Gazette on October 27, 2020, for the mark SILHOUETTE BEAUTY BRAND and Design

(hereinafter the “Opposed Application”). Beauty Brands (hereinafter “Opposer”) believes that it will be damaged by registration of the mark shown in the Opposed Application and hereby opposes the same.

As grounds for opposition, it is alleged as follows:

1. Opposer, Absolute Beauty, LLC d/b/a Beauty Brands, is a Delaware corporation organized under the laws of the State of Delaware, having a principal place of business at 4600

Madison Avenue, Suite 400, Kansas City, Missouri 64112.

2. Upon information and belief, Applicant, Victoria Ogunyinka, is an individual in the

United States, having a recorded address at 1111 River Road, Edgewater, New Jersey, 07020.

Applicant has no recorded attorney of record.

OPPOSER’S TRADEMARK

1. Opposer is the owner of several trademarks containing “BEAUTY BRANDS.” Below is a table for Opposer’s trademark registrations for marks consisting of or containing the phrase

Opposer’s use of “BEAUTY BRANDS” in connection with its cosmetic and hair care retail and beauty salon services has been continuous, commercially significant, and substantially exclusive since at least as early as 1995. Notably, all but one of the U.S. trademark registrations for Opposer’s Marks have reached incontestable status as a result of such long-term, continuous, and exclusive use of Opposer’s Marks.

3. Opposer’s Marks have acquired extensive goodwill as related to services offered thereunder, and as identifying high quality cosmetic and hair care retail and beauty salon services, which have their origin with Opposer.

APPLICANT’S PROPOSED TRADEMARK

4. Applicant has sought to register the word mark SILHOUETTE BEAUTY BRAND in International Class 26 for “Hair extensions; hair pieces.”

5. The Opposed Application was filed on April 10, 2020, under Section 1(b) of the

Trademark Act, claiming a bona fide intent to use the trademark. The filing date is more than 30 years after Opposer’s (via its predecessor-in-interest’s) first use of the BEAUTY BRANDS Mark.

6. The Opposed Application was published in the Official Gazette on October 27,

2020. Accordingly, Opposer has timely filed this Notice of Opposition. - 4 -

Count I - Priority and Likelihood of Confusion Trademark Act §2(d) - 15 U.S.C. §1052(d)

7. Opposer realleges the allegations set forth in each of the paragraphs above as if fully set forth herein.

8. Based on Opposer’s prior trademark rights in the BEAUTY BRANDS Mark and the confusingly similar nature of Applicant’s applied-for mark, as further set forth below, Opposer has a real interest in this proceeding and a reasonable belief of damage.

9. Applicant’s goods identified in connection with Applicant’s applied-for mark are competitive with, nearly identical to, closely related to, and/or in the natural zone of expansion to

Opposer’s products.

10. Applicant’s and Opposer’s goods, respectively identified in connection with the

Opposed Application and Opposer’s BEAUTY BRANDS Mark, are such that they are directed to the same and overlapping classes of customers and are offered through the same and overlapping channels of trade.

11. Applicant’s applied-for mark is confusingly similar to Opposer’s BEAUTY

BRANDS Mark in sight, sound and meaning. Further, Applicant’s applied-for mark,

SILHOUETTE BEAUTY BRAND virtually subsumes and incorporates the literal element of

Opposer’s BEAUTY BRANDS Mark.

12. Applicant’s use and registration of the applied-for mark in connection with the goods identified in the Opposed Application is likely to cause in the minds of the public confusion, mistake or deception as to the source of origin of Applicant’s goods that would lead the public and prospective purchasers to believe that Applicant’s goods are those of Opposer and/or are provided by, sponsored by, approved by, licensed by, or affiliated with Opposer, or are in some other way legitimately connected to Opposer and/or its goods or business. - 5 -

13. If Applicant is granted a registration for SILHOUETTE BEAUTY BRAND for the goods identified in the Opposed Application, Applicant would obtain at least a prima facie exclusive right to use this mark. Such registration would be a source of damage and injury to

Opposer, and to the reputation and goodwill it enjoys in its BEAUTY BRANDS Mark.

14. A registration to Applicant based on the Opposed Application would remain as a cloud on Opposer’s legal right to exclusive use of the BEAUTY BRANDS Mark.

WHEREFORE, Opposer respectfully requests that this opposition be sustained and

Applicant’s application to register SILHOUETTE BEAUTY BRAND, Application Serial No.

88867233, be denied as filed and published, and Applicant adjudged not entitled to registration of the mark SILHOUETTE BEAUTY BRAND.
