dismissed appeals, made under the Town and Country Planning Act (Control of Advertisements) Regulations 1992, in respect of the undermentioned planning applications:- (1) DC/01/4524A – Dudley Road East, Tividale; (2) DC/01/4549A – Park Lane / Park Street, Oldbury.
