Date of Issue: 24th March, 2021 In the matter of Economic Regulation of Aeronautical Services provided by Airport Operators - Interim arrangement to continue the levy of existing tariffs beyond 31.03.2021 for the relevant Control Period. This is regarding extension of interim arrangement to continue levy of existing aeronautical tariff for further a period beyond 31.03.2021 in respect of the following Airports categorized on the basis of the same being in different stages of determination as detailed in the table below: I. (CHIAL) (i) The determination of aeronautical tariff by the Authority in respect of Hyderabad, Bangalore, Cochin Airports, for the 3rd Control Period, and, in respect of Chandigarh Airport for the 2nd Control Period, is already in progress and completion of the process will take time. The Authority, has, therefore, decided that the tariff applicable as on 31.03.2021 may be further extended for a period of 06 (six) months w.e.f. 01.04.2021 to 30.09.2021 or till the determination of tariffs for the relevant Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum. COD not announced; *Jalour 10/2017-18 18/2020-21 (i) The tariff determination for 3rd Control Period is due for the above mentioned airports (refer Table-II). Out of these 08 airports, it is ascertained that the commercial operations at 03 airports namely Guwahati, Trivandrum, and Jaipur, are due to be handed over by AAI to M/s Adani, shortly, post privatization. It is, therefore, expected that the submission of MYTP/ATP for these airports by the new Operator will take more time. (ii) In respect of the remaining 05 airports, the Authority is in receipt of MYTP/ATP in respect of few airports, for which tariff determination process is initiated. MYTP/ATP in respect of other airports is expected shortly. (iii) Keeping in view that the tariff determination process for all the above mentioned 08 AAI managed airports will take more time, the Authority, has, decided that the tariff applicable as on 31.03.2021 may be extended for a further period of six (06) months w.eJ. 01.04.2021 to 30.09.2021, or, till the determination of tariffs for the 3rd Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum . Ahmedabad 52/2020-21 17/2020-21 M/s Adani- 2. Lucknow 49/2020-21 24/2020-21 AAIALIALIALIAM IAL 3. Mangaluru 48/2020-21 - (i) M/s Adani vide their letter no. ALiALlCO/AERA-IT/2021/1, letter no. AMIALICO/AERA-IT/2021/1 & letter no. AAIALICO/AERA-IT/2021/1 dated 25.01 .2021, has requested the Authority to extend the existing tariff, applicable as on 31 .03.2021, for a further period of 06 (six) months up to 30.09.2021 for Lucknow, Mangaluru, and Ahmedabad Airports. In the aforementioned letters M/s Adani has also stated that they shall be submitting the MYTP/ATP for the three airports (i.e. for Ahmedabad & Lucknow Airports for the 3rd Control Period, 51 and, LLO. Marigaluru for 1 Control Period) by May 2021. Order No. 65/2020-21 Page 20f3 (ii) The Authority, has therefore, decided that the existing tariff, applicable as on 31.03.2021, may be extended for a further period of six (06) months w.eJ. 01.04.2021 to 30.09.2021, or, till the determination of tariffs for the relevant Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum . ORDER In view of the above, to avoid any regulatory vacuum in respect of the tariffs being levied by the regulated entities, the Authority, in exercise of powers conferred by Section 13(1) of the Airport Economic Regulatory Authority of India Act, 2008 hereby orders that:­ (i) The Airport Operators (listed at Table I, II, & III) are allowed to continue the levy of existing tariff, applicable as on 31.03.2021 , on interim basis, for a further period of 06 (six) months w.e.f. 01.04.2021 to 30.09.2021 or till the determination of tariffs for the relevant Control Period, whichever is earlier. (ii) The Airport Operator may ensure compliance of the Order. As p·art of the transition process, 'Adani Group has formed a Special Purpose Vehicle namely, Adani Ahmedabad International Airport Ltd (AAIAL). A Concession Agreement for Sardar Vallbhbhai Patel International Airport (SVPIA), Ahmedabad has been signed between Airports Authority of India (AAI) and Adani Ahmedabad International Airport Ltd (AAIAL) on 14.02.2020. As per the agreement Adani Ahmedabad International Airport Ltd (AAIAL) (the Order No. 52/2020-21 Page 1 of3 concessionaire) shall undertake operations, management and development of the Sardar Vallbhbhai Patel International Airport (SVPIA), Ahmedabad, subject to the terms and conditions of the Concession Agreement from the date of commencement of operations by AAIAL. 3. AAIAL, vide its letter no. AAIAL/CO/AERA-IT/2020/! dated 17.09.2020, has further stated that they need some time to submit MYTPfor the consideration of the Authority and requested the Authority to allow continuation of the existing aeronautical tariff from the date of COD till determination of tariff by AERA based on submission of MYfP as per the provisions of AERA Regulatory Framework. AAIAL vide mail dated 02.11.2020 further stated that AAIAL will take over the domestic cargo operations from AAIC,LAS ,as per the agreement and requested AERA to allow AAIAL to charge the- existing tariff approved for the present concessionaire M/s CSC for Domesti?Cargo Handling service. 4.
