November 7, 2018 State Attorneys General Post-Election Report 2018 The Top Line Results New Attorneys General 18 new attorneys general will take office in January as a result of this election cycle, including • 10 Democrats elected (Colorado, Connecticut, Delaware, Illinois, Michigan, Minnesota, Nevada, New York, Rhode Island, and Wisconsin) • 3 Republicans elected (Florida, Ohio, and South Dakota) • 4 attorneys general yet to be appointed (Wyoming, Alaska, Hawaii, Maine) • 1 attorney general to be appointed to fill a vacancy (Missouri) Turnovers There were four states that turned over party control. All turnovers were Republican to Democrat: Colorado, Wisconsin, Michigan, and Nevada. In all of these races, the governorship went to the Democratic candidate as well. Partisan Split Party control among attorneys general is expected to be split among 27 Democratic and 24 Republican attorneys general, assuming that the three governor-appointed attorneys general will follow the governor’s party (Alaska, Wyoming, and Hawaii) and that Maine will be Democratic based on the composition of the state legislature. Before the election, the partisan split was 28 Republicans, 22 Democrats, and one Independent. Incumbency All incumbents seeking reelection won another term, except for one. Republican Brad Schimel (WI) lost his bid for reelection. Attorneys General Running for Higher Office 9 incumbent attorneys general sought higher office, with only three (Maine, Missouri, and Ohio) succeeding in that effort. Cynthia Coffman (R-CO) lost her party’s nomination for governor; Janet Mills (D-ME) won the governorship; Lori Swanson (D-CO) lost her party’s nomination for governor; Josh Hawley (R-MO) won a seat in the US Senate; Adam Paul Laxalt (R-NV) lost his race for governor; Mike DeWine (R-OH) won his race for governor; Bill Schutte (R-MI) lost his race for governor; Marty Jackley (R-SD) lost his party’s nomination for governor; and Patrick Morrissey (R-WV) lost a race for a Senate seat and will thus remain as attorney general. -

Daniel D. Tompkins, War Governor Richard V. Barbuto {Editor’s note: This paper was presented at the 6th Annual International War of 1812 Symposium at Oswego New York on 2 April 2016} New York and the contiguous British provinces of Upper and Lower Canada were the center of fighting for the duration of the war. From the Niagara River across Lakes Ontario and Champlain and down the Saint Lawrence River toward Montreal, soldiers, sailors, and native warriors contended fiercely while civilians suffered grievously. While the U.S. Constitution assigned the defense of the nation and the function of declaring and waging war to the federal government, it was widely understood that the conduct of war was a shared enterprise between the federal and state governments. While the governors of the New England states avoided participation in the conflict, Governor Daniel D. Tompkins of New York worked closely with the Madison Administration to prosecute the war. General studies of the war focus largely on the conduct of the federal government. However, the role of New York, both as a staging area for the invasions of the Canadas and as a source of material and human resources, has been treated lightly. Historians have cited Tompkins as an ardent supporter of the war, but his specific contributions receive minimal attention. This is somewhat odd, since in his role as commander-in-chief of the state militia, he had a potential land force larger than the regular army. This essay is a preliminary examination of his efforts over five years to prepare New York for war with the British Empire and his work resourcing the conflict once Congress declared war. -

[ CONCLUDED JULY 24, 1794. ] Contracts between the State of New York and different tribes of the Six Nations of Indians, specifying their several cessions and reservations of land, etc. On the 19th of April, 1793, George Clinton, governor of New ! York, transmitted to Thomas Jefferson, Secretary of State of the United States, an exemplification of the different treaties entered into by that commonwealth with the Indians of the Six Nations, subsequent to the conclusion of the war of the American revolution. In his letter to Mr. Jefferson, Governor Clinton says, "I had written to the clerk of the city of Albany, and did not receive his answer until yesterday : he informs, as I suspected, that the superintendent of Indian affairs under the British government, was, at the commencement of the revolution, possessed of all the records and documents respecting Indian affpairs, and took them with him when he left the country.” SIX NATIONS OF NEW TORK. 41 The exemplification, thus transmitted, contains a transcript from the record book of Indian deeds, remaining in the office of the secretary of the State of New York, and, commencing in the year 1748. This transcript embraces, 1. A deed, executed by the sachems and chief warriors of the Oneida and Tuscarora nations, at a treaty held at fort Herkimer with George Clinton and other commissioners for Indian affairs for the State of New York, whereby the aforesaid sachems and chief warriors conveyed, on the 28th day of June, 1785, for the consideration of $11,500, in goods and money, "all that tract of land situate on the west side of the line commonly called the line of property, established at a treaty held at fort Stanwix in 1768, and on the north side of the Pennsylvania line, beginning at the mouth of the Unadilla, or Tianaderha river, where the same empties into the Susquehanna river ; thence up the said Unadilla, or Tianaderha river, ten miles measured on a straight line, thence due west to the Chenango river, thence southerly down the said Chenango river to where it empties into. -

