Summary Twenty-seven Member countries, along with the European Union, the Russian Federation and the Slovak Republic, submitted reports on their activities for the years 1996 and 19971. All these reports were presented to the Committee on Competition Law and Policy in 1997. There were initiatives leading to the adoption or entry into force of new competition-related legislation in Hungary, Italy and Switzerland; major amendments were made to existing laws in the Czech Republic, France, Ireland, Japan, Korea, New Zealand, Spain, the United Kingdom and Russia. Two countries—Canada and Sweden—envisaged changes to their competition law. To facilitate compliance with its legislation, the United States published guidelines to foster innovation in the health care sector. In addition, the European Commission published four interpretative notices on the distinction between concentrative and co-operative joint ventures, the concepts of concentration and undertakings concerned, and the calculation of turnover. Although deregulation and privatisation have had a great impact on laws, regulation and procedural rules, all countries were active in enforcement. Efforts were not spared to counter practices constituting horizontal or vertical restraints on competition. Supervision over mergers which might have anticompetitive effects continued. 2. Changes to competition laws and policies adopted or envisaged In Australia, the main changes to competition law having already been made (see the OECD report covering 1995-96), only secondary amendments were introduced, to: i) specify powers and enforcement procedures for competition law; ii) extend the scope of application of competition law to the entire business sector; iii) enact provisions relating to boycotts; and iv) supplement the guidelines for mergers. In addition, improvements were made to the national access regime under the Trade Practices Act. In Austria, no amendments to competition law were made during the period under review. In Canada, a bill was presented to the House of Commons on 7 November 1996 to update the Competition Act, in order to reflect new market trends and enforcement requirements. The main changes involved the settlement of cases involving misleading advertising or deceptive marketing practices, remedies for deceptive telemarketing practices, and the administrative processing of prior notifications of mergers. The Czech Republic, in November 1996, instituted the Office for the Protection of Economic Competition (the “Office”), which assumed the responsibilities of the former Ministry of Competition. During the period under review, while there were no changes to national competition law, an important step was taken towards harmonisation with EU legislation. In my view the School constitutes not only a method for develop- ing norms of private law out of the historical materials of Roman and German-Germanic laws, but is based on a wider conception of culture, law and history that is also connected to the political positions of that time. In Savigny’s founding pam- phlet, »The vocation of our time ...«, two major theoretical topics for this long-lasting influence can be found: The Romantic one, which views law as a part of culture and parallel to language and cus- tom, based on the »spirit of the people«, and, on the other side, the rationality of the European tradition of Roman law, which was developed and administered by jurists.These two basic points, in part standing in contradiction to one another, form a fertile tension that provides an impulse to the intellectual discussions and new movements in jurisprudence and history analysed in the text.

Just as our stark rights vocabulary receives subtle amplification from its encoded image of the lone rights-bearer, our weak vocabulary of responsibility is rendered fainter still by our undeveloped notion of human sociality.1 One of the principal deficiencies of the dominant liberal individualist understanding of rights is its inability to do justice to the rights of institutions.2 This inability is a telling instance of what Mary Ann Glendon terms “The Missing Dimension of Sociality”3 in contemporary liberal rights discourse. It identifies the contract for work as the key legal institution in the field, and the primary focus of scholarly analysis. Characterising the act of contracting for work as an example of what Weber called economic social action oriented to the legal order, it proposes that Weber’s notion of the labour constitution be used to map the context within which contracting for work takes place. And it argues that, in comparison to traditional socio-legal approaches, ESLL has the significant advantage of allowing for account to be taken of the individual and commercial, as well as the social and legal, elements of contracting for work.

This dissertation argues that the interwar years constituted a third point of inflection that transformed Japanese law and laid the foundation for the Japanese welfare state. In the wake of World War I, amid varied and widespread social tumult, a group of influential professors at Tokyo Imperial University undertook to remake civil law as an instrument of social policy. They rejected the Japanese civil code as it was codified in the 1890s, along with the methods of strict interpretation developed by their teachers. In its place they envisioned a new paradigm of legal thinking and practice that they believed could mend tearing social fabric. Their ideas were inspired by a transnational discourse on the centrality of society to law that emerged at the end of the nineteenth century. In Japan they coalesced into a new and nationally distinct legal movement that came to be called “social jurisprudence” (shakai hōgaku). There were many elements, but the most notable were an emphasis on the indeterminacy of legal interpretation and a preference for informal conflict resolution, as opposed to the formal procedures of the modern judiciary.

The form and degree of freedom is a right that should expand the limiting boundaries for an individual in different spheres of life: in manufacturing, in economic activity, etc. Man, his rights and freedoms are the supreme value, and fundamental human rights and freedoms shall be enjoyed by everyone from birth. These are the two components of the constitutional legal understanding (value-oriented law and natural law). Human rights are a reflection of the fact that the comprehensive perfection of humankind is impossible without exercising human rights.     Ioannis Kampourakis, Erasmus University Rotterdam* Bound by the Economic Constitution: Notes for “Law and Political Economy” in Europe Abstract: The aspiration of this article is to start a conversation about the possible contribution of a Law and Political Economy research agenda in Europe. I first unpack the role of law in structuring the economy at the supranational level by examining the legacy of ordoliberalism and the Economic Constitution of the EU as the normative project of insulating the internal market from political contestation. I then attempt to map the critical approaches that challenge the depoliticization of the economy and constitute the backdrop for an emerging LPE agenda. In particular, I discuss negative universalism, which focuses on the legal form as a limit to power and as enabling particular causes to make claims in universal terms; instrumentalism, which favors politicizing the law to advance egalitarian agendas; and counter-hegemony, which looks to civil society and to social transformation beyond the state. Concluding with a call for pragmatic and contextual critical practice, I attempt to carve out a space for an LPE in Europe agenda rooted in the normative commitment to democracy and equality as a form of immanent critique, in the aspiration to use institutions for social transformation, and in an orientation towards democratic power-building.
