Whereas, a reciprocal agreement in regard to the plying of transport vehicles on Inter-State routes was entered into between the States of Tamil Nadu and Kerala and published with the Home Department Notification No.II(2) /HO/3365(a)/ 76, at Pages 1 to 6 in Part II- Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 30th June 1976; And Whereas, the First Supplemental Agreement to the main agreement in regard to the operation of Stage Carriages and Public carriers by both States has been entered into between the States of Tamil Nadu and Kerala and published with the Home Department Notification No. II(2)/HO/6126(c) /79 at pages 1 to 3 in Part II – Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 29th September, 1979; And Whereas, the Second Supplemental Agreement to the main agreement in regard to the operation of Stage carriages, Public Carriers, Private Carrier, Goods Vehicles, Tourist Taxis and Light Motor Vehicles, Goods vehicles (Not covered by permit) by both States has been entered into between the States of Tamil Nadu and Kerala and published with the Home Department Notification No.II (2)/HO/4579(c)/84, at pages 1 to 5 in Part II- Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 10th August 1984; And Whereas, the Third Supplemental Agreement to the main agreement in regard to the operation of Stage Carriages by both States has been entered into between the States of Tamil Nadu and Kerala and published with the Home Department Notification No.II(2)/HO/2482(b)/95, at pages 1 to 11 in Part II-Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 14th July 1995; And Whereas, the Fourth Supplemental Agreement to the main agreement in regard to the operation of Stage Carriages, Goods Carriages, Tourist Taxis and Vehicles of the Educational Institutions by both States has been entered into between the States of Tamil Nadu and Kerala and published with the Home Department Notification No.II(2)/HO/959(a)/99, at pages 1 to 5 in Part II-Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 11th August 1999; And Whereas, the Fifth Supplemental Agreement to the main agreement in regard to the operation of Stage Carriages by both States has been entered into between the States of Tamil Nadu and Kerala and published with the Home Department Notification No.II(2)/HOPE/307(d)/2008, at pages 1 to 9 in Part II-Section 2 of theTamil Nadu Government Gazette Extraordinary, dated the 27th June 2008; Ex-II-2(92) [ 1 ] 2 tamil nadu government gazette Extraordinary

And Whereas, the Governments of Tamil Nadu and Kerala have agreed to enter into a further supplemental agreement under section 88 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) for the purpose of operation of Stage Carriages on certain new inter-state routes and for addition/deletion of services on certain existing inter-State Routes and for bringing the Tourist Taxis and Motor Cabs under one heading “Motor Cabs” under single point tax; Now, Therefore, in exercise of the powers conferred by sub-section (6) of Section 88 of the Motor Vehicles Act, 1988, (Central Act 59 of 1988), the Governor of Tamil Nadu hereby publishes the following supplemental agreement entered into between the Governments of Tamil Nadu and Kerala, the draft of the same having been previously published as required by sub-section (5) of Section 88 of the said Act in the Home Department Notification No.II(2)/HO/411(b)/2018 dated 26th April 2018 at pages 1 to 16 of Part-II-Section-2 of the Tamil Nadu Government Gazette Extraordinary, dated 26th April 2018.

SUPPLEMENTAL AGREEMENT Whereas, it is decided to control and augment the Stage Carriages services on inter-state routes between the States of Tamil Nadu and Kerala by way of permitting the State Transport Undertakings of both the States to operate on new routes to be included in the agreement and to modify the existing routes covered by previous agreements. Now, Therefore, it is hereby agreed to publish the Sixth Supplemental Agreement in the following terms and conditions entered into between States of Tamil Nadu and Kerala subject to the previous agreements:-

(I). Operation of Stage Carriage Services by State Transport Undertakings:- 1. The Stage Carriage services on 30 routes with 54 buses covering 8,753.2 kms in the State of Kerala as shown in the Annexure-A shall be exclusively operated by the State Transport Undertakings of State of Tamil Nadu. 2. The Stage Carriage service on 49 routes with 88 buses covering 11,719 kms in the state of Tamil Nadu as show in the Annexure-B shall be exclusively operated by the State Transport Undertaking of State of Kerala. 3. Variation and Modification of existing routes included in the previous Reciprocal Agreements in the Stateof Kerala operated by the State Transport Undertakings of Tamil Nadu on 25 routes and thereby increasing 48.4 Kms in the State of Kerala is shown in Annexure-C. 4. Variation and Modification of existing routes included in the previous Reciprocal Agreements in theState of Tamil Nadu operated by the State Transport Undertakings of Kerala on 13 routes and thereby reducing 2,854 Kms in the State of Tamil Nadu is shown in Annexure-D. 5. Details of additional services to be operated by the State Transport Undertakings of Tamil Nadu in connection with different fairs and festivals every year is shown in Annexure-E. 6. Details of additional services to be operated by the State Transport Undertakings of Kerala in connection with different fairs and festivals every year is shown in Annexure-F. 7. Details of additional services to be operated by the State Transport Undertakings of Tamil Nadu during summer seasons (March 15 to June 15) every year is shown in Annexure-G. 8. Details of additional services to be operated by the State Transport Undertakings of Kerala during summer seasons (March 15 to June 15) every year is shown in Annexure-H. 9. The State Transport Undertaking of Tamil Nadu would operate additional services during weekends (Friday to Monday) in every week is shown in Annexure-I. 10. The State Transport Undertaking of Kerala would operate additional services during weekends (Friday to Monday) in every week is shown in Annexure-J. (II). General:- 1. It is further agreed that the grant of temporary permits by the State Transport Authority of Home State for the operation of additional services during Weekends (Friday to Monday) may be considered as deemed countersignature of the State Transport Authority of reciprocating State. The details of service including Number of bus and Registration Number, Trip details are to be mutually handed over between the State Transport Undertakings prior to the starting of services. 2. In the event of more number of buses are to be operated exceeding the provisions in the Annexure E, F, G, H, I and J or for any other occasions the State Transport Undertakings of both States may be permitted to operate additional services on mutual agreement. The details of routes, number of round trips, number of buses to be operated and the duration of operation may be decided by the co-ordinators of the State Transport Undertakings of both the States subject to the fulfillment of usual conditions existed in the previous agreements. 3. It is further agreed by the State Transport Undertakings of both the States that the accidents and consequent bus release formalities should be completed mutually by the State Transport Undertakings in the respective States and the minor repairs and break down repairs shall also be done reciprocally on payment basis. (4.) It is also agreed that the State Express Transport Corporation Tamil Nadu Limited, Chennai and Kerala State Road Transport Corporation, Thiruvananthapuram will be the co-ordinators for State Transport Undertakings of Tamil Nadu and Kerala respectively with regard to the Inter-State stage carriage operation and related matters between the State of Tamil Nadu and Kerala. It is agreed that the vehicles of the State Transport Undertakings covered by permits as per the terms of the final agreement would be on single point tax basis. It is also agreed that the Government of Tamil Nadu and the Government of Kerala shall observe the statutory requirements as laid down under sub-section (5) and (6) of Section 88 of the Motor Vehicles Act, 1988 (Central Act, 59 of 1988).