Journal of Higher Education Athletics & Innovation Volume 1, Issue 7 Basketball, Books, And Brotherhood: Dewitt Clinton High School as Scholastic Model of Postwar Racial Progression and African American Leadership Arthur Banton Department of History Tennessee Technological University Abstract: In 1950, the City College of New York (CCNY) became the first racially integrated team to win the national championship of college basketball. Three of the players on that team, Arthur Glass, Mike Wittlin, and Ed Warner, attended DeWitt Clinton High School in the Bronx, New York. At the time Clinton High School was one of the most academically rigorous public schools in the city and the United States. During this postwar period, nearly one third of Clinton graduates attended college at a time when the national high school graduation rate stood at 20%. Unlike most high schools in the United States, Clinton was racially integrated with more than 20% of the student body identifying as African American. Like their contemporaries, Black students were encouraged to pursue opportunities that seemed unthinkable in an era of racial stratification. As a result, Clinton produced several Black students armed with the skills to navigate the terrain of prejudice and other social barriers. DeWitt Clinton High School was a model for interracial brotherhood while also fostering Black leadership. The Black athletes who attended CCNY were better prepared for the transition of competing on a racially integrated college team, can be partially attributed to their secondary schooling at DeWitt Clinton. This article examines the racial climate of DeWitt Clinton during the postwar years when the three young men were in attendance and how it fostered a culture of Basketball, Books, and Brotherhood. -

Edited by DEXTER PERKINS, City Historian and BLAKE MCKELVEY, Assistant City Historian VOL. 1 JULY, 1939 No. 3 ROCHESTER ONE HUNDRED YEARS AGO THE CITY AND ITS PEOPLE In 1839 the United States was still a preponderantly agricultural nation, a nation of small farmers. In the whole settled area of our country, which then extended hardly beyond the Mississippi-except for such states as Arkansas, Missouri, and Louisiana-there were only fifteen cities with a population of over 20,000 people. The largest, New York, was about the size of Rochester today. The next largest, Baltimore, had only slightly over 100,000, while New Orleans ran a close third with Philadelphia and Boston as fourth and fifth. In 1839 the region of Western New York, and still more, of course, the states between the mountain barrier of the Appalachians and the Great River, could still be spoken of without absurdity as the West. In this Western region cities were, of course, even less numer- ous and important than along the seaboard. Chicago had its future all before it. Detroit and Saint Louis were as yet of minor importance. The largest urban communities were New Orleans, Cincinnati, and Pittsburgh, with a population of approximately 100,000, 45,000, and 30,000, respectively. In such a situation as this, young Rochester, with 20,000 inhabitants, could hold up its head proudly and indulge in rosy dreams that it might become one of the great cities of America. The growth of this local community of ours had, indeed, been remarkable. In 1839 it was less than thirty years since Hamlet Scran- tom had come to Rochester to become the first permanent settler on ROCHESTER HISTORY! published quarterly by the Rochester Public Library, dis- tributed free at the Library, by mail 25 cents per year. -
The Common Law Powers of the New York State Attorney General
THE COMMON LAW POWERS OF THE NEW YORK STATE ATTORNEY GENERAL Bennett Liebman* The role of the Attorney General in New York State has become increasingly active, shifting from mostly defensive representation of New York to also encompass affirmative litigation on behalf of the state and its citizens. As newly-active state Attorneys General across the country begin to play a larger role in national politics and policymaking, the scope of the powers of the Attorney General in New York State has never been more important. This Article traces the constitutional and historical development of the At- torney General in New York State, arguing that the office retains a signifi- cant body of common law powers, many of which are underutilized. The Article concludes with a discussion of how these powers might influence the actions of the Attorney General in New York State in the future. As United States Senator from 1833 to 18M+, he established a record for political integrity, honesty, and courage that made him a valuable leader of the Democratic Party and gained for him the respect of the Whig opposition. Wright's position in Washington as a presidential liaison in the Senate caused him to play an influential role in both the Jackson and Van Bur9:1 administrations. He maintained a highly developed sense of political Idealism throughout his career.
